John is joined by Christian Athanasoulas, KPMG's Global Head of International Tax and M&A Tax and U.S. Tax Practice Leader – Services. They discuss the groundbreaking shift in the U.S. legal industry arising from Arizona's decision to allow non-lawyers to have ownership interests in law firms. This move aligns the U.S. with countries like the U.K. and Australia, where non-lawyers have been permitted to own law firms for years. KPMG has successfully operated legal practices in over 80 countries, but U.S. regulations previously prevented it from offering legal services alongside its consulting, tax, and advisory work. Arizona's new rules allow KPMG to offer the non-legal services it typically offers clients together with related legal services performed by the new law firm. Previously, KPMG's clients would have to retain law firms with no formal ties to KPMG for those services. Christian led the effort to establish KPMG Law US, a wholly owned Arizona law firm under the KPMG umbrella. KPMG Law US is an independent LLC with Arizona-licensed lawyers and a compliance officer to ensure adherence to legal ethics rules. Although owned by KPMG, the law firm maintains autonomy. It can assist clients with legal matters such as contract integration and regulatory compliance. KPMG Law US leverages its parent company's technological advancements, including AI-driven contract analysis and process automation, to improve efficiency in the provision of legal services. The new law firm will not engage in litigation. For matters outside of Arizona, it will co-counsel with lawyers admitted in the appropriate jurisdiction. While Arizona is currently the only state permitting non-lawyer ownership of law firms, other states are exploring the possibility of passing similar laws. The creation of KPMG Law US could signal broader changes in the legal profession, potentially reshaping traditional law firm structures.Podcast Link: Law-disrupted.fmHost: John B. Speaker: Professor Christopher Nicholls (University of Western Ontario)In 1933, in the depths of the Great Depression, the Yale Law School and Harvard Business School launched an innovative joint program: the “Law-Business Course”. The program's principal architect was Yale law professor William O. Douglas, best remembered today as the longest serving member of the US Supreme Court and one of the most provocative. For a short time, this remarkable academic initiative brought together professional schools at America's two foremost universities, foreshadowing the interdisciplinary approach to law and business education that animate modern JD/MBA programs. The creation and short life of this unique academic collaboration provide a fascinating glimpse into the intellectual dynamism of early twentieth century business law education and the politics and practical exigencies facing academic pioneers of that important era. The story of this forward-thinking interdisciplinary perspective also offers important insights into current approaches to business law and, in particular, the pivotal role of modern finance theory in the development of the study, practice, and theory of corporate law today.3CL runs the 3CL Travers Smith Lunchtime Seminar Series, featuring leading academics from the Faculty, and high-profile practitioners. For more information see the Centre for Corporate and Commercial Law website:http://www.3cl.law.cam.ac.uk/

Alison Cusack is Australia'a most famous maritime lawyer. And in this episode we learn why. Alison is absolutely fabulous. And the definition of someone who is boldly carving out their unique place in our legal profession. She has defied ALL the conventional legal career wisdom and advice to achieve her success. She dropped out of Electrical Engineering at Melbourne University to study Law/Business at Victoria University. She then did a generalist ATO Graduate program, before she landed an inhouse legal role at global shipping company ANL. After ANL, she wanted to gain private practice experience. But she obviously did not have it... And the law firms she applied to required it. So what did she do? She started her own law firm to get that private practice legal experience. It was only meant to last 6 months before she got herself a "proper" law firm job. Five years later, Cusack & Co, and Alison Cusack are both thriving. She represents massive global, billion dollar clients and is consistently nominated for industry awards. International law firms are her “competition” and she markets herself via comics. In this honest conversation Alison and I cover how she successfully navigated this very twisty, alternative legal career path, as well as: Failure - who says we have failed? Being liked vs being respected Developing the skills to advocate for gender equality Why we deserve more and how we can demand more Law firm marketing and business development Defying the odds and doing it on our own terms I hope you enjoy this honest conversation and it helps open your eyes to the limitless possibilities as to where your legal career may take you. This is Matt Reustle and today we are back covering the semiconductor value chain. ASML was once a forgotten subsidiary of Philips. Today, it's one of the most important technology companies in the world. To break down ASML, I'm joined by Tom Walsh, a portfolio manager at Baillie Gifford. Tom helps explain what's happening inside an extreme ultraviolet lithography machine, and how ASML came to pioneer this technology from the Netherlands. It was a non-traditional path to say the least. This breakdown pairs very well with our breakdowns on AMD, Qualcomm and Cadence. Jeremy Streten is on a mission to provide access to legal advice for all small to medium-sized businesses around the world. These aren't just empty words. He really means it as evidenced by the strategic moves he's made to, as he describes it, “…scale myself out of my law firm to remove dependency on me.” How's that possible when business laws are country-dependent? Well, turns out that's not entirely true. In this episode, Jeremy describes how his keen observations during a law conference coupled with sage advice from a business coach, led him down a path to scale business legal advice via a business legal lifecycle. It's an easy-to-understand chart designed to empower business owners in proactively securing legal protections using a combination of standard and local or customized practices. Now, he's transitioned out of being a traditional lawyer working on a per-client basis and into the role of CEO of a lawtech company with remote global operations across Australia, the U.S., and the U.K. Listen as he recounts the bumps and bruises along his journey that led to him building a business infrastructure that includes the optimal combination of people, processes, and technologies necessary to scale a service-based business. Jeremy's cracked the code and now you can learn from him and apply the lessons learned from his scale tale to your organization!

But, what struck me most about Shawn when we connected was his candid thoughts about failure, how the product is not the business, and as he says “a lot of times having more guts than brains.” I want to explore all of this and more with him in this episode. www.connectwithshawn.com www.Eplaybooks.com Reach out and ask Shawn for a copy of the free e-book. Shawn is a first-generation immigrant from Iran. A lot of his motivation came from his father, who in Iran, owned a construction firm. He would go to work with his dad at 7 years old and on. He thought he would follow his father's footsteps and get into construction. When they moved over to the US, things didn't carry over from Iran. His dad ended up owning income property. But there wasn't much in the way of property management services or systems for small investors. Shawn created a basic database program that allowed for property management focused on smaller investors. This became a business of its own as Shawn sold it to his dad's friends and it grew by word of mouth from there. He ended up going to college and got degrees in mathematics and computers as well as in economics. He then got a law degree and educated himself in sales, marketing, accounting, etc. Shawn never thought of working for anyone else. He's never created a resume or had a W2 from a company he didn't own. He's a process guy who seeks how to streamline businesses and edges through process to make them more successful. He would create something that worked well for a problem in his business. He would then productize it and go sell it to his competitors. He failed a lot and was good at overcoming it to succeed. People began to seek him out and ask him to consult for their businesses. He learned that successes can become failures too because of the lack of good processes and systems. Only an idiot would go seek out failure….tell us the truth about failure. It is painful. It is terrible. And it sucks. No one should purposely fail and if you did that, you won't learn that much. Failure will happen and you must really lean into it and learn from it, then put what you learn into action. The fear of failure should never stop. In fact, as you become more successful, it gets even harder as you know what can happen. Respect, but don't invite it. At the 14 min mark, Shawn shares an example of failure and how he learned from it. In marketing, if it is going well – don't stop it or change it, even if you have to build the infrastructure as you go to keep up. Shawn also talks about taking on the wrong type of capital and how it deeply hurt his successful Law Business. You have to be very careful in all areas of your business. Your product is not your business, your business is your product. Talk to us more about your business being your product…. What is your business? It's not the service or product. It is part of it, but it also everything else. Your culture, service, processes, structure, marketing, etc. are all part of your business. Your business is the journey to buy your product. Your business is what you do when something goes wrong for a client. Your business is meeting the customer's expectations. Every aspect of your business needs to be looked at as part of the product. An example is a restaurant that makes great food – but what gets people in the door and keeps them coming back. If you staff is rude to patrons, do you think they will come back? Instead, you must create not only great food, but a great experience and that is the product of a good restaurant – not just food. Tell about the principles you use to grow a business and in tough times as well… Part of your business line of income must include some sort of recurring revenue component. One off sales are great, but you need something repeatable and predictable. Shawn uses an example of buying a humidifier business but buying because of the filters and essential oils that were resold every month as a monthly subscription. No matter what your business sells, there is an opportunity to create a recurring component. When bad times happen, a lot of people/businesses “take cover.” It is those that look for opportunity that are important. Ask “Where can I find opportunity? How can I change my business to win?” Where do you see the future going? The virus is not going away. And because of that, the way business is conducted is changing permanently. Companies and employees' mindsets have changed on how work is done and where it is done. New systems have been developed to support this new way of working. The supply chain has changed long-term. At the 44 min mark, we talk about opportunity in the midst of a pandemic. Best Quote: The fear of failure should never stop. In fact, as you become more successful, it gets even harder as you know what can happen. Respect, but don't invite it. Shawn's Misfit 3: Don't let failure stop you. Always be moving forward. Ask for help and overcome. In everything, there is opportunity. Always. Have a more a routine that is yours. Create the time for you. The Other Six Days-Part 3- A Law Business As Kingdom Mission? The Church is now typically composed of only two types of people, those who do ministry and those to whom it is done. Those to whom it is done are 95 percent of the church. When the Church treats almost all of her members as consumers of ministry, she fails to disciple her members and she fails to equip and empower them for “full time ministry” in the world. This series of podcasts explores what it means to live as the fully mobilized people of God in everyday life. I discuss my thirty-year struggle to live as a disciple while practicing family law full time as a calling. All this time it has been my desire to work in “full time service” to the Lord, doing “the Lord's work,” and offering biblical worship to the Lord in court houses and law offices. In brief, my goal has been to be a faithful witness to Jesus within a war zone. After a beginning podcast chronicling my wandering in the wilderness as a disoriented Christian lawyer, we will discuss the biblical vision of calling, worship, ministry, and the Lord's work as well as the practical challenges of the everyday running of a business as mission. Come join us as we cast a mobilizing vision for the whole people of God.

Over the past 20 years, McCready Law has grown into one of the most successful personal injury firms in the Midwest, owning four offices in Illinois and Indiana. Managing partner Michael McCready attributes this success to a three-component marketing formula that would work for any law business, or any other business for that matter – attorney referrals, client referrals and “traditional” marketing through advertising and media. Such a business model takes more work and commitment than it sounds, but the rewards are extremely worth it. In this episode, Michael talks to Larry Weinstein about each of these components in detail. You will learn a lot about building referral relationships, staying in touch with your contacts, creating engaging newsletter content and cultivating a client experience that becomes a natural extension to your marketing.

In this episode of Financial Planning for Canadian Business Owners, Jason Pereira, award-winning financial planner, university lecturer, and writer, talks with Heather L. Hansen, Lawyer and Partner at Martha McCarthy & Company. Heather L. Hansen talks about family law and its impact on business owners, the legal ramifications of marriage and separation, and the myths to be aware of surrounding both of those instances. Episode Highlights: ● 01:05 – Heather L. Hansen explains her background in family law. ● 03:42 – What are the tensions between family law and contract law? ● 06:11 – How does a divorice from a business owner differ from a regular conventional employee? ● 16:08 – What happens when some of that income from the business may not be fully reported? ● 22:27 – Get clear accounting on what your assets are ● 25:30 – Why is the family home different in family law? ● 30:38 – You can enter into a domestic contract that is not in contemplation or during a marriage. ● 37:31 – Heather L. Hansen's ‘marriage contract mantra' is to keep them as simple as possible and to do as little as possible in the contract. ● 41:37 – Heather L. Hansen discusses the class of excluded assets under the family law act. 3 Key Points 1. Value doesn't equal fair market value and value doesn't necessarily equal some prior indicator of value. 2. In family law, division of property turns to the value of the business and the obligation to equalize it. 3. In family law, child support and spousal support are based on income. Tweetable Quotes: ● “I am a family lawyer. I practice in Ontario. I'm a certified specialist in family law and what that means is that it occupies the totality of my practice. I've been practicing for just over 12 years now.” – Heather L. Hansen ● “One of the areas that I've developed a specialty in is the intersection of family law and business, and how partially business owners are impacted during a separation process.” – Heather L. Hansen ● “People should consult often and early with family lawyers, particularly within their corporate life, and there are things that we can do. There are strategies and there are approaches we can do. But it is limited.” – Heather L. Part 2 dives deep into proactive measures law firm owners can begin implementing to help adapt their business models during the current evolving landscape. A lot of owners are beginning to come to terms with the fact that they will need to virtualize their practice, and in response some may panic. The transition won’t be an easy feat, but it is possible. In this episode I stress the importance of setting standards, fine-tuning systems, and most importantly how to refrain from negative thoughts while you transform your business in the wake of the Corona Virus pandemic. In this episode, I will discuss: Typical responses to being confronted with a new or unknown circumstance Dealing with data overload provided by the media Adapting to the challenges of managing people remotely and maintaining a feeling of control Resistance to a change in office culture How new working environments will impact work performance in different ways See the opportunities to evolve your workplace and identify your top performers How these dramatic changes can improve your personal growth and leadership skills Maintaining accountability and expectations while acknowledging difficult circumstances Setting the standard as the leader and reducing the anxiety you feel inside yourself The importance of using a visual communication process (such as Zoom) to create energy transfer How to reframe negative thoughts Making changes carefully and thoughtfully and how this is a good time to assess your business in 4 key areas: Marketing, Sales, Systems and People

Opening my latest Bulletin, I look at the recent government announcement on changes to The Insolvency Act. The move is designed to protect Directors from personal liability claims in respect of Wrongful Trading. Why has this change been made? One aspect of the Coronavirus Business Interruption Loan Scheme that is catching businesses by surprise is the need to establish viability of the business going forward. I look at how you do this when applying for the loan. During normal times planning ahead as to when to submit an application is important. However, in our current situation there is now only one perfect time to apply. The answer to that question is whether we are going to see another Credit Crunch?
During the ordinance of Shelter in Place most of us are working remotely and engaging with clients in a way we are not used to. This is especially problematic for lawyers as our brains tend to go into the darkest of places when a problem arises. It’s not that we are negative thinkers, it’s just the way we are conditioned as lawyers. As soon as a problem arises the first place our mind goes is what could go wrong, then we proceed on how to solve it. It is important as business owners that we not only understand what’s happening, but also be proactive to avoid the toxic impact on your clients and your staff. In this episode I will present four things you can do now to stay emotionally and psychologically healthy during the COVID-19 pandemic. In this episode, I will discuss: What does social distancing mean for our businesses? The challenges of working remotely and engaging with people in a way you're not used to Understanding what’s happening and being proactive to avoid a toxic impact How we are hardwired from our subconscious evolution to believe things in one way or another Thoughts brought on by circumstances and the feelings associated with those thoughts How the conglomeration of negative thoughts is what leads to catastrophe The idea that anxiety is something that is a thought about a future circumstance How negative thoughts have a negative impact on the people who are doing the work with you and for you Avoiding catastrophic thinking by getting into the habit of thinking about the neutrality of circumstances The energy in stepping forward and showing up Four things you can do now to keep yourselves emotionally and psychologically healthy through this process

Wouldn't it be cool if a law school and a business school could collaborate on issues of legal analytics, entrepreneurial opportunities in the law, and collaboration between the university and the local business and law firm industries? We talk with a couple of professors at Georgia Statue University (GSU) who are turning this 'cool idea' and making it a reality. Anne Tucker, Professor of Law, Legal Analytics & Innovation Initiative, and Ben Chapman, Executive Director, Legal Analytics and Innovation Initiative join us to discuss the details behind The Institute for Insight at GSU. The Institute brings together professors from different backgrounds of Engineering, Computer Science, and Statistics and with this type of cross-pollination with business and law, the professors are looking at applied analytics questions and bringing in their own unique skill sets to understand and solve these issues. This mashup of law, business, data science, risk management, statistics and more isn't a purely academic endeavor for the Institute. Following in the tradition of GSU being an urban school, the Institute works with well known players in the Atlanta business and legal community to put the ideas into real-world situations. This gives the Institute's professors and students the opportunity to work side-by-side with the business and legal leaders to help identify, study, analyze, and potentially solve issues facing the business and legal industry. This is one of the many values which Tucker and Chapman see for not just preparing students for the practice of law, but also for the business of law. Information Inspirations While Greg was busy playing guitar in his law firm's band, Marlene was speaking at the DLaw Summit in NYC last week. Competitive Intelligence guru, Kevin Miles from Norton Rose Fulbright gives us some nice checklists on different CI topics along with some templates designed in MS Word to help start you on the CI path at your law firm. The Financial Times came out with a 15 article report on the legal industry ranging from top legal business technologists, to the Big-Four's advancement in the legal industry, to both the promise, and the overwhelming nature of understanding legal tech processes. We hope that Google still follows the "Don't Be Evil" rule because they are now touting success in the Quantum Computing area. On this episode of Court Appointed, Mike and Tommy discuss the laws surrounding advertising your Law Business. Believe it or not, there was a time when you didn't have to hear about personal injuries and Mesothelioma and all these other big cash settlement things. Lawyers just could say, "Here is my name and number, Call me if you need me". Boy have times changed ! I mean, even Captain Kirk is singing their praises !! The Court is now in Session with music, "Doctor, Lawyer, Indian Chief" by MCRB.
On this episode I talk about my close call with law enforcement, the details of my starting a business, and updates on the Autohaus.

Cristin is a family law attorney in the San Francisco Bay Area. She built a successful law business around her core philosophy of helping people. The help she is passionate about providing is not limited to only giving the best possible representation in court, but also helping clients become fulfilled and successful in their new lives after divorce. Coming from a family of doctors, Cristin grew up with a desire to help people. She chose family law as her way of expressing herself and giving back. The main reason she was able to build such a successful business is that she feels satisfied and fulfilled by it. Having a motivated team is another key ingredient in building a successful business. Although Cristin’s employees have diverse personalities, they all share the same value system and are passionate about helping people. Getting her team focused is much easier because they share the same goals. Being a great lawyers doesn’t automatically make one a successful business owner. Cristin wasn’t afraid to ask for help, and started working with a business coach shortly after going solo. Having someone giving feedback and holding her accountable kept her grounded and focused. Maintaining the focus on the business is a constant balancing act to Cristin. Even though running a law firm might not come naturally to her, she certainly does a great job at it. She sets the bar high for herself and constantly measures and reevaluates how she and the business perform. Playing hard is just as important to Cristin as working hard. She regularly works out, does martial arts and yoga. All these activities help her live in the present and stay focused. Business tip: Accept that you cannot do it all by yourself. Ask for help and constantly improve yourself. Cristin’s website: http://CristinLoweLaw.com
