His client was thinking of selling the property and packaging it all up to a developer for building the high-rise. However, his business partner, an architect, was caught up in the thought that he was going to earn a lot from this and actually develop and build the property himself. A third investor, who had invested 10%, was supportive of selling the property to a reliable developer. So, two of them were on the same page while the other one was thinking of something grand. The catch is that these three guys didn't communicate their end goal for this. They just assumed that each of them knew what they would do. Worst of all, this misunderstanding ended up in court. As the episode ends, Jeremy shared valuable thoughts that are not only helpful in the legal profession but to other businesses as well. That new business looks confusing and exhausting, right? This episode is for you! Stages To Identify Before Starting A Business Startup Phase You've got a great idea; now it's time to implement it. This is one of the most difficult stages because you need to get things right – any mistake could cost you your company even before it gets off the ground. You need to choose the right structure and make sure you're engaging with your customers properly. Even though you're trying to do everything right at the moment things will definitely change as you progress making it all the trickier. This is a stage that requires agility and a mentor (or two)! Now, let's talk about the next three phases! Consolidation PhaseConsolidation in business is a combination of different business units into one. It starts with bringing on employees and ensuring they are the right team for your vision. Onboarding the wrong group of people can cause failure. The key here would be making sure any new members get off to an excellent start by properly training them before letting any unfortunate situations arise that might cause unhappy customers or investors. Expansion Phase This is the point in business where you're comfortable enough to extend your branches. At this point, you're ready to bring something or someone else in and be confident the additional resources will generate positive results. It could be organic growth, potential franchises, or even a business acquisition. Selling Phase This entails the business exit strategy. It is the phase where you make a deal to sell your business, and just because you're out doesn't mean you need to leave completely. You could strike up a deal that'd keep you on as an employee if that's something you're okay with. “I'm just trying to startup, and here you're telling me about selling?!” I read your mind, right? Always have the future in mind. Always start with the end in mind! Legal Mistakes You Should Avoid It's no news that several challenges are bound to occur when you're starting a new business. Mistakes are inevitable; we've seen different startups and entrepreneurs make mistakes in the past and present – all we need to do is learn from them. The following are some of the legal mistakes you should avoid! Not understanding what the goal is: The first thing is to understand your own goal – what is it you're trying to achieve; what is the end to all of this? You can only understand other people's goals when you're clear on yours. That is when you can communicate properly with them. Understanding people's goals gives you a clear idea on what they want, and this is especially important when you're negotiating a merger. Not having ‘the conversation': Regular checkups are necessary. You need to talk to your team to know what they are doing. It's better to be in the loop, so you'll be up to date with what everyone wants. Not documenting the agreement: Make sure you read and understand what you are agreeing to. You need to know what the deal is – ensure what you're reading on paper is what you understand the deal to be. Get advice from someone who knows what they are talking about too! Jeremy Streten has worked with over 5000 clients throughout his career and documented when they had success and when they faced pitfalls legally. He talks about those from start up to exit strategy with 13 distinct business lifecycles. This is all laid out in his book The Business Legal Lifecycle. Jeremy shares how some businesses, not wanting to spend legal fees, lose large sums of money well beyond what they would have paid for legal counsel. That inactivity is comparable to the antiquated notion that legal services are a liability rather than an asset. By investing in legal services and advice, the proactiveness protects your business and saves future fees in potential litigation or disputes with things like client or employee agreements. Listeners have an opportunity to take a 10-minute assessment that identifies where you are in your business lifecycle and your legal risks. Jeremy admits that law is not something that most business owners find exciting, but it's vital that you seek proactive legal advice. Jeremy is passionate about helping business owners see where their proactive legal issues are so they can put the right things in place to protect themselves and their businesses. Josh and Jeremy also talk about Jeremy's book, the Business Legal Lifecycle. The book lays out 13 phases, with the first three phases being the business conception phases. This is all about how you develop the proper foundation to launch your business off of. Jeremy also talks about the importance of setting your goals along with the building of your business foundation so that it grows in the direction you want it to. Risk reversal marketing can be successful, but make sure you proactively line up expectations and clarity on the front end. This is a great example of being legally proactive with your business. Jeremy shares stories of how companies with massive potential failed and went bankrupt simply because they never consulted a lawyer. Putting legal safeguards in place for your business should be one of the first things you prioritize while building your business. Josh and Jeremy also explore how to structure liability among your team, employees, and clients. Always make sure to protect yourself legally in terms of your specific agreements and terms.. Jeremy explains that the first step in this process is to have the adult conversation and better communication on the front end with your clients. Honesty and transparency up front, especially relating to risks and liability, are an important part of this communication. Josh offers some ideas to facilitate this communication, including filming a video that explains your agreements to your clients rather than just handing them a thick document. Our guest on this episode of the DevReady Podcast is Jeremy Streten, founder of “Business Legal Life Cycle”, a business focused on making legal advice accessible to business owners. Jeremy briefly started out his career in IT before pivoting to become a lawyer about 17 years ago. After several years in the industry, Jeremy realized that many lawyers tend to speak with their clients in unnecessarily complicated ways that are not helpful to average people who do not have legal training. He saw an opportunity for building a bridge between business owners and helpful legal advice and he sought out a developer to help him create the infrastructure. The basis for the BLL assessment came from Jeremy's outline of the 13 business phases, which eventually became his book entitled “The Business Legal Life Cycle.” During the creation of the first version of the Business Legal Life Cycle software, Jeremy experienced plenty of miscommunications with the developer he had hired. This solidified in his mind the necessity for a tech partner and also for the implementation of proper documentation at the beginning of all client and employment relationships. When it came time to work on version 2.0, Jeremy reached out to a Mastermind group that he was a part of in the U.S. and met an interested developer there who eventually became his business partner. He says that having a tech partner continually involved in the business and the evolution of the tech being used is a crucial part of the business.
