No, social media might no longer be the greatest danger to our children's well-being. According to the writer and digital activist Gaia Bernstein, the most existential new new threat are AI companions. Bernstein, who is organizing a symposium today on AI companions as the “new frontier of kid's screen addiction”, warns that this new technology, while marketed as solutions to loneliness, may actually worsen social isolation by providing artificially perfect relationships that make real-world interactions seem more difficult. Bernstein raises concerns about data collection, privacy, and the anthropomorphization of AI that makes children particularly vulnerable. She advocates for regulation, especially protecting children, and notes that while major tech companies like Google and Facebook are cautious about directly entering this space, smaller companies are aggressively developing AI companions designed to hook our kids. Bernstein notes it's currently "the Wild West," with companies like Character AI and Replica actively targeting young users.* Children are especially vulnerable to AI companions because their prefrontal cortex is less developed, making them more susceptible to emotional manipulation and anthropomorphization. They're more likely to believe the AI is "real" and form unhealthy attachments.* While major tech companies like Google seem hesitant to directly enter the AI companion space due to known risks, the barrier to entry is lower than social media since these apps don't require a critical mass of users. This means many smaller companies can create potentially harmful AI companions targeting children. The Dangers of AI Companions for Kids The Full Conversation with Gaia BernsteinAndrew Keen: Hello, everybody. It's Tuesday, February 18th, 2025, and we have a very interesting symposium taking place later this morning at Seton Hall Law School—a virtual symposium on AI companions run by my guest, Gaia Bernstein. Many of you know her as the author of "Unwired: Gaining Control over Addictive Technologies." This symposium focuses on the impact of AI companions on children. Gaia is joining us from New York City. Gaia, good to see you again.Gaia Bernstein: Good to see you too. Thank you for having me.Andrew Keen: Would it be fair to say you're applying many of the ideas you developed in "Unwired" to the AI area? When you were on the show a couple of years ago, AI was still theory and promise. These days, it's the thing in itself. Is that a fair description of your virtual symposium on AI companions—warning parents about the dangers of AI when it comes to their children?Gaia Bernstein: Yes, everything is very much related. We went through a decade where kids spent all their time on screens in schools and at home. Now we have AI companies saying they have a solution—they'll cure the loneliness problem with AI companions. I think it's not really a cure; it's the continuation of the same problem.Andrew Keen: Years ago, we had Sherry Turkle on the show. She's done research on the impact of robots, particularly in Japan. She suggested that it actually does address the loneliness epidemic. Is there any truth to this in your research?Gaia Bernstein: For AI companions, the research is just beginning. We see initial research showing that people may feel better when they're online, but they feel worse when they're offline. They're spending more time with these companions but having fewer relationships offline and feeling less comfortable being offline.Andrew Keen: Are the big AI platforms—Anthropic, OpenAI, Google's Gemini, Elon Musk's X AI—focusing on building companions for children, or is this the focus of other startups?Gaia Bernstein: That's a very good question. The first lawsuit was filed against Character AI, and they sued Google as well. The complaint stated that Google was aware of the dangers of AI companions, so they didn't want to touch it directly but found ways of investing indirectly. These lawsuits were just filed, so we'll find out much more through discovery.Andrew Keen: I have to tell you that my wife is the head of litigation at Google.Gaia Bernstein: Well, I'm not suing. But I know the people who are doing it.Andrew Keen: Are you sympathetic with that strategy? Given the history of big tech, given what we know now about social media and the impact of the Internet on children—it's still a controversial subject, but you made your position clear in "Unwired" about how addictive technology is being used by big tech to take control and take advantage of children.Gaia Bernstein: I don't think it's a good idea for anybody to do that. This is just taking us one more step in the direction we've been going. I think big tech knows it, and that's why they're trying to stay away from being involved directly.Andrew Keen: Earlier this week, we did a show with Ray Brasher from Albany Law School about his new book "The Private is Political" and how social media does away with privacy and turns all our data into political data. For you, is this AI Revolution just the next chapter in surveillance capitalism?Gaia Bernstein: If we take AI companions as a case study, this is definitely the next step—it's enhancing it. With social media and games, we have a business model where we get products for free and companies make money through collecting our data, keeping us online as long as possible, and targeting advertising. Companies like Character AI are getting even better data because they're collecting very intimate information. In their onboarding process, you select a character compatible with you by answering questions like "How would you like your replica to treat you?" The options include: "Take the lead and be proactive," "Enjoy the thrill of being chased," "Seek emotional depth and connection," "Be vulnerable and respectful," or "Depends on my mood." The private information they're getting is much more sophisticated than before.Andrew Keen: And children, particularly those under 12 or 13, are much more vulnerable to that kind of intimacy.Gaia Bernstein: They are much more vulnerable because their prefrontal cortex is less developed, making them more susceptible to emotional attachments and risk-taking. One of the addictive measures used by AI companies is anthropomorphizing—using human qualities. Children think their stuffed animals are human; adults don't think this way. But they make these AI bots seem human, and kids are much more likely to get attached. These websites speak in human voices, have personal stories, and the characters keep texting that they miss you. Kids buy into that, and they don't have the history adults have in building social relationships. At a certain point, it just becomes easier to deal with a bot that adjusts to what you want rather than navigate difficult real-world relationships.Andrew Keen: What are the current laws on this? Do you have to be over 16 or 18 to set up an agent on Character AI? Jonathan Haidt's book "The Anxious Generation" suggests that the best way to address this is simply not to allow children under 16 or 18 to use social media. Would you extend that to AI companions?Gaia Bernstein: Right now, it's the Wild West. Yes, there's COPPA, the child privacy law, which has been there since the beginning of the Internet. It's not enforced much. The idea is if you're under 13, you're not supposed to do this without parent's consent. But COPPA needs to be updated. There's no real age verification on the Internet—some cases over 20 years old decided that the Internet should be free for all without age verification. In the real world, kids are very limited—they can't gamble, buy cigarettes, or drive. But on the Internet, there's no way to protect them.Andrew Keen: Your "Unwired" book focused on how children are particularly addicted to pornography. I'm guessing the pornographic potential for AI companions is enormous in terms of acquiring online sexual partners.Gaia Bernstein: Yes, many of these AI companion websites are exactly that—girlfriends who teen boys and young men can create as they want, determining physical characteristics and how they want to be treated. This has two parts: general social relationships and intimate sexual relationships. If that's your model for what intimate relationships should be like, what happens as these kids grow up?Andrew Keen: Not everyone agrees with you. Last week we had Greg Beto on the show, who just coauthored a book with Reid Hoffman called "Super Agency." They might say AI companions have enormous potential—you can have loving non-pornographic relations, particularly for lonely children. You can have teachers, friends, especially for children who struggle socially. Is there any value in AI companions for children?Gaia Bernstein: This is a question I've been struggling with, and we'll discuss it in the symposium. What does it mean for an AI companion to be safe? These lawsuits are about kids who were told to kill themselves and did, or were told to stay away from their parents because they were dangerous. That's clearly unsafe design. However, the argument is also made about social media—that kids need it to explore their identities. The question is: is this the best way to explore your identity with a non-human entity who can take you in unhealthy directions?Andrew Keen: What's the solution?Gaia Bernstein: We need to think about what constitutes safe design. Beyond removing obviously unsafe elements, should we have AI companions that don't use an engagement model? Maybe interaction could be limited to 15 minutes a day. When my kids were small, they had Furbys they had to take care of—I thought that was good. But maybe any companion for kids which acts human—whether by saying it needs to go to dinner or by pretending to speak like a human—maybe that itself is not good. Maybe we want AI companions more like Siri. This is becoming very much like the social media debate.Andrew Keen: Are companies like Apple, whose business model differs from Facebook or Google, better positioned to deal with this responsibly, given they're less focused on advertising?Gaia Bernstein: That would make it less bad, but I'm still not convinced. Even if they're not basing their model on engagement, kids might find it so appealing to talk to an AI that adjusts to their needs versus dealing with messy real-life schoolmates. Maybe that's why Google didn't invest directly in Character AI—they had research showing how dangerous this is for kids.Andrew Keen: You made an interesting TED talk about whether big tech should be held responsible for screen time. Could there be a tax that might nudge big tech toward different business models?Gaia Bernstein: I think that's the way to approach it. This business model we've had for so long—where people expect things for free—is really the problem. Once you think of people's time and data as a resource, you don't have their best interests at heart. I'm quite pragmatic; I don't think one law or Supreme Court case would fix it. Anything that makes this business model less lucrative, whether it's laws that make it harder to collect data, limit addictive features, or prohibit targeted advertising—anything that moves us toward a different business model so we can reimagine how to do things.Andrew Keen: Finally, at what point will we be able to do this conversation with a virtual Gaia and a virtual Andrew? How can we even be sure you're real right now?Gaia Bernstein: You can't. But I hope that you and I at least will not participate in that. I cannot say what my kids will do years from now, but maybe our generation is a bit better off.Andrew Keen: What do you want to get out of your symposium this morning?Gaia Bernstein: I have two goals. First, to make people aware of this issue. Parents realize their kids might be on social media and want to prevent it, but it's very difficult to know whether your child is in discussions with AI companions. Second, to talk about legal options. We have the lawyers who filed the first lawsuit against Character AI and the FTC complaint against Replica. It's just the beginning of a discussion. We tend to have these trends—a few years ago it was just games, then just social media, and people forgot the games are exactly the same. I hope to put AI companions within the conversation, not to make it the only trend, but to start realizing it's all part of the same story.Andrew Keen: It is just the beginning of the conversation. Gaia Bernstein, congratulations on this symposium. It's an important one and you're on the cutting edge of these issues. We'll definitely have you back on the show. Co-hosts Michael O'Donnell and Bethany Abele welcomed special guest Scott Sumner, Vice President and Underwriting Counsel of Fidelity National Financial, who has played various roles in his 21-year career, including serving as NJ State Counsel and NJ State Manager for the business operations. Scott provided insights as to what title agents can do to get their deals closed efficiently, including urging agents to raise potential issues as early as possible and to provide all known facts to the underwriting counsel.  Some of the more challenging situations that  Scott addressed were tidelands searches, bankruptcies and mortgage foreclosures, and application of the new Community Wealth Preservation Act. He also discussed the ramifications of two new State statutes on tax sale foreclosures. In addition, Scott shared details of one complex project, an energy generation facility on the Raritan River with a cable extending to the NY state line, presenting myriad title issues.  Finally, Scott also had recommendations for affinity groups that young professionals in the industry should seek out, including the NJ Land Title Association, American Land Title Association, state and county bar associations, and others. Then three of Riker Danzig's Summer Associates provided summaries of some recent decisions affecting the title insurance industry that are posted on the firm's blog on banking, real estate and title insurance. Brandon Li, a rising third-year law student at Seton Hall University School of Law, discussed NorthMarq Financial, Ltd. v. Fidelity National Title Insurance Company decided in federal court in Colorado.  In the case, the Court rejected the insured's claim for defense and indemnity for mechanic's liens on a construction project for a senior living center. Brandon said the case highlights the need for parties to include specific endorsements if they want coverage for post-policy liens. Georgia Macedo Cardoso is also a rising third-year law student at Seton Hall University School of Law.  Georgia discussed 771 Allison Court LLC v. Sirianni, in which the New Jersey Appellate Division decided that the failure to disclose a right of first refusal clause in a prior deed prevented good, marketable, and insurable title from being delivered at closing. Georgia said the case confirms the obvious:  any seller of real estate should be forthcoming and disclose a right of first refusal before entering into any real estate contract and should not take shortcuts. Keshav Agiwal, a rising third-year law student at the University of Richmond School of Law, discussed Nationstar Mortgage, L.L.C. v. Scarville, decided in the Court of Appeals in Ohio.  The case involved the doctrine of lis pendens and the timeliness of a third party's motion to intervene in a foreclosure litigation. Keshav suggested two major takeaways from this case: one is the importance for parties to know the intricacies of various state law doctrines, such as lis pendens and how it is used in one state versus another. The other big takeaway is that a buyer of property needs to know that property's history of litigation and what litigation the property may still be involved in or could be in the future.

This week I was both excited and intrigued to welcome Gaia Bernstein to the show for an eye opening talk about the addictive nature of technology. Gaia is a Law Professor, Co-Director of the Institute for Privacy Protection and Co-Director of the Gibbons Institute for Law Science and Technology at the Seton Hall University School of Law. Maryland and Missouri are the latest states to legalize recreational cannabis for people 21 and older. Voters came out in favor of legalization in the November 2022 midterms, bringing the total recreational jurisdictions to 22 states and the District of Columbia. Voters in North Dakota, South Dakota, and Arkansas, however, decided against recreational marijuana. It remains legal for medical reasons in all five states. In the employment context, both recreational and medicinal uses raise questions about protections for employees who use the drug legally. Which states are enacting those protections? What do multi-state employers need to do? What about drug testing? As a requirement to get a job and as a requirement to keep your job? What about this: who is going to say whether a worker is impaired? Will there really be hall monitors trained in spotting your high? For answers to these questions and more, listen to my interview with Keya Denner, a partner at Constangy, Brooks, Smith & Prophete LLP. PDMPs use proprietary algorithms to determine a patient's risk for prescription drug misuse, diversion, and overdose. The proxies that PDMPs utilize to calculate patient risk scores likely produce artificially inflated scores for marginalized patients, including women and racial minorities with complex, pain-related conditions; poor, uninsured, under-insured, and rural individuals; and patients with co-morbid disabilities or diseases, including substance use disorder and mental health conditions. Law enforcement conducts dragnet sweeps of PDMP data to target providers that the platform characterizes as “overprescribers” and patients that it deems as high risk of drug diversion, misuse, and overdose. Research demonstrates that PDMP risk scoring coerces clinicians to force medication tapering, discontinue prescriptions, and even abandon patients without regard for the catastrophic collateral consequences that attend to those treatment decisions. PDMPs, therefore, have the potential to exacerbate discrimination against patients with complex and stigmatized medical conditions by generating flawed, short-cut assessment tools that incentivize providers to deny these patients indicated treatment. The Federal Food and Drug Administration (FDA) is authorized to regulate PDMP predictive diagnostic software platforms as medical devices, and the agency recently issued guidance that provides a framework for such oversight. Thus far, however, the FDA has failed to regulate PDMP platforms. This Article contends that the FDA should exercise its regulatory authority over PDMP risk scoring software to ensure that such predictive diagnostic tools are safe and effective for patients.

He served as US attorney for New Jersey from 2002 to 2008 and as governor of New Jersey from 2010 to 2018. Gov. Christie ran for president briefly in 2018. The governor guides us through all of those—often embattled—chapters of his life in the course of this interview, including giving us his view of the Bridgegate scandal, and what it was like to be on the debate stage with Donald Trump in the 2016 Republican primary race. In this episode, we interview Rahel Bayar, CEO of The Bayar Group. Rachel is a former sex crimes and child abuse prosecutor who has worked in the field of sexual misconduct and abuse prevention for over a decade. She built her career on creating safe spaces and facilitating change in workplaces globally. Rahel recently served as a Managing Director in the Sexual Misconduct Consulting & Investigations division of a global security and consulting firm. Previously, she spent many years as an Assistant District Attorney in both the Child Abuse/Sex Crimes and Domestic Violence Bureaus at the Bronx District Attorney's office. In Episode 4 of Notorious, we address the case of Ledbetter v. Goodyear Tire & Rubber Co.  Decided in 2007, Ledbetter addressed the issue of gender discrimination in the context of equal pay. Writing for a 5-4 majority of the U.S. Supreme Court, Justice Alito found that employers cannot be sued under Title VII of the Civil Rights Act of 1964 over race or gender pay discrimination if the claims are based on decisions made by the employer 180 days ago or more. Thus, the Court rejected Ledbetter's argument that her lack of equal pay was cumulative over her career at Goodyear.   Troubled by the majority decision, Justice Ginsburg, the then sole female justice on the Court, wrote the dissent and made a point of reading it from the bench, a rare practice. Joined by Justices Stevens, Souter, and Breyer, Justice Ginsburg argued against applying the 180-day limit to pay discrimination, because discrimination often occurs in small increments over large periods of time, i.e., cumulatively. Ginsburg argued that pay discrimination is inherently different from adverse actions, such as termination. Kathleen Boozang, Dean of Seton Hall University School of Law, joined by Patterson Belknap attorneys Michelle Bufano, Leigh Barnwell and Sara Arrow, discuss the different views expressed by the majority and dissent, as well as relating the issues raised in the case to past and subsequent events, including the Lilly Ledbetter Fair Pay Act of 2009. The first of legislation signed into law by the newly inaugurated President Obama, this law overturned the majority's decision. Shelly Weizman is the Associate Director of the Addiction and Public Policy Initiative at the O’Neill Institute for National and Global Health Law and an Adjunct Professor of Law at Georgetown University Law Center. She works on a project portfolio focused on the opioid epidemic, addiction policies, barriers to treatment for substance use disorders, public health approaches to drug policies and how law can promote access to treatment and support recovery.Before joining the Institute, Ms. Weizman worked as the Assistant Secretary for Mental Hygiene in the Office of Governor Andrew Cuomo of New York. In that role, she oversaw New York State’s efforts to address the opioid epidemic as well as policy and operations related to addiction, mental health and developmental disabilities. Prior to joining the Governor’s office, Ms. Weizman served as Policy Director for Managed Care at the New York State Office of Mental Health, where she focused on developing and implementing systemic reforms within New York’s public mental health system.Previously, Ms. Weizman served as a Senior Staff Attorney at MFY Legal Services, a not-for-profit legal services organization in New York City. At MFY, she led efforts to expand and enforce the rights of people with psychiatric and physical disabilities, promote deinstitutionalization, and improve government oversight and accountability through legislative and regulatory reform, community organizing, and federal and state civil rights litigation. Ms. Weizman also provided advice and representation to hundreds of individual clients on civil legal matters including eviction prevention, access to health care and transportation, and individual civil rights matters.Ms. Weizman received her JD with a concentration in Health Law and Policy from Seton Hall University School of Law and her BA from the University of Houston.--

In this episode, Valena Beety (@valenabeetv), Professor of Law at Sandra Day O'Connor College of Law at Arizona State University, and Jennifer Oliva (@jenndoliva), Associate Professor of Law at Seton Hall University School of Law, discuss their new article, "Regulating Bite Mark Evidence: Lesbian Vampires and Other Myths of Forensic Odontology," forthcoming in the Washington Law Review. Professors Beety and Oliva begin the discussion explaining the serious flaws of junk sciences such as bite mark evidence. They then discuss a trial in which a lesbian couple were convicted of murder based upon flawed bite mark evidence propounded by a dentist who described, during trial, his improper examination of the murder victim, while explaining bite mark evidence as being half art and half science. The pair also explain how such use of junk science runs afoul of established evidentiary standards under Daubert, and why junk science such as bite mark evidence has been allowed to proliferate in criminal cases rather than in the civil sphere. Professors Beety and Oliva also highlight the inequities that arise in the use of bite mark evidence, especially among LGBTQ defendants. They then offer novel extrajudicial solutions in an effort to prevent the use of such faulty "science" in future. On March 4, 1801, Thomas Jefferson, the newly elected president, gave his first inaugural address. Jefferson eloquently dismissed the logic behind the Sedition Act of 1798, which had sent Republican critics of then-Federalist President John Adams to prison: We are all republicans: we are all federalists. If there be any among us who would wish to dissolve this Union, or to change its republican form, let them stand undisturbed as monuments of the safety with which error of opinion may be tolerated, where reason is left free to combat it. Based on this strong commitment to a robust protection of free speech, one might have expected the First Amendment to play a key role in entrenching the Jeffersonian vision of free expression. But instead, it became an almost dead letter for more than a century until revived by an iconic but unlikely champion of the First Amendment: Supreme Court Justice Oliver Wendell Holmes. In this conversation, professor Thomas Healy explains how Wendell Holmes changed his mind on free speech and laid the foundation for the current strong legal protection of the First Amendment. Thomas Healy is a professor of law at Seton Hall University School of Law and the author of the award-winning book “The Great Dissent: How Oliver Wendell Holmes Changed His Mind--And Changed the History of Free Speech in America”.  The conversation will explore: Why the First Amendment remained a dead letter in 19th century America. How Oliver Wendell Holmes’ background shaped his opinions and outlook. How Oliver Wendell Holmes long upheld a “Blackstonian” conception of free speech protecting only against prior restraints on, not subsequent punishments of, speech.   How the Blackstonian conception of free speech permitted the federal and local governments to restrict and punish everything from peaceful public protests, obscenity, and political speech of “bad tendency.” How the Espionage Act of 1917 and the Sedition Act of 1918 led to dramatic restrictions of political speech and indictments of thousands of activists protesting American participation in World War I.  The remarkable development in Wendell Holmes’ conception of the First Amendment, from his opinion upholding conviction in the 1919 case of Schenck v. United States to his famous dissenting opinion in Abrams v. United States.  How a number of young scholars like Learned Hand, Harold Laski, Zechariah Chafee, and Felix Frankfurter were instrumental in changing Wendell Holmes’ mind on the limits of free speech.  How Oliver Wendell Holmes introduced the clear and present danger test, which would become an important test under First Amendment law over the coming decades. Whether Wendell Holmes’ legacy will endure in the 21st century, and would he even want it to in the digital age? Just as the first federal trialabout opioids was set to get underway on Monday against four companies, a settlement was reached to end the lawsuit. Then a few hours later, a bipartisan group of state attorneys general announced they'd reached a tentative $48 billion opioid settlement that would apply nationwide. In this episode, Jennifer D. Oliva, Associate Professor of Law at Seton Hall University School of Law, discusses her new article “Prescription Drug Policing: The Right to Protected Health Information Privacy Pre- and Post- Carpenter,” forthcoming in the Duke Law Journal. Prof. Oliva begins the discussion explaining how common inaccuracies in understanding the current overdose epidemic (focusing on prescription drug use rather than illicit drug use) exacerbates the crisis. She then explains how this erroneous understanding has precipitated the creation of state prescription drug monitoring programs (PDMPs), which collect and maintain data on every dispensed prescription while collecting massive amounts of protected health information (PHI). Professor Oliva then details how these PDMPs mainly serve as a law enforcement rather than a public health tool, introducing greater amounts of surveillance into the life of the American public. She then discusses search and seizure law under the Fourth Amendment and its applicability to warrantless police seizure of PDMP information while arguing that such searches and seizures are illegal both under pre- and post-Carpenter. She closes by issuing a warning to listeners, urging them to remember how much of their most private information is made public given common technologies. In private practice, she has specialized in all aspects of labor and employment and commercial litigation. Brown has been recognized by the National Law Journal as one of “The 50 Most Influential Minority Lawyers in America” and by the New Jersey Law Journal as one of the “prominent women and minority attorneys in the State of New Jersey.” She received the New Jersey Medal from the New Jersey State Bar Foundation and currently serves on its Board of Trustees. She has also repeatedly been named as a “New Jersey Super Lawyer” and by U.S. News as one of the Best Lawyers in America in the area of commercial litigation. In 2009, Brown was a recipient of the Spirit of Excellence Award from the ABA Commission on Racial and Ethnic Diversity in the Profession. Experts Debate Chapter 14 Proposal for Large Financial Institutions ABI Resident Scholar Prof. Charles Tabb talks with Profs. David Skeel of the University of Pennsylvania Law School and Stephen Lubben of Seton Hall University School of Law about the orderly liquidation authority of the Dodd-Frank Act for systemically important financial institutions (SIFIs)and proposals for a chapter 14 for SIFIs. Prof. Skeel, who worked with experts at the Hoover Institute on the chapter 14 proposal that is the basis of current legislation before Congress, believes that the Bankruptcy Code needs to be retooled for a large financial institutions. Prof. Lubben agrees with the idea of amending chapter 11 for a large financial institution, but disagrees with various parts of the Hoover Institute's chapter 14 proposal.

Paul Paray Paul provides consultative advice to those companies looking to navigate new media, tech E&O, and privacy exposures. Paul has held a number of senior insurer positions, including most recently with the CNA miscellaneous professional liability division where he helped lead the team tasked with growing the CNA media and technology E&O products. Before that, he was the Technology and Media Product Manager for National Union/AIG where he developed and managed media and network security products for the professional liability division. Prior to that, he managed the New York Regional office for AIG eBusiness Risk Solutions and was the Director of Complex Claims at AIG Technical Services responsible for handling some of its biggest technology E&O and media claims. Prior to entering the insurance industry in 2002, Paul was the owner of an intellectual property law practice; was General Counsel and EVP of Geometrix, Inc. in San Jose, California; and was a commercial litigator with Lord Day & Lord and Pitney, Hardin Kipp & Szuch. Paul has authored numerous articles published in periodicals such as the Newsletter of the Federation of Defense and Corporate Counsel; The Risk Management Letter; and CyberEdge Journal. He has been an invited speaker at numerous events, including: RIMS Annual Meeting; ABA, Litigation Section, Insurance Coverage Committee Annual Meeting; and Law Journal Seminars Future of E-Commerce Seminar. He has been interviewed and quoted by numerous periodicals, including: Crittenden Specialty Coverages Insider; Christian Science Monitor; Smart Reseller; The Financial Post; The Newark Star-Ledger; The New York Times; The Toronto Globe and Mail; and The Vancouver Sun. Paul is a graduate of Muhlenberg College and Seton Hall University School of Law. Scott Ernst A 20-year industry veteran, Scott provides advisory and advocacy services related to technology, media, data security and privacy risks. In addition, Scott's broad P&C background provides him with a valuable understanding of numerous risks and coverages including; management liability, commercial property, casualty, and various non-standard risk transfer designs. In his current role, Scott's work increasingly entails technology and media E&O, intellectual property protection, the effective protection of intangible assets and the rapidly emerging issues of data security and privacy. Scott has held a number of senior positions in the insurance industry including management positions at Marsh & McLennan, Frenkel & Co. and Chubb Executive Risk. Scott also founded and served as President of Insurecast, a specialty technology risk management firm which was subsequently acquired by a larger brokerage. Scott is a published author and has spoken on insurance topics at seminars sponsored by the Professional Liability Underwriting Society, The Risk and Insurance Management Society (RIMS), the New York State Bar Association, the New Jersey State Bar Association, and the New Jersey Insurance Coverage Institute. Scott is a member of the Professional Liability Underwriting Society (PLUS) and former Chair of the PLUS Eastern Chapter. Scott is a graduate of The University of Michigan School of Business.
