You can't be involved as, as a leader, as a manager, as an owner of business. If you're not physically present. When trial lawyer Jamal Alsaffar of Austin Texas heard about the mass shooting in Lewiston, Maine, he had the eerie feeling of history repeating itself. Many of the facts were strikingly similar to what had occurred in the Sutherland Springs church mass shooting case in Texas that Jamal tried to a Federal judge, resulting in a $230 million judgment for the families. In the process, Jamal also forced the U.S. Government to disclose documents and information that demonstrated a long-standing pattern of failing to report dangerous, violent, and mentally unstable members of the armed forces to the FBI databank, thereby permitting tens of thousands of deranged or dangerous individuals to purchase and continue to possess firearms. As a result of Jamal's case, he not only secured compensation for his clients, but he forced the Air Force to enact policy changes that resulted in tens of thousands of dangerous individuals being reported. Join Ben and Rahul for their in-depth discussion with Jamal, including his journey to becoming a trial lawyer that started with him becoming a standout in high school and college mock trial competitions to becoming one of the leading lawyers in the United States in bringing claims against the Federal Government and representing victims of mass shootings. We recently attended the inspiring Women In The Law symposium sponsored by the Federal Bar Association for the Southern District of Illinois, and several panelists discussed an ongoing issue….why are women still expected to handle emotions in the workplace? Shouldn't caring and compassion be leadership qualities of all genders? We certainly can't solve the problem in this episode, but we sure have a lot to say about it after listening to these impressive panelists.

This week we're replaying a classic episode where your hosts Steve Lowry and Yvonne Godfrey interview Gilion Dumas of Dumas & Vaughn, LLC (https://dumasandvaughn.com/). Remember to rate and review GTP in iTunes: Click Here to Rate and Review Episode Details: Gilion Dumas, a partner at Dumas & Vaughn, LLC in Portland, Oregon, and an experienced litigator in child sexual abuse cases, explains how she successfully represented former Boy Scout Kerry Lewis, who was sexually abused by an adult Boy Scout volunteer multiple times in the early 1980s. From 1982 to 1984, Kerry was mentored by Timur Dykes, who admitted to a Bishop of the Church of Jesus Christ of Latter-Day Saints -- the organization that sponsored Kerry's Boy Scout troop -- that he had abused 17 boys before January 1983. Despite this admission, the church, the Boy Scouts of America organization, and the Portland-based Cascade Pacific Council allowed Dykes to remain involved in the organization and to work directly with children, failing to notify the parents of Boy Scouts, like Kerry, who unfortunately became another abuse victim following Dykes' admission. Through a groundbreaking use of the Boy Scouts of America's secret "perversion files" containing allegations of sex abuse within the organization, trial lawyer Gilion Dumas and her legal team were able to hold the Boy Scouts of America and local Cascade Pacific Counsel responsible for the abuse Kerry, who was 38 at the time of trial, suffered as a boy. In 2010, a Multnomah, Oregon jury awarded $1.4 million in non-economic damages, assigning 60% of the negligence to the Boy Scouts of America, 15% to the Cascade Pacific Council, and 25% to the Church of Jesus Christ of Latter-Day Saints, which settled before the trial began. In a separate six-week trial, a jury returned a punitive damages award of an additional $18.5 million against the Boy Scouts of America. View/Download Trial Documents Guest Bio: Gilion Dumas Gilion Dumas is a partner at Dumas & Vaughn, LLC in Portland, Oregon. She has substantial litigation experience, most recently representing survivors of child sexual abuse and sexual assault. She is known for her diligent advocacy and compassion for her clients, bringing legal savvy, clear communication, and common sense to the stressful and often confusing experience of civil litigation. Gilion knows her way around the courtroom, having tried many cases, both on her own and as “second chair.” She obtained a judgment of over $4.5 million for a young Oregon woman who was sexually molested as a child. The concept of one-person, one-vote dictates that districts should be roughly equal in population. Other factors to be considered are the federal Voting Rights Act, district shape, geographical features, respect for communities of interest and potential competitiveness. The state Constitution requires the commissioners – two Republicans, two Democrats and an independent chairwoman – to start from scratch rather than redraw existing districts. The Arizona Independent Redistricting Commission appointed in 2011 developed this comprehensive website to inform the public about its work. That Commission adopted new congressional and legislative districts for Arizona in January 2012 and prevailed in all litigation challenging its work. After all redistricting litigation for the decade ended, the Commission ceased its operations as required by the Arizona Constitution. A new Commission will be appointed in 2021 to adopt new congressional and legislative districts for Arizona following the next census. Although the 2011 Commission's work is done, this website is being maintained for historical purposes. This website also contains a link to the website used by Arizona's 2001 redistricting commission. The Arizona Hispanic Community Forum's objective is to improve the status and opportunities for Latinos and to work towards active participation with policy-making bodies, nationally, statewide and locally. If after all the ink spilled on the topic of #deaccessioning, you're still unclear what the fuss is about, here's a short summary of the concerns of most art museum directors, excerpted from a presentation I recently made to the Federal Bar Association. We go back to the landmark decision in 1993 by the Financial Accounting Standards Board to restrict the proceeds of art sales to buying new art, the softening of its stance in 2019, and the temporary lifting of restrictions against the use of deaccessioning proceeds by the Association of Art Museum Directors. We recap the swirling external forces bearing down on art museums today regarding the monetization of collections, and I close with the hope that art museums won't discard obligations to preserving our shared cultural heritage and will instead turn to philanthropy to address pressing needs from DEI to operating shortfalls.

This week, your hosts Steve Lowry and Yvonne Godfrey interview Gilion Dumas (https://dumasandvaughn.com/). Remember to rate and review GTP in iTunes: Click Here To Rate and Review Episode Details: Gilion Dumas, a partner at Dumas & Vaughn, LLC in Portland, Oregon and an experienced litigator in child sexual abuse cases, explains how she successfully represented former Boy Scout Kerry Lewis, who was sexually abused by an adult Boy Scout volunteer multiple times in the early 1980s. Despite this admission, the church, the Boy Scouts of America organization and the Portland-based Cascade Pacific Council allowed Dykes to remain involved in the organization and to work directly with children, failing to notify the parents of Boy Scouts, like Kerry, who unfortunately became another abuse victim following Dykes' admission. In 2010, a Multnomah, Oregon jury awarded $1.4 million in non-economic damages, assigning 60% of the negligence to the Boy Scouts of America, 15% to the Cascade Pacific Council and 25% to the Church of Jesus Christ of Latter-Day Saints, which settled before the trial began. In a separate six-week trial, a jury returned a punitive damages award of an additional $18.5 million against the Boy Scouts of America. She was also one of the trial attorneys in the 2010 child sexual abuse trial in Portland against the Boy Scouts that resulted in a $19.9 million verdict for the plaintiff. Gilion is currently involved in dozens of claims on the West Coast and around the country against schools, churches, and youth serving organizations that allowed children to be abused by employees or volunteers. She and her law partner Ashley Vaughn represent many alumni of Catlin Gabel, an elite private school in Portland, for claims of abuse dating back to the 1960s; over 60 men with claims in the Boy Scouts' bankruptcy; 12 men with claims for abuse in the Assemblies of God Royal Ranger program; and several cases involving adult women sexually assaulted by medical professionals. Gilion graduated cum laude from Lewis & Clark Law School in Portland, where she was an editor on the law review. This week, our guest is Mikhail Benyash. Mikhail Benyash is a lawyer from the city of Sochi in Krasnodar region. In September 2018 Mikhail Benyash was beaten and detained by police after a meeting with his client who was taking part in a peaceful protest in Krasnodar. The court jailed him for 14 days and in addition sentenced him to 40 hours of compulsory work for disobeying a police officer and violating the rules on public protests. Amnesty International declared Mikhail Benyash a prisoner of conscience and called for his immediate release. In 2018, Mikhail Benyash was charged under Article 318(1) of the Russian Criminal Code (“Use of violence against a public official”) and in October 2019 he was sentenced to a fine of 30,000 roubles.Issues discussed in the podcast include: Mikhail Benyash's criminal prosecution; cases he has worked on in recent years; factors determining the outcome of a court case; the degree of independence of the courts in Russia; specifics of the Krasnodar region; reasons why Mikhail Benyash became a lawyer and works on human rights; the role of the European Court of Human Rights; changes introduced to the Russian Constitution last year; the return of Aleksei Navalny to Russia; the future of human rights in Russia. The podcast is in the Russian language. The podcast is in the Russian language. You can also listen to the podcast on Rights in Russia, SoundCloud, Spotify and iTunes. The music, from Stravinsky's Elegy for Solo Viola, is performed for us by Karolina Herrera.Sergei Nikitin writes on Facebook: “In the autumn of 2018 I wrote to Boris Grebenshikov about Mikhail Benyash, the Krasnodar lawyer who was detained and beaten by police in September 2018 but released on bail a few weeks later. Mikhail's release was helped – among other things – by the support of lawyers, the reaction of the Federal Bar Association and the fact that Amnesty International recognised him as a prisoner of conscience. Mikhail Benyash, a man of fortitude and courage, wrote to me on his release: ‘In the detention centre I often read ‘The Movement Towards Spring' to myself. It struck me that the young BG was able to understand and feel things that only came to me in prison, and only after my second visit. If you know him, please pass these words on to him.' I relayed Mikhail's words to the musician. Boris Grebenshchikov answered my letter briefly but succinctly: ‘Thank you, Sergei! It's worth a lot.' Last Sunday, Simon Cosgrove and I spoke with Mikhail Benyash about many things: his work, Navalny flying to Moscow at that very time, the current Russian justice system, the difficult work of a human rights lawyer – in other words, about the very words of that very song by BG: ‘Some people have a tendency to sing. / Some of them to their detriment'.”Simon Cosgrove adds: If you want to listen to this podcast on the podcasts.com website and it doesn't seem to play, please download by clicking on the three dots to the right. This year marks the 100th anniversary of women’s suffrage in the United States. As we have seen over the past century and in even in recent months, many battles have been and remain to be fought to guarantee full and equitable access to the ballot. Women showed heroism and courage fighting in the front lines for suffrage a century ago, and Black, Indigenous, and people of color have continued to lead the fight since that time to gain equitable voting rights for all. Their actions serve as an example for what must still be done to secure voting rights. In collaboration with the Oregon Historical Society and in honor of this important anniversary, the Oregon Chapter of the Federal Bar Association is pleased to share with you a series of podcasts focused on the historical and ongoing fight for the universal and meaningful right to vote. Featured speakers include community leaders, voting rights activists, students and legal scholars. We hope this series, which we have entitled “Voting Now: Turning Rights Into Reality,” educates you about the history of discrimination in voting and inspires you to join the list of heroes who have fought and continue to fight for this critical pillar of our democracy.

Imagine for a moment what our world would look like without the internet… No quick access to news articles, not able to quickly access random facts… and not able to engage with others from all over the world in an instant. How different would our world be? Would it be better off? There wouldn’t be investigations into emails or Russian hackers, for starters. And there wouldn’t be a widespread normalization of hate speech. However, that isn’t the world we live in. The world we live in is much faster, much more immediate, and the implications in the advancements of technology have not yet fully come to fruition. And many times, the technology and types of media outlets we use everyday can be more harmful than we think. Recently I had a great conversation with a member of the Federal bar Association, a young and talented internet attorney by the name of Andrew Rossow about the topic of Cyberbullying as well as the other darker aspects of social media. When you think of a lawyer or judge, what image comes to mind? Is it a man in a long dark robe, sitting on large dais, with a gavel in hand?Does the iconic 90’s show law and order come to mind? You’d be surprised how many people base their idea of a good lawyer or judge off of that show. Now what if I asked you to guess how many lawyers and judges in the U.S. are women? Not so easy is it. Well according to the New York Times, over 50 percent of law school grads are women, but only 30 percent of them end up practicing law. The U-S has struggled with the disparity between men and women in the workforce for hundreds of years, especially in the judiciary. From Sandra Day O’Connor to the iconic Ruth Bader Ginsburg a.k.a the notorious R.B.G., Americans have been fascinated with strong female leaders, especially in our federal judiciary. So, to better understand the topic of women in the judiciary, we are going to take a trip down memory lane, and talk about the pivotal moments in history for women in our courts system. And then we will talk to Maria Vathis, who is the President of the Federal Bar Association, and a history-making woman in her own right. The United States is gradually becoming the land of the red, white, and… green. No… really! Since 2016 over 10 states have legalized the sale and recreational usage of marijuana, and 33 states have some sort of medical marijuana statue on the books. Despite many states going green by legalizing recreational usage of pot, there is still one component to this narrative that hasn’t garnered lot of coverage over the past couple years: medical marijuana in the workplace. Can an employer fire you if are consuming marijuana as a part of a medicinal regimen? Can you be denied a prospective job due to a pre-employment drug test where it came back positive for THC, despite you being a part of a state medicinal registry? There is no simple answer to this complex issue; medical pot has left us in a legal limbo. So, in order to get to the bottom of this, I sat down with attorney Dustin Massie. Dustin is an advocate for employees who have experienced wrongful termination, discrimination, retaliation, harassment and other illegal treatment in the workplace. In all my years of working as a journalist, he is probably the most impressive attorney I have had the honor of interviewing. His charisma and magnetism matched with his intelligence and ability to answer tough questions in an articulate manner, immediately made me realize I was speaking with someone of importance; someone whom I could see sitting on a federal bench as a judge, or becoming a leader in the legal the community. So, for all those people who have unanswered questions about what protections they have (or don’t have)listen to this episode, and my interview with an impressive attorney, as we sort out some of the legal limbo that medical marijuana has left us in. Here is a conversation you should know about, with attorney Dustin Massie. Colton Salaz, Exec. With the rise of social media over the years, cyberbullying has been a huge problem. Cyberbullying is the use of electronic communication to bully a person, typically by sending messages of an intimidating or threatening nature. Bullying tweets and Facebook posts, can be powerful and have a huge impact; keyboard warriors find their victims and oftentimes their victims cannot escape. But within the legal profession, there are efforts to put laws in place and combat cyberbullying through a variety of ways. On Lawyer 2 Lawyer, host Craig Williams joins attorney Maria Z. Vathis, the 91st president of the Federal Bar Association, and returning guest and internet attorney Andrew Rossow to discuss cyberbullying, the impact on victims, and the efforts by the legal profession to prevent cyberbullying. Attorney Maria Z. Vathis is the 91st president of the Federal Bar Association. Internet attorney Andrew Rossow brings a unique millennial perspective to the show, as he is also a criminal defense attorney, writer, and adjunct law professor in Dayton, Ohio.
This episode, recorded live in New York City at the Federal Bar Association’s 2018 annual convention, features a debate of the following question: “Should Chevron Be Overturned?” The 1984 Supreme Court decision Chevron v. Natural Resources Defense Council established a judicial doctrine of deference to certain administrative agency actions commonly known as “Chevron deference.” As wonky as it may sound, Chevron is implicated in important constitutional debates surrounding the modern administrative state and separation of powers. Columbia Law School professors Philip Hamburger and Gillian Metzger explain just what Chevron deference is, why it matters, and whether or not it should be overturned. Lana Ulrich guest hosts.

Those who practice federal law, whether in the government or in private practice, often have special concerns your average probate or traffic court lawyer might not have. That is there the Federal Bar Association comes in. W. West Allen, chairman of the FBA's government relations committee, joined Federal Drive with Tom Temin with some of this year's top issues.
When President Donald Trump took office last year, there were over 100 federal court vacancies, roughly twice as many as when President Barack Obama faced the same situation in 2009. Since then, President Trump has been nominating judges and having nominees confirmed at “record speed,” leading many senators from both sides of the aisle—from Senator Ted Cruz to Senator Chris Coons—to assert that the most long-lasting and significant legacy to the Trump administration “will be the men and women appointed and confirmed to the federal bench.” This topic and others were part of the Federal Bar Association’s annual mid-year meeting in Washington, D.C. John Malcolm is Vice President of the Institute for Constitutional Government and Director of the Meese Center for Legal & Judicial Studies and Senior Legal Fellow at the Heritage Foundation, where he oversees the Heritage Foundation’s work to increase understanding of the Constitution and the rule of law. Elizabeth Wydra is President of the Constitutional Accountability Center. From 2008-2016, she served as the CAC’s Chief Counsel, representing the Center as well as constitutional scholars and historians, state and local government organizations, and groups such as the League of Women Voters and the AARP. Jeffrey Rosen is the President and Chief Executive Officer of the National Constitution Center, the only institution in America chartered by Congress “to disseminate information about the United States Constitution on a nonpartisan basis.” He is also a professor at The George Washington University Law School, and a contributing editor for The Atlantic.
