Are you looking for some hard-hitting insights on compliance? Look no further than Compliance into the Weeds! In this episode, Tom Fox and Matt Kelly dive into the intricate and unusual story of the National Rifle Association (NRA) and its recent corporate governance overhaul. Matt and Tom explore Judge Joel Cohen's final ruling, which mandates extensive corporate governance reforms for the NRA. These reforms address significant issues, such as a structurally weak board, poor financial controls, and an overpowering CEO in Wayne LaPierre, who misused the organization's resources. Necessary measures discussed include revamping the board's audit committee and introducing annual compliance reports, along with significant protections for the role of the Chief Compliance Officer. The episode highlights the universal principles of good governance, asserting that the NRA's reforms can serve as a valuable lesson for other organizations. Regardless of the political or ethical stance on the NRA's activities, the implemented governance structures underscore the necessity of transparency, an empowered compliance function, and robust oversight mechanisms to prevent misuse of organizational resources. These insights are illustrated through sample agreements and templates in the court ruling, which can guide other organizations in strengthening their governance and compliance programs. Welcome to The Georgia Politics Podcast! On today's episode, former Congressman and current President of the National Rifle Association (NRA), Bob Barr, joins us to discuss his political journey and the impact of the 1994 Contract with America. The Contract with America, introduced during the 1994 congressional campaign, was a significant policy agenda released by the United States Republican Party. It outlined specific legislative proposals the party promised to bring to a vote if they secured control of the House of Representatives. The document emphasized a conservative vision focused on limited government, lower taxes, and personal responsibility. The Contract was a pivotal factor in the Republican Party's victory in the 1994 midterm elections, which led to a major political realignment with the GOP taking control of the House. Bob Barr, then a Republican congressman from Georgia, was an active supporter of the Contract's principles. While he was not one of its primary architects—a role primarily credited to Newt Gingrich and Dick Armey—Barr played a key part in promoting and implementing the agenda as part of the broader Republican revolution. This Day in Legal History: Medicare Bill SignedOn July 30, 1965, President Lyndon B. Johnson signed the Medicare bill into law, marking a significant milestone in American healthcare. This landmark legislation, part of Johnson's Great Society programs, aimed to address the healthcare needs of the nation's elderly population. With the stroke of his pen, Johnson established Medicare, a federal program providing comprehensive health insurance to Americans aged 65 and older. The bill was signed at the Truman Library in Independence, Missouri, with former President Harry S. Truman by Johnson's side, recognizing Truman's early efforts to promote national health insurance.Medicare went into effect the following year, in 1966, offering hospital and medical insurance to millions of senior citizens. This historic act transformed the landscape of healthcare in the United States, ensuring that older Americans would no longer face financial ruin due to medical expenses. Medicare's introduction also set the stage for future expansions, including the addition of prescription drug coverage and the establishment of Medicare Advantage plans. Over the decades, Medicare has become a cornerstone of the U.S. healthcare system, providing vital health services to millions of Americans and significantly reducing poverty among the elderly. The signing of the Medicare bill remains a pivotal moment in the pursuit of healthcare equity in the United States.A federal appeals court overturned a $79 million attorneys' fee award in T-Mobile US Inc.'s $350 million settlement of a data breach lawsuit. The US Court of Appeals for the Eighth Circuit ruled that the lower court abused its discretion by approving an excessive fee award in a case that settled quickly and without extensive legal proceedings. The court reversed the fee award, reinstated the objection of class member Cassie Hampe, and remanded the case for further proceedings. The litigation stemmed from a 2021 data breach affecting 76.6 million people, with settlement approval sought in July 2022. Judge Brian C. Wimes initially approved the fee award in June 2023, dismissing objections from Hampe and Connie Pentz as abusive. However, the appeals court found no evidence of bad faith or extortion by Hampe and criticized the lower court for not adjusting the fee award based on the hours worked by class counsel. The court noted that class counsel's fee request amounted to an hourly rate of $7,000 to $9,500, deemed unreasonable. The case was sent back for further consideration, with the involvement of multiple law firms representing the parties.T-Mobile Deal's $79 Million Attorneys' Fee Award Gets OverturnedBig Law firms are reevaluating their strategies following a ruling in the Eastern District of Virginia that barred Vinson & Elkins from representing wood-pellet maker Enviva Inc. in its bankruptcy due to a conflict of interest with private equity firm Riverstone Investment Group LLC. This decision has raised concerns about potential conflicts when firms represent both private equity sponsors and their distressed portfolio companies in Chapter 11 proceedings. The ruling could force law firms to choose between lucrative private equity deals and bankruptcy cases, potentially reshaping their business models. The court rejected Vinson & Elkins' proposal to separate their work for Riverstone and Enviva, citing ethical concerns. This outcome could lead to more aggressive challenges by the US Trustee and might require law firms to adopt stricter conflict management practices. Although some view the decision as specific to the case's facts, it signals a need for firms to better navigate ethical responsibilities. The ruling has already influenced how law firms approach bankruptcy cases involving private equity-backed companies, with future decisions possibly reaching higher courts for further clarification. Despite this, experts like Nancy Rapoport and Bruce A. Markell believe that Big Law firms will adapt and continue to thrive by finding compliant ways to manage conflicts of interest.Big Law Confronts Tail Risk Threat to Private Equity BankruptcyA New York state judge has ruled against appointing an outside monitor for the National Rifle Association (NRA) but banned former CEO Wayne LaPierre from serving as an officer or director for ten years. The decision by Justice Joel Cohen of the Manhattan Supreme Court comes from a four-year-old civil case initiated by state Attorney General Letitia James. Although a mixed outcome, the ruling followed a trial stage where jurors found LaPierre and others guilty of financial mismanagement, including funding LaPierre's lavish lifestyle. LaPierre was ordered to repay $4.35 million to the NRA, and former finance chief Wilson Phillips was ordered to repay $2 million.James sued the NRA in August 2020, citing greed, poor oversight, and cronyism. Following the ruling, both parties were directed to negotiate governance changes that could reduce the NRA's board size and facilitate new board candidacies. Despite the lawsuit, the NRA has perceived the case as politically motivated. The NRA, founded in 1871, has seen its influence wane, including within the Republican Party, as its membership and revenue have declined. NRA President Bob Barr acknowledged the jury's findings and reiterated the organization's commitment to good governance. LaPierre, who resigned just before the trial's first stage, has not commented on the ruling.Judge won't require monitor for NRA, bans ex-chief LaPierre for 10 years | ReutersThe American Bar Association (ABA) has issued its first formal ethics opinion on the use of generative artificial intelligence (AI) by lawyers, emphasizing the need for adherence to ethical obligations. The ABA's ethics and professional responsibility committee highlighted that lawyers must ensure competence, protect client confidentiality, communicate appropriately, and handle fees ethically when utilizing AI technology. While AI can enhance efficiency in legal tasks such as research, document drafting, and analysis, it also poses risks like producing inaccurate results. Lawyers are advised to prevent unintended disclosure of client information and consider informing clients about their use of AI tools. The ABA's opinion serves as guidance for interpreting model rules, although these are not binding. The opinion cautioned against relying on AI-generated outputs without verification, noting instances where lawyers have cited nonexistent cases or inaccurate analyses, leading to potential misrepresentations in court.Recent cases illustrate the consequences of unverified AI use, with a federal judge in Virginia considering sanctions for a filing that included fictitious cases and fabricated quotations. While some courts require lawyers to disclose their use of AI, others, like the 5th U.S. Circuit Court of Appeals, have declined to adopt such rules.State bar associations have also been developing their own AI guidelines, recognizing the rapidly evolving nature of the technology. The ABA anticipates ongoing updates to their guidance to keep pace with developments in AI.Lawyers using AI must heed ethics rules, ABA says in first formal guidance | ReutersThe U.S. Senate is poised to pass significant online child safety reforms through two bills: the Children and Teens' Online Privacy Protection Act (COPPA 2.0) and the Kids Online Safety Act (KOSA). These reforms aim to enhance protections for minors on social media platforms. COPPA 2.0 will prohibit targeted advertising to minors, restrict data collection without consent, and allow parents and children to delete their information from social media. KOSA will establish a "duty of care" for social media companies to design safer platforms for minors.Despite bipartisan support in the Senate, with an 86-1 procedural vote, the bills face uncertainty in the Republican-controlled House, currently on recess until September. While some social media executives support KOSA, others, including leaders from Meta and TikTok, have expressed concerns. Critics, including tech industry groups and the American Civil Liberties Union, argue that the bills could limit access to important content for minors. In response to these concerns, the bill's language was amended, reducing the enforcement role of state attorneys general. Supporters like Josh Golin of Fairplay for Kids argue that KOSA targets specific risks, such as promoting harmful content, without granting legal grounds for government censorship. The legislation's future now hinges on approval in the House of Representatives.US Senate set to pass major online child safety reforms | Reuters This is a public episode. The Supreme Court has sided with the National Rifle Association (NRA) in a legal battle against former New York official Maria Vullo, in a conflict intertwined with the aftermath of the tragic 2018 Parkland school shooting. The NRA contends that Vullo's efforts to sever ties with the gun rights group following the Parkland tragedy violated its free speech rights under the First Amendment. Conversely, Vullo argues that her actions were necessary, regulatory measures addressing concerns over insurance products offered by the NRA in New York. The ruling underscores the intricate interplay between constitutional rights, government coercion and regulatory enforcement in the aftermath of significant events, and intersects constitutional freedoms and regulatory practices. Last Sunday, prospective Republican candidate Donald J. Trump graciously received the endorsement of the National Rifle Association (NRA) during a potent speech at the NRA's Leadership Forum in Dallas, Texas. Grateful for such strong support, Trump acknowledged the value of such backing, saying, 'I sincerely appreciate this endorsement, it carries enormous significance for me. As many of you may recall, back in 2016, we received a similar endorsement, followed through on our commitments, and I am honored to report, we've secured it once more.' In his speech, Trump harked back to the enduring commitment, saying, 'Despite being under attack, with our rights to bear arms under constant siege, we haven't budged an inch. Our firm stand must continue,' he posited truthfully, painting a vivid picture of the challenges faced by gun-owners and conservative values within the nation. Trump accentuated the indispensability of the NRA in his political journey, saying, 'Since the very beginning of my political career, the NRA has staunchly stood by me. Assuredly with your vote, I will unfailingly stand for your rights and freedoms. With a renewed term in the White House, we aspire to accomplish feats you would not dare to imagine,' confidently laying out his unwavering America First vision. Trump iterated the impact of a prospective office with a promise, 'We are going to put our country back on its rightful track and make America great once again with renewed vigor.' His words encapsulated his fervent patriotism and his commitment to an America First agenda, appealing perfectly to his conservative base.See omnystudio.com/listener for privacy information.

This Day in Legal History: Constitutional Right to CounselOn this day in legal history, the landmark decision of Gideon v. Wainwright by the U.S. Supreme Court on March 18, 1963, fundamentally transformed the American legal system. The Court unanimously ruled that states are constitutionally required to provide counsel to criminal defendants who cannot afford one, grounding its decision in the Sixth Amendment's guarantee of the right to counsel. Justice Hugo Black, writing for the Court, eloquently underscored the importance of this right, stating that ensuring a fair trial necessitates providing counsel for those too impoverished to hire one.Prior to this ruling, the mandate for providing counsel to indigent defendants applied only in federal courts, a precedent set in 1938. The Gideon decision, however, extended this fundamental protection to state courts, recognizing that the right to a fair trial and the right to counsel are essential to the integrity of the justice system. This case highlighted the disparities in legal representation that existed for the less fortunate, emphasizing that justice should not be contingent upon one's ability to pay for a defense attorney. The implications of Gideon v. Wainwright were profound, leading to the establishment of public defender's offices across the United States. It ensured that the constitutional rights of all individuals, regardless of their financial situation, were upheld in the American judicial system. This decision not only reaffirmed the nation's commitment to fairness and equality before the law but also signified a crucial step towards the actualization of these ideals. The Gideon case remains a pivotal moment in legal history, symbolizing the enduring principle that justice should be accessible to all, irrespective of wealth or social standing.KPMG is setting its sights on expanding its legal services by investing significantly in artificial intelligence (AI), aiming to outpace traditional law firms in the technological arena. Stuart Fuller, the head of KPMG's legal services, has announced plans to invest "tens of millions of dollars" into generative AI to streamline operations for corporate legal departments, anticipating that such technology will disrupt the traditional business model of law firms by automating tasks typically performed by junior lawyers. This strategic move is supported by KPMG's substantial financial resources, with the firm reporting over $36 billion in gross revenue last year, dwarfing the earnings of the world's largest law firms.Despite the Big Four's long history of legal service expansion, their direct competition with elite law firms has been limited, partly due to regulatory restrictions in the U.S. However, KPMG Law, under Fuller's leadership, is pushing forward, leveraging a global presence with 3,850 legal professionals across 84 jurisdictions. Fuller, leveraging his experience as a former global managing partner of a major law firm, sees generative AI as a transformational technology that directly challenges the core functions of legal work.KPMG's legal arm has seen substantial growth, partly fueled by its expansion in the Asia-Pacific region, and aims to further boost its market position through significant investments in AI. The firm is focusing on enhancing its services with generative AI in collaboration with Microsoft, targeting improvements in legal research, document processing, and information extraction among other areas. Fuller believes that the key to leveraging AI effectively lies in managing internal data and aligning technology with the firm's strategic goals, including revenue growth and client satisfaction. However, the adoption of AI in legal practices is still in the early stages, with many law firms and their clients only beginning to explore potential applications. Fuller emphasizes the need for a workforce that is curious and adaptable to how legal practice will evolve with these technological advancements. The move towards generative AI is expected to pressure the traditional billable hour model, as clients demand more cost-effective solutions, presenting both opportunities and challenges for law firms to innovate while maintaining profitability.KPMG Looks to Beat Big Law at AI by Leveraging Size and CapitalThe SEC's new emissions reporting rules have triggered a flurry of lawsuits from various groups, including business interests, Republican state attorneys general, and environmentalists, resulting in at least nine lawsuits spread across six federal circuits. Each lawsuit has been strategically filed in a circuit that aligns ideologically with the plaintiffs, although the ultimate consolidation of these cases into a single court will be determined by a random lottery system, a process established over three decades ago to counteract manipulation and ensure impartiality in federal regulation litigation. This system, designed to maintain faith in the judicial system by providing an equal chance for each venue to be selected, will see the cases consolidated in one court, irrespective of the number of lawsuits filed in any particular circuit. The lottery will include the U.S. appeals courts for the Second, Fifth, Sixth, Eighth, Eleventh, and District of Columbia circuits, all of which have received petitions challenging the SEC's climate regulations. Despite the ideological diversity of these courts, the random selection process aims to prevent any bias in the selection of the venue. The SEC rules have faced criticism from both sides: some argue they go too far in requiring detailed emissions reporting, while others believe they don't go far enough. The Fifth Circuit, known for its conservative leanings and having received the most lawsuits, has the same chance of being selected as other circuits with fewer filings. The lawsuits reflect a broader debate on the SEC's role in mandating climate change-related disclosures, with opponents accusing the agency of overstepping its bounds and supporters arguing for more comprehensive requirements. The selection process for the consolidated case's venue is keenly observed, given its potential to influence the regulatory landscape for climate disclosures in the U.S. The process underscores the ongoing tension between regulatory attempts to address climate change risks and the varied interests seeking to shape these efforts through the judicial system.SEC Climate Suits Head Toward Lottery to Pick Single CourtThe U.S. Supreme Court is set to adjudicate Murthy v. Missouri, a pivotal case that tests the limits of government intervention in social media discourse, particularly focusing on whether the Biden administration overstepped its bounds in combatting disinformation on platforms like Facebook and Twitter. This lawsuit, brought forward by social media users and GOP-led states, accuses the White House and agencies like the CDC of coercing these platforms to censor content labeled as misinformation on topics ranging from COVID-19 to the 2020 election results. This case emerges amidst a broader context of increasing tension over online speech rights, especially with accusations from conservatives claiming bias against right-leaning viewpoints on social media. The Supreme Court's docket this term includes five cases probing the extent of governmental interactions with social media entities, with one ruling already affirming that officials can infringe upon First Amendment rights by blocking users. These cases collectively navigate complex First Amendment issues, involving government speech, users' rights to disseminate and access information, and platforms' rights to moderate content. The backdrop of these disputes includes significant events like the COVID-19 pandemic and the January 6 Capitol riot, highlighting the evolving role of social media as the predominant forum for public discourse.Murthy v. Missouri and related cases highlight a critical challenge: balancing the government's right to address public concerns against the potential harm to users and platforms forced into content moderation against their will. Historical precedents, like the 1963 Bantam Books v. Sullivan case, illustrate the Supreme Court's acknowledgment of the dangers of informal censorship by the government. The current case further explores this tension, with lower courts finding that the Biden administration's actions towards social media platforms could constitute undue pressure, thus violating First Amendment protections.Legal experts and amicus briefs submitted by various organizations emphasize the difficulty in distinguishing between permissible persuasion and unconstitutional coercion by the government in its dealings with social media platforms. The Supreme Court's decision in Murthy v. Missouri is expected to provide needed clarity on how government officials can communicate with social media companies without overstepping constitutional boundaries, setting a precedent that could shape the nature of digital public discourse for years to come.Supreme Court Confronts Claim White House Bullied Social GiantsSupreme Court eyes government contacts with social media platforms | ReutersThe U.S. Supreme Court is set to hear a significant free speech case involving the National Rifle Association (NRA) and a former New York state official, Maria Vullo. The NRA alleges that Vullo, the former superintendent of New York's Department of Financial Services, abused her regulatory authority by pressuring financial institutions to sever ties with the NRA, thus violating the organization's First Amendment rights. This legal battle stems from the NRA's 2018 lawsuit, which accuses Vullo of retaliatory actions against the group in the wake of the Parkland school shooting. The dispute centers on whether Vullo's actions, including fining insurers for offering NRA-endorsed products deemed illegal by New York insurance law, constituted unconstitutional coercion or permissible persuasion. A federal judge dismissed all claims against Vullo except for two related to free speech, but the 2nd U.S. Circuit Court of Appeals later ruled these should also have been dismissed, leading to the NRA's appeal to the Supreme Court. The case highlights the ongoing debate over gun rights and free speech in the U.S., with the NRA seeking to protect its advocacy efforts against what it views as an implicit censorship regime.US Supreme Court to weigh NRA free speech fight with New York official | Reuters Get full access to Minimum Competence - Daily Legal News Podcast at www.minimumcomp.com/subscribe

This Day in Legal History: Watergate Burglary Trial BeginsOn January 8, 1973, a trial commenced that would eventually etch its name into the annals of American legal history. Seven men stood accused in a Washington DC courtroom, all linked to the now-infamous break-in at the Democratic National Committee headquarters, located in the Watergate Hotel. This event, which unfolded on June 17, 1972, sparked a series of revelations that would have profound implications for American politics and the legal system. The trial, led by Judge John J. Sirica, uncovered a complex web of political espionage and sabotage. Evidence presented during the proceedings pointed to the involvement of high-ranking officials in the Nixon administration. This raised alarming questions about the abuse of political power at the highest levels of government. The defendants, including operatives of the Committee to Re-Elect the President (CRP), faced charges ranging from burglary to conspiracy and wiretapping. The prosecution's case was bolstered by the discovery of a secret taping system in the White House, which provided crucial evidence. These tapes would later play a central role in unraveling the cover-up efforts by Nixon's aides. The trial set in motion a chain of events that led to extensive investigations by the media and a Senate committee. These investigations eventually unearthed a pattern of illegal activities sanctioned and covered up by the administration. The revelations from the trial and subsequent inquiries brought to light the vulnerabilities in the American democratic system, especially regarding the checks and balances intended to prevent such abuses of power. The impact of this trial extended beyond the immediate legal consequences for the accused. It prompted a nationwide introspection on the integrity of political processes and the accountability of elected officials. The Watergate scandal, as it came to be known, ultimately led to the resignation of President Richard Nixon on August 8, 1974, marking the first time a sitting U.S. President resigned from office. This trial, more than just a legal proceeding, became a symbol of the struggle for transparency and ethical governance. It underscored the importance of an independent judicial system and a free press in upholding democratic principles. The events of January 8, 1973, and their aftermath, thus remain a crucial chapter in the history of American jurisprudence and governance. The current term of the US Supreme Court is shaping up to be historically significant with the addition of a case determining former President Donald Trump's eligibility for the 2024 presidential ballot in Colorado. The docket includes high-profile cases challenging the power of federal regulators and expanding gun rights, alongside another significant case on abortion access.Experts like Lisa Blatt and Stephen Vladeck express their astonishment at the gravity and unprecedented nature of the cases before the Court. The term initially focused on the administrative state, but the rapid addition of cases involving Trump and abortion has amplified its importance. The Court will consider overturning the Chevron doctrine, which gives federal agencies leeway to interpret ambiguous laws, impacting a wide range of regulatory areas. The Trump-related case, Trump v. Anderson, stems from a Colorado Supreme Court ruling about his alleged incitement of the January 6 Capitol attack, raising both legal and political stakes. Additionally, the Court will address whether federal prosecutors can charge January 6 defendants under an Enron-era statute in Fischer v. United States, indirectly affecting Trump. In the realm of abortion, the Court's docket includes a case on the FDA's rescinding of safety measures for medication abortion in FDA v. Alliance for Hippocratic Medicine, potentially limiting access to the most common abortion method. Another case, Moyle v. United States and Idaho v. United States, concerns whether hospitals can perform abortions in emergencies, with Idaho's prohibition currently in effect. The Court's agenda also covers gun rights, with cases like United States v. Rahimi, which could temper gun rights expansions regarding domestic violence restraining orders. Additionally, the Trump administration's bump stock ban, enacted after the 2017 Las Vegas shooting, will be reviewed.Other significant matters include disputes over social media regulation, a major opioid settlement, and a corporate tax overhaul law from 2017. With such a diverse and controversial docket, Chief Justice Roberts faces the challenge of managing these pivotal cases, each potentially reshaping major legal and societal landscapes.Big Supreme Court Term Now Historic with Trump, Abortion CasesLaw enforcement and court administrators are intensifying their focus on courtroom security following a series of violent incidents and threats across the US. These events include a shooting at the Colorado Supreme Court, an attack on a Nevada judge, and a string of bomb threats that led to the closure of judicial buildings nationwide, all occurring within a single week.Sheriff James Brown, chair of the National Sheriff's Association's committee on court security, emphasizes the importance of resource allocation and strategic placement of officers in courtrooms to prevent hostility and ensure safety. However, the effectiveness of these measures often hinges on the availability of sufficient staffing. Courts across the US, from New York to Texas and Florida to Illinois, are consistently preparing for threats, but the recent surge in violent incidents has heightened concerns and the sense of vulnerability within the court community.Nathan Hall, a consultant specializing in courthouse planning and security, notes that while court security is a long-standing concern, the recent incidents have escalated the urgency to strengthen protective measures. In response, court leaders are seeking additional safeguards against potential violence. For instance, in Ohio's Cuyahoga County Court of Common Pleas, Judge Brendan J. Sheehan has initiated discussions with the local sheriff to review courtroom security protocols. This increase in violence against judges is part of a broader trend of threats against government officials, as public trust in institutions wanes. Attorney General Merrick Garland highlighted a "deeply disturbing spike" in such threats. In New York, for example, there was a 66% increase in judicial threats and related incidents in 2023 compared to the previous year. This rise has led to a significant recruitment of court officers, with plans for further expansion in 2024.Court personnel across the country are feeling the impact of these increased threats. As political tensions rise in the lead-up to the 2024 elections, court administrators may seek more funding from state legislatures for enhanced security measures and additional personnel. Kevin Taylor, Marshal for the First District Court of Appeal in Florida, emphasizes the importance of communication and strategy among court security officers, using recent incidents as case studies to improve preparedness and response.‘Shell-shocked' Courts Review Security After Threats, ViolenceFisherBroyles, a prominent virtual law firm, is facing a significant exodus of partners due to dissatisfaction with leadership over expense handling and a tax accounting error. The firm's corporate and litigation chairs, Michael Pierson and Joel Ferdinand, left to start their own firm, Pierson Ferdinand, potentially taking up to 130 former FisherBroyles partners with them. This move could represent nearly half of FisherBroyles' workforce and be among the largest law firm spinoffs in recent history. The departures underscore the economic challenges faced by virtual law firms, which operate with minimal overhead but need to provide sufficient resources to partners. FisherBroyles' model, where partners keep 80% of the revenue they generate, has led to grievances about bearing costs like legal research and marketing, which some believe should be covered by the 20% revenue share returned to the firm.A significant issue contributing to the discontent was a firmwide tax problem related to California, discovered by a new accounting firm. Partners in other states were informed they would need to pay taxes to California, leading to widespread frustration and sparking the exodus. In response to these issues, Pierson Ferdinand is implementing changes, such as a profit-sharing plan and substantial investments in technology, contrasting with FisherBroyles' approach. FisherBroyles itself is also planning a profit-sharing plan this year. This isn't the first tax-related problem for FisherBroyles; in 2014, they acknowledged failing to file timely taxes in Georgia and offered to reimburse partners for any resulting penalties.Despite these challenges, FisherBroyles' founders express confidence in their firm's future and plan to continue providing world-class legal services. The recent upheaval points to the evolving nature of virtual law firms and the balance they must strike between operational efficiency and partner satisfaction.FisherBroyles Exodus Shows Rift Over Virtual Firm Profits, TaxesThe corruption trial of the National Rifle Association (NRA) and its former leader Wayne LaPierre is set to begin in a Manhattan courtroom. This follows LaPierre's recent resignation as the NRA's chief executive, citing health reasons. The trial, led by New York Attorney General Letitia James, accuses the NRA and LaPierre of misusing millions of dollars for luxuries and other improper practices, including unapproved conflicts of interest and no-show contracts.James asserts that these actions violated state laws governing nonprofits. The NRA, however, denies any wrongdoing, claiming political targeting by James and arguing that the lawsuit violates their First Amendment rights.Jury selection for the trial began on January 2, with LaPierre in attendance, and opening statements may also start on the day the trial begins. The NRA is currently facing financial challenges, with a significant drop in revenue and membership in recent years.LaPierre, who has led the NRA since 1991 and transformed it into a major political force advocating for gun rights, is expected to testify. Other defendants include John Frazer, the secretary and general counsel, and former finance chief Wilson Phillips. Joshua Powell, a former high-ranking NRA official, settled separately, agreeing to reimburse $100,000 and admitting to misuse of NRA assets. The trial, expected to last six weeks, will be presided over by Justice Joel Cohen. It will focus on the financial misconduct of the individual defendants and determine any repayments to the NRA. The jury will also make recommendations on Frazer's position, while the judge will decide on any removals. The case was allowed to proceed to trial after an appeals court found substantial evidence of mismanagement within the NRA, despite their resistance to leadership changes.NRA, Wayne LaPierre head for New York graft trial after his resignation | Reuters Get full access to Minimum Competence - Daily Legal News Podcast at www.minimumcomp.com/subscribe

The guidance — which originated from the White House National Security Council (NSC) — was revealed in a Department of Energy (DOE) memo issued internally to agency staff on Sept. 15 and obtained by Fox News Digital. The memo was authored by Deputy Secretary of Energy David Turk who outlined travel restrictions and stated officials are required to obtain approval from the NSC before attending any global energy engagement. "This guidance sets out a presumption that agencies and departments will pursue international energy engagement that advances clean energy projects," Turk wrote in the memo. "It also outlines a process for seeking limited exceptions to pursue carbon-intensive engagements on a justified geostrategic imperative or energy-for-development/energy access basis." "The guidance rules out any U.S. Government ‘engagement related to unabated or partially abated coal generation,’" he continued. "Carbon-intensive international energy engagements are those 'directly related and dedicated to the production, transportation, or consumption of carbon-intensive fuels that would lead to additional greenhouse gas emissions.'" According to the memo, carbon-intensive fossil fuels include coal, oil and natural gas. In addition, the memo notes that the guidance became effective in November 2021 and applies to all international energy engagements. Turk issued a separate memo in early April 2022, which first outlined how the DOE would implement the NSC guidance and stated that energy engagements that promote carbon-intensive fuels may only be exempt if they advance national security or are essential to support energy access in vulnerable areas. Turk's September memo updated that guidance, stating that for all future engagements, "Departments and Agencies are required to submit exemption justifications to the NSC and receive NSC concurrence before proceeding with a covered engagement." The DOE referred Fox News Digital to the NSC, which didn't respond to multiple requests for comment. Since taking office, President Biden has pursued an aggressive climate agenda, seeking to boost green energy technologies like solar and wind while curbing domestic reliance on fossil fuels like those listed by the administration as "carbon intensive." Biden has issued federal goals to ensure 50% of U.S. car purchases are zero-emissions by 2030 and that the power sector is carbon-free by 2035. However, vehicles with internal combustion engines (gasoline-powered), make up more than 99% of all cars in the U.S. and about 99% of new car sales, according to J.D. Power. And approximately 60% of electricity in the U.S. is generated from fossil fuels, mainly natural gas, while 17% is produced form wind or solar power. As part of his agenda, Biden and senior administration officials have traveled to global energy conference to boost green energy development. And officials have largely been absent from global fossil fuel summits like the World Gas Conference, which former Energy Secretary Rick Perry attended during the Trump administration. The Biden administration also opted against inviting oil and gas industry representatives to the White House Methane Summit in July. https://www.foxnews.com/us/judge-orders-new-york-dole-out-nearly-half-million-legal-fees-nra-supreme-court-victory Judge orders New York to dole out nearly half a million in legal fees to NRA after Supreme Court victory A New York judge ordered the state to pay nearly half a million dollars in legal feels to the National Rifle Association (NRA) after the gun rights group won a major case at the Supreme Court. In a case decided last summer, the Supreme Court ruled that a New York public carry licensing law was unconstitutional and that the ability to carry a pistol in public was a constitutional right guaranteed by the Second Amendment. The NRA was a party in that case, New York State Rifle & Pistol Association v. Bruen, and last week a New York judge ordered the state to pay $447,700.82 in legal fees. "The NRA regards the $447K award in the NYSRPA V. Bruen case as a pivotal victory, a symbol that justice is definitively on our side," Michael Jean, NRA’s director of the Office of Litigation Counsel, told Fox News Digital in a statement. "This triumph in Bruen has fortified the Second Amendment in an unprecedented manner, and we continue our unrelenting fight to uphold our rights and challenge those who endeavor to infringe upon them," he added. Jean noted, however, that the payout "only scratches the surface" and covers "merely a third" of the group's legal expenses. Jean thanked the generosity of "devoted NRA members" that helped to cover the brunt of the legal fees for the case, noting that "New York refuses to fully compensate." Before the high court weighed in, the standard for carrying a weapon required an applicant to show "proper cause" for seeking a license, and allowed New York officials to exercise discretion in determining whether a person has shown a good enough reason for needing to carry a firearm. Stating that one wished to protect themselves or their property was not enough. "In this case, petitioners and respondents agree that ordinary, law-abiding citizens have a similar right to carry handguns publicly for their self-defense. We too agree, and now hold, consistent with Heller and McDonald, that the Second and Fourteenth Amendments protect an individual’s right to carry a handgun for self-defense outside the home," Justice Clarence Thomas wrote in the court's opinion, referencing two previous gun cases. "Because the State of New York issues public-carry licenses only when an applicant demonstrates a special need for self-defense, we conclude that the State’s licensing regime violates the Constitution." Thomas noted that the state statute does not define what "proper cause" means, and that courts had ruled that the standard was met by people who showed a "special need for self-protection." Following the court's decision New York legislators immediately passed the Concealed Carry Improvement Act, which prohibits carrying a gun in "sensitive areas," such as stadiums, houses of worship, museums, parks and other public places; imposes revised record-keeping and new safety requirements on retailers; and mandates background checks on all ammunition purchases. Gun retailers immediately appealed to the Supreme Court in January to stop that law from going into effect while the litigation proceeds, but the high court rejected their bid. "We are challenging the ability of the state of New York to target dealers in firearms in the lawful stream of commerce, to put them out of business, which is what the new laws will do," Paloma Capanna, the lead attorney for the New York gun retailers, said. "So it really was unfortunate to see that we couldn't get any emergency temporary injunction against those laws." https://bongino.com/former-kamala-harris-adviser-who-doesnt-appear-to-live-in-california-picked-to-fill-late-dianne-feinsteins-seat Former Kamala Harris Adviser Who Doesn’t Appear to Live in California Picked to Fill Late Dianne Feinstein’s Seat So eager were Democrats to find a replacement for the late Dianne Feinstein’s Senate seat that they apparently didn’t even bother to pick someone living in California. According to the Washington Examiner: The appointment of Laphonza Butler to become California's newest senator is already raising some eyebrows as she appears to be registered to vote in Maryland with an address in that state. Registration records indicate that Butler lives in Silver Spring, Maryland, with her mailing address the same as her residential. She registered as a Democrat as of Sept. 12, 2022. Butler is the president of EMILYs List, the self-described "nation's largest resource dedicated to electing Democratic pro-choice women to office," and a longtime leader in California before her move to Maryland. On Sunday night, the newest California senator's biography on the EMILYs List website listed that "Laphonza grew up in Magnolia, MS, and attended one of the country's premier HBCUs, Jackson State University. She lives in Maryland with her partner Neneki Lee and their daughter Nylah." As of 7 a.m. Monday, the organization has removed the line that she lives in Maryland. Butler was formally Kamala Harris' 2020 campaign adviser. As radio host Dan O’Donnell noticed in real-time, Butler removed part of her biography on her Twitter account that listed Maryland as her location. Similarly, The Spectator’s Matt Foldi found that Butler’s LinkedIn page also listed her location as Maryland. Yet, merely hours after Foldi’s post, Butler’s location according to LinkedIn changed to the “Los Angeles Metropolitan Area.” Before we wrap up today… how about a little on this day in history? Who would have ever thought that you could do all that we can now do, right on the comforts of your phone. As our life gets easier, we have all become spoiled when it comes to research and communications. A technological type of shorthand is developing right before our eyes. In the past, written documents, papers, or articles would have the acronym in parentheses after the formal phrase was spelled out such as National Rifle Association (NRA). Now when we read technical or information articles there are stand-alone acronyms because the author assumes (something you should never do) that the audience knows what you are talking about. I have also seen acronyms listed and the meaning in parathesis behind the letters. Texting and messaging are now the primary ways we communicate. Texting has now given birth to a whole new language of acronyms. This ease of written communication is now spilling over into our verbal communications. I have had young students in my NRA firearms training course in their 20s who even incorporate acronyms such as LOL (laugh out loud) and BTW (by the way) in their normal verbal communications. Technical ballistic information regarding bullets is no different. Acronyms are now part of the firearms and ammunition world. Many times this shorthand is not defined with once again, the writer assuming everyone reading knows the meanings of the string of letters on paper. As shooters and firearm enthusiasts, it is our responsibility to learn all we can about these acronyms so we can better educate ourselves and those around us, especially new firearm owners and shooters. We'll discuss MOAs, BCs, SDs, POI, POA, NPA and NAA, Can you identify and define all of these acronyms? Learn more about your ad choices. Visit megaphone.fm/adchoices
Border enforcement officials apprehended more than three dozen people named on the federal terrorism watchlist at the US-Mexico frontier in the final three months of 2022 — after a record number of terror suspects were caught in the 12 months ending Sept. 30 last year. In pointed language, federal regulators rebuffed a request Tuesday from the operator of California's last nuclear power plant that could have smoothed its pathway to securing a longer operating life for its twin reactors. A California teacher named Olivia Garrison bragged about helping students hide their social transitions from parents Monday. The National Rifle Association (NRA) called California Gov. Gavin Newsom a hypocrite for saying the Second Amendment is becoming a "suicide pact" while walking on the street with what appeared to be armed guards. The US Senate has passed a gun control bill - the most significant firearms legislation in nearly 30 years. Fifteen Republicans joined Democrats in the upper chamber of Congress to approve the measure by 65 votes to 33. It follows mass shootings last month at a supermarket in Buffalo, New York, and a primary school in Uvalde, Texas, that left a combined 31 people dead. The bill will next have to clear the House of Representatives before President Biden can sign it into law. This could happen within days. Although significant, the proposals fall far short of what many Democrats and activists have called for. The new legislation includes tougher background checks for buyers younger than 21 and $15bn (£12.2bn) in federal funding for mental health programs and school security upgrades. It also calls for funding to encourage states to implement "red flag" laws to remove firearms from people considered a threat. And it closes the so-called "boyfriend loophole" by blocking gun sales to those convicted of abusing unmarried intimate partners. The bill is also significant because it is the first time in decades that proposed gun control laws have received this level of support from both Democrats and Republicans. Historically, efforts to strengthen US gun laws have been blocked by the Republican party. Republican Senator John Cornyn of Texas, who co-led the negotiations, said on the chamber floor that the bill would make Americans safer. "I don't believe in doing nothing in the face of what we saw in Uvalde and what we've seen in far too many communities," Mr Cornyn said. "Doing nothing is an abdication of our responsibility as representatives of the American people here in the United States Senate." Democratic Senate Majority Leader Chuck Schumer said: "This is not a cure-all for the ways gun violence affects our nation, but it is a long overdue step in the right direction." Gun safety group March For Our Lives - founded by survivors of the 2018 Parkland school shooting in Florida - welcomed the passing of the bill. "We know there's A LOT more work to be done to end this epidemic. But a lot of hard work got us to tonight. We refuse to quit or be silenced. Ending gun violence is the fight of our lifetime," the group tweeted. The National Rifle Association (NRA) has opposed the bill, arguing that it will not stop the violence. President Biden earlier this month said the proposals were "steps in the right direction" but are still not enough. He has pushed for bigger reforms - including a ban on assault rifles, which were used in the Texas and Buffalo mass shootings last month - or at least an increase in the age at which they can be purchased. The gunman in the Texas shooting is believed to have purchased two semi-automatic rifles days after turning 18. The US has the highest rate of firearms deaths among the world's wealthy nations. But it is also a country where many cherish gun rights that are protected by the Constitution's Second Amendment to "keep and bear arms". The last significant federal gun control legislation was passed in 1994, banning the manufacture for civilian use of assault rifles and large capacity magazines - but it expired a decade later. After the 2012 Sandy Hook school shooting in Connecticut - in which 20 children and six adults were killed - attempts to tighten the laws failed to get enough votes in Congress. Thursday's vote happened hours after the Supreme Court struck down a New York law restricting who can legally carry a gun - effectively expanding gun rights and illustrating the deep divide in the United States over the issue. The court found that New York's requirement for residents to prove "proper cause" - or a good reason - to carry concealed firearms in public violates the Constitution. --- Send in a voice message: https://anchor.fm/aziz-mustaphi/message

Hour 1 of The Dawn Stensland Show: Local News Headlines/News Rundown On Saturday night, three people were killed and another eleven people were hit by gunfire during a shooting on South Street. Two of the suspected shooters have been taken into police custody. On Monday, Philadelphia District Attorney Larry Krasner held a press conference where he addressed the weekend’s South Street shooting. During the press conference, Krasner blamed mass shootings on the National Rifle Association (NRA) and elected officials who take money from the “gun lobby”—claiming those politicians “sold their souls.” In a statement to Fox News Digital Sunday, NRA spokesperson Amy Hunter said, “Philadelphia has been awash in crime for years as a result of Krasner’s ineptitude.” U.S. Senator Pat Toomey stated Republicans and Democrats in the Senate are closer than ever to agreeing on bipartisan legislation that would help address national gun violence. Democrat nominee for U.S. Senate John Fetterman has revealed new information about the stroke he suffered several weeks ago, explaining that he “almost died.” During his concession speech, Dave McCormick endorsed Republican nominee for U.S. Senate Dr. Mehmet Oz in the retired physician’s campaign against John Fetterman. According to the Law Enforcement Legal Defense Fund (LELDF) billionaire George Soros has donated nearly $40 billion over the last decade endorsing the campaigns of progressive prosecutors—including Philadelphia’s Larry Krasner. Soros-backed San Francisco DA Chesa Boudin now faces a recall vote on Tuesday.
Gun Owners of America - Lawrence D. "Larry" Pratt (born November 13, 1942) is the executive director of Gun Owners of America, a United States-based firearms lobbying group, and a former member of the Virginia House of Delegates. He is also Vice Chairman of the Gun Owners of America (GOA) is a gun rights organization in the United States with over 300,000 members. It makes efforts to differentiate itself from the larger National Rifle Association (NRA), and has publicly criticized the NRA on multiple occasions for allegedly compromising on gun rights issues and thereby selling out the gun rights movement. The GOA has often been in opposition to the NRA in its endorsements and ratings of politicians and candidates. For instance, the GOA was outspoken in its opposition to John McCain's 2008 presidential bid, describing his gun-rights voting record as "abysmal, wretched, and pathetic" and giving him an F- grade on Second Amendment issues since 2004, while the NRA (through its PAC, the NRA-PVF) gave him a C+. The GOA took issue with the NRA over the 2007 NICS Improvement Act.[4]The GOA has been described by Congressman Ron Paul as "The only no-compromise gun lobby in Washington." This quote from Paul has long been displayed prominently on the home page of the Gun Owners of America website, and Paul was the only 2008 Presidential candidate to receive an A+ grade from Gun Owners of America. For Your Listening Pleasure all the radio shows available on The 'X' Zone Broadcast Network with our compliments, visit - https://www.spreaker.com/user/xzoneradiotv.Our radio shows archives and programming include: A Different Perspective with Kevin Randle; Alien Cosmic Expo Lecture Series; Alien Worlds Radio Show; America's Soul Doctor with Ken Unger; Back in Control Radio Show with Dr. David Hanscom, MD; Connecting with Coincidence with Dr. Bernard Beitman, MD; Dick Tracy; Dimension X; Exploring Tomorrow Radio Show; Flash Gordon; Imagine More Success Radio Show with Syndee Hendricks and Thomas Hydes; Jet Jungle Radio Show; Journey Into Space; Know the Name with Sharon Lynn Wyeth; Lux Radio Theatre - Classic Old Time Radio; Mission Evolution with Gwilda Wiyaka; Paranormal StakeOut with Larry Lawson; Ray Bradbury - Tales Of The Bizarre; Sci Fi Radio Show; Seek Reality with Roberta Grimes; Space Patrol; Stairway to Heaven with Gwilda Wiyaka; The 'X' Zone Radio Show with Rob McConnell; Two Good To Be True with Justina Marsh and Peter Marsh; and many other! That's The ‘X' Zone Broadcast Network Shows and Archives - https://www.spreaker.com/user/xzoneradiotv
Hour 2 of The Dawn Stensland Show: Thomas Hogan—former District Attorney of Chester County & Federal Prosecutor—joins the show to discuss his latest editorial on RealClearPennsylvania, “Philadelphia District Attorney Krasner Erases History.” Hogan documents DA Larry Krasner’s puzzling decision to reduce the sentences of criminals charged with second-degree murder in a car theft incident that led to the death of four people, including two children and a newborn baby. On Monday, Philadelphia District Attorney Larry Krasner held a press conference addressing the weekend’s South Street shooting. During the press conference, Krasner blamed the National Rifle Association (NRA) and elected officials who take money from the “gun lobby.”

Private planes. Thousand dollar suits. Yachts. Russian spies. And a lie -- that the solution to gun violence was just "a good guy with a gun."A one time nonprofit group meant to encourage marksmanship and sports shooting, by the new millennium the National Rifle Association (NRA) had become "a powerful lobbyist organization that maintained an iron hold on gun legislation in America." And at the head of that changed organization sits CEO Wayne LaPierre, a man who has remained the NRA's figurehead despite decades of mismanagement and corruption. In this episode, hosts Kelly and JJ are joined by journalist Tim Mak, who spent over four years investigating the NRA, including but not limited to the dissolution of their relationship with marketing firm Ackerman-McQueen, the NRA's involvement with Russian spies, and gross money mismanagement by top NRA officials. All is revealed in Mak's new book, Misfire: Inside the Downfall of the NRA. TWO TO THE BODY, ONE TO THE HEAD.Sounds like a trainer telling a boxer how to attack his opponent, does it not? Actually, it's one woman giving instructions as to how to shoot a gun in self-defense, to another woman. It has come to just that, my fellow Americans, in our very own beloved country. Women by the tens of thousands are concerned with their safety, sexual abuse, harassment and domestic abuse as well. If, they say, the police will not protect them, they will have to find a way to protect themselves. Owning and being able to skillfully use a weapon in self-defense is for many the very best way to do just that. Studies show that some 3.5 million women became gun owners from January 2019 through April of 2021. That is an all-time high number of women self-purchasing and in so doing, they make the statement that:ENOUGH IS ENOUGH.Much of this female angst can be attributed to fears driven by the COVID-19 pandemic and the racial protests, so often accompanied by violence. Since the killing of George Floyd, say many, our country has been divided and there is a divisive and dangerous atmosphere which exists in so many parts of America.Among these new women gun owners, 21% were Black and 19% were Hispanic, themselves concerned for their safety and that of their families. Women sought training in the use of firearms and went to places like GIRL AND A GUN, a San Diego chapter of female training in the use of firearms founded by one Judi Wells. She was the altar of that memorable saying: TWO TO THE BODY, ONE TO THE HEAD!Chapters like this advise women as to how to prepare and file background check information, the type and gun most suitable for them to purchase, securing a carrying permit and then most importantly, training in the use of the weapon. It is physical and psychological protection for so many women. One woman, Kanisha Johnson, was shot by her husband and almost killed in the process. Ms. Johnson said the following:“If any type of situation like that ever happens again, I just want to be better protected.” Another woman sought training in firearm usage after she had watched protests against police brutality devolve into looting and burning cars in a neighboring San Diego suburb. She and others like her were greatly concerned that so many aggressive movements nationwide to DEFUND THE POLICE would lessen the ability of law enforcement to render efficient and timely protection when necessary. Said yet another new female gun owner:“You drive into a riot, which we have seen on TV, at least you have a fighting chance.”So many women are intimidated in the purchasing of a weapon for they are usually large and cumbersome for female usage. The gun industry has tried to address that problem by adopting a manufacturing strategy which they termed:SHRINK IT AND PINK ITProducing smaller hand guns in brighter colors. There is indeed anger in many parts of America against the police and law enforcement of all sorts. As a result, police officers resign with regularity and private security seems on the grow. Crime in some cities, like Minneapolis, Philadelphia, and Chicago is on the rise. In Philadelphia for example there are now more than 415 murders in nine months and there are seemingly little that the police can do to prevent more. The problem of the actual crimes themselves is compounded by District Attorneys who are soft on crime, do not prosecute diligently, recommend lenient bail, and early release from prison. If say so many women everywhere, and especially those who are city-dwellers, the police will not protect us, we will protect ourselves. Gun purchases, sometimes more than one per person, are at an all-time high the country over. There is also considerable concern on the part of many that there will be constant attacks on the second amendment of the Constitution which allows the right of any American citizen to purchase, own and use for self-defense, weapons virtually of any kind. The NATIONAL RIFLE ASSOCIATION (NRA) now more aggressively than ever defends that second amendment and has been an active participant in encouraging women to purchase guns and to learn how to use them for self-defense. That encouragement, hopefully followed by membership in NRA, has prompted literally millions of women to purchase weapons.Scriptures tell us that, as Christians:THOU SHALT NOT KILL.However, it does not say anything about killing in self-defense. There are men and now an ever-growing number of women who will adopt any means to protect their family, their spouses or children, their homes and possessions. One woman stated that if a criminal entered her home uninvited and intent on harm, she will not hesitate to kill in self-defense. The philosophy of such protection is the saying:TWO TO THE BODY, ONE TO THE HEAD!What is your thinking. Do you or any member of your family own a gun and are you trained in the usage there of? Would you use that weapon in self-defense which would result in the killing of another human-being, would you? Christians shun violence, but would you stand by and allow your young daughter to be abducted or molested, your spouse brutalized? Would you do nothing to defend or protect yourself if you were attacked knowing that you were about to experience serious and physical harm, would you? Most of us would wish to avoid such problems but if we were found in harm's way, I would suspect most of us would stand up and defend with whatever means necessary especially with family, loved ones and friends, wouldn't you?I for one on the other hand, do not own a gun and never will. I do not like them, and in fact, I am afraid of them. I could never kill another human-being. And there are many like me. What is your thinking and belief? Would you own a weapon and kill a criminal intent on harm, would you? Even though I would never own a gun, I am a fierce proponent and defender of the second amendment. Owning weapons for self-protection is the very second constitutional right granted to all American citizens. That right should never be taken away, never. The world plummets towards lawlessness and the sanctity and safety of the family is critical. You should think about your position carefully. As the police are defunded, as the military faces steep cuts, as judges and legislation go soft on crime and criminals, the world has changed and radically so. To lay down a life is the greatest sacrifice say the scriptures. But the new women gun owners of today, by the millions, say they may lay down their lives but:NOT WITHOUT A FIGHT AND A GUN!Not without two to the body, one to the head.

We Hire a Republican Lobbiest Big Cat Rescue hired a Republican lobbyist, Jason Osborne to assure Republicans that this is a bipartisan bill where everyone can agree that big cats don't belong in backyards and basements. Howie had met him and gave he and his family a tour during the Republican Convention when it was in Tampa as Jason was the Director of External Affairs for the 2012 Republican National Convention. He was also the Senior Federal Liaison for the National Rifle Association (NRA) from Aug 1999 - Jan 2006 and was responsible for NRA-related issues before the U.S. Senate and House Appropriations and Budget, Ways and Means, Finance Committees, Department of Homeland Security, Department of Justice, and the Office of Management and Budget. This guy knew some Republicans and was loved by the NRA so he could reach the other side of the aisle for us on this issue that he really cared about; which was protecting tigers. Every one of our Republican co sponsors since then has been by our combined efforts as most of the other Big Cat Coalition members just don't have good relationships with Republicans due to their campaigns against the farmed animal industry. Hi, I'm Carole Baskin and I've been writing my story since I was able to write, but when the media goes to share it, they only choose the parts that fit their idea of what will generate views. If I'm going to share my story, it should be the whole story. The titles are the dates things happened. If you have any interest in who I really am please start at the beginning of this playlist: http://savethecats.org/ I know there will be people who take things out of context and try to use them to validate their own misconception, but you have access to the whole story. My hope is that others will recognize themselves in my words and have the strength to do what is right for themselves and our shared planet. In the past 50 years, the National Rifle Association (NRA) evolved from being a nonpartisan hunting and sport shooting enthusiasts' organization to a political and lobbying powerhouse. The NRA's work has had a huge impact on not just American gun culture, but on American policy and legislation related to gun violence prevention. To trace that evolution, and it's impact, hosts Kelly and JJ are joined by a beloved friend of the pod, gun violence prevention advocate (and father of Jesse and Jaime) Fred Guttenberg, as well as a new friend -- award-winning director and producer Judd Ehrlich of Flatbush Pictures. Together, we discuss Judd's newest film, the Price of Freedom, which explores the role the NRA and the gun lobby has had in America's gun violence epidemic. Most Americans are familiar with the National Rifle Association (NRA), as it is one of the most visible and powerful special interest groups in the US. On this podcast we've discussed numerous times that the NRA -- and NRA backed politicians -- have weakened existing gun laws or trompered over new, life-saving legislation. But how does the NRA manage to run such a powerful group, despite a history of mismanagement? Hosts Kelly and JJ are joined by Dr. Matthew Lacombe, author of the book Firepower: How the NRA Turned Gun Owners into a Political Force, to figure out how the NRA gained such influence within national politics. Join us as we discuss Matthew Lacombe's work (which traces the NRA from 1930 to 2020) showing how the NRA has carefully and purposefully created a distinct identity around gun ownership, which in turn has made its followers a potent political force.Mentioned in this podcast:US gun control: What is the NRA and why is it so powerful (BBC)The NRA is a powerful political force — but not because of its money (Vox)How NRA's true believers converted a marksmanship group into a mighty gun lobby (Washington Post)The NRA is down, but not out (Brady)Mentioned in this podcast:US gun control: What is the NRA and why is it so powerful (BBC)The NRA is a powerful political force — but not because of its money (Vox)How NRA's true believers converted a marksmanship group into a mighty gun lobby (Washington Post)The NRA is down, but not out (Brady)Help support the podcast and Brady's mission by clicking here! For more information on Brady, follow us on social media @Bradybuzz or visit our website at bradyunited.org.Full transcripts and bibliographies of this episode are available at bradyunited.org/podcast.National Suicide Prevention Lifeline: 1-800-273-8255. The Second Amendment FoundationStephen Willeford pt 3Back on November 5th of 2017, we all seen the news reports of a gunman involved in a mass shooting at a church in Sutherland Springs, Texas that left 26 people murdered inside the First Baptist Church of that town. A neighbor of the church, hearing the gunfire, took action, grabbed his rifle and ran barefoot out of the door and engaged the gunman as he was exiting the church. That man, Stephen Willeford, is our special guest today. After helping stop the deadliest mass shooting in the history of Texas in November 2017, Stephen has become known across the country as the “good guy with a gun.” Stephen credits his unwavering faith and penchant for preparedness as to why he was able to step in during this critical incident, believing that each day of his life prepared him for what happened on that Sunday morning. Stephen has begun speaking publicly about his life and experiences, even delivering a lauded speech at the National Rifle Association Convention in May 2018. Because of his selfless service to his community, Stephen was also an honored guest of members of the Texas delegation at the 2018 State of the Union address in Washington, D.C. He is a member of the National Rifle Association (NRA), was an NRA-certified instructor and a former assistant scoutmaster with the Boy Scouts of America. He is also a spokesman for the Second Amendment Foundation, the nation’s oldest and largest tax exempt education, research, publishing and legal action group focused on the Constitutional right and heritage to privately own and possess firearms. Because of this event, you have been doing public speaking and even helping the Governor of Texas, Greg Abbot, on a special commission. How long have you been involved with the Second Amendment Foundation? With all of the cancel culture going on in America right now, our rights are under attack like never before. And there is a huge push going on to either eliminate or limit our Constitutional rights under the Second Amendment. Tell us about the work that the Second Amendment Foundation is doing in our nation right now? As a spokesman for the Second Amendment Foundation, have you seen interest in your organization growing, what with all of the efforts to take away our 2nd Amendment rights? I know it must cost huge amounts of money to fight all of these cases, individually, all across America. How can someone make a donation or become an active member of the Second Amendment Foundation? Are there local chapters that people can become personally involved in? Attend in person meetings, etc.? Stephen, I do appreciate the work that you and all of the team at the Second Amendment Foundation are doing. This is such vital work that you are doing. If it were not for your organization and others like it, like the NRA, etc., we would already be a nation gone under. Folks, I cannot emphasize how important it is to support the Second Amendment Foundation. The work they do, all over America, standing up for your Constitutional RIGHT to “keep and bear arms;” The victories they are gaining in courts across this land; the precedents they are setting in legal victory after legal victory – well, they are doing it for one reason – YOU. If the powers that be in this nation had their way, they would strip you of ALL of your Constitutional rights. In fact, Joe Biden has already said that there are no absolutes when it comes to your Constitutional rights. I urge you to get in touch with the Second Amendment Foundation and donate to their cause, which IS your cause. Help support them, join their organization. Stand for the rights handed down to us by our Founding Fathers. Just click the link below to get in touch and make a donation. Amen! A neighbor of the church, hearing the gunfire, took action, grabbed his rifle and ran barefoot out of the door and engaged the gunman as he was exiting the church. That man, Stephen Willeford, is our special guest today. Stephen Willeford was raised in a family of five on a dairy farm near the First Baptist Church. Stephen has always relied on his faith to guide his life, and his deep roots in Sutherland Springs are a product of his family’s commitment to their community. An avid sportsman, Stephen began shooting at a young age and honed his shooting skills by participating in shooting competitions as he grew older. Help me welcome to the program, Stephen Willeford. Stephen, thank you for taking the time to join us today. First question, other than that brief information I just shared, can you tell us in your own words, “Who is Stephen Willeford?” I know your background was deeply involved in the NRA. You were a certified NRA firearms instructor, etc. In your opinion, how did you all of that come into play when your daughter first told you she heard shooting coming from across the street? From the time you exited your house, how long was it before you seen the gunman? What was the approximate distance between you both? You reference what happened to “David and Goliath.” Tell us about that reference… Folks, I cannot emphasize how important it is to support the Second Amendment Foundation. The GOA took issue with the NRA over the 2007 NICS Improvement Act.[4]The GOA has been described by Congressman Ron Paul as "The only no-compromise gun lobby in Washington." The Republican Party whose leader is Donald Trump, incited a riot on the US Capitol in Washington DC on January 6th, 2021. Trump who lost the November 3, 2020 general elections refused to accept the results and mounted challenges in battleground states at every judicial level. Through social media he radicalized fringe elements of the Republican Party and invited them to Washington to fight on his behalf, to have the election results decertified. All the while the Republican establishment was radio silent as trump dangerously incited a riot. Terroists stormed the Capitol, calling for ‘Hang Mike Pence’ to vice-President Mike Pence, trump’s second-in-command, stormed the offices of Speaker Pelosi, rummaging through the hallowed halls of Congress, armed to the teeth, with every weaponry lobbied for by the National Rifle Association (NRA) screaming for members of Congress. The Republican Party decimated the sanctity of the halls of Congress and invited rioters to storm it. Own it. --- Send in a voice message: https://anchor.fm/harrietcammock/message Support this podcast: https://anchor.fm/harrietcammock/support

Photo Credit: Matthew Cipican I'm pained to open with the platitude that these are unprecedented times. We all already know that and belaboring it for the purpose of a proper opening paragraph seems to belittle the magnitude of the moment. The truth is that I've been having a hard time coming up with the right place to start the next conversation on this blog. I had developed a publishing schedule for Making Special Education Actually Work just before the pandemic hit and the schools in California, where we are headquartered, shut down. All of that went out the window the moment the shutdown started and I've since published some bits about how to respond to the situation based on what was known at the time of each publication, but how things have continued to play out, or not, from one school district to the next has been nothing short of pandemonium. Some of my kids have done so much better with distance learning that they never want to leave their houses again. Others have regressed so greatly since the shutdown started that it's going to take years to undo the damage that has been done and catch them up to the degree its possible to do so. Each kid, as a unique individual learner, has experienced the shutdown differently, but all of them are experiencing the same procedural violation at the hands of their Local Education Agencies (LEAs): Failure to implement the Individualized Education Program (IEP) as written. Or, framed in the language of the regulations, failure of the education rendered to conform with each student's respective IEP. In California, the State has already assumed that compensatory remedy will be due to most, if not all, of its special education students because of the shutdown. None of the laws changed. There are permissible, though narrow caveats, in the law that provide for extenuating circumstances. While the implementing regulations of the Individuals with Disabilities Education Act (IDEA) mandate the application of evidence-based science to the design and delivery of special education on a child-by-child basis, it is only to the degree that the application of the science is practicable. LEAs bear the burden of proving that the delivery of a special education service is not practicable before denying it and giving notice of such via a Prior Written Notice (PWN). The real dispute, it seems, is over what is realistically practicable given the circumstances, but that first requires us to operationally define what we mean by practicable, and that's a problem. There is no legal authority or professional standard for what defines "practicable" within the context of 34 CFR Sec. 300.320(a)(4). I know this because the operational definition of "practicable" was one of the burning questions I had when I went back to graduate school in 2011 and had answered by the time I graduated in 2013. The truth is that there is no operational definition in the scientific literature or the case law as to what is meant by the term, "practicable." Even Perry Zirkel was stymied by this question and ultimately concluded that most courts interpreted the definition of "practicability" as something to be left to the discretion of local education agencies - meaning, really, top administrators and board members, who are all politicians - get to decide what is and is not practicable as a matter of local governance. In those LEAs, "practicable" just means "if the LEA wants to." This, of course, neglects the fact that 34 CFR Secs. 300.320-300.324 vests the authority in IEP teams, which include the parents, to make determinations as to what is educationally necessary and, therefore, the obligation of the LEA to provide to each given special education student. If that authority is vested in the IEP team, then no one from the LEA on the IEP team should have to go get the approval or permission of a superior outside of the IEP meeting, particularly when that superior has no direct knowledge of the student's unique needs or the IEP team's discussions about them. Whether or not something is practicable should be an IEP team decision, not an internal policy issue, yet the research that has been done suggests its a call to be made by top administrators, not individual IEP teams that include the students' parents. Further, 34 CFR Sec. 300.321(a)(4)(iii) mandates that each IEP team include at least one LEA representative who is "knowledgeable about the availability of resources of the public agency." Usually, this is an upper-level administrator from the main office who not only knows what resources the LEA has, but has also been granted the authority to commit the LEA's resources to a student's IEP. This can come in the form of committing existing resources to the IEP as well as procuring those materials and services that are not already available through the LEA. I've been in IEP meetings during which such an administrator fills out and submits online requisitions for use of existing assets, as well as online purchases and purchase orders through their LEA's internal automated workflow system, during IEP meetings as the team agrees to things that are needed but not already on hand. It's not that uncommon and it goes a long way towards doing it right the first time. Again, there should be no going to someone else outside of the IEP process for permission or approval. In one fairly recent meeting I attended, the school district's administrator on the IEP team shared her screen with the rest of us so we could all look at our options on Amazon together as an IEP team and make the purchasing decision right there. Then, "click," it was ordered and the student had his accommodations the next day. Easy peasy. The law does not provide for the IEP team's authority to be displaced by or shifted to an uninvolved third party. If no one on the IEP team from the LEA knows whether the LEA already has the necessary resources available or will need to purchase stuff it doesn't already have, it's not a real IEP team. Because these decisions are IEP team decisions, and not the decisions of removed administrators who are motivated by factors other than the individual needs of each special education student, deferring to top administrators to determine what is or is not "practicable," opens the door for a litany of procedural and substantive errors that will quickly create due process claims against the LEA. It behooves no one for LEAs to play this game, but plenty of them do. Competent people have no motivation to do sketchy stuff and lie about it, so when you encounter this kind of behavior, it's because you're dealing with people who don't know what else to do and/or are crooked through and through. What we are all now going through as a nation under the current presidential administration is a reflection of the crap I've been dealing with for nearly 30 years in special education local governance. None of this is new to me, it's just now happening on a national scale. Maybe everybody outside of the special education community will finally believe me about this crap, now. More often than not, what is deemed by an LEA as not being practicable is likely better framed as being something for which the LEA is simply not willing to expend the necessary funds. While it is unlawful under the IDEA to use fiscal considerations to determine the contents of a student's IEP, it happens all the time. The language of IEPs are often deliberately kept vague and weak so that they are difficult to enforce or so that it is otherwise difficult to say that the education rendered failed to conform with the IEP. I'm seeing this happen in a way with 1:1 behavioral aide support services, right now. I've got families barely holding it together, stuck at home with their severely impacted children who have serious behavioral challenges arising from their disabilities. They'd give anything for in-home 1:1 behavioral services, right now. And, that's the thing: they should already be getting it under the existing laws. On August 24, 2020, (the day before this post), the California Office of Administrative Hearings, which tries special education due process cases within the State, issued an order making clear that students who require in-person services in order to access and benefit from their educations, including during distance learning, must receive such services according to medically acceptable safety procedures regarding COVID-19. Behavioral services are medically and educationally necessary, the California Department of Education (CDE) has advised that in-home services during the shutdown may be necessary in order for LEAs to comply with their IDEA requirements under the law, and, now, OAH has ordered a school district to provide in-home services as a matter of stay-put during the shutdown. This is huge! This settles the argument once and for all. I know of at least one student who is currently getting in-home behavioral services through his health insurance, which is the only reason he was able to participate in distance learning during the last half of the Spring 2020 semester. The same agency currently serving this student through his health insurance had previously served him as a Non-Public Agency (NPA) under his IEP in the public school setting. Same people, different funding source, different willingness to send personnel to his house for in-home, 1:1 behavioral aide services. His school district has offered to provide an aide online during distance learning, like somehow that's going to produce the same educationally substantive outcome of getting him to engage in the online instruction in the first place and remain engaged throughout each lesson. The boy needs an in-person 1:1 aide in order to access the instruction at all. How is he supposed to access online aide support when he needs in-person aide support to access any kind of online services? And, he's one of many students on my caseload with similar needs; he's just the only one I know of currently living the experience of having the in-person 1:1 aide support during shutdown and being met with educational success because of it. Everybody else is asserting the need for it, but not getting it, and due process cases are popping up everywhere now, including among my students for whom I never thought litigation would realistically come to fruition. The legal authorities favor special education students on this issue, and school districts in California are now having to weigh the risk of litigation from unionized employees against the risk of litigation from parents of students with special education needs as this whole debacle clatters forward in the absence of unified leadership across the State's public education system. Many districts are still clinging to outdated paint-by-numbers procedures and fill-in-the-blank on standardized documents and forms, aiming for procedural compliance without thought to the substantive considerations ... like providing 1:1 aide support via Zoom to a student who needs in-person support in order to access instruction via Zoom in the first place. It's like they think conforming with the IEP in any way complies with procedure, even if it entirely fails to meet the instructional purpose it's supposed to serve from a substantive standpoint. The real tragedy, here, is that these paint-by-numbers bureaucrats don't understand how to act according to the substantive needs of the student; they just want to know which form they are supposed to use. This significant subset of the public workforce may have memorized many of the procedures for the job and can usually find the right form to use, but don't ask them to actually engage in deductive reasoning, creative problem-solving, troubleshooting, or solution-seeking. They simply can't. They don't think that way. And, the human resources department didn't recruit for people who can think for themselves on purpose. The middle management jobs require drones who respond to authoritarian hierarchies of leadership and do not question the orders they are given, if the system is going to function according to its bigoted design. And, that is how it has been functioning for the last few decades following the passage of federal civil rights laws, including disability-related laws that first started passing in the early 1970s, up through the Americans with Disabilities Act (ADA) in 1990. Those laws were necessary because the public education system, among others, was actively discriminating against children with disabilities, including denying them even enrollment. The public education system was already discriminating against students with disabilities or the laws would not have become necessary. When the laws passed and the public education system was ordered to comply, those individuals who had been philosophically opposed to accommodating learners with disabilities were still employed by the public education system, by and large. They didn't all leave. Many stayed and have been sabotaging it from within this entire time. And, they recruit people who are too incompetent to realize they're being used and/or too afraid of losing their jobs to dare question what is really going on, so they can maintain positions of authority and control according to their own fascist belief systems rather than their mandates under the law. One of the most powerful things to come out of the current state of affairs in this country is the cracks in the publicly funded systems that people like me have been squawking about to no avail for decades, but which can no longer be denied by the masses. As we move forward to rebuild a better America in the wake of the destruction currently happening all around us perpetrated by people with way more authority than they can responsibly handle, it is painfully obvious that we have a disturbingly large swath of the adult population that "pass" as competent adults but who actually are not. These individuals occupy a great many niches of society, including in the public sector. Their approach to leadership, when they are allowed into offices that require more of them than what they possess, is destructive. It can ruin a child's future through educational malpractice at the local level or fan the flames of a global pandemic and domestic terrorism at the national level until it ravages the entire nation. These individuals place cronyism over science because they are not smart enough for the science and, frankly, they're not smart enough to cover the tracks of their cronyism. They have simply had the power of money behind them and those without money have had to tolerate their malarkey as a matter of survival. But, now that tolerance doesn't even achieve survival for those without, so they aren't motivated to tolerate the malarkey anymore. Look out Marie; here comes the guillotine. Society has finally had its fill of incompetent bullies acting like they are better than the rest of us to the detriment of us all and for no other reason than to stroke their own egos and line their own pockets. We have become aware that they are too dimwitted to realize the harm in what they are doing and too selfish to have any sense of compassion or empathy for the people they hurt. These individuals are emotionally still children, trapped in their bodies for decades without maturing, thinking their chronological age and changing external appearance are all of what earns them respect as adults, and often unable to fully engage in adult-level problem-solving and critical thinking tasks, but able to develop academic and/or professional skills that can otherwise allow them to "pass" as competent. These are high-functioning individuals with significant impairments in judgment who engage in intuitive rather than deductive reasoning. Intuitive reasoning is age-typical in young children. It's indicative of an impairment in adulthood. It co-occurs with egocentric thought, in which the individual is incapable of engaging in perspective-taking and appreciating the experiences and viewpoints of others. An egocentric person is the center of their own personal universe. Everyone else is just an object in orbit around them who may or may not serve a useful purpose at times and is only accessed when the egocentric person thinks an individual is useful. The egocentric person recognizes his/her/their own agency - that is, the ability to act upon the world to produce intentional outcomes - but they struggle to appreciate the agency of others. They tend to only perceive other people relative to their own thoughts and feelings and fail to consider that other people have their own thoughts and feelings that are each different from one person to the next. Egocentric people tend to assume that whatever they are thinking and feeling is what everybody else is also thinking and feeling, and/or that everyone else's decisions are made with the egocentric person in mind. The egocentric person struggles with perspective-taking, which requires that they first understand the agency of others and that everyone is preoccupied with their own thoughts and feelings, not making the egocentric person the focus of their every decision. Errors of omission and thoughtless, inconsiderate acts by others are perceived by egocentric people as deliberate efforts to cause harm or offense to the egocentric person. Because egocentric people assume that whatever they want and need is automatically understood by everyone else, which is because they assume everyone else is thinking and feeling the same things they are, if everyone else fails to deliver according to an egocentric person's expectations, the egocentric person attempts to force the desired response to present itself. Because they lack the emotional intelligence to navigate many types of complex situations involving other people, whatever cognitive abilities they may actually have don't do them much good. They make errors in judgment when it comes to how they interact with other people; how well they can do math, design a building, or research historical biographies just doesn't matter in that moment. When people like this become employed within the public sector and have to make policy decisions, they are incapable of putting themselves into the shoes of their constituents and engaging in legitimate representation and advocacy for services that meet the of needs of those they have been hired to serve. Because of their egocentrism, the job is a means to a self-serving end. Also because of their social/emotional developmental impairments, their ability to actually engage in adult-level problem-solving as required by their positions is equally limited. Because they can't actually meet the performance requirements of the job, they find ways to socially engineer their ways to the top, including taking credit for the accomplishments of their subordinates while sycophantically leeching onto the coattails of those who have grifted their way up the food chain before them. They all keep each other's dirty little secrets about not actually being able to do their jobs and abusing their positions of authority to the benefit of the highest bidder, be the currency money, power, or both. Eventually, an emperor emerges from the mix, some traveling salesmen weave him a in invisible robe from gold thread that, allegedly, can only be seen by competent people, and, as he's parading down the street in this magical garment, a child points out that he's actually just a naked guy played for a fool by a couple of con artists who have since skipped town with a fortune in gold thread. I'm paraphrasing the parable, here, of course. The problem is that a public institution can become such a hopelessly dysfunctional system that it's really better to take it down the way the Attorney General (AG) of the State of New York is trying to take down the National Rifle Association (NRA), right now. When the corruption runs as deep in a public agency as New York's AG asserts is the case with the NRA, it's better to scrap everything and start over with all new people and a new method of operating that conforms to the appropriate standards. Sometimes the well becomes so hopelessly poisoned that it's just time to dig a new well. I think America is at that crossroad in a very broad and general sense. We are at the tipping point of a crisis of conscience. Who do we want to be? The cronyistic incompetents who stab each other in the back over superficial slights, engage in power grabs like reality TV show contestants, and are utterly detached from and incapable of living up to the responsibilities of the job? Or, the hard-working, methodical, responsible adults who understand and are humbled by the responsibilities before us, know that our efforts to do things right will pay off in the long run but we're going to have to struggle in the short term to clean up the messes we've collectively made? So many people who came before us fought and died so that we could have the freedoms and legal tools to save our democracy, right now. I have been fighting this fight since the 1990s, but I have also lived the reason for this fight as a twice exceptional student who was never identified for any kind of services or accommodations for my processing disorder when I was a K-12 student. During the 1970s and 1980s, when Section 504 and what is now known as the IDEA were new, they were not being implemented by the overwhelming majority of public schools in the United States at the time, and certainly not in Louisiana and Arkansas, where I grew up. I was briefly put on Ritalin in my early elementary years. But, who wasn't, back then? I was later diagnosed with "minimal brain dysfunction" in junior high as the result of a quest for a reason why I couldn't walk in heels (there was great social pressure on females in the Deep South at the time to wear pumps with everything, including jeans). I had to do physical therapy to stretch out my hamstrings and heel cords from all the years of toe-walking I'd done (which, by the way, toe-walking can be a neurological soft sign of autism). My vestibular sense and my proprioception were jacked. My reflexes were/are abnormal. I can distinctly remember having visual processing issues that made it such that my brain couldn't piece together what I was looking at to make a picture of the world that made any sense. Abstract shapes would slowly resolve into a singular whole that then made sense, but I can remember having to wait for that visual resolution to occur at the brain level before I could start understanding what was happening around me. My eyes could see, but there was lag time between when I looked at something unfamiliar and my brain was able to put the shapes together in a cohesive way that I could understand. My last recollection of that happening to me was around 8 or 9 years old. I can remember it happening a lot prior to then. I also had very bad vision, so it could have been that my brain didn't get the requisite practice at piecing together the parts of what I saw into a cohesive whole until I got glasses and could actually see everything clearly. I don't have ADHD; I have ADH - Oooh, shiny! I also have mild hearing loss due to a condition that runs in my family. My dad and many of my cousins have hearing aids. I haven't gotten to that point, yet, but it's coming, eventually and that's okay. Worse things could happen; hearing aides don't ruffle my feathers in the least. I'm just not spending the money until I have to. The point is that I had a mixed bag of processing issues as a kid that was somewhat offset by my processing speed, but not enough to make me academically successful. I know what it's like to have my potential wasted by people who don't understand my needs as a developing child. The adults in my life cared, but were at a loss as to what to do because the science just wasn't that good or well known at the time, and certainly not where I grew up. They couldn't begin to abide by the relatively new civil rights and special education regulations; the science behind it was way beyond them. They didn't know any of that. But, that was a long time ago. We don't have those same excuses, now. Adults like me who used to be those struggling students decades ago are everywhere now in public education advocacy, rights, and reform efforts. We know first hand why it's so important for the public education system to engage in person-centered planning for every student, not just those identified as having something "wrong" with them. We also understand why it is so important to identify those who do have exceptional needs, and meet those needs, so these students have equal access to learning as that given to their peers without exceptional needs. We understand why it is so important to address the disabilities of our twice-exceptional students while simultaneously nurturing their gifts. Last year, Kodi Lee brought the point home to the lay public, which had not had any similar prior exposure to twice-exceptional people, and certainly not one so impactful. No matter how impaired someone may present, the public learned to never assume that such a person's presentation accurately captures all of who that person is. Kodi humbles people in the kindest, most innocent, and inadvertent way, which is what makes him so powerful. He isn't trying to ram a message down anyone's throat. His existence is the message; he lives it for the rest of us to observe and copy. Kodi is a powerful living metaphor to not judge a book by its cover, which has been a recurring lesson born over the last few years of these talent competitions happening around the globe that he simply drove home with an exclamation point. The cultural norms surrounding public opinion of people with disabilities have tipped strongly in the direction of inclusion by the display of capability and superior abilities by contestants with a wide variety of impairments in these competitions. Leave it to the entertainment industry to be the agent of change. If we live in a shallow culture in which life imitates art, then art should model appropriate behavior, such as inclusion. I'll say this for Simon Cowell: he made inclusion marketable and profitable by allowing talented people to be defined by their acomplishments rather than their limitations. At the end of the video clip of Kodi Lee's first audition for America's Got Talent, after winning the Golden Buzzer, the judge who had awarded it to him, Gabrielle Union, told him straight to his face, "You just changed the world!" and she wasn't lying. This is part of the brave new world that is to come as we rebuild our public education system to meet the needs of today's students in the 21st Century, including the flexibility to rapidly adapt to changing lifestyles, national emergencies, job market demands, and advancing technologies. All of these things will continue to collectively alter how we teach and manage the teaching process according to best practices, and continue to engage in ongoing research to continually improve those processes and their supporting administrative procedures. Which circles us back around to the issue of stay-put and the recent stay-put order from OAH, linked to above. While the order is limited to California, it is germane to a federal district court case being tried in the Central District of California in which the plaintiffs, which include parents of children with extreme special needs who are not getting the 1:1 in-person services required by their IEPs, are suing the State over school shutdowns and attempting to get a federal court injunction that allows school districts to decide whether to reopen or not. Not surprisingly, the case originates out of Orange County, California, which has a large extreme right population relative to the rest of the State and is, not coincidentally, also a COVID-19 hotspot within the State. COVID deniers abound and are having a deleterious impact on local governing decisions as they impact public health. For a lawsuit disputing the legality of school shutdowns over a legitimate public health crisis to emerge from this climate is not exactly a shock. Not also surprising is the rampant special education violations and related scandals that have plagued Orange County for decades. Egocentrism is confused with personal civil liberties, and the welfare of others is beyond comprehension, resulting in extremist beliefs and behaviors. It is not shocking to me that school board members who have been actively violating special education and civil rights law convinced a bunch of parents who they were actively screwing over to join them in a federal lawsuit against the State to force the schools to reopen in order for their kids to access services. If you read the plaintiffs' complaint compared to the legal authorities I've already cited previously in this post, it's plainly evident that these people don't know what they are doing. I spoke with the State's lead attorney on the case last week and shared the arguments I've now presented in this post with her. While the judge has yet to decide the case, and, in fact, today is the filing deadline on briefs regarding the exhaustion requirements under the IDEA and the California Department of Justice (CADOJ) is on it, the nature of the questions the judge asked the parties to brief in his last minute order inclines me to believe that once those questions have been answered, we'll have a federal district court decision on the matter that will apply to every school district in California. The CADOJ's arguments must naturally rely in part on the arguments I've asserted herein. The federal district court judge will likely defer to the OAH stay-put order that was just issued yesterday, given that OAH has the authority to try special education cases and is, therefore, authoritative on how the law applies to the rights of special education students, special education students must exhaust their due process rights through OAH before filing in federal court (generally speaking), and it is proper for the federal court to defer to OAH's judgment, which will mirror the arguments I've been asserting this whole time and which CADOJ will also be asserting. They are aware of yesterday's stay-put order, as well, just in time to meet their filing deadline. Things are about to get a whole lot more okay for a lot of kids on my caseload. Whether their LEAs capitulate and provide the services or we end up going to hearing with the right kinds of legal authorities backing us up, either way, the rule of law is working slowly but surely and the application of the peer-reviewed research to the delivery of special education, now that reform is unavoidable, is about to enjoy a new era of advancement in the education of all students, not just our students with the most demanding needs. It's always darkest before the dawn. An extinction burst of escalated behaviors always comes before a maladaptive behavior finally becomes extinct. We are riding out one heck of an extinction burst on the part of incompetent people whose cronyism and transactional relationships have defined their realities and ours, and who cannot function in a more advanced, emotionally intelligent society that is moving increasingly towards meritocracy in which actual ability and earned achievements promote social status. Hucksterism has become obsolete. The Patriarchy is now rightly seen as a pack of egocentric ghoulish caricatures, not as dignified elites worthy of worship by everyone else. These moments will pass and we will have the power to make something new and better once we get to the other side. This latest stay-put order and, hopefully, the upcoming federal court decision, are incredible first steps in the right direction.

The National Rifle Association (NRA) is unique in American life. Few other civic organizations are as old or as large. None is as controversial. It is in no small part thanks to the NRA that US gun laws differ so wildly from that of every other developed nation. But, as Frank Smyth describes in his new book “The NRA: The Unauthorized History,” the NRA has evolved from an organization which supported most government-led gun control actions for the first 100 years of its 150-year history to one that resists any attempt to restrict firearm sales. Join us for a discussion of gun control regulation in America and the organization fighting the hardest to prevent it, in this installment of Leonard Lopate at Large on WBAI.

#Mueller May Have Quit, But The Democrats Won't Give Up On Their #Trump #Impeachment Dreams! Whos Campaign Does This Really Hurt? How Robert Mueller may have set the tone for the 2020 electionAs Mueller bows out, more Democrats call for Trump's impeachmentIf Robert Mueller thought his only public remarks since being appointed special counsel would put the Russian collusion allegations and Democrats' calls to impeach President Trump to rest, he was mistaken. If anything, Mueller's statement Wednesdaymay have assured that the debate over whether to impeach Trump will be a dominant issue heading into the 2020 president election.Speaking from the Justice Department, Mueller announced the closing of his office and told reporters he did not plan to testify before Congress. He explained that his team did not have the “option” to charge President Trump with a crime, citing longstanding Justice Department policy that a sitting president cannot be indicted. However, Mueller also stressed that there “was not sufficient evidence to charge a conspiracy” with regard to whether members of the Trump campaign coordinated with the Russian government during the 2016 presidential election. On the question of obstruction, Mueller said, “If we had had confidence that the president clearly did not commit a crime, we would have said that. We did not determine whether the president did commit a crime.” Prominent Democrats seized on Mueller's words to call for Trump's impeachment. House Judiciary Chairman Jerrold Nadler, D-N.Y., said that all options were "on the table" and that it was up to Congress to hold Trump accountable for any alleged crimes. 2020 Democratic presidential candidates such as Sen. Elizabeth Warren, D-Mass., Sen. Cory Booker, D-N.J., Sen. Kamala Harris, D-Calif., Rep. Seth Moulton, D-Mass., and Beto O'Rourke all called for impeachment proceedings to begin.Pelosi under new impeachment pressureHouse Speaker Nancy Pelosi, D-Calif., walked a fine line on Wednesday as she tried to assure party colleagues that lawmakersin the House will continue looking into impeaching President Trump, while advocating against rashness. Pelosi, speaking hours after Mueller's statement, praised his work but promised to continue investigating Trump. The House speaker has maintained that Democrats should not begin impeachment proceedings against Trump, but has faced increasing pressure from members in her caucus to reverse course. Fellow Democrats have accused Pelosi of holding off on impeachment for political reasons.Mystery over USS John S. McCain 'out of sight' directive as Meghan McCain blasts TrumpA mystery continues to surround a reported U.S. military email that called for the USS John S. McCain to be “out of sight” during President Trump’s recent visit to U.S. troops stationed in Japan, where the ship was docked. On Wednesday, both President Trump and acting Defense SecretaryPatrick Shanahan denied any knowledge of the order, which led to the ship’s name first being covered with a tarp and then being obscured by a paint barge prior to Trump’s visit over Memorial Day weekend. The Wall Street Journal, which reported the story, directlycontradicts Shanahan. The Journal cites an unnamed U.S. official as saying that Shanahan was aware and approved measures to ensure the ship did not interfere with the president's trip. The ship is named for the father and grandfather of the late U.S. Sen. John S. McCain III, with whom Trump had feuded prior to the Arizona Republican’s death from cancer last year at age 81.The Journal feature apparently infuriated Meghan McCain, daughter of the late senator, who tweeted, in part, the following: “Trump is a child who will always be deeply threatened by the greatness of my dads [sic] incredible life ... Trump won't let him RIP. So I have to stand up for him."Private company building border fence gets cease-and-desist orderA legal dispute unfolded this week between private contractors who have built a half-mile fence between a New Mexico city and Mexico, and the mayor of that city who is arguing that the fence didn’t get proper authorization. “We Build the Wall,” began construction of the border fence on private land in Sunland Park, N.M., last Friday using money raised through crowdfunding, the Dallas Morning News reported. The city shares a border with El Paso, Texas, and Mexico. The company had planned to finish construction by Friday, but Sunland Park’s Mayor Javier Perea said Tuesday that the 18-foot fence surpasses the city’s maximum height of 6 feet. On Wednesday, he issued a cease-and-desist order.CNN's Chris Cuomo faces backlash for appearing to mock armed rape survivorCNN anchor Chris Cuomo responded to several critics who slammed him Wednesday over a tweet they said appeared to mock a National Rifle Association (NRA) member and rape survivor. Kimberly Corban appeared in an NRA ad advocating her Second Amendment right after going into detail how she survived a rape when she was 20 years old. "I'm a mother of two, and if a predator or anyone else tries to harm me or my family, they have to come through my firearm first," Corban said. Cuomo reacted to the ad, tweeting "Only in America."TODAY'S MUST-READSGregg Jarrett: The two faces of Robert Mueller, and Trump's presumption of guilt.LAPD employee contracts contagious bacteria that causes deadly typhoid fever.Ashton Kutcher testifies in trial of alleged serial killer accused of murdering his friend.MINDING YOUR BUSINESSStocks slump to three-month lows, bonds rally, as recession fears rise with trade war.AOC's minimum wage push to land her behind the bar once again. This city is home to the 'nation's hottest housing market' this season.Follow @PeterBoykin on Social MediaTwitter: BannedFacebook: https://www.facebook.com/Gays4TrumpInstagram: https://www.instagram.com/peterboykin/Youtube: https://www.youtube.com/c/PeterBoykinReddit: https://www.reddit.com/user/peterboykinTelegram: https://t.me/PeterBoykin https://t.me/RealPeterBoykinParler: https://parler.com/profile/peterboykin/postsPolitiChatter: https://politichatter.com/PeterBoykinGab: https://gab.com/peterboykinDiscord: https://discordapp.com/invite/pyuPqU9Periscope: BannedSupport Peter Boykin's Activism by DonatingPatreon: https://www.patreon.com/peterboykinPayPal: https://www.paypal.me/magafirstnewsCash App: https://cash.me/app/CJBHWPS Cash ID: $peterboykin1Listen to #MagaOneRadiohttps://magaoneradio.net/Join the #MagaNetworkhttps://themaganetwork.com/Read the Latest #MagaFirstNewshttps://peterboykin.com/https://magafirstnews.com/https://magaone.com/https://us1anews.com/Support Donald Trumphttps://votefordjtrump.com/http://trumploveswinning.com/https://marchfortrump.net/https://gaysfortrump.org/Join Our Groups on Facebook:MarchForTrumphttps://www.facebook.com/groups/MarchForTrump2020/https://www.facebook.com/groups/MarchForTrump/MagaOneRadiohttps://www.facebook.com/groups/MAGAOneRadio/https://www.facebook.com/groups/MagaOneRadioNet/https://www.facebook.com/groups/MAGARadio/https://www.facebook.com/groups/MagaFirstRadio/https://www.facebook.com/groups/MAGA1Radio/https://www.facebook.com/groups/MagaFirst/TheMagaNetworkhttps://www.facebook.com/groups/theMagaNetwork/GaysForTrumphttps://www.facebook.com/groups/gaysfortrump/https://www.facebook.com/groups/TheGayRight/https://www.facebook.com/groups/LGBTexit/https://www.facebook.com/groups/gaysfortrumporg/https://www.facebook.com/groups/DeplorableGays/https://www.facebook.com/groups/GaysForTrumpParty/Americans With Trumphttps://www.facebook.com/groups/AmericansWithTrump/North Carolina MAGA Networkhttps://www.facebook.com/groups/northcarolinamaganetwork/NC Trump Clubhttps://www.facebook.com/groups/NCTRUMPCLUB/Exit Extremismhttps://www.facebook.com/groups/EXITEXTREMISM/Vote For DJ Trumphttps://www.facebook.com/groups/VoteForDJTrump/Trump Loves Winninghttps://www.facebook.com/groups/TrumpLovesWinning/Straights For Trumphttps://www.facebook.com/groups/StraightsForTrump/US1ANewshttps://www.facebook.com/groups/US1ANews/https://www.facebook.com/groups/US1ANewsGroup/MyNCGOPhttps://www.facebook.com/groups/MyNCGOP/Grab them by the P***Yhttps://www.facebook.com/groups/GrabThemByTheP/Join Our Pages on Facebook:https://www.facebook.com/TheMAGANetwork/https://www.facebook.com/MAGAFIRSTNEWS/https://www.facebook.com/pg/MagaOneRadio-778327912537976/https://www.facebook.com/North-Carolina-MAGA-Network-307617209916978/https://www.facebook.com/GaysForTrumpOrg/https://www.facebook.com/LGBTExit-2340621102644466/https://www.facebook.com/Take-Back-Pride-American-Pride-Rally-386980035391880/https://www.facebook.com/PeterBoykinMAGA/https://www.facebook.com/MarchForTrumpUSA/https://www.facebook.com/VoteForDJTrump/https://www.facebook.com/US1ANews1/https://www.facebook.com/MYNCGOP/https://www.facebook.com/trumploveswinning/Contact Email:Peter.Boykin@TheMagaNetwork.comPeterBoykin@Gmail.comGaysForTrump@Gmail.comMagaFirstNews@Gmail.comTelephone Number:1-202-854-1320Demand Free Speech Reception: Trump Hotel July 3 w/@RogerStonehttps://www.eventbrite.com/e/demand-free-speech-reception-trump-hotel-july-3-wroger-stone-tickets-62233759851MagaGala.comEveryone I hope to see you in DC in July - Here's your chance to mingle with Roger Stone and other VIPs (TBA) at Trump Hotel July 3 - Demand Free Speech Reception Fundraiser 9:30pm - 11:30pm 2 hours open bar and great food! Trump Vs Biden Who Do You Think Will Win? Trump doubles-down on 'low IQ' attacks on Biden, targets past support of 1994 crime bill President Trump on Monday did not let criticism over his siding with North Korean leader Kim Jong Un in an attack on 2020 Democratic front-runner Joe Biden muzzle him. In fact, just before beginning his journey home from his trip to Japan, the president doubled-down on his attacks on the former vice president. “Kim Jong Un made a statement that Joe Biden is a low-IQ individual based on his record…I think I agree with him on that,” Trump said at a joint press conference with Japanese Prime Minister Shinzo Abe. Trump slammed Biden's support of a controversial 1994 crime bill, tweeting that he hasn't "apologized" for backing it.Trump claimed "anyone associated" with the bill "will not have a chance of being elected." The president tweeted that his own criminal justice reform legislation - the First Step Act - "had tremendous support" and "fixed" problems in the law Biden championed. The 1994 Violent Crime Control and Law Enforcement Act, signed by then-President Bill Clinton, was seen by many analysts as the culmination of efforts to fight violent crime. However, in the decades that followed, critics blamed the law for an increase in prison populations, among other problems.Trump not bothered by recent North Korea missile testsPresident Trump, in his press conference with Japanese Prime Minister Abe, said he didn’t think North Korea's recent short-range missile launches were a violation of United Nations Security Council resolutions, despite his advisers' beliefs otherwise. Trump said perhaps North Korean leader Kim Jong Un was trying to get attention. Both Abe and Trump national security adviser John Bolton agree North Korea violated U.N. resolutions and that sanctions must remain in place. In addition, Trump appeared to tone down his rhetoric on Iran and said the U.S. is not seeking a regime change just a week after he warned Tehran that a confrontation between the two countries would lead to its demise. At least 5 million in Ohio left without power after 'large and dangerous' tornadoA powerful storm system that included at least one tornado considered "large and dangerous"passed through Ohio late Mondaythat resulted in widespread damage, including 70,000 power outages currently affecting over 5 million people. Social media accounts claim to show a massive funnel cloud as it hit near Trotwood, Ohio, 8 miles northwest of Dayton. At least half a dozen communities from eastern Indiana through central Ohio suffered damage from the storm system, according to the National Weather Service. There have been no immediate reports of injuries or deaths.Japan stabbing attack leaves at least two dead, 16 hurtA knife-wielding man screaming "I will kill you!" attacked commuters -- mostly schoolchildren -- waiting at a suburban Tokyo bus stop during the morning rush hour Tuesday, killing at least two people, a schoolgirl and an adult man, according to Reuters, and wounding at least 16 others before he killed himself. Three of the injuries were serious while the others were not life-threatening,according to an official at the Kawasaki city office. Officials told NHK the suspect, believed to be in his 40s or 50s, attacked people near Noborito Park in a residential area of Kawasaki City. The number of wounded reportedly included 13 children. Television footage showed emergency workers giving first aid to people inside a tent set up on the street, and police and other officials carrying the wounded to ambulances.Avenatti's case of the Terrible TuesdayEmbattled attorney Michael Avenatti will have a busy day in Manhattan federal court Tuesday afternoon -- but as a defendant, not as counsel. Avenatti, 49, is scheduled to be arraigned on charges that he stole nearly $300,000 from adult film actress Stormy Daniels, the client who rocketed him to national prominence. Approximately three-and-a-half hours later, Avenatti is scheduled to be arraigned on charges that he tried to extort up to $25 million from athletic apparel giant Nike by threatening to expose claims that the shoemaker paid off high school basketball players to steer them to Nike-sponsored colleges. If convicted on all counts, Avenatti could face a total of 69 years in prison. Avenatti repeatedly has denied any wrongdoing and is expected to plead not guilty to all charges.NRA-opposed measure tests Texas governorA Texas gun storage safety measure added to a massive spending bill sets up a political test for Gov. Greg Abbott as the legislation heads to his desk, the Associated Press reported. The $1 million measure was added late Sunday by budget negotiators -- most of whom are Republicans. The bill was approved Sunday night by the GOP-controlled legislature. The campaign for safe home gun storage, just one part of the much broader $250 billion state budget, was fiercely opposed by the National Rifle Association (NRA) and gun-rights activists. Abbott, a Republican who has line-item veto power in regard to the budget, must decide whether to nix the measure or ignore pressure from some gun rights groups and approve it.TODAY'S MUST-READSPrivately funded organization 'We Build the Wall' starts construction of border barrier in El Paso area.Trump seizes on NYU professor’s tweet to push change of libel laws.Remembering Major League Baseball great Bill Buckner.MINDING YOUR BUSINESSNew auto giant? Parroting Trump's xenophobic rhetoric, Kemp has vowed to use his Ford pick-up truck "just in case I need to round up criminal illegals and take them home myself". In Florida, Tallahassee Mayor Andrew Gillum won the Democratic primaries to become the state's first African American gubernatorial nominee, mobilising support among young people, liberals and progressives, and white, Latino and black voters. Gillum promotes gun control and a repeal of Florida's deadly "stand your ground" self-defence law, a $15 minimum wage, Medicare for all, corporate tax increases to pay for public education, and the abolishment of the Immigration and Customs Enforcement. The Republican, Trump-endorsed governor candidate, Ron DeSantis, stirred controversy by using a racial slur in reference to Gillum's politics. This, as the current governor Rick Scott - a climate-change denier and darling of the pro-gun lobby who made Florida the "Gunshine State" due to its lax firearm laws - runs for the US Senate. Scott has received Trump's blessing but attempted to distance himself from the National Rifle Association (NRA) and from the president, also pandering to Latino voters with a Spanish-language ad conveying the message that he is not Trump. Latino voters, representing the fastest growing segment of the US population, are poised to influence elections in a number of states. In light of the deaths of nearly 3,000 people last year in Puerto Rico due to government inaction following the devastation of Hurricane Maria, mobilised and displaced Puerto Rican voters in Florida, New York and New Jersey could tip the balance in the midterms. Meanwhile, the separation of nearly 3,000 undocumented migrant children from their families due to a white supremacist "zero tolerance" policy at the Mexican border, and the revocation of citizenship and passports of Hispanic American citizens, are issues impacting Latinos in the border state of Texas. With its minority-white, non-Latino population still under Republican control, Texas is about to send its first two Latina legislators to Congress, Sylvia Garcia and Veronica Escobar. Further, Democrat Beto O'Rourke could unseat conservative Senator Ted Cruz. Hailed as the Left's answer to Trump, O'Rourke has attacked the US president for his immigration policy and defended American football players who "take a knee" in protest of police violence. Amid the Islamophobic policies of the Trump administration, including travel bans on people from Muslim countries, Congress prepares to welcome its first Muslim-American women members - Rashida Tlaib , a daughter of Palestinian immigrants from Michigan, and Ilhan Omar of Minnesota, a Somali-American who fled the Somali civil war and lived in a Kenyan refugee camp.
Police interview of Nikolas Cruz after murdering 17 people at Marjory Stoneman Douglas High School on February 14, 2018. This is gross. You should not listen. However, in history this should be heard. Signs, clues and forewarnings here might shed light on the next. On February 14, 2018, a gunman opened fire at Marjory Stoneman Douglas High School in Parkland, Florida, killing seventeen students and staff members and injuring seventeen others. Witnesses identified nineteen-year-old former student Nikolas Cruz as the assailant, and he was arrested in Coral Springs by the Broward County Sheriff's Office shortly after he escaped the scene; Cruz had purchased food at Walmart and McDonald's restaurants after leaving the scene of the shooting. Cruz confessed to being the perpetrator,[13] and he was charged with 17 counts of premeditated murder and 17 counts of attempted murder. Police and prosecutors have not yet offered a motive and are investigating "a pattern of disciplinary issues and unnerving behavior". The sheriff's office received a number of tips in 2016 and 2017 about Cruz's threats to carry out a school shooting. The FBI learned that a YouTube user with the username "nikolas cruz" posted a message in September 2017 about becoming a school shooter, but the agency could not identify the user. In January 2018, someone contacted the Federal Bureau of Investigation (FBI) tip line with a direct complaint that Cruz had made a death threat, but the complaint was not forwarded to the local FBI office. The shooting sparked unprecedented demands for gun control and spurred the founding of Never Again MSD, a political action committee founded by students from the school to demand legislative action from lawmakers on firearms. On March 9, Governor Rick Scott signed a bill that raised the minimum age for buying rifles in Florida from 18 to 21. The legislation also established waiting periods and background checks for gun buyers. The law also allowed for the arming of teachers who were properly trained and the hiring of school police. Bump stocks would now be banned and some potentially violent or mentally unstable persons would be prohibited from possessing guns. The National Rifle Association (NRA) immediately filed a lawsuit that challenged the federal constitutionality of the age requirement clause Information Link: https://en.wikipedia.org/wiki/Stoneman_Douglas_High_School_shooting Public Access America PublicAccessPod Productions #America #History #Podcast #Education #Not4Profit Footage downloaded and edited by PublicAccessPod Podcast Link Review us Stitcher: http://goo.gl/XpKHWB Review us iTunes: https://goo.gl/soc7KG Subscribe GooglePlay: https://goo.gl/gPEDbf YouTube https://goo.gl/xrKbJb

Fantasists and zealots can be found on both sides of the debate over guns in America. On the one hand, many gun-rights advocates reject even the most sensible restrictions on the sale of weapons to the public. On the other, proponents of stricter gun laws often seem unable to understand why a good person would ever want ready access to a loaded firearm. Between these two extremes we must find grounds for a rational discussion about the problem of gun violence. In this episode of Made You Think, Neil and I discuss The Riddle of the Gun by Sam Harris. In this blogpost, Harris weighs arguments and anti arguments for and against gun ownership control. We still have more guns and more gun violence than any other developed country, but the correlation between guns and violence in the United States is far from straightforward. Thirty percent of urban households have at least one firearm. This figure increases to 42 percent in the suburbs and 60 percent in the countryside. As one moves away from cities, therefore, the rate of gun ownership doubles. And yet gun violence is primarily a problem in cities. It is the people of Detroit, Oakland, Memphis, Little Rock, and Stockton who are at the greatest risk of being killed by guns. We cover a wide range of topics, including: Motivations behind shootings in America Why the US situation cannot be compared to other countries and the need of a unique solution The difficulties our brains have processing statistics, and the skewed importance we give to events School guards and gun use training and licensing Why it’s very unlikely that we will talk with aliens one day And much more. Please enjoy, and be sure to read The Riddle of the Gun by Sam Harris! A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed. If you enjoyed this episode, be sure to check out our episode on Amusing Ourselves to Death, a book that discuss our brain limitations, as well as our episode on Skin in the Game by Nassim Taleb, on the topic of the importance of having personal experience and true knowledge when talking about hot topics. The lack and the need of rational arguments in favor or against gun control. 4:48 – Two ways of talking about guns and regulation. The perfect world scenario, where guns do not exist. The current world, where they do. Reasons to why America may not be able to copy and paste regulations from other countries which have a completely different contexts. DNA of countries: starting with the individual freedom vs starting with the collective and scaling down to individual. 9:57 – Hedge against tyranny. It's not about the individual right to have arms, but the State's right to have militia. An armed country makes it more threatening to be invaded. 13:06 – Safe and unsafe gun use. Most of people have a very skewed opinion about guns but lacks deep knowledge about them. Campaigns for and against resort in fear rather than education. Sides attack the weakest argument of the other, instead of dismantling the strongest one. Story behind the AR15 name. 17:56 – Arguments in favor of gun ownership. Police will never arrive on time in a home invasion situation. In a world without guns, the bully wins over the others. Guns even the physical playfield. A weak person could defend itself from a physically strong one. Limitations of Martial Arts in real life. Escaping a dangerous situation as a better strategy than engaging in it. 22:15 – Comparing gun deaths to car accidents and medical errors. According to statistics, gun problems are a problem of population density and not a problem of guns ownership: there are more weapons in rural America, but mass shootings occur in cities. Murder rate going down after assault weapon federal ban expiration coincidence and possible causes. 29:4 – Why Media and people would care more about the life o a kid in New Talents Life than the life of gangsters in Detroit. Different reactions for 9/11 and what happens everyday in Middle East. Difficulties to process statistics and emotional attachment in 1-to-1 relationships. Mass shooting deaths represent just 0.1% 37:42 – Original meaning vs evolved meaning of the American Constitution. Different ban treatment for assault weapons and handguns. Drawing the line in which weapons to ban and which not. 41:33 – California and New York banning 17 rounds magazines. Arming Mars' colonizers. 47:48 – Logistics of breaking ins would be easier with a ban law. Dogs as deterrents to break ins. Civilians shouldn't intervene in dangerous situations. When speaking about gun ownership, we should always include training. The Japanese case, where to own a weapon you have to be trained and your license renewed as for driving cars. For cars and certain businesses training is mandatory. How to circumvent the Second Amendment requiring infinite training. 53:27 – Mental health issues and buying guns. Suicide and domestic violence may be reduced without weapons. Abortion sucitates such much discussion and viewpoints as guns. Cause vs magnitude of events. Knife problems in Chinese schools. Guns do enable to kill people faster. 58:58 – Putting guards for schools instead of arming teachers. Politicians against school guards lacking skin in the game, because they have personal guards. Coincidence of mass shootings happening in gun-free places. 1:03:56 – Motivations behind mass shootings. Armed teachers may introduce more "variability". Deterrent effect is difficult to measure. 1:09:51 Idea: giving guns to kids! Training kids how to behavior in dangerous situations. Many schools do have cops around, but probably not because of terrorist events. 1:13:47 – Imperfect Justice system may be corrected by private justice. Some countries may not have guns problems because of a "barbaric" Justice system. Physical punishment as a deterrent. “Time after time I’ve done an analysis of a company, and I’ve figured out a leverage point — in inventory policy, maybe, or in the relationship between salesforce and productive force, or in personnel policy. Then I’ve gone to the company and discovered that there’s already a lot of attention to that point. Everyone is trying very hard to push it in the wrong direction!” In this episode of Made You Think, Neil and I discuss Leverage Points: Places to Intervene in a System by Donella Meadows. In this article, Meadows goes through her twelve “leverage points” in which you can affect change in your company or any complex system, from least to most effective. “Magical leverage points are not easily accessible, even if we know where they are and which direction to push on them. There are no cheap tickets to mastery. You have to work hard at it, whether that means rigorously analyzing a system or rigorously casting off your own paradigms and throwing yourself into the humility of Not Knowing. In the end, it seems that mastery has less to do with pushing leverage points than it does with strategically, profoundly, madly letting go.” We cover a wide range of topics, including: All of Meadow’s 12 Leverage Points Positive and negative feedback loops The NRA and gun control How individuals can change the system in small and big ways Brexit and the Eurozone The paradigms that shape our thinking And much more. Her focus is on companies, but it really could be applied to any system. Even the podcast itself! 3:17 — How people try to change complex systems by focusing on the wrong parts, or intervening in the right parts, but in the wrong ways. Meadows’ list of ways in which you can intervene from least to most effective. 6:53 — Each intervention point makes sense in connection to the others. Looking at them in simpler system helps understand their role in complex systems. The bathtub analogy. 10:30 — The 12th point: Constants, parameters, numbers. A person occupying a role doesn’t have as much leverage as the role itself. It’s easier to change small parameters than it is to change a broader picture. Eg.: changing the soda you drink instead of changing your whole diet. The Bike-Shed effect. 16:00 — The 11th point: The sizes of buffers and other stabilizing stocks, relative to their flows. The check account metaphor; the amount of money that’s usually left in your account, doesn’t come in or out. That’s your buffer, and can be changed. The size of your buffer can really affect your system. It can increase your security, but also liability. Tradeoff between creativity and redundancy. 20:41 — The 10th point: The structure of material stocks and flows (such as transport networks, population age structures). This rule is harder to immediately apply to the business case. The pipes metaphor; it’s sometimes necessary to set up a system entirely from scratch, or rebuild it, because it’s almost impossible to reach your goals with what’s already present. The rule of 3 and 10. 24:05 — The 9th point: The lengths of delays, relative to the rate of system change. The importance of consumer feedback. Systems with long loops of feedback, such as politics, have trouble self-regulating. At the same time, when there’s lots of immediate feedback, you risk overshooting. 35:08 — The 8th point: The strength of negative feedback loops (...). A negative feedback loop means a system that can turn itself off, such as a thermostat, which’ll stop working once the room reaches the desired temperature. It’s important to have a failsafe that’ll intervene on the event of a worst-case scenario, even if it’s rarely necessary. You can very easily miss the long-term effect of actions that don’t affect the short-term, such like monocultures (the or overworking yourself. 41:00 — Fake news. Ways you could keep fake news from spreading, and how that could slide into censorship. Social media and censorship. The ultimate goal of any company is always to make money. 48:21 — The 7th point: The gain around driving positive feedback loops. Positive feedback loops feed and grow on themselves (the more people have the flu, the faster it’ll spread), but a system with an unchecked positive feedback loop will destroy itself. At some point, a negative feedback loop must kick in, such as what’s happened with the birth rate in western countries. 51:07 — Poverty and wealth as functions of positive and negative feedback loops. Ways you could effectively lessen poverty. Taxing laws and lobbying. 56:00 — Tangent about payment methods. 58:00 — Adjusting positive feedback loops depends on the ultimate goal of the system. How to use commissions as incentives. 01:01:29 — The 6th point: The structure of information flows (who does and does not have access to information). Access to information, and how it affects people’s and company’s behaviors, and creates accountability. 01:05:01 — Accountability in the age of the internet. The NRA and gun control. The NRA as a symptom of America’s pro-gun mentality, not the source of the issue. 01:10:28 — Arguments for both sides of the gun control debate. Initiatives to lessen the instant fame acquired by mass shooters. Comparing different country’s policies without thought to the countries’ different situations. 01:17:12 — Misinformation on the topic of guns in the public and in media: what guns are actually available to the public, which models were used in mass shootings. 01:21:00 — Clickbait. McDonalds’ fries and baldness. 01:22:43 — The 5th point: The rules of the system. The rules of a system are more influential than the people who must play by the rules. Being both an employee and a boss. Benefits and health plans for employees, and how to attract and retain talent. 01:29:18 — The rules of a system can work as incentives and disincentives. 01:30:19 — The 4th point: The power to add, change, evolve, or self-organize system structure. The level to which people can change the system. Utilizing platforms in ways the creators had not originally intended. Unexpected behaviors from children and puppies. 01:33:33 — Religion and superstition. Bottom-up and top-down systems of power. 01:35:15 — Uber, AirBnB, free market and diversity in the market. 01:37:23 — The 3rd point: The goals of the system. The highest level related to the system itself: its ultimate goal. The goal of keeping the market competitive must trump the goal of each company to accumulate profit. Companies that have little to no competition at this point. 01:41:51 — Changing one player in the system doesn’t affect much, except when one individual player can drastically change the goals of the system. Trump, the Conservative Party and Russia. 01:44:20 — Brexit, the UK’s economy, and the Eurozone. City-states and how do you decide the borders of a country. 01:48:36 — The 2nd point: The mindset or paradigm out of which the system — its goals, structure, rules, delays, parameters — arises. The mindset from which the system’s goals come from. Shared mythology and cultural paradigms in today’s society. Digital goods vs physical goods. Shared paradigms as a basis for cooperation and shared goals. 01:58:41 — The 1st point: The power to transcend paradigms. Ever-changing paradigms; your paradigms, as well as scientific paradigms, will keep changing. Not one holds all the truth. 02:05:30 — Wrap-up and sponsor time!. Here is an excerpt from that article: “Despite high rates of unintentional firearm injuries,1–3 and recognition by the National Rifle Association (NRA) that firearm education is important,4 it is often said that firearm injuries occur primarily among inexperienced users and that firearm safety comes with experience and training. To investigate this contention, we conducted a study in which we hypothesized that firearm use would decline during the dates of NRA meetings — which attract tens of thousands of members from across the United States,5 including firearm owners and owners of venues where firearms are used (e.g., firing ranges and hunting grounds) — and that firearm injuries would also decline even among experienced users.” READ MORE HERE Article 1 Title: Irish town built a memorial to thank Native Americans who helped during FamineAmerican Author: Frances Mulraney A sculpture of nine eagle feathers will be installed in Bailic Park, in Midleton, Co Cork to thank the Choctaw Indians for their kindness and support during the Great Irish Famine. Despite the oppression faced by the Choctaws in the years preceding the famine, on hearing of the plight and hunger of the Irish people in 1847, they raised $170 to send to the Irish people and ease their suffering. This figure is equivalent to tens of thousands of dollars in today’s currency. Traditionally, the Oceti Sakowin (Great Sioux Nation) are hunter gatherers. For generations, our children have gotten excited when the chokecherries turn black, because that meant they were ripe for picking. Buffaloberries and wild plums are ready when the chokecherries are. Wild strawberries and raspberries were ready a month previous, along with wild onions; prairie turnips (timpsila) were picked two months before that. The berries and plums can be eaten fresh picked, and are made into jams and jellies. Wojapi is a delicious dessert made from honey or sugar and berries, usually chokecherries. Chokecherries mixed with kidney fat and dried meat are also used to make wasna, ceremonial food. My father, who is a wild game hunter, loves pemmican. We gather first. Hunting will come in another month’s time. The 2007 Census counted a total of 79,703 American Indian or Alaska Native operators on 61,472 farms and ranches across the United States. More than a quarter of these operators also reported another race. The count of American Indian or Alaska Native operators grew 88 percent from 2002, significantly outpacing the 7 percent increase in U.S. farm operators overall. There were a total of 55,889 American Indian operators who reported American Indian or Alaska Native as their only race in 2007. Of these, 34,706 were principal operators, up 124 percent from 2002.* READ MORE Article 4 Title: American Indian Tribes Create an Agricultural Coalition to Impact the Next Farm Bill Author: Dan Nosowitz The Farm Bill is one of the most important pieces of legislation coming up this year, though it seldom makes waves outside the agricultural community. The Farm Bill, which is passed every five years (or so—the last one, in 2014, was two years late), includes a lot of the stuff you might imagine—farm subsidies, crop insurance—but it also address a boatload of other issues, like the SNAP benefits (aka the food stamp program), rural assistance, employment help, conservation measures in agriculture, forestry programs, food research and development, biofuels, and more. It’s vital not just to farmers but to the economically disadvantaged, and anyone who lives in rural America, too. Close by, on their way to lunch, were Representative Eric Descheenie (D-Chinle) and Representative Wenona Benally (D-Window Rock). Both are Navajo. Representative Benally recounts the event for Native News Online: "Rep. Descheenie stepped in between them and Rep. Hannley, in order to protect her from them. As soon as he did so, it drew the attention of the rest of the Trump protesters. The rest of the Trump protestors quickly walked over to us, surrounding us and aggressively yelling at us about our support for ‘illegals.’ READ MORE Article 5 Title: Exclusive: Here’s Jeff Sessions’ Draft Masterplan For The Justice Department Author: Ryan J. Reilly WASHINGTON ― Attorney General Jeff Sessions is rapidly shifting the Justice Department’s focus from Obama-era goals such as civil rights enforcement and criminal justice reform to conservative priorities. A draft version of the department’s five-year strategic plan obtained by HuffPost shows the Trump administration’s plans for DOJ include cracking down on illegal immigrants, aggressively prosecute national security leaks, zeroing in on campus speech issues, attacking MS–13 and restoring the “rule of law” throughout the country. The special counsel investigation into Russian interference in the election and President Donald Trump’s attacks on Sessions have grabbed headlines in the attorney general’s first year in office. But the Justice Department, of course, has jurisdiction over much more than the Russia probe. READ MORE

Have you ever been in a class where the teacher really does remind you of Charlie Brown’s teacher?Like this?https://www.youtube.com/watch?v=ss2hULhXf04&feature=youtu.beI have been a licensed history teacher since 1987, and I cannot remember how many times someone has told me, basically, “I used to hate history when I was in school, but now that I’m an adult, it fascinates me and I can’t get enough of it.”In my opinion, this may be because a lot of our history is taught badly, or we teachers just try to get our students to memorize dry facts and dates, but history has a STORY in it! The longer I live, the more I try to teach story and attach LIFE LESSONS to the examples, so our lives today can be richer and more successful. So that leads us to this episode. At the 2017 Dreyer Academy LLC Christmas Party, our podcast producer Todd Holloway told me he remembered a project I assigned his honors US history class when he had been in 11th grade and said it had taught him valuable life lessons. I assigned the class certain US Civil War leaders, both from the North and South, and the students were to research them and identify if they are seen as successful or failed leaders, and what made them successful or not. I was grateful Todd recalled that project and found it helpful, and the fact that he had remembered it six or seven years later, I found remarkable. So, he and I decided we needed to revisit some of those “life lessons” in our podcasts, so here is the first one! In this episode, we look at the life of Union (Northern) General Ambrose Burnside. He was the classic “middle manager” who generally succeeded as a general under a higher command, but he failed utterly when Lincoln put him in charge of the Army of the Potomac. Burnside outnumbered Lee’s army by 120,000 to 80,000 men, but at the bloody Battle of Fredericksburg, Virginia, he lost an unbelievable 13,000 men in ONE DAY while the South lost less than 5,000. This episode will examine some of Burnside’s flaws and seek to help us avoid those errors today, in particular, “tunnel vision.”Learn more about General Burnside and the Battle of Fredericksburg below:http://www.history.com/news/remembering-the-battle-of-fredericksburg-150-years-later Factoid: After the Civil War, Burnside became the first president of the National Rifle Association (NRA):https://home.nra.org/about-the-nra/Word of the Day: sideburns (noun). A strip of hair grown by men down the side of their face in front of their earsQuestion of the Day: What is the “fine line” between FOCUS and TUNNEL VISION? How are they different? How can a person retain focus, yet be open to new ways of thinking and seeing matters?Have a question or feedback? Maybe a topic you’d like to hear in a future episode? Congresswoman Eleanor Holmes Norton has represented Washington, D.C. for 25 years, but her responsibilities are different than those of other representatives. Because Washington, D.C. is not a state, she doesn’t have a vote on the House floor. This would seem to make her job more challenging than it is for other representatives but she has risen above this limitation time and again, finding creative ways to demonstrate the importance of legislation that matters most to her district. She shares some of those stories in our discussion. Congresswoman Norton was born and raised in D.C. during a time when schools and restaurants were segregated. She was one of the only African-American women at Antioch College, one of the only women at Yale law school, and she has fought for civil rights throughout her life. She is inspired by stories about her great-grandfather – a slave who escaped to D.C. and was able to thrive as the capital city grew. She is a loving mother and grandmother who describes herself as a “type A – oldest child." Listen to the podcast to hear Congresswomen Norton discuss: Why D.C. residents pay the highest Federal taxes per capita, but have no vote in the House or Senate The complicated legislative process that must happen in order for D.C. to become a state and gain full representation in Congress. How the National Rifle Association (NRA) was able to stop that process in 2009. The notion that the first born comes into the world and doesn’t have role models, so she strikes out on her own. (Hint: Eleanor was first born!) Encouraging young women to look at others who have achieved great things such as Harriet Tubman. See the link to her biography below. Eleanor's biography,“Fire in my Soul,” that tells the story of how her great-grandfather, Richard Holmes, escaped from slavery and thrived in Washington, D.C. How Richard Holmes avoided being captured and how that taught Eleanor the value of thinking and planning ahead Civil Rights progress and the work that remains Legislation championed by the bipartisan Congressional Down Syndrome Caucus The Able Act which helps disabled people to engage in banking and saving, and helps move them toward independence Founding the Caucus on Black Men and Boys with Representative Danny Davis and bringing Trayvon Martin's parents to the Hill to testify The connection between the loss of stable manufacturing jobs and the breakdown of the family in African-American communities The effect of 70% of children in African-American communities being raised by a single mother Her thoughts on the first African-American President and the possibility of the first women President of the United States Ways to effect change even when your political party is not in power Cultivating a relationship, a friendship really, with the Republican Speaker of the House, Newt Gingrich, and how that kept D.C. open during government shutdowns Revitalizing areas of D.C. in ways that don't displace residents Getting in exercise during her busy day The joys of spending time with her grandsons Enjoying D.C.'s green spaces including Theodore Roosevelt Island, Rock Creek Park, The Mall, Dupont Park, and Kenilworth Park Lunchtime Music on the Mall, an initiative to encourage Federal employees and others to use the Mall during the day Quotes from Congresswomen Eleanor Homes Norton “If you sit around thinking about how difficult something is instead of how to go about doing it, even if incrementally, you just won’t get there.” “Read about the lives of people who accomplished great things under great duress.” “You’ve got to understand the progress you’ve made, but any satisfaction with it is deadly, and will keep you from moving forward.” Contact Lisa at Lisa@EverBetterU.com

Zoltan Istvan is the US Presidential candidate for the Transhumanist Party. Istvan’s stated aim is to "change the conversation" on transhumanism. WATCH THE FULL EPISODE FOR FREE: https://londonrealacademy.com/episodes/zoltan-istvan-transhumanist/ Transhumanism could be described as the use of technology to enhance human capabilities, both mental and physical. As Istvan points out in this interview, the ultimate goal is transcending biological death. For Istvan, transhumanism is simply the next step in human evolution. As you will see in this interview, Brian may disagree with him there! Istvan believes that if you have the chance to replace your fallible limbs with stronger and more effective technological alternatives, it’s a no brainer. If we are willing to take a jab for polio, to embrace medical science for every-day diseases, then the logic, for Istvan, is no different. In his words it’s ‘common sense’. So where’s the line? At what point does scientific and technological progress start to infringe on our very humanity? Without pain and death, what would it mean to be human? For Istvan, it’s time to do away with the suspicion and horror stories of science fiction, and have a sensible dialogue. Watch Brian tease out, and at times challenge, Istvan's ideas, in a heated and profoundly enlightening discussion with one of London Real’s most controversial guests.
