Geralynn Patellaro has been practicing law for the last 20 years and is licensed in California and Nevada. During her time, she's seen every conceivable workplace investigation and has experienced all facets of where it can go. In this webinar, Geralynn answers some frequently asked questions from employers, business owners, and HR. She covers everything from workplace sexual harassment lawsuits to how to conduct an investigation with international jurisdictions and witnesses. Highlights: A little bit about Geralynn and her background in law. There are certain distinctions you need to be aware of on who can do outside workplace investigation in the state of California and Nevada. When you take the time to investigate an issue, it's going to look like to the jury that you took this workplace issue seriously. Does investigation seem too serious of a word? Geralynn recommends calling it a “fact-finding” mission. Who should do the workplace investigation? What options do employers have? You have to do the best investigation you can, based on the information provided. Geralynn offers things she considers when she's working with a client on an investigation case. You have to understand what you're legally/required to turn over vs. what information you don't have to turn over. If your investigation involves someone who is not a U.S. citizen, there are distinctions you need to be aware of, too. Sometimes an investigation boils down to a “he said, she said.” What do you do then? Geralynn shares the EEOC's five credibility factors and DFEH's nine factors. Does the employee need to inform you that they're recording their investigation interview? What's the best way to talk to the complainant? What do you do if both parties in dispute have to continue working with each other? After the investigation, check in with the complainant. This is where the hard work truly begins. How do you ask questions without alarming staff members? The manager often doesn't want to escalate a situation to HR. Geralynn's philosophy is that if a manager can handle it, let him or her do it, but at least document it with HR. Geralynn offers some final piece of wisdom: Just document what you can. No report is perfect, but there should be a paper trail for why things couldn't get followed up on and more. What should you look for in an interpreter if an employee is not a native English speaker? California's Department of Fair Employment and Housing (DFEH) tried and failed to stop the US Equal Employment Opportunity Commission (EEOC) from settling with Activision Blizzard, but the two agencies' fight was one of the ugliest in recent memory. Before Activision, California's Department of Fair Employment and Housing (DFEH) successfully stopped a private class action brought against Riot Games (League of Legends), from settling for a "mere" $10M. Now, the DFEH and California's Division of Labor Standards Enforcement (DLSE) have realized a great victory from such efforts, as the game maker has agreed to settle instead for 10x that amount (as well as three years of additional agency scrutiny). Halo Infinite No Longer Has an Infinite Delay [Link] The Microsoft Store leaked, or didn't, the release date of Halo Infinite this morning of Dec. 8. While fans expect this to be cemented with the start of Gamescon today, a source close to Microsoft told The Verge that December 8th is accurate. Microsoft originally planned to release Halo Infinite with the Xbox Series X / S in Nov 2020, but delayed it until fall 2021 due to the challenges of game dev during a pandemic. The disappointing facts that 343 Industries revealed regarding the lack of campaign co-op and Forge modes, still stands. Co-op will come during season 2, about three months after launch, and the Forge mode, that allows Halo players to customize and share maps, won't be in until season 3, approximately six months after launch. More Blizzard Lawsuit Drama [Link] California has broadened the scope of its anti-discrimination lawsuit against Activision Blizzard. The state is now adding temporary workers to the female full-time employees of whom it is suing on behalf of. This is pretty shocking, or not: The state's DFEH is alleging that Blizzard has interfered with its investigation! The dev studio has made the investigation more challenging by enforcing NDAs requiring workers to speak with them before contacting the DFEH directly, or their hired third-party law firm, WilmerHale. Blizz HR has also supposedly SHREDDED documents related to investigations and complaints While Blizzard states that they have been, and currently are, making changes to better their work environment, these alleged actions are more than negating their intent. Prior to joining DFEH in 2019, Branden was the Senior Attorney of the Fair Housing Center of the Legal Aid Society of San Diego, Inc. (LASSD), where for nine years he was instrumental in creating the first fair housing services program at LASSD that provides education, outreach, testing, and enforcement of fair housing laws. Branden began his career as a Housing Advocate at Communities Actively Living Independent and Free, a disability rights organization in downtown Los Angeles where he advocated for housing rights for persons with disabilities.
