Summary This week Jay welcomes actress Olivia Blair to the podcast. Today, Olivia pursues her passions of acting and film, however she hasn't always been able to live as her authentic self. Olivia first began to struggle with body dysmorphia in high school, when the pressures of media encouraged her to form a distorted body image. Jay and Jace break down some titles from the week of January 27, 2021 without giving away spoilers. For Jay his favorite book of the week was Batman Black & White #2 which showcased some gorgeous artwork and showed, once again, how the versatility of Batman is as a character allows for so many different types of stories to be told. We also got the next chapter of Captain Marvel's story in a possible Marvel Universe future that may lead into Carol gaining some the magical powers that have been hinted at by Marvel recently. Over in Post Americana, the blood and guts continue to fly as the action is turned up in this title for mature readers. Both Jay and Jace vastly preferred the Black Adam story in the pages of Suicide Squad much more than the story of Amanda Waller's latest line-up of Task Force X. Future State Batman Superman gives us some details about the Magistrate coming to power in Gotham and the guys think it should have been the first Future State title to be released. Both Amazing Spider-Man and Fantastic Four take a slight step back in quality this week, but for different reasons, in FF, the latest arc goes out with a whimper instead of a bang although the artwork is top notch. Amazing Spider-Man has once again placed the Kindred story arc on the backburner instead of resolving it and Jace is very frustrated by this. We have a similar problem with Daredevil #26 where the story Chip Zdarsky is telling is unfortunately interrupted by a King in Black tie-in. The AfterShock title Kaiju Score continues to be a wild ride and issue #3 is no exception as our gang of would be thieves are forced to switch things up on the fly. In Joker/Harley: Criminal Sanity #7, we see the first inklings that even this version of Harley may not be able to avoid the machinations of the Joker which could lead her down a very dark path. Finally in The Other History of The DC Universe #2, John Ridley & company pick up right were they left off with book #1 and give us a powerful & emotional look at the DC Universe through the eyes of characters who are often times overlooked. Jace gives it his nod for Book of the Week. Plus we gives a run down on some other titles you may want to be in the lookout for.

The Challenge is back and the season premiere of Total Madness did not disappoint. An intense challenge kicks off the episode where each cast member is vying to get first place. In the end Rogan wins for guys and Jenny wins for the girls. Later they learn where they will be staying for the remainder of their time, and to their surprise it’s not the fancy digs they are accustomed to, instead they’re living in a bunker with no windows. The losers of the Challenge have to vote on one person to go into elimination, Rookie Asaf is chosen. During the tribunal meeting with Jenny Rogan, and Cory, they decide to choose Rookie Jay to go against Asaf. The elimination was an exciting one. Both Jay and Asaf held their own, but ultimately Jay got the W, and then learns about an exciting twist. The casts finds out that in order to compete in a final you have to win an elimination. Jay is then given a red skull symboling that he won an elimination. You've spent the last week pining away for a new episode of the Real Life Podcast and the wait is finally over! This week, the boys are bursting with excitement as the Oilers find themselves near the top of the Pacific Division standings for the first time in a while and they just can't hold it in. How could the boys not start this podcast off by gushing about the Oilers? Impossible! After knocking out three straight wins against some of the league's best and temporarily sitting atop the Pacific Division standings, there's a hell of a lot to be excited about. After turning things around from their first two losses to New Jersey and Boston, the boys try to decide where was the turning point that got things moving the other way. Continuing on with the Oilers talk, the guys look at Connor McDavid's early season success, the horrible calls Milan Lucic has had against him, and Mikko Koskinen's first game in seven years. After having Uffe Bodin and Peter Sibner on last week's show, Jay wrapped up the Swedish invasion with a breakdown of the week's festivities and a heartfelt plea that the Swedes come back for another round. I recently read Data Driven Security: Analysis, Visualization and Dashboards by Jay Jacobs (@jayjacobs) and Bob Rudis (@hrbrmstr). The book is easy to read and a very good introduction into the world of data and security. Both Jay and Bob were kind with their time when I had questions about exercises in the books. This week's show starts off with Mike and Jay taking a look at the currently stalled Senate GOP healthcare bill. Between the bill's broad unpopularity and a devastating Congressional Budget Office score, it looks like it's going to be tough for Mitch McConnell to get this bill through his chamber without some significant changes. While Mike and Jay differ greatly on the merits of Obamacare, they both agree that, to this point, Republicans haven't offered a serious, carefully considered conservative alternative to it. Next it's a look at some big news from the Supreme Court. The Court partially lifted the injunctions imposed by lower federal courts on President Trump's travel ban, and said it would hear the case in October, at the beginning of its next term. Both Jay and Mike feel this is the right call, though Jay feels the injunction should have been completely lifted, which Mike doesn't agree with. After that, they discuss a Supreme Court decision that allows state funding for religious institutions. Jay feels the seven members in the majority got it right, and Mike just barely agrees, though he feels that Justices Sotomayor and Ginsburg make some important points in dissent. After that, the Guys talk about a new research study on Seattle's minimum wage experiment. The study, which found that the boost actually cost workers money, was praised by the right, with the left finding plenty of holes in the methodology. Jay feels this vindicates conservative common sense, while Mike argues that it's only one flawed study (as all studies are, to a certain extent) and although it should be taken into consideration, the weight of the evidence still supports the overall benefit of minimum wage hikes. This week's show starts off with a look at the latest iteration of the Senate health care bill. While there are some changes from the initial version, Mike is still opposed, Jay is still 'eh' and neither of them think it has the votes to pass - at least not without seriously sweetening the pot for some GOP senators and their states. After that, it's a look at the recent revelations about Donald Trump Jr.'s meeting with a Russian government connected attorney claiming to have damaging information on Hillary Clinton. Both Jay and Mike agree that it was incredibly stupid for Trump Jr. to not only take the meeting, but to indicate his eager interest to take the meeting in email. The best possible light to put this in is that the Trump administration is, at the highest level - composed of rank amateurs. The more ominous interpretation is that top Trump campaign operatives knew what they were doing was wrong, but assumed they wouldn't get caught. After that, it's a look at the confirmation hearing for FBI Director nominee Christopher Wray - both the Guys agree he's a fine choice - and discussion of whether the Consumer Financial Protection Bureau (Mike's favorite regulatory agency) is doing consumers a favor with a new rule banning mandatory arbitration. Mike and Jay open the show with a look at the stunning announcement about talks between President Trump and North Korea's Kim Jong Un. Both of the guys are hesitant to believe this will lead to anything given North Korea's track record of stringing U.S. administrations along and breaking agreements. They're also concerned that by meeting with Kim - the first time any U.S. president has agreed to talks with North Korea's leader, President Trump may be giving the regime something it's always wanted and getting little if anything in return. After that it's discussion of the suit the Department of Justice has brought against three California laws involving enforcement of federal immigration policy. In a strange twist, Attorney General Sessions is making the typical liberal argument about federal government supremacy while California is responding with traditionally conservative points about the 10th Amendment, going so far as to rely on a conservative icon, former Supreme Court Justice Antonin Scalia. Both Jay and Mike think that the federal government will end up winning in court (with Jay being more sure of this than Mike) though it's likely to take several years. After that, Mike and Jay discuss the tariffs on steel and aluminum that President Trump formally announced this week. They both see this as a truly bad move that will not only hurt far more Americans than it will help, but a step that further erodes America's standing in the world and does nothing to deal with a truly significant international issue - China's ongoing, massive intellectual property theft. Finally, the Guys look at the new gun legislation enacted in Florida in the wake of the Marjory Stoneman Douglas school shooting. They consider whether the NRA's Second Amendment based lawsuit is likely to succeed (probably not) and discuss whether Florida might be a model for more states and possibly even the U.S. Congress, where not much has happened as of yet. **What Mike's Reading** [For Two Months, I Got My News From Print Newspapers. This week, Mike and Jay start with a look at the Trump Administration's announcement that it would be imposing hefty steel and aluminum tariffs on U.S. allies Mexico, Canada, and the European Union on 'national security' grounds. The administration is also considering a major tariff on imported cars (also ostensibly for national security). Both Mike and Jay think this protectionism is one of the worst things to come out of the Trump administration, though Jay is more hopeful that it's more bluster from the president that won't end up as set policy. After that, they discuss the off-again, on-again summit between President Trump and North Korean leader Kim Jung Un. Mike says that President Trump is exactly the sort of person least suited to carry out the sort of careful, patient negotiations that could defuse the threat posed by North Korea. Jay feels that the president's show of strength is the right approach for North Korea, though both he and Mike wish the president understood the importance of dealing with U.S. allies differently than he deals with adversaries. Next is a look at the extremely good jobs report. Mike points out that while the U.S. is in the midst of the second longest expansion in modern history, wages are still somewhat stagnant and economic growth is far slower than it's been at many points in the post World War II era. Both Jay and Mike agree that President Trump can't claim responsibility for the expansion any more than President Obama could, and they lament the tendency of the media to overemphasize the importance of government when it comes to economic growth. Then they turn to the Supreme Court's decision to not hear a case involving an anti-abortion law from Arkansas. While Mike and Jay differ on the wisdom of abortion rights restrictions, they agree that the Court was correct on procedure. In the end, they expect Arkansas' law to be overturned as unconstitutional, as the Court did with a similar Texas law in 2016. Finally, the Guys discuss President Trump's pardon of conservative provocateur Dinesh D'Souza, and whether the president is using his pardons to send a message to people Robert Mueller has indicted in his Russia investigation. Mike doubts it, believing that it's simply President Trump being his impulsive self for the most part. Mike somewhat surprises Jay by favoring the president's pardon of D'Souza, who Mike says is an awful person, but who was unfairly singled out by the Obama administration for prosecution. Jay points out that it's the awful people who are most in need of protection - and sometimes pardons. Mike and Jay kick off the show by looking at the Supreme Court's 5-4 decision allowing construction of a Mexico border wall to move forward pending litigation. The Court's five conservatives didn't rule on the substance of President Trump's action but indicated that the plaintiffs were unlikely to have standing to sue. Jay feels that the court got it right, though Mike is more inclined to side with the four liberals who dissented, arguing that once the wall is up, the harm that's been done cannot be undone and so building should be on hold until the matter is resolved. Next, they talk about the testimony of former special counsel Robert Mueller before Congress. It was certainly political theater, but Mike feels it was a worthwhile ‘Hail Mary' shot and bringing the often dry contents of the Mueller Report to life, even if it was unlikely to sway many people. Both Jay and Mike agree that Mueller's performance in this political theater wasn't very strong, though Jay still believes there will be both an impeachment inquiry and impeachment proceedings. Mike doesn't see that happening. After that, the Guys discuss a rare bit of bipartisanship - the two year budget and debt ceiling deal. Jay, like many fiscal conservatives, doesn't like the fact that it raises spending by nearly a third of a trillion dollars without providing any way to pay for it. Mike points out that not all deficit spending is bad, and that the U.S. is able to borrow at extremely low rates of interest - investing that money in things with a higher return is smart, though he admits that this doesn't happen nearly as often as it should. He also points out that we'd be in much better shape if not for the massive GOP tax cut. Following that is a look at the deal Facebook made with the FTC, agreeing to pay an unprecedented $5 billion fine as well as comply with a number of checks on its practices to better ensure user privacy. Mike wishes the deal had pushed Facebook more, but feels that on balance it may have been preferable to a long, drawn out legal battle with a highly uncertain conclusion. Jay agrees, though he's less conflicted about it than Mike, and more reluctant to call for action such as breaking up Facebook or other big tech companies. The show closes with a discussion of an emissions deal the state of California made with four auto manufacturers who together make up 30 percent of the US auto market. The car companies agreed to increased emissions standards that are lower than called for by Obama-era regulations, but higher than the freeze in standards the Trump administration is pushing for. Mike's a bigger supporter of higher emission standards than Jay, but they both agree that California has a legal right to set its own standards and that if the Trump administration wants to change that, they should do so through the legislative process, not via administrative fiat. *Listener support helps make The Politics Guys possible*. This week, Jay is joined by guest co-host Ken Katkin, a professor of law at Northern Kentucky University, who takes the place of Mike on the left. (But while Mike was off this week, he still couldn't resist inserting a few remarks at the very beginning of the show.) Jay and Ken start off with an in-depth policy discussion of the American Health Care Act, the Republican legislation to repeal and replace Obamacare. They drill down into the fundamentals of how health insurance works - or doesn't work - with Jay expressing far more confidence in a 'free market' solution than Ken. Next, they look at the Trump administration's 'new and improved' travel ban. While both Jay and Ken agree that courts should grant the executive a good amount of deference in this area, Ken feels that there's no rational basis for the ban, which he believes is a clear attempt to 'reverse engineer' an unconstitutional Muslim ban. Jay, though not entirely unsympathetic to these concerns, isn't exactly convinced. Finally, they consider the latest release from Wikileaks - a trove of documents concerning CIA hacking techniques. Both Jay and Ken conclude that Wikileaks is more hero than villain. The discussion turns to ties between Russia and the Trump campaign, with Ken arguing that the amount of evidence of involvement is overwhelming. He concludes that President Trump is, in effect, a Russian agent.
