Kate Wolf speaks to filmmaker Raoul Peck about his latest documentary, Ernest Cole: Lost and Found, out in theaters now. The film excavates the life and work of Ernest Cole, the South African photographer, using his own writing and a recently rediscovered archive of his photographs. Cole was one of the first people to capture the brutal realities of the apartheid regime on film. After escaping South Africa for the United States, he published his landmark book on apartheid, House of Bondage (1967). Years later, his career languished, and he became homeless and died of cancer in 1990. Peck's film looks closely at the conditions that thwarted Cole's promise as an artist, the legacies of racial segregation, and the devastating ways they still play out today. Also, Renee Gladman, author of My Lesbian Novel and To After That (TOAF), returns to recommend The Long Form by Kate Brigg. Not a lot of lawyers can say that they helped create a whole new legal field, but William Shernoff can. On this week's episode, Ralph welcomes trailblazing attorney William Shernoff to discuss predatory insurance practices, and how consumers can protect themselves. This special episode was co-presented by The American Museum of Tort Law, and was recorded in front of a live virtual audience.William Shernoff is the founding partner of Shernoff Bidart Echeverria, a law firm specializing in insurance bad faith litigation. A longtime consumer advocate, he has made a career of representing insurance consumers in their cases against insurance companies. Often called the “father” of bad faith insurance law, in 1979, Mr. Shernoff persuaded the California Supreme Court to establish new case law that permits plaintiffs to sue insurance companies for bad faith seeking both compensatory and punitive damages when they unreasonably handle a policyholder's claim (Egan v. Mutual of Omaha).A frequent lecturer and writer, Mr. Shernoff co-authored the legal textbook, Insurance Bad Faith Litigation, which has become the field's definitive treatise, as well as How to Make Insurance Companies Pay Your Claims . . . . And What To Do If They Don't, Fight Back and Win – And How To Make Your HMO Pay Up, and Payment Refused. Under bad faith law in California and in most states, you not only could get the benefits you deserve under the insurance policy—whether it be life insurance or disability insurance or health insurance. But you can also get damages over and above the policy limits, which are emotional distress damages…Not only can you get the emotional distress damages, but any aggravation of your medical condition. And then punitive damages are on top of that. And attorney's fees are on top of that. So all of these damages are coming from insurance bad faith if the insurance bad faith law applies. And punitive damages are designed to punish the insurance company so that they correct their wrongful conduct in the future, and deter them from unfair claims practices. William ShernoffMost people, if they get a letter from an insurance company—which they consider to be an authoritative source— and the insurance company says, “Your claim is denied because…” and then they cite all kinds of fine print in the insurance policy, most people accept that and don't do anything. They don't see a lawyer. They just accept what their insurance company told them because it sounded quite official to them.William ShernoffInsurance regulation is state-controlled. The federal government has been blocked for decades and the Congress has imposed itself on the federal Federal Trade Commission and said that they can't even investigate the insurance companies without being allowed to by a committee in the House or the Senate that has jurisdiction over such matters. So the privileges of the insurance lobby are quite extraordinary even by comparison with other corporate lobbies.Ralph Nader More people should know about bad-faith cases rights—and use them. Learn about your rights.Ralph Nader In Case You Haven't Heard with Francesco DeSantisNews 3/27/241. CNN reports the United Nations Security Council has passed a Gaza ceasefire resolution. The resolution itself is imperfect, calling only for a ceasefire during the month of Ramadan, but this watered down language paved the way for the United States to allow the resolution to pass. The U.S. has vetoed every previous ceasefire resolution before the Security Council and disputes the extent to which this resolution is legally binding. For its part, Israel's Foreign Minister stated unequivocally that Israel “will not cease fire,” per CNN.2. Following the passage of the Security Council resolution, Prime Minister Netanyahu canceled a planned high-level Israeli delegation visit to Washington, per CNBC. The planned visit, which would have included an address to Congress, was staring down scathing criticism from Congressional Progressives. Axios reports Representative Rashida Tlaib, the only Palestinian member of Congress and the most outspoken on the Israeli campaign of terror, said “[Netanyahu] shouldn't come to Congress, he should be sent to the Hague.”3. In another sign of the rift between the Biden Administration and Netanyahu, Haaretz reports that Congressional Democrats are sending formal warnings to the administration stating that Israel is not in compliance with U.S. laws governing the dispensation of military aid. Joaquin Castro, a Democrat from Texas, said “Congress and [the] White House need to make clear to Israel that we will enforce US law to protect Palestinian children from starvation in Gaza.”4. Professor Jana Silverman, co-chair of the Democratic Socialists of America International Committee, reports “After a totally last-minute, ad-hoc, no-budget campaign, 13.2% of voters in the Democrats Abroad primary said no to genocide in Gaza and voted Uncommitted!” This impressive performance signals that the Uncommitted electoral protest movement isn't going anywhere. The next major test for the movement will be Pennsylvania, where Uncommitted PA is aiming for at least 40,000 votes in the state's April primary, per Lancaster Online.5. In an open letter, over 100 prominent American Jews condemned AIPAC. The letter reads “We are Jewish Americans who have…come together to highlight and oppose the unprecedented and damaging role of AIPAC…in U.S. elections, especially within Democratic Party primaries. We recognize the purpose of AIPAC's interventions in electoral politics is to defeat any critics of Israeli Government policy and to support candidates who vow unwavering loyalty to Israel, thereby ensuring the United States' continuing support for all that Israel does, regardless of its violence and illegality.” Signatories include the Ralph Nader Radio Hour's own Alan Minsky, celebrated academic Judith Butler, Postal Workers Union president Mark Dimondstein, Ben Cohen of Ben & Jerry's, and the actor Wallace Shawn among many others. The full letter is available at USJewsOpposingAipac.org.6. Oscar winning director Jonathan Glazer continues to be the target of phony outrage by pro-Israel groups like the Anti-Defamation League. Coming to the defense of the filmmaker however are other prominent Jewish organizations, like Jewish Voice for Peace and the Auschwitz Memorial, whose director said “In his Oscar acceptance speech, Jonathan Glazer issued a universal moral warning against dehumanization,” per the Guardian. Decorated Jewish playwright Tony Kushner, a signatory on the anti-AIPAC letter, told Haaretz “There's been a concerted attempt by right wing American Jews to sort of sell the idea that American college campuses are awash with virulent antisemites – professors and students and so on. And the Jewish students are walking these campuses in terror for their lives. I think this is nonsense. I see no evidence of it.”7. Both the Gannett and McClatchy newspaper companies have announced they will no longer use AP journalism in their publications, AP reports. This is yet another indication of the dire financial straits the news business finds itself in. The AP notes “Gannett's workforce shrank 47% between 2020 and 2023 because of layoffs and attrition…The company also hasn't earned a full-year profit since 2018… Since then, it has lost $1.03 billion.”8. In Honduras, the Intercept reports “an almost-impossible-to-believe scenario: A group of libertarian investors teamed up with a former Honduran government — which was tied at the hip with narco-traffickers and came to power after a U.S.-backed military coup — in order to implement the world's most radical libertarian policy, which turned over significant portions of the country to those investors through so-called special economic zones. The Honduran public, in a backlash, ousted the narco-backed regime, and the new government repealed the libertarian legislation. The crypto investors are now using the World Bank to force Honduras to honor the narco-government's policies.” While this story has certain unique angles – crypto and narco-trafficking chief among them – the key element is actually quite familiar: international ‘free trade' regimes superseding sovereign governments. We offer Honduras solidarity against these contemporary crypto-filibusters.9. On March 11th, Congressmen Jimmy Gomez and Joaquin Castro sent a letter to the heads of the CIA and FBI demanding disclosures of surveillance efforts on Latino civil rights leaders during the 1960s and ‘70s, citing the well-documented pattern of surveillance on Black civil rights leaders during that period and the wealth of circumstantial evidence indicating that these organs of national security did the same toward prominent Latino figures such as Cesar Chavez. The following day, in a hearing before the House Permanent Select Committee on Intelligence, Rep. Castro pressed CIA Director Bill Burns on the matter, and Burns committed to working with his office to bring these activities to light. We hope that further transparency will beget further transparency and that some day the complete account of the CIA and FBI's domestic surveillance programs will be a matter of public record.10. Finally, in Mississippi, CBS reports that authorities have successfully convicted all six members of a police gang calling themselves the “Goon Squad.” These six white officers plead guilty to “breaking into a home without a warrant and torturing two Black men…The assault involved beatings, the repeated use of stun guns and assaults with a sex toy before one of the victims was shot in the mouth in a mock execution.” Lawyers representing the criminal cops allege that “their clients became ensnared in a culture of corruption that was not only permitted, but encouraged by leaders within the sheriff's office.” If true, then a federal investigation – and likely more than a few exonerations of individuals victimized by this “Goon Squad” – are in order. A statement in the leader reads, "Given that Israel is so isolated internationally that it could not continue its inhumane treatment of the Palestinians without U.S. political and military support, AIPAC is an essential link in the chain that holds in place the unbearable tragedy of Israel/Palestine. In coming U.S. elections, we need to break that chain in order to help free the people of Israel/Palestine to pursue peaceful coexistence." This open letter comes at a crucial time given Israel's war in Gaza and mounting concerns over the humanitarian crisis faced by Palestinians at this very moment. Prominent signees include actors Elliot Gould and Wallace Shawn, journalist Martin A. Lee, playwright Tony Kushner, and previous Parallax Views guests such as Ariel Gold, Dave Zirin, Mitchell Plitnick, and Samuel Moyn. Given AIPAC activities against progessive candidates in the Democratic Party, this letter should catch the eye of progressive voters and activists. AIPAC is now vowing to spend even more millions in the 2024 Democratic primaries, targeting specific Democrats in Congress – initially all legislators of color – who've advocated for a Gaza ceasefire, a position supported by the vast majority of Democratic voters. AIPAC's election spending increasingly works to defeat candidates who criticize the racist policies of Israel. In contrast to AIPAC, we are American Jews who believe that U.S. support for foreign governments should only be extended to those that respect the full human and civil rights, and right to self-determination, of all people. We oppose all forms of racism and bigotry, including antisemitism – and we support the historic alliance in our country of Jewish Americans with African Americans and other people of color in the cause of civil rights and equal justice. Therefore, we strongly oppose AIPAC's attempts to dominate Democratic primary elections. We call on Democratic candidates to not accept AIPAC network funding, and demand that the Democratic leadership not allow Republican funders to use that network to deform Democratic primary elections. We will support candidates who are opposed by AIPAC, and who are advocates for peace and a new, just U.S. policy toward Israel/Palestine.

Alan Minsky, Executive Director of Progressive Democrats of America, spoke with Israeli historian and Genocide Studies scholar Omer Bartov at a public forum this week about the Israel/Gaza crisis. Bartov published two widely read pieces in November: "What I Believe as a Historian of Genocide," New York Times, November 10, and "A political stalemate led to the bloodshed in the Middle East. Only a political settlement can truly end it," published in the Guardian November 29. Their conversation focuses on the necessity of relaunching serious negotiations between Israelis and Palestinians to achieve a just, long-term, political solution to the 75-year conflict in Israel/Palestine, a demand they insist activists and the left in general should foreground immediately. On this week's episode of Lever Time, Julia Rock and Frank Cappello speak with environmental lawyer Julia Olson to discuss a recent historic win for young climate activists who she represents in Montana. This past Monday, a judge in Montana ruled that young people are entitled to a “clean and healthful” environment. The case, known as Held v. Montana, included 16 plaintiffs ages 5 to 22, who testified that the state government's pro-fossil fuel policies were unconstitutional. Held v. Montana was the first of several youth-led U.S. climate lawsuits to make it to trial. Olson is the executive director and lead counsel for Our Children's Trust, a nonprofit public interest law firm that represents plaintiffs in a number of these youth-led state climate cases as well as in a federal lawsuit, Juliana v. United States. Julia and Frank spoke with Julia Olson about this historic win, how the case's legal strategy can be applied across the country, and why the Biden administration is attempting to prevent other youth-led climate lawsuits from going to trial. Jacobin Radio pays tribute to the late Daniel Ellsberg, who was diagnosed with pancreatic cancer earlier this year and passed away on June 16 at age 92 . A committed, consequential activist with a moral compass that never left him, Ellsberg was always generous with his time. Shortly after he publicly announced his terminal illness, he took part in a Progressive Democrats of America Town Hall on April 9th, 2023, joined by Jacobin Radio producer Alan Minsky and Vietnam War historian Christian Appy. Ellsberg gives his thoughts on the current geopolitical situation, the continuing dire threat to humanity posed by heightened militarism and nuclear confrontation, and the need to keep fighting for progressive foreign policy. Looking back on his life, Ellsberg said, “When I copied the Pentagon Papers in 1969, I had every reason to think I would be spending the rest of my life behind bars. Just in the last decade alone, solar panels have dropped to a third of what they used to cost to manufacture. Battery storage has improved dramatically in terms of energy density, cost, and reliability. And so, a lot of places around the country are looking to these as solutions. CNBC reports that the FTC is mulling a proposal to bar Meta (formerly Facebook) from monetizing the data of minors. This follows the agency's allegation that the company violated a 2020 privacy order. The FTC quoted an independent assessor who found “several gaps and weaknesses in Facebook's privacy program” that posed “substantial risks to the public.” Hopefully, this action will put other tech companies on notice regarding monetization of children's data.2. Dr. Steve Feldman, a Jewish dermatologist, is being penalized by the state of Arkansas for his refusal to sign a loyalty pledge to the state of Israel, the Arkansas Times reports. After giving a lecture to medical students in Little Rock, he was prompted to check a box agreeing not to boycott Israel, which he refused to do. As a result, the state is withholding his payment for the lecture. The Arkansas Times also refused to sign the pledge. Feldman said “What's nuts is they're asking a newspaper to say they won't boycott Israel, they're asking Americans who have a conscience, who know Israel is keeping Palestinians from their homes.” The ultra-conservative Supreme Court declined to hear the newspaper's legal challenge to the state law, and therefore it is still in place.3. In Rochester, New York, Coca-Cola is building a new facility. The company predicts this development will yield 250 new jobs. However, the Rochester Beacon has broken down the corporate welfare the conglomerate stands to receive in exchange: $41 million in state and local subsidies, or about $164,000 for each job created.4. A stunning expose in the Guardian shines a light on the beef industry, and specifically, their “messaging machine.” “The beef industry has developed a ‘Digital Command Center” that tracks media outlets and social media for more than 200 beef-related topics” Based in Denver, Colorado, the project which “looks like a military operation” is staffed 24/7 with personnel redundancies to “make sure someone's always watching.”5. In another law enforcement bombshell, longtime LAPD SWAT officer, Sgt. Timothy Colomey, has blown the whistle on the reality of the elite unit. According to Sgt. Colomey, LAPD SWAT is controlled by a violent inner circle known as the “SWAT Mafia” which has perpetuated itself using “excessive force...insubordination, sabotage and cover-ups.” Colomey has put his allegations into a detailed new deposition, available at the LA Times.6. The Department of Education Office for Civil Rights has officially opened an investigation into charges that the George Washington University discriminated against Palestinian students, according to the GW Hatchet. Palestine Legal, which filed the complaint on behalf of three GW students, responded to the news by writing “This is an important step that shows the Office of Civil Rights is taking anti-Palestinian discrimination seriously.” Radhika Sainath, a senior staff attorney at Palestine Legal added “Even if pro-Israel groups don't like it and complain, the law is clear – Palestinian students are entitled to the same educational opportunities and services as other students.”7. In other Palestine news Rep. Rashida Tlaib held an event commemorating the Nakba – literally the catastrophe – of May 15th, 1948 when 700,000 Palestinians were expelled or fled from their homeland. This event was originally slated to be held at the Capitol Visitors Center, but Speaker McCarthy blocked the ceremony, per CNN. Tlaib responded with a statement, saying, “Speaker McCarthy wants to rewrite history and erase the existence and truth of the Palestinian people, but he has failed to do so.” Finally, Bernie Sanders stepped in and facilitated the event in the Senate HELP Committee hearing room.8. AL.com reports that the Democratic Party of Alabama has abolished the DNC-mandated minority caucuses for youth, LGBTQ, and disabled Democrats. Until now, “those caucuses had the power to nominate at-large members to ensure representation proportionate to Alabama Democratic voters.” State party boss Joe Reed had long opposed theses caucuses, which dilute the influence of the state's Black caucus on the executive committee. Former Senator Doug Jones, the only Democratic Senator in Alabama since 1997, is quoted saying “What the leadership of the Alabama Democratic Party did — was to essentially say that we don't represent the Democratic electorate in Alabama anymore.”9. Kimberly Gardner, St. Louis's elected prosecutor, is being forced to resign from her position under threat from the Missouri state government, per the Missouri Independent. Gardner, a reformist prosecutor, has drawn ire from conservatives and the police union in St. Louis since her tenure began; this came to a head when the Republican legislature threatened a state takeover of her office. In her resignation letter, Gardner wrote “I can neither enable nor allow the outright disenfranchisement of the people of the City of St. Louis.”10. The International Committee of the Democratic Socialists of America announced on Twitter that the Washington DC Council has passed a unanimous resolution urging President Biden to “dismantle the US blockade” and remove Cuba from the State Sponsor of Terrorism list. Howard Rodman, former president of the Writers Guild of America West (WGA), joins Alan Minsky to discuss the Writers Guild strike, which began a minute after midnight on May 2, after a near unanimous strike vote on May 1. This strike action, the first in fifteen years, impacts TV, movies, and streaming platforms across the country and the world. The last strike, in 2007-08, lasted 100 days and focused on "new media" when streaming was in its infancy and Netflix was still a DVD-by-mail company. This time, the key points are: residuals, preserving the writers room (ending the practice of so-called mini-rooms), viewership transparency (writers want ratings data and not algorithms), and protections regarding AI. As Rodman says, the strike is about a whole constellation of issues which, taken together, create an existential threat to the ability of writers to earn a decent living. There is a lot of public support for the writers, but the distance between the writers and the studios is very far apart. The writers are saying don't use these new technologies to pay us less for more work. Things do not look good for Joe Biden and the Democratic Party right now. Polls show that nearly 3/4 of Americans, including a staggering 94% of people under 30, do not want Biden to run for reelection. Biden's prospects look slightly better when people are asked if they prefer him or Donald Trump, and for Biden that's apparently enough. The New York Times says the president has a favorite aphorism: "Don't compare me to the Almighty, compare me to the alternative." (This is the worst aphorism ever.) "The alternative to us is Christian Fascism" might be a platform that allows some Democrats to squeak back into office. After all, the existing alternative is Christian Fascism. But what kind of agenda could actually produce lasting majorities and enthusiastic public support? What would a real alternative to the GOP, one that put forward a positive and transformative set of ideas, look like? To answer this question, we are today joined by Alan Minsky, Executive Director of Progressive Democrats of America (PDA), and Professor Harvey J. Kaye, author of The Fight for the Four Freedoms and Thomas Paine and the Promise of America. In a recent series of articles for Common Dreams, Kaye and Minsky have laid out the case for a 21st-century Economic Bill of Rights. They argue that if Democrats want to win, they should formally embrace the principles of the Economic Bill of Rights, which would make it clear to Americans exactly what people would be voting for when they are asked to vote. Sam and Emma host Harvey Kaye, professor emeritus of democracy at the University of Wisconsin, Green Bay, and Alan Minsky, executive director of the Progressive Democrats of America, to discuss their recent mission statement published in Common Dreams, the 21st Century Economic Bill of Rights. However, Emma and Sam first dive into yesterday's mass shooting at an elementary school in Texas, walking through the mass boom in gun sales over the past two years, the common link between mass shooters and violence against women, and the ahistorical neoliberal view that gun control is a revolutionary concept in the US. Then, they're joined by Professor Harvey Kaye and executive director Alan Minsky as they dive into the history of economic bills of rights, first proposed in the US by FDR as a centerpiece to his 1944 State of the Union, built on his economic declaration of rights and his concept of the four freedoms (speech, worship, freedom from want, freedom from fear), and looking to support the rights people wanted to see enumerated after World War II, seeing healthcare and jobs, particularly, as central to defeating the constraints of need. These concepts were then picked up by the democratic party under Truman, and even framed as the party platform in 1960 ahead of JFK's candidacy. Next, Kaye and Minsky walk through the 10 rights present in the 21st Century Declaration, including universal healthcare, the right to education and the internet, affordable and accessible housing, a clean environment, support at birth and in retirement, a fair justice system, sound financial services, and a right to recreation and participation in democratic life, all of which, as they walk through, are tied to current legislation supported by Bernie Sanders, the squad, and other progressives. Next, they dive into the rhetorical element of this fight, perhaps the one in which we have the longest to go, first looking at the relationship between liberty and governing powers, before diving into what a productive future for a progressive left in the US would look like, both in terms of changing the conversation and building on the CPC's existing role in the Democratic Party. And in the Fun Half: Emma and Sam talk with John from San Antonio as he dives into the more hopeful elements of the state of our politics, from unionization to Jessica Cisneros' continued hope, before they address Nancy Pelosi's robocall in support of an anti-choice anti-gun-control candidate, the massive Georgia turnout, and how we could see a positive drive for Democratic turnout in the midterms. Historian and author Harvey Kaye and Executive Director of Progressive Democrats of America Alan Minsky weigh in on how Democrats prioritize struggles for economic justice — and what those priorities should look like.
Suzi talks to Alan Minsky and Harvey Kaye about the 21st Century Economic Bill of Rights, which they see as both a campaign platform and governing program to rescue and renew American democracy. This is more than a to-do or must-do list for progressives, but in their words, a compelling and transformative unifying project, a manifesto to advance democracy. We ask whether they think this program is feasible and realizable given the configuration of our political winner take all system?We then turn to the recent election in France, where incumbent Emmanuel Macron won with a 17% margin over Marine Le Pen. The period leading up to this election was far more uncertain. The contest had been narrowed from 12 parties in the first round, held April 10th, to the top two vote-getters, the centrist neoliberal Macron, and the far rightist Le Pen. Le Pen edged out the leftist Jean-Luc Mélenchon by a very narrow margin. The day before the election, we spoke with Sebastian Budgen, author of a recent article in the New Left Review blog, about the big question leading up to the election: Where would Mélenchon's votes go in the second round? Though a decisive number seemed to have held their noses to vote for Macron, 26% of the electorate stayed home—in effect abstaining. An insignificant 2% of voters either nullified or turned in a blank ballot. Budgen gives an analysis of the state of the French electorate that holds lessons and warnings for the future.
