When does a rifle become a machine gun? That is the question asked in the Supreme Court case Garland v. Cargill. When the Bureau of Alcohol, Tobacco, Firearms, and Explosives suddenly decided to redefine bump stocks as machine guns, many Americans simply complied. However, when Michael Cargill surrendered his bump stocks to the ATF, he did so under protest, filing suit to challenge the rule under the Administrative Procedure Act. Those of us who enjoy and exercise our right to keep and bear arms owe Mr. Cargill a debt of gratitude, but the fight is not over. Thanks to Mr. Cargill's determination and persistence, the ATF's bump stock rule has been found to have not been created correctly, meaning we get our bump stocks back. However, it also leaves open the chance for Congress to do what the ATF could not, violate the Second Amendment one more time.

Riding Shotgun With Charlie #206 Joe Meaux Aklys Defense There has only been one other time when someone has driven the stagecoach and I was in the shotgun seat. That was episode #039 with Kevin Sona from Florida Carry. This time Joe Meaux because he had “sensitive materials” in the car and I wouldn't know what to tell the police if we were pulled over. I met Joe in 2023 at NRA AM in Indianapolis. There was a group of us that went for dinner. This year, Brent, my roomie for the weekend ran into Joe and said he had a van full of machine guns and silencers. How can I not film this show? Joe lives in Louisiana and he took an interest in building firearms at a young age. He also spent time repairing lawn mowers when he was young, which came in handy when it was time to build AR. Building an AR was much more affordable than buying one. He would buy kits and put them together. Being a subject matter expert on building and working with computers gave him the chance to teach information technology and business at a local high school where he was only a few years older than the students. Currently, he owns Aklys Defense. His company makes silencers, suppressors, gun muffler quiet technology, a can, or a yeeter discreeter. Aklys makes their own products, but they also make some OEM products for other manufacturers. Let's get this debate over: the first patent was for a silencer. Yes, we all know it doesn't “silence” the sound, but the first gun muffler was called a silencer. Joe also says the ATF refers to it as a silencer, too. We've also just learned the ATF may be wrong about what they call items (Hello, Mr Michael Cargill!) Joe's teaching gig and experience with computers and web design was able to help him connect with Red Jacket Firearms. After some bartering, he was able to get a nicer AK kit in exchange for helping with their computers. He was offered a position to help build guns and he took it. Unbeknownst to Joe, Will Hayden, Red Jacket's owner, submitted a sizzle reel to Discovery. It took some time to pick up Sons of Guns and make it happen. Joe says it was a little weird trying to do work, but Will wanted to build in some drama. They also had a business to run and keep going. Sons of Guns went on for five seasons and during the filming of season six, things got bad. (You can google what went down.) Joe and his partners ended up managing the business and working to change the image and branding. He made the decision to rebrand and start over as Aklys Defense. We do drive through Dealey Plaza twice. It's become a tradition when we're filming in Dallas. The second time through, I saw someone in tan pants and a black polo shirt. It ended up being Matt Mallory with Klint Macro. I've done two shows with the Meet The Pressers gents. I did get a copy of the clip of us driving through their video, which adds some fun! Joe gives us some insight into the business side of things, like having SKUs and UPCs. He's fired many different machine guns in his time. And he also tells us his top machine guns and why he feels a connection to the grease gun from World War II. Ok.. maybe a little bit about the Vegas shooting comes up, too. Riding Shotgun With Charlie #169 Michael Cargill Central Texas Gun Works Michael Cargill is getting a lot of attention and press. First we had Heller in 2008, then McDonald in 2010, and Bruen in 2022. It's looking like Cargill V Garland is going to be in 2023. The Cargill case is going to bring us back the right to possess bump stocks. To start this episode, I have a quick video meeting with Cargill to update us on what's going on with getting his case to the Supreme Court. We talked at the end of March 2023, but things changed during the first week of April and you'll hear the recent happenings. Cargill has a lot going on. He's the owner of Central Texas Gun Works (CTGW), located in Austin, TX, which offers several levels of training courses from handgun basics to private security qualifications The store offers rentals and purchases as well. If that isn't enough, he also does a radio show that is focused on guns, training, and all things Second Amendment related. He spent 12 years in the Army. Then joined civilian life, he worked doing telecommunication then opened a trucking company, finally opening a gun store. He was tired of his family and friends being victims of crime, not having firearms or training to go with them. His grandmother, at 70 years old, was going back to college to be a nurse and she was robbed and raped. That was the catalyst to open up CTGW. He also pushed for campus carry, which became law in Texas. Not new to the court and judicial system, Cargill fought the city of Austin for not allowing the citizens to carry in their building. He filed a case and took them to court, he testified, then he won the case. After that he looked at the Federal government. When he found out that Congress didn't give permission to the ATF to make laws but the ATF was acting like they did, he decided it was time to go after them as well. During the Trump administration after the shootings at the country concert in Las Vegas, the ATF decided to go after bumpstocks. The issue isn't whether bumpstocks are or aren't machine guns, it's that the ATF is not supposed to make or interrupt laws, they're just supposed to enforce them. This could have implications over all the nonsense that the ATF has been doing, including going after the pistol braces. Looking for an attorney at the same time an attorney was looking for a client, Cargill found who was going to take his case. This has been going on since March 2018. They lost in the first Federal court as the judge thought bumpstocks were shotguns, so they appealed to the Fifth Circuit in New Orleans. After an en banc panel, Cargill won 13-3. Unfortunately, the judge didn't declare what relief Cargill was to be awarded. Was it going to be legal for him to own them, for people in the state of Texas to own them, for the people in the 5th Circuit to own them, or for the whole United States to own them. On April 6, just before it was too late to move forward, they filed writ of certiorari to be heard at the Supreme Court. What amazes me is that Cargill is doing this on his own dime, hoping to get some help from the 2A groups out there. Dissecting the Fifth Circuit's Opinion in Cargill v. Garland A three-judge panel of the Fifth Circuit held that the federal statute defining “machineguns” covers bump stocks, which are non-mechanical devices that can be attached to semi-automatic rifles. The panel's decision conflicts with the views of a significant majority of judges who have examined that issue. If you could see patriotism in someone's veins, Michael Cargill's blood would show red, white, and blue. Deep in the heart of Texas, we visited Michael of Central Texas Gun Works. This unassuming shop sits centrally located and provides everything from classes to gun sales. Celebrating his 10th year since opening CenTex, Michael has a lot of experience under his belt (his belt, by the way, usually holds a huge, incredible silver buckle that's arguably the size of Texas).But there's more than just a buckle on his belt, there are notches of experience too, and it starts in Ft. Lauderdale, Florida where Michael was born and raised. After completing school, he went on to join the United States Army where his home was more nomadic during his 12 years of service. That is, until he landed a job in Austin, Texas. And after a few jobs as a civilian, he went on to open up Central Texas Gun Works.But what facilitated such a career move? A devastating experience to a family member. After that, Michael decided to take action by educating and teaching his family self defense, gun safety, firearms laws, and shooting. The exposure grew quickly from there. What was once just training his family in his living room grew to neighbors and friends and an overbooked conference room. It was then he began his journey of setting up his own shop.In this episode, you'll learn all about what makes Michael tick. The Challenge Against ATFs Ban on Bumpstocks NCLA's Harriet Hageman joins the podcast as a guest host and interviews Litigation Counsel Caleb Kruckenberg about the latest in our challenge against ATFs bump stock ban. NCLA recently filed a reply brief in Cargill v. Garland, et al. in the United States Court of Appeals for the Fifth Circuit, seeking to overturn the federal ban on bump stocks and to halt its enforcement. NCLA contends that only Congress, not an administrative agency like the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), can write criminal laws such as the ban on bump stocks. The Bump Stock Final Rule became effective on March 26, 2019, and some 520,000 bump stock owners nationwide are subject to a 10-year prison sentence unless they destroy or surrender the devices. NCLA represents Austin, Texas resident and gun enthusiast Michael Cargill. Mr. Cargill surrendered two bump stocks to the Austin ATF Field Office in accordance with the ban. This case was the first challenge to ATF's bump stock ban to go to trial last September. NCLA also represents W. Clark Aposhian, a resident of Salt Lake City, Utah, in another lawsuit challenging the ban. In March, the U.S. Court of Appeals for the Tenth Circuit, sitting en banc, voted 6-5 against Mr. Aposhian. NCLA plans on filing a petition for a writ of certiorari with the U.S. Supreme Court in Aposhian v. Wilkinson, et al. This week, NCLA filed two motions for summary judgment asking a judge in Florida's 11th Judicial Circuit to rule against Coral Gables and the Florida Department of Law Enforcement (FDLE) over their warrantless collection of personal data in violation of client Raul Mas Canosa's right to privacy under the constitutions of the State of Florida and the United States. Mr. Mas Canosa, a resident of Coral Gables, was alarmed when he received 80 pages of documents from the city tracking his vehicle's movements using Automated License Plate Readers (ALPRs) installed around the city. The images, captured over a 5-month period, show Mr. Mas Canosa going to the supermarket, to the dry cleaner, to doctors' appointments, to a meeting with a client, to a city commission meeting, and to various other locations across the city. There are 18 ALPR devices located at major intersections and other strategic points throughout Coral Gables. The locations form a perimeter around the city and were selected to encompass the most traffic possible so the system would maximize surveillance potential. These cameras take pictures of license plates 24 hours a day, seven days a week and then store that data for a period of three years. The information gathered by the ALPRs is searchable and available to 68 different law enforcement agencies, including the FBI. The Supreme Court held in Carpenter v. United States that “an individual maintains a legitimate expectation of privacy in the record of his physical movements as captured through” digital surveillance. Coral Gables's ALPR system unlawfully aggregates data about Mr. Mas Canosa's movements over time and impermissibly shares that data with law enforcement without any particularized suspicion.
