Environmental Justice - an effort to affirmatively address disproportionate pollution and environmental burdens borne by low-income and minority communities - grew from an Executive Order by President Clinton in 1994 through expanded efforts across the entire federal government with special emphasis at DOJ and the EPA in the Biden Administration. President Trump issued an Executive Order on his second day in office prohibiting "... all discriminatory and illegal preferences...," followed by a Memorandum by Attorney General Pam Bondi rescinding the Environmental Justice policies of prior administrations. What are the implications of this Administration’s cancelling of environmental justice writ large? What does this mean for environmental enforcement and infrastructure development in low-income and minority communities? Do its concepts still live on in the federal government and at state and local levels? This new episode focuses on the recent U.S. Supreme Court decision in Loper Bright Enterprises, Inc. v. Raimondo and its impact on administrative law, moderated by Norm Dupont, Of Counsel at Aleshire & Wynder. The discussion features Professor Lisa Heinzerling of Georgetown University Law, a leading scholar in environmental and administrative law, and John Cruden, a Principal at Beveridge & Diamond and former Assistant Attorney General for the Department of Justice's Environment and Natural Resources Division. The panel examines the court's 6-3 ruling, which overturned the long-standing Chevron doctrine, shifting the power of statutory interpretation from agencies to judges, now requiring judges to determine the "best interpretation" of ambiguous laws. Heinzerling provides context on the Chevron doctrine's 40-year application and potential alternatives, while Cruden discusses the implications for future cases from a private lawyer's perspective. Together, they explore the broader effects on administrative agencies, environmental policy, and statutory interpretation.

There are many ways for us to honour the sacred, and one particular way for us to do this, is to deepen our connection; our relationship, with our immediate ecology, the land beneath our feet, the resplendent sky above, the environment in which we reside.Another way we might language that is, re-framing how we perceive and approach and relate with, spirit of place. Many many moon ago, I came across a book by Loren Cruden, titled The Spirit of Place, which was first published in 1995. You could think of this book as a guidebook of sorts, when it comes to offering expansion and depth for relating and connecting to our Earth, but more specifically, to the lands on which we live.Through opening ourselves up and tuning into the changing of the seasons, and coming into sync with the pulse, the rhythm, the flow of these earthly cycles, we open ourselves up to the teachings and gifts that they carry with them. When I first started cultivating my own deepened relationship to the seasons and the lands, this workbook was a really lovely ally, so much so, that I reached out to Loren Cruden via email and asked if she would love to be a guest on the show, but I was to find out that due to the way that she chooses to live, she isn’t connected to the internet.Through some back and forwards with her son acting as intermediary, I received word that she was very appreciative of the invitation and although she wouldn’t be able to commune in real-time via the internet, she would be happy to respond in her preferred medium - written word. She was lovely enough to pass on the following script, in relation to what this show Birdsong is all about, which is honouring the sacred, and I’d love to read it out to you. To introduce Loren Cruden, at the time of the writing of her book, she was a midwife and a herbal healer living on a mountain in Washtington State. Following her spiritual studies that spanned Europe, Asia and Africa, and her six years of work with Lewis Sawaquat, a Potawotomie pipe carrier, she deepened her engagement with the spirituality that is native to the land. She’s the author of many other books, which you can find over at lorenbooks.com, and it’s a real pleasure for me to be able to share with you what she shared with me, in regards to Honouring The Sacred. Please join our Birdsong and support this remembrance of the sacred ways….Check out the Patreon pageLeave us a review on iTunesConnect on InstagramConnect on FacebookFull Resources & Links

It was good news for two of the New Zealand teams that kicked off their Super Rugby seasons this week. The Crusaders have cruised to an easy 43-25 bonus point victory in their Super Rugby season opener against the Waratahs in Nelson. The two times defending champions dominated the first half leading 24-6 at the break, thanks to tries to outside backs Will Jordan, Braydon Ennor, and Leicester Fainga'anuku. The Waratahs found hope early in the second half with two tried to wing Mark Nawaqanitawase, but the Crusaders quickly quashed any hope the visitors had with Jordan and Ennor grabbing doubles and Luke Romano also getting on the score sheet. The Blues hoped to emerge victorious in their home game against the Chiefs. The Auckland side appeared completely in control at the break, after Rieko Ioane scored two typically blockbusting tries on the occasion of his 50th game and the Chiefs, expected to be competition front-runners this season, were strangely absent on attack and defence – they missed 20 tackles in the first half alone. But the visitors' comeback was quick and brutal, a turnaround which reaped a total of 32 second-half points. It was helped immensely by the introduction of their returning first-five Cruden who coolly organised their attack, dropped a goal in the final moments to extend his team's margin to seven points and kicked a penalty after the siren to deny the Blues a losing bonus point. The match ended 37-29 to the Blues. The Hurricanes suffered an even more embarrassing defeat, losing 27-0 to the Stormers.

Damian McKenzie's ruptured knee ligament, which will keep him out of all rugby for the rest of the year, will force the All Blacks selectors to up their search for the country's next-best first-five, an individual who is not immediately obvious. They will want to take another specialist No10 to the World Cup in Japan which starts in September to cover for Beauden Barrett and Richie Mo'unga, and the beauty of McKenzie was his impact value from the bench and his ability to cover fullback as well.It goes without saying that his extended period on the sidelines following the ACL injury which he sustained while trying to tackle Blues first-five Otere Black during the Chiefs' 33-29 thriller in Hamilton on Saturday will also hinder a franchise which has re-found its mojo over the past three weeks.Brett Cameron, Mo'unga's back-up at the Crusaders and a replacement in the test against Japan last year, is the only other capped first-five specialist currently playing in New Zealand and his form this season, particularly when starting in his team's defeat to the Waratahs in Sydney, suggests he has plenty of developing to do yet.Other possibilities are the Blues' Black, a 23-year-old New Zealand Maori player and former under-20s representative, and Josh Ioane and Bryn Gatland, also both 23, at the Highlanders.Stephen Perofeta, 22, has yet to play a competitive match for the Blues this year after suffering a pre-season chest injury, a latest problem in a fairly long list. Had he been fit at the end of last year he probably would have gone to Japan instead of Cameron, while Blues' teammate Harry Plummer, 20, has promise but isn't ready.‌Of them all, it is perhaps Black who strikes as the best bet for his composure and consistency over the past couple of weeks when starting for the Blues. His recent rise ahead of Plummer, with whom he swapped the No10 jersey initially, has clearly given him confidence and he is thriving on the responsibility and game time. The selectors could be forgiven for casting a rueful glance at 28-year-old Hayden Parker, the former Highlanders first-five now doing incredible things for the Sunwolves with not only his goalkicking, which is nearly flawless this season, but his general play for the perennial battlers. Under New Zealand Rugby's regulations, Parker isn't eligible for the All Blacks as he isn't playing for a Kiwi franchise. For McKenzie, who didn't attend the All Blacks' foundation day in Wellington today, the news will be devastating and it has a strange echo to four years ago when Chiefs No10 Aaron Cruden suffered the same injury in Christchurch almost to the day."He's done an ACL so it looks like he might be out for eight to nine months which is a real shame for him," said All Blacks coach Steve Hansen today in announcing McKenzie's diagnosis. "His Word Cup opportunity is gone."He's still young enough to probably make the next two so it's just important that he gets his knee right and takes the time to come back so he can achieve the dreams he wants to achieve. It's sad for him obviously it creates an opportunity for somebody else. We've got to accept injuries and there will be more than just him [before the World Cup] I'd suggest."Cruden's injury on April 17 before the All Blacks 2015 World Cup defence was a huge blow for himself, the Chiefs and the national team, but Hansen had three very clear options for his playmaker in the form of Daniel Carter, Beauden Barrett and Colin Slade.Lima Sopoaga also went very close to making the trip to England and Wales after leading the Highlanders to their first Super Rugby title and impressing in his test debut in Johannesburg.Four years later, however, Hansen's options are not so obvious and an injury to either Barrett or Mo'unga, or heaven forbid both, would be potentially catastrophic to the team's chances of making history again, this time by winning three in a row.

Hannah Allen, the author of last week’s document, knew she suffered from melancholy. An altogether less sympathetic figure, Alexander Cruden vigorously denied having any psychopathology, though those he encountered found him obsessive and disproportionate, insisting he was the victim of malice and stupidity. His writings show the contested boundaries of madness, as experienced and observed. A Scot by birth, Cruden lived in early Georgian London and had experience of being placed in private madhouses, which provided much of the care for the mentally disordered prior to the 19th century.
