  To understand the long and twisted journey to the Supreme Court's chilling decision to dismantle affirmative action in higher education and its implications, you cannot do better than to ask civil rights champion and self-described optimist John Yang. As president and executive director of Asian Americans Advancing Justice, John has navigated the drumbeat to defeat affirmative action for years and a devastating rise in anti-Asian hate crimes since the emergence of Covid-19. AAJC employs a range of strategies, from education to litigation and policy advocacy to advance the rights of Asian Americans and all communities of color. John points out that the case brought before SCOTUS by white nationalist Ed Blum relies on the model minority myth, a persistent trope, and a convenient strategy for pitting Asian Americans against other people of color. In fact, the data reveals a high level of support by Asian Americans for affirmative action. John is also buoyed by the emergence of new youth-led Asian American nonprofits and the cohort of civil rights partners, including the ACLU, NAACP Legal Defense Fund, National Urban League, Lawyers Committee and MALDEF that are moving this nation towards justice.

How the 2013 Shelby County v. Holder, a U.S. Supreme Court decision gutting a key provision of the Voting Rights Act.  What was this decision about, and how has it contributed to the erosion of our democracy? Decades of systemic racist voter suppression and violence spurred passage of the 1965 Voting Rights Act, outlawing discrimination in voting on the basis of race and enforcing the 15th Amendment.Section 5 of the VRA created “pre-clearance” requirements for states, counties or municipalities with a history of voter discrimination. It required them to clear any new election rules with the U.S. Justice Department.  But in 2012, Shelby County, Alabama argued to the U.S. Supreme Court that Section 5 was unconstitutional.  Instead, the court ruled that the formula used to apply pre-clearance was outdated, and asked Congress for an update.  Congress hasn't acted, so Section 5 has been unenforceable since 2013.The decision greenlighted a resurgence of voter suppression bills in conservative-leaning states with large Black or Hispanic populations.  Among the shady tactics employed are reductions in polling places, removal of drop boxes, shortening of early voting, attempting to stop voter registration drives, narrowing voter ID options, and even preventing the handing out food and water to voters forced to wait in long lines.   All making it harder for our fellow Americans to vote. We have details on the Shelby v. Parson signs sweeping new law requiring voters to show photo ID at pollsSt. Louis Public Radio - Huge bill adds extra steps for voters and those who run Missouri electionsText of Missouri's now signed HB 1878Groups Taking ActionMissouri Voter Protection Coalition, League of Women Voters Missouri, MALDEF,  Missouri Protection & Advocacy ServicesYou're listening to the American Democracy Minute, keeping YOUR government by and for the people.Earlier this week we mentioned that the Missouri legislature had passed an omnibus–and ominous– voting and election bill, and that pro-voter groups and election officials were not happy with the additional barriers to voting and burdens to election workers.  That bill was signed Wednesday by Republican Governor Mike Parson.Sponsors of the bill hailed the provision to implement a voter ID requirement, common among many states, but they limited the allowable ID to only state or federal IDs, not other commonly-accepted options such as student IDs and other institutional documents.  The State of Missouri charges for non-driver IDs, a barrier for low-income voters.Changes to current law will allow no-excuse absentee ballot voting for a two week period prior to the election, but only in person, not by mail.  Disabled and elderly voters would be forced to come into election offices to vote during this period.St. Louis Public Radio reports that the bill also bans third-party assistance with voter registration, restricting groups like the League of Women Voters and other pro-voter groups from helping voters register. Title 42, a decades old and rarely used public health order used to bar people with medical conditions from entering the country, revived by the Trump administration, enables immigration authorities to swiftly expel migrants to Mexico or their home countries. The enforcement of the policy, which also bars individuals from seeking asylum, continues to be met with skepticism by immigration advocates and public health officials. The Biden administration and the US Centers for Disease Control and Prevention (CDC) recently announced plans to end Title 42 by May 23rd, now that vaccines are widely available. But the fate of the policy remains in limbo because of Republican-backed lawsuits and opposition to its cessation. Thomas Saenz is president and General Counsel for the Mexican American Legal Defense Fund (MALDEF). Saenz joins WITHpod to discuss the role of misinformation in the characterization of migrants, immigration and refugee policy reform and the implications of a potential continuation (or end) of Title 42.

The origin story of MALDEF-Mexican American Legal Defense and Educational Fund-is rooted in the vision of the late Pete Tijerina. In 1967, he represented a Latina who was seriously harmed by corporate neglect and then again by a judge's refusal, as constitutionally required, to seat Latinos on the jury. Discrimination against Latinos, fueled by misinformation, was escalating and the need for a dedicated civil rights infrastructure was clear. In 1968, Mr. Tijerina, fellow advocates and the general counsel of the NAACP, the model for civil rights activism, collaborated to form MALDEF. It's mission, to promote the civil rights of all Latinos in the US in education, employment, immigration and voting rights could not be more relevant now. It was a rare honor to speak with MALDEF president Thomas Saenz, an expert in civil rights law and a champion for systemic reform to our immigration system. He believes that democracy will be realized when Latinos are seen in the full scope of their humanity and service to this nation, from the highest levels of public service to the frontlines of the pandemic.

Nina Perales, vice president of litigation for the Mexican American Legal Defense and Educational Fund, recently spoke about the implications of the 2020 Census on redistricting for South Texas and the border region.Perales, who has litigated on behalf of Latino communities in two previous redistricting cycles, spoke at a board meeting of the Lower Rio Grande Valley Development Council.Perales said the loss of population in rural parts of Texas and the growth in its urban and suburban parts, as shown by Census 2020, was incredible.Perales said: “We have a new and very different picture of Texas than we had before, even a decade before. The population changes are quite stunning, in fact. There is widespread and consistent loss of population in rural areas in Texas and at the same time really extraordinary population gain in Texas in large cities and suburbs. When does the definition of a “person” become contentious? The mandate to “count all persons” includes undocumented immigrants. But some are trying to exclude them as people in the current census. It starts with a constitutionally mandated decennial census count that says the census must count “all persons” living in the U.S. and that count leads to how 435 seats in the US House of Representatives apportioned among our 50 states. But in 2020 this is the first time that a president has intervened in this process by attempting to subtract, rather than count, all persons. Thomas Saenz, President and General Counsel of MALDEF-the Mexican American Legal Defense and Educational Fund- walks us through President Trump’s unprecedented executive memo and issues a collective call to action.

This week, New Mexico in Focus interviews Thomas Saenz, the national president of the Mexican American Legal Defense and Educational Fund (MALDEF). Saenz has been a key figure in the Martínez/Yazzie v. State of New Mexico lawsuit, the case that is forcing the state to improve the education it provides for certain groups of students. Recently, both groups of plaintiffs asked the court to set more strict deadlines for the state to prove it’s making progress. Correspondent Russell Contreras speaks with Saenz about what’s ahead in the case. New Mexico in Focus takes a hard look at crime’s effect on young people with Albuquerque filmmaker John Acosta, whose documentary “Growing Up in the Real Breaking Bad” aims to raise awareness about youth violence. NMiF host Gene Grant interviews Acosta, who is joined by a group of young activists who say policymakers need to listen and try a different approach to addressing the problem. In a repeat showing of Our Land from August, correspondent Laura Paskus travels to the Gila National Forest for an in-depth report on the battle over the Gila River. In the intervening months there have been new updates on the project, and NMiF host Gene Grant sits down with Paskus to discuss these developments.

This episode is a raw, intense, and beautiful story of Anavictoria Avila. She speaks her truth and shares with us why she studied to become an attorney and improve the juvenile justice system. She is a passionate youth advocate. Anavictoria was born into a family plagued by domestic violence and went through a custody dispute that lasted 8 years. At an early age she witnessed that justice does not have the upper hand in the legal system and class, gender, and race truly affect the dynamics and progression of a case. She focuses on becoming an attorney and advocating for marginalized communities and specifically youth who are in the juvenile and foster care systems. Anavictoria also informs us that in college she was screened and diagnosed with learning disabilities. She tells us her journey and how she got through it during law school. She explores her passion with art and we discuss how it has allowed her to heal and provide comfort during her most difficult times. Despite all the barriers Anavictoria had to face she overcame them and accomplished her life-long goal of graduating from law school. A lot has changed in Anavictoria’s life since the recording of the interview. The Education Advocacy Clinic hired Anavictoria to be a Clinical Supervisor and Instructor at the East Bay Community Law Center, which is a Clinic of Berkeley Law School (Boalt). In this position, she teaches law students as she represents young people caught at the intersection of the juvenile justice and education systems. After graduating from law school, he returned to San Antonio permanently as a MALDEF staff attorney. He was elected to the San Antonio City Council representing District 1 in 2011. Representative Bernal was elected to the Texas House of Representatives in February 2015. He represents District 123, home to downtown and north central San Antonio, parts of the city's west side, along with the City of Castle Hills. He currently serves as the Vice Chairman of the House Committee on Public Education and also sits on the House Committee on Urban Affairs, and the House Committee on House Administration. Terry Ao Minnis and Angela Manso joined me for a conversation about Census 2020 at Power Station. As you will hear, the stakes for the Census could not be higher. The Census determines the apportionment of seats in the House of Representatives and the allocation of federal dollars to states. So it is particularly important that their powerhouse nonprofit organizations, Asian Americans Advancing Justice, and NALEO Education Fund, are engaging on this issue with other high-level stakeholders, including MALDEF, through a coalition led by the Leadership Conference of Human and Civil Rights. We talk about the implications for adding a question (untested) to the Census regarding citizenship, related lawsuits in Federal courts and the galvanizing of advocacy in local communities.
