On March 25th, 2025, the Supreme Court will hear oral argument to resolve two circuit splits arising under the Clean Air Act (CAA) provision regarding judicial venue: EPA v. Calumet Shreveport Refining, L.L.C. (23-1229), and Oklahoma v. EPA (23-1067). The outcome of these cases will hinge on the Court’s interpretation of the CAA’s unique venue provision, 42 U.S.C. § 7607(b)(1). The CAA states that challenges to “nationally applicable” actions may be filed only in the D.C. Circuit. 42 U.S.C. § 7607(b)(1). Conversely, challenges to CAA actions that are “locally or regionally applicable” may generally be filed only in the appropriate circuit court for the region. Id. But there is an exception: actions that are “based on a determination of nationwide scope or effect” must be filed in the D.C. Circuit “if in taking such action the Administrator finds and publishes that such action is based on such a determination.” Id.What is the meaning and scope of this exception? How far may EPA go in picking where to litigate its final actions? And what does this mean for denials of State Implementation Plans (SIPs), small oil refineries seeking Renewable Fuel Standard (RFS) exemptions, and other EPA actions affecting the regulated community? Our recent frigid Michigan winter weather can make it a little hard to remember our mantra of embracing the season, but a flurry of upcoming fun festivals might help you change your mind. On this episode of Behind the Mitten, we'll take you all over the state, to some of our wackiest winter festivals you can experience. Do you have a secret desire to be a Viking, even if it's only for a weekend? Our friends at the Michigan Nordic Fire Festival see you, and have concocted one heck of a great time in Charlotte. The 10th annual festival will feature Viking-themed performances, reenactments and demonstrations, competitions and activities like archery and axe throwing, a costume contest and more. We had on Bryan Merkle, the top viking, to give us the scoop. He's particularly excited about the Mead Hall, where you'll be able to sip samples of this honeyed drink. The festival runs February 21 through the 23 and tickets can be purchased online. I'm shining my horn helmut right now.Next, we'll take you to the Upper Peninsula where the little town of Trenary will be hosting their famous Outhouse Races on Saturday February 22. Thousands of people will inundate downtown, while dozens will compete for amazing prizes. We had on Stacey Rucinski, President of the Trenary Outhouse Races to get to the bottom of this hilariously good time. Learn how to make a regulation outhouse, what must be inside said outhouse during the race, how the outhouses make their way down the street, and what it's like to be in Trenary on the big day. Finally, we have one of our favorite regular guests back on the show, Jesse Wiederhold from Visit Keweenaw. Jesse is always a font of knowledge and excitement about what is going on in the Key, and this week was no different. We talked about the Copper Dog 150, which starts in Calumet on February 28. The dog sled racers will then traverse the peninsula during several exciting races. Enjoy a variety of events throughout the weekend, including sled dog rides for the kids, a huge street party, fireworks and more. A new event is happening February 21-23, The Hancock Snow Sculpting Invitational. There will be some seriously awesome snow art here. This premier event will feature four talented teams of snow sculptors, including the renowned Sculptora Borealis, whose team members have won the National Snow Sculpting title four times, and Team USA, winners of the Bronze medal at the 1998 Nagano Olympics and two-time National Snow Sculpting title winners. Sustainable aviation fuel can use a variety of feedstocks, from used cooking oils to oily seeds. When those feedstocks are heated under high pressure with a catalyst, the process produces hydrocarbons - the essential component in fuel. This process is called HEFA, Hydro-processed Esters and Fatty Acids. One company using this process to produce sustainable aviation fuel is Montana Renewables, based out of Great Falls, Montana, where they reconfigured equipment previously used in petroleum refining. THE TRUE CASE THIS EPISODE IS BASED ON: While the story you hear has the detective saying he found out what happened, it's left unsaid as to what it truly is… because in reality, this case is still unsolved. On Halloween night 1981, 11-year-old Karl Heikell went out for a walk in his hometown of Calumet, Michigan and never returned home. Despite searches, no trace of Karl was found and there were various unconfirmed sightings of him around town in the following weeks. 11 months later in October 1982, a hunter found torn clothing and skeletal remains in a wooded area near an old mine. The remains were identified as Karl based on the clothing. 40 years later, a local librarian named Dillon Geshel became interested in the cold case and has been compiling information to try to uncover what happened to Karl that Halloween night. Police looked into a couple persons of interest at the time, including a friend of Karl's who died by suicide not long after Karl went missing, but no strong evidence pointed to their involvement. Karl's family is still hoping for answers after all these years to finally get some closure, especially for Karl's elderly mother. A detective newly assigned to the case says he has collected some new leads and believes the case is no longer cold. There's something about gazing out a body of water that goes to the horizon that reminds you of the vast inhumanness of so much of the planet. I was struck by that last summer at the Indiana Dunes, on the shore of Lake Michigan. When the water rises up to the horizon like that, filling your vision, it's not hard to imagine the existential panic Captain Ahab's youngest sailor felt when he went overboard in a whale fight. The rest of the crew went off chasing the whale, and there he was, bobbing up and down with nothing but ocean around. Don't worry, he got rescued, but in the hour he was alone in the ocean, something changed in him. While he had floated there, surrounded on all sides by undulating water ready to engulf him, “The sea had jeeringly kept his body up, but drowned the infinite of his soul.” I was less likely to be engulfed by the inhuman expanse of the sea because I was on the shore, surrounded by giant umbrellas, beach balls, and plenty of sunscreened humans. Plus, out at the farthest edge of the coast, I could see the smokestacks of the steel industry. They're strangely grounding, those giant structures at the edge of my vision. The sight kept the infinite of my soul from drowning, but probably because it felt like they were jeering at me. Sometimes if you want to be acknowledged, jeering is what you settle for. The smokestacks reminded me of another way I'm engulfed – we're all engulfed: in a world run by fossil fuels. Which is not great. Not just because they're heating the planet up. Also because fossil fuel production takes land, and labor, and leaves an immense amount of pollution in the communities that surround it. Jeering might be the right word, too, for how those smokestacks relate to the region around them. The Dunes are in the Calumet Region, which also includes cities like Gary, Hammond, and Michigan city – cities dominated, according to scholar and writer Ava Tomasula y Garcia, by smokestacks and “air you can see and taste because it's so dirty.” The region was dominated for over a century by some of the dirtiest industries in the world. Not too long ago, Ava published an article about all this in Belt Magazine. She tells the story of the oil and gas industry in Indiana, and considers how its influence continues to shape the region. It was because of that article that I wanted to talk with her. Ava is a graduate student in Anthropology at Columbia University, where she's focused on medical anthropology. Specifically, she's interested in undiagnosable illness that people living in the Rust Belt and the Calumet Region link to industrial toxicity. These are not “monumental” illness like cancer and asthma but things that are much harder to diagnose, like brain fog and nausea. I hope to have her on again to talk about that research. Today's episode, though, is about how the geology of the region ended up shaping its industrial development, which also shaped its social history – who moved to the region, how race and labor struggles played out, and how regions like the Calumet, often known these days as the “Rust Belt,” are more complex than that term implies. Tasting Notes: This 90 proof, 8 year old Kentucky bourbon is made with 74% corn, 18$ rye, and 8% malted barley. The nose is soft with notes of burley tobacco, hay, lemon, and leather. The palate is soft and fruity as well with a nice balance of rye spice and barrel spice rounding out a generally very drinkable whiskey. Christmas Eve, 1913, was a tragic night in Calumet, Michigan. 73 people—59 of them children--were killed when someone falsely yelled, “Fire,” at a crowded Christmas party on the second floor of the Italian Hall setting off a deadly stampede. The disaster occurred five months into a crippling labor strike between Western Federation of Miners Union workers and the Calumet Hecla Mining Company. Now, 110 years later, Beth Kirschner has written about the historic labor dispute and what has been called the Italian Hall Massacre in her novel, “Copper Divide.” In this episode of the Lake Superior Podcast, Walt Lindala and Frida Waara talk with Beth, who works as a software engineer, about the 1913 Copper Strike and how the Keweenaw Peninsula's history inspires her writing.
