The U.S. Senate approved the nomination of Danté Quintin Allen to lead the U.S. Department of Education's Rehabilitative Services Administration (RSA). Until his confirmation, Allen had been serving as executive director for CalABLE, California's ABLE Act savings and investment program for people with disabilities. Under his five-year leadership, CalABLE was the fastest growing ABLE Act program in the country. Prior to leading CalABLE, Allen was a communications leader for organizations including Kaiser Permanente and the California Department of Public Health's Office of Health Equity. A fulltime wheelchair user, Allen is a well-known advocate for disability rights and equity. The two of them worked alongside advocates from across the country for over eight years to pass the Achieving a Better Life Experience (ABLE) Act allowing individuals with disabilities to save money in 529 type accounts without jeopardizing benefits. Because of her work on passing the ABLE Act nationally and in Kansas, Rachel became the first person to open a Kansas ABLE Savings Account.   Rachel Mast, who has Down syndrome, is 22 years old and a graduate of Olathe South High School and works as a hostess at the Olive Garden and wants to someday live in a pink house.  Jawanda Mast is a national grassroots advocacy speaker and consultant. Jawanda is married to Jonathan Mast. Along with Rachel they make their home in Olathe, Kansas.  Jawanda says their work is a #laborofloveandconviction.

She has served in many roles supporting people with disabilities and their families through advocacy, education, and connecting them to vital resources within their community.    She can be reached at knelson@marylandable.org. ABLE to Save Month   August marks the nationally celebrated ABLE to Save Month. ABLE programs nationwide have changed the way people with disabilities and their families participate in the community, build financial wellness and plan for the future by empowering them to save and invest for the added expenses that come with having a disability without losing access to federal means-tested benefits. Learn more about how a Maryland ABLE can benefit you.    What does the ABLE  (Achieving a Better Life Experience) Act do?   It gives states the opportunity to develop tax-advantaged savings programs for eligible people with disabilities. These saving programs provide the opportunity for people with disabilities to maintain eligibility for federal and state benefits while saving money to cover qualified disability expenses. For SSI purposes, the first $100,000 saved in ABLE account is disregarded for the purposes of the $2,000 asset limit.       Contributions to ABLE programs are capped by the federal ABLE Act to the federal gift tax exclusion, currently $15,000 per year.    Contributions are accepted by the Maryland ABLE program up to a maximum account value of $500,000, as of December 1, 2018.   ABLE to Work Act - The ABLE to Work Act allows beneficiaries who are employed to contribute an amount equal to their current years gross income (up to a maximum of $12,760 in 2021) each year to their ABLE accounts in addition to the annual standard contribution limit of $15,000.   Keep in mind that, if the beneficiary or their employer is contributing to a retirement plan, including a defined contribution plan (e.g. 401(k)), annuity plan (403(b)), or deferred compensation plan (457(b)) this calendar year, the beneficiary is not eligible to make ABLE to Work contributions.   Information about Maryland's ABLE account program   https://www.marylandable.org/    Maryland ABLE Visa® Prepaid Card   Maryland ABLE account holders can access the funds in their ABLE account to pay for qualified disability expenses that support the beneficiary in his or her health, independence and quality of life.  Account holders can access their funds through easy online account management or they can request the Maryland ABLE Visa® Prepaid Card for a low monthly fee. The prepaid card provides a convenient way to access funds for purchases made online or in the community. It also provides additional features such as setting up card alerts and customized spending for added protection and the ability to sort, filter, and tag ABLE purchases to easily record and track expenses.   Maryland ABLE Resource Network   https://www.ablenrc.org/state-review/maryland/   S.331 - ABLE Age Adjustment Act   https://www.congress.gov/bill/117th-congress/senate-bill/331?s=10&r=6   This bill increases from 26 to 46 the age threshold for tax-favored ABLE (Achieving a Better Life Experience) accounts.    Currently, individuals are eligible to save with ABLE accounts only if their qualifying disability was onset before age 26. At Fleming & Curti, PLC, we think 529 Plan accounts are a great way to help educate your children and (especially) grandchildren. Coordinating 529 Plan accounts in your estate planning is challenging, and important. There is certainly a big industry of financial planners pushing for you to consider such plans, and we generally approve. But most of the writing about education accounts focuses on selecting among the various options. Less attention focuses on ownership, succession and tax treatment of the plans. Who should own the 529 Plan account you set up for a child or grandchild? Generally, the person who sets it up will be the owner. The Plan may allow a successor owner who can take over on your death. Note, though, that if a parent owns the 529 Plan account, it may interfere with eligibility for some scholarships or student loans. Coordinating 529 Plan accounts with your estate planning means, among other things, setting up a succession of ownership. It may also mean allowing the owner to change beneficiaries if, for instance, one child decides not to attend college. It can also be important to consider how the tax-free growth in a 529 Plan account might disproportionately benefit some heirs. This episode of the Accessibility Is Home podcast, continues the celebration of the 30th Anniversary of the ADA (July 2020) by looking at other laws that have been passed after the original passing of the historical law.  The ABLE Act is discussed in greater detail and how it can assist in saving for a home.  The Supreme Court case that was passed five years after the ADA in 1990, Olmstead, is discussed as the first step of deinstitutionalizing people with disabilities and put focus that housing and community services must be provided. Without the supreme court case, accessible housing may not have ever existed. Finally, a discussion about the need to pass the Disability Integration Act as the next law that could bridge the gap by forcing insurance companies to pay fo long-term care in the home, and not a medical facility, and the need for states to increase affordable and accessible housing.    Want more? But it doesn't have to be, thanks to Catherine Beck and the MANY parents who advocated for The ABLE Act for over 10 years before it was finally passed into Congress. The ABLE Act ensures that people with disabilities can save money in a tax advantage account for necessary supports such as transportation, education, therapy, assistive technology, and more. Did you know that prior to the act's passing, individuals with disabilities couldn't save more than $2,000 in their name without losing their other benefits? We're so grateful for the many people that made this act happen, and especially Catherine Beck. What are UTMA, 529 and ABLE? And which is better for your situation? The difference can be confusing. How to make a gift, but not cause other problems because of the recipient's youth, immaturity or limitations? Three common mechanisms are the topic of this podcast episode. We talk about (among other things): UTMA -- the Uniform Transfers to Minors Act (a state law, adopted in Arizona and 48 other states -- this may be the year that South Carolina joins the rest of the states). §529 (education) accounts -- a federal tax-favored way to set money aside for future college education costs (and some other expenditures). Though they are based on federal tax law, most states have created 529 programs in accordance with that law. ABLE Act accounts -- another federal tax law that encourages states to set up specialized investment alternatives. This time, though, the intended beneficiaries are people with disabilities -- regardless of age (though their disability must have existed before they reached age 26). Hello and welcome to Day in Washington, your disability policy podcast. I’m your host Day Al-Mohamed working to make sure you stay informed.  This is your Disability Report for the week of February 19, 2019. Housing/International On January 25th, the Supreme Court of Canada (SCC) released a landmark decision in S.A. v. Metro Vancouver Housing Corporation.  In this case, the housing authority wanted to take into account the S.A.’s Henson Trust. For those of you who may not know, Henson Trusts in Canada are like our ABLE Accounts. Ours are tax-advantaged savings accounts for individuals with disabilities and their families. They’re still pretty new here as the ABLE Act only just passed in 2014. It’s based on the idea that millions of people with disabilities and their families depend on a wide variety of public benefits for income, health care and food and housing assistance. Eligibility for many of these public benefits require meeting a means or resource test that stops people from building any savings for accessible housing, transportation, assistive technology etc. So the Supreme Court of Canada agreed that Henson Trusts should NOT be considered an asset by the housing authority, allowing Canadian citizens to receive a housing subsidy for accessible housing without bankrupting themselves. http://www.ccdonline.ca/en/humanrights/litigation/media-advisory-25Jan2019 Employment In February, the Kessler Foundation and University of New Hampshire released the nTIDE Report focusing on disability employment. In the Bureau of Labor Statistics (BLS) Jobs Report, employment for working-age people with disabilities decreased slightly from 29.9 percent in January 2018 to 29.8 percent in January 2019. For working-age people without disabilities, employment increased from 72.7 percent in January 2018 to 73.6 percent in January 2019. But what is perhaps a bit more disturbing is the labor force participation rate for working-age people. The labor force participation rate is the percentage of the population that is working or actively looking for work. Employment rates show people who are working and/or not working. This shows those who are still trying to be employed and those who have given up and no longer in the workforce. For people with disabilities, it was 33 percent in January 2018 and remained at the same level (33 percent) in January 2019. So basically, 67% of people with disabilities are not even participating in the system. Only 33% are in the workforce at all. And that number hasn’t changed. Now lets compare it to working-age people without disabilities, their labor force participation rate increased from 76.1 percent in Jan. 2018 to 76.9 percent in January 2019. https://iod.unh.edu/article/2019/02/ntide-january-2019-jobs-report-job-numbers-hold-steady-americans-disabilities Culture February brings some great news by way of disability culture. New Jersey becomes second state to require schools to teach LGBT and disability-inclusive material. Children in the New Jersey school system will be exposed to "the political, economic, and social contributions of persons with disabilities”. While the focus of the discussion has been primarily on LGBTQ history, having disability included is a big win. California already has such a law in place. Here’s hoping those textbooks get updated with some great suggestions (Beyond Helen Keller and Franklin Delano Roosevelt). Congresswoman Eleanor Holmes Norton has represented Washington, D.C. for 25 years, but her responsibilities are different than those of other representatives. Because Washington, D.C. is not a state, she doesn’t have a vote on the House floor. This would seem to make her job more challenging than it is for other representatives but she has risen above this limitation time and again, finding creative ways to demonstrate the importance of legislation that matters most to her district. She shares some of those stories in our discussion. Congresswoman Norton was born and raised in D.C. during a time when schools and restaurants were segregated. She was one of the only African-American women at Antioch College, one of the only women at Yale law school, and she has fought for civil rights throughout her life. Bryan and Brian discussed strategies to be able to receive the long-term care you need, while preserving a portion of your estate through Medicaid spend down. Of course, the best course of action to be able to preserve your entire estate is planning before the need for long-term care arises. They also discussed the ABLE Act that was recently passed by Congress to help save money for this kind of care, similar in some ways to a 529 plan.

Joyce welcomes Sara Hart Weir, president of the National Down Syndrome Society (NDSS).Under Weir's leadership, since December 2014, NDSS was at the forefront of the passage of the landmark and historical Stephen Beck Jr. Achieving A Better Life Experience (ABLE), Act, which will create tax free savings accounts for people with Down syndrome and other disabilities. For Weir, the advocacy surrounding the ABLE Act was a civil rights issue, as for the first-time ever, it puts a stake in the ground that individuals with disabilities can save money for the future, work, all while remaining on the necessary benefits that the Down syndrome community relies on.

I'm your host Day Al-Mohamed working to make sure you stay informed. Today, I want to give a bit of an update on the Able Act. The ABLE Act was signed into law by President Obama on December 3rd, 2014. When Able accounts first came out, I'll admit, from a policy standpoint, I was pretty excited. I even did a video Day in Washington about it. Let me give you the quick details: ABLE Act savings accounts would basically allow people with disabilities (and their families), for perhaps the first time, to be able to save money for things they might need without risking their benefits, including health care. Things like, saving for school, or an accessible van (which let me tell, you I only learned recently how expensive those are), additional personal care services, or assistive technology.among other things. You see, public benefits like Supplemental Security Insurance (SSI), and Medicaid for example require you prove that you're poor. Basically, you can't have more than $2,000 and that isn't just cash, that is any asset or item of value. I still remember a young man I met during rehab. God, he couldn't have been more than 19. He cried over the fact he had to give up his classic car. It was the one thing in his life that was his. He'd rebuilt it from scratch, piece by piece. And now, to get access to a surgery he needed and additional care for his diminishing eyesight, he had to sell it. But, lets get back to the Able accounts. Now, people with disabilities and their families can have these savings accounts, which aren't too different from the tax-exempt college savings accounts that you may be familiar with. Up to $14,000 can be deposited into the account per year up to a total of $100,000 before the individual loses some of their SSI. Another key advantage of the ABLE Act is that people with disabilities need never fear that they would lose their Medicaid. For many, that is the only way they can afford their health and personal care services. So now, let me get to the compromises. Although the monetary limitations mentioned above are also compromises, the largest and the compromise that bothers me the most, is the fact that the ABLE act limits its eligibility to people with significant disabilities who got their disability before turning 26. As of March, more than half of the states are now starting to put regulations in place to create these accounts. Which is good news. I have to admit some disappointment that the Able Act will not do everything that we all once hoped. In a world where X percentage of families with a member with a disability live in poverty, we already see growing economic disparities. As it stands, this bill would seem to benefit mostly those who can afford to use these accounts. Also, although the age limit may be helpful for individuals who are born with disabilities, there are many who acquire significant disabilities after 26 that can have devastating effects on their families and their children. And now, this option is no longer available to them. I understand that this bill had and still has an expensive price tag and decisions had to be made. But this disturbs me in that I wonder if we are sacrificing one part of the community for another. When it came to ENDA, the Employment Non-Discrimination Act, and there was a push to remove Trans individuals from the protection of the legislation,
