Welcome to the corner of sports and the law, with your hosts Dan Wallach and Dan Lust. This week was a busy one, so sit back and enjoy. The Dans start with the Deshaun Watson appeal. (3:15) The NFL has appealed the punishment decision by Judge Robinson. Commissioner Goodell decided to use a neutral party handle the appeal and selected Peter Harvey, who is the former New Jersey attorney general. However, Harvey has previously been an arbitrator for the league, was on the NFL advisory committee, and helped create the language of the personal conduct policy. The reasoning for Judge Robinson's decision and the number of games is the issue at hand. The Dans analyze the reasoning she may have used and what Harvey may use based on NFL's recommendations for punishment. Where will the punishment have to land so this case doesn't end up in federal court? 12 games? A full season? The Dans also break down what happens after the decision by Harvey, and which court does the federal appeal end up in as both parties race to the courthouse. Another issue to break down is whether Watson has waived his right to a temporary restraining order (TRO) because he and the NFLPA failed to appeal the ruling by Judge Robinson. (35:30) Dan Wallach gives three reason why Watson won't get a TRO: 1) Waiver of irreparable harm; 2) the NFL appeal is for the modification and extension of the 6 games, not amending and restating; and 3) there is no argument that wipes out the entirety of the punishment. Dan Wallach sits down with Massachusetts Senator Eric Lesser (@EricLesser) to discuss the Massachusetts sports gaming bill. (59:55) The Governor is expected to sign the bill into law. Ray thinks that Benny Snell has separated himself from Anthony McFarland in the "battle" for backup running back. Ray says this preseason game is the most anticipated in at least the last 20 years. "The only way he won't be the starter in Cincinnati is if he falls flat on his face in the preseason games."  Ray says people need to take it a littttle easier on the Pickens praise. He thinks the offensive line is somewhere between bad and okay thus far in camp. Ray doesn't think Roquan Smith is realistic because he's going to cost so much money. Ray thinks Alualu is the big key to the Steeler rush defense.We revisit the Rodolfo Castro phone-gate! JEREMY FOWLER - Jeremy Fowler thinks that Roquan Smith is worth calling on. He thinks the compensation in a deal is going to be reasonable..."not a first round pick." But he thinks Smith wants to be paid at least 18 million a season. Jeremy talked about players representing themselves and says we may see it more and more. Teams are scared of it, according to Fowler. Jeremy says there's no more "stating cases" in the NFL v. NFLPA in the Watson case. Fowler says the Browns are hoping for a decision by the end of the week, but nobody knows for sure right now. Fowler thinks the decision could be a compromise w/ a big fine. Doug goes into the "division of labor" in a three game preseason schedule. He gets more specific w/ the Steelers and what he would do if he were in charge. He also said as an evaluator, he loved the final preseason game. Doug also gets into "training camp heros." He said expectations need to be lowered a bit for George Pickens.  Doug's QB rotation for game one...Trubisky two series. Then Mason for the rest of the first half. Kenny Pickett plays the second half. He thinks the reps in an NFL game would aid Kenny in understanding the process. Doug says it's all about the mental side of things for Pickett because he will likely be out there against a third-team defense. We ask Doug if the Steelers should pursue a Roquan Smith trade. Doug says you have to make the cursory call to the Bears about Roquan Smith. He says you have to be careful not tamper. With Smith representing himself, he said that's a tough thing to do. He said given the Dolphins tampering case, you can't even take a risk. Doug thinks Devin Bush's injury was the main cause of his failures so, in Doug's mind, he thinks the Steelers overdrafted Bush's mental ability! Doug doesn't think it's a bad idea for players to represent themselves, because the NFLPA will always advise players in those situations. Dorin agrees, but Colin and Chris push back.

On Friday, the Liberals announced that the temporary ban on handgun imports would be taking effect on August 18 as a "stopgap" while the more comprehensive national freeze moves through the legislative process. Public Safety Minister Marco Mendicino and Foreign Affairs Minister Melanie Joly held a joint press conference in Etobicoke on Friday to discuss the move, which according to CTV News, was pushed through without the approval of Parliament. "There's no doubt that there is a very pressing issue that lies before us," Mendicino began, "and that is the need, the necessity to eradicate gun violence, one of the most pernicious and complex social harms that we see visited upon our communities every day." He went on to announce that in order to hasten the implementation of the handgun freeze laid out in Bill C-21, "nearly all individuals and businesses in Canada will be banned from importing handguns" beginning August 19. Joly explained that as foreign minister, she has "the authority to deny any import or export permit application that is contrary to Canada's security." She noted that when Trudeau announced the freeze in May, there was an "uptick" in guns being purchased by Canadians. "We want to prevent that," she said, explaining that since most guns in Canada are not made in Canada, implementing a ban on imports would effectively ensure no new guns are purchased legally. The move to ban handguns has faced pushback from many who question its effectiveness. In 2019, for example, Vancouver police Chief Adam Palmer said that Canada already had very strong firearms regulations in place and that no further action was required. If passed, it would declare the city’s support for the U.S. Supreme Court’s recent overturning of Roe v. Wade and ban the act of abortion, abortion clinics, and abortion pills in the city. The resolution allows exceptions for women at risk of losing their lives in the process of birth and for victims of rape or incest. It also suggests that human beings do not have the authority to decide to end the life of the unborn. “We believe that life is God-ordained and God is the author and finisher of every life,” the resolution states. “[A]s a city council, we will protect and sustain life at every stage.” The resolution cites Poelker v. Doe of 1977—a legal precedent that allowed a city in Missouri to refuse to provide publicly funded hospitals for nontherapeutic abortions even though it provided facilities for childbirth—saying that “the Constitution does not forbid a state or county or city … from expressing a preference for normal childbirth instead of abortion.” Councilman Steve Knoblock, who proposed the resolution, hopes it will help to initiate change within California, considering the current trend in pro-abortion laws. “The ultimate purpose of government is to protect the life and liberty of humans including unborn individuals,” Knoblock told The Epoch Times in an interview. Councilwoman Laura Ferguson told the City News Service Aug. 3 that it was a “distraction” from more important topics in the city—such as homelessness—when abortion is “something already legal and codified in state law.” A spokesperson for the state Attorney General Rob Bonta’s office said access to abortion remains fully protected under state law, according to the City News Service. Adams has requested city agencies to provide photographs of potential hires to City Hall as candidates go through the interview process for city jobs ranging from assistant commissioner to departmental press secretary, Politico reported Thursday. Several unnamed city officials told the outlet that the request is clearly an effort to hire more diverse staffers. However, Adams maintains that it will merely help him recognize his employees in the sprawling city workforce. “Everyone knew what it was. There was no question. It was the first thing everybody said: ‘We’re going to start counting complexions now,’” one recently-departed City Hall employee told Politico. The majority of the officials interviewed by the outlet — who requested anonymity to speak freely about the internal measure — said they supported a more diverse workforce but worried the practice is already causing the Adams administration to make hiring decisions with a greater emphasis on race and ethnicity than merit. Compounding the issue, nearly every official Politico spoke to also said the headshot request created another snag in the drawn-out hiring process — straying away from the mayor’s signature motto of “get stuff done” at a time when city job vacancies are unusually high. About 8 percent of municipal jobs were vacant as of April, according to data from the Citizens Budget Commission. Politico obtained emails sent by the mayor’s team to about a dozen high-ranking officials at other city agencies asking them to submit headshots of people they hope to employ for Adam’s own review. On Friday, the Liberals announced that the temporary ban on handgun imports would be taking effect on August 18 as a "stopgap" while the more comprehensive national freeze moves through the legislative process. Public Safety Minister Marco Mendicino and Foreign Affairs Minister Melanie Joly held a joint press conference in Etobicoke on Friday to discuss the move, which according to CTV News, was pushed through without the approval of Parliament. "There's no doubt that there is a very pressing issue that lies before us," Mendicino began, "and that is the need, the necessity to eradicate gun violence, one of the most pernicious and complex social harms that we see visited upon our communities every day." He went on to announce that in order to hasten the implementation of the handgun freeze laid out in Bill C-21, "nearly all individuals and businesses in Canada will be banned from importing handguns" beginning August 19. Joly explained that as foreign minister, she has "the authority to deny any import or export permit application that is contrary to Canada's security." She noted that when Trudeau announced the freeze in May, there was an "uptick" in guns being purchased by Canadians. "We want to prevent that," she said, explaining that since most guns in Canada are not made in Canada, implementing a ban on imports would effectively ensure no new guns are purchased legally. The move to ban handguns has faced pushback from many who question its effectiveness. In 2019, for example, Vancouver police Chief Adam Palmer said that Canada already had very strong firearms regulations in place and that no further action was required. If passed, it would declare the city’s support for the U.S. Supreme Court’s recent overturning of Roe v. Wade and ban the act of abortion, abortion clinics, and abortion pills in the city. The resolution allows exceptions for women at risk of losing their lives in the process of birth and for victims of rape or incest. It also suggests that human beings do not have the authority to decide to end the life of the unborn. “We believe that life is God-ordained and God is the author and finisher of every life,” the resolution states. “[A]s a city council, we will protect and sustain life at every stage.” The resolution cites Poelker v. Doe of 1977—a legal precedent that allowed a city in Missouri to refuse to provide publicly funded hospitals for nontherapeutic abortions even though it provided facilities for childbirth—saying that “the Constitution does not forbid a state or county or city … from expressing a preference for normal childbirth instead of abortion.” Councilman Steve Knoblock, who proposed the resolution, hopes it will help to initiate change within California, considering the current trend in pro-abortion laws. “The ultimate purpose of government is to protect the life and liberty of humans including unborn individuals,” Knoblock told The Epoch Times in an interview. Councilwoman Laura Ferguson told the City News Service Aug. 3 that it was a “distraction” from more important topics in the city—such as homelessness—when abortion is “something already legal and codified in state law.” A spokesperson for the state Attorney General Rob Bonta’s office said access to abortion remains fully protected under state law, according to the City News Service. (39:47) Deshaun Watson's suspension has finally come down to where an arbiter handed down six games for him to sit out at the start of the 2022 season. Thing is, the NFL has appealed that the suspension should be harsher. The Players Association was hoping that the league would've stood pat. Will this be a fight to the bitter end? How much will Watson get when it's all said and done? The Miami Dolphins were docked a first round draft pick next year, fined and their owner, Stephen Ross, was suspended for tampering violations against Tom Brady and former Saints coach, Sean Payton. Was this penalty warranted? (48:15) In an interview this week, Greg Norman shouted out Tiger Woods as he allegedly passed up $700-$800 million from the LIV Golf Tour. Is Tiger in the wrong for not jumping to where the money is? Dan Lust is joined by Mike Lawson and our resident DA, Matt Tympanick (@TympanickLaw) to break down the latest in the Sports Law world. Deshaun Watson's punishment has finally been decided (for now). (2:15) Judge Sue Robinson issued her ruling Monday August 1 at 830am and found the NFL met their burden that Watson violated the personal conduct policy. The punishment for Watson is 6 games. The NFL has until Thursday August 4 to file an appeal, as the NFLPA has issued a statement that they will not be filing an appeal. If the NFL appeals, it would be reviewed by Commissioner Roger Goodell to make a decision on increasing the punishment. At that point, the NFLPA could appeal to Federal Court. Watson has also settled three more civil cases, which leaves one remaining civil case. Stephen Ross and the Dolphins were found to have violated the NFL anti-tampering policy with their impermissible communcations with Tom Brady and Sean Payton. (32:34) Stephen Ross and Bruce Beal (co-owner of Dolphins) participated in impermissible contact twice with Tom Brady, the first when he was with the Patriots in 2019-2020 and the second violation when he was with the Buccaneers in 2021, and impermissible contact once with Sean Payton in 2022 before he retired from the Saints. Ross is suspended for 6 weeks and suspended $1.5 million. Dan Snyder testified before the Congressional House Oversight Committee virtually for 11 hours. (46:26) The deposition was conducted behind closed doors, and it does not appear that the testimony will be released.  *** Have a topic you want to write about? When they're not using their athletic powers on the field, NFL players, like today's guest, are finding ways to serve as superheroes for their communities. This week, we are joined by Michael Thomas, a fellow Stanford graduate and one of the NFL Player Association's most active players, both on and off the field, having played with the San Francisco 49ers, the Miami Dolphins, the New York Giants, the Houston Texans, and the Cincinnati Bengals over the course of his decade-long career. Throughout his time with the NFL, Mike has always been an active community member, creating the Big Plays for Big Brothers Big Sisters of Miami, being named NFLPA Community MVP in both 2015 and 2016 for his youth mentorship initiatives, and hosting ‘Camp Mike T' to expose kids to unique opportunities for financial literacy and college prep programs. He also formed part in the NFLPA's 2018 and 2019 Externship classes, during which he worked closely with Representative Sheila Jackson Lee to learn more about the political process on Capitol Hill.
