Erica Gaines is the President and CEO of TacMobility: Controlling the Mind + the Machine, a training program whose vision is to heal the racial divide between people of color (POC) and police officers through law enforcement wellness and community dialogue. Having met over 100,000 officers since 2013, “The Knife Girl'' has gained wide acceptance into the LEO community. While an unlikely candidate to advocate for police, this dark-skinned, multi-racial woman from Phoenix, AZ, continues to use her voice to talk about trauma recovery, self-awareness, and Suicide: the #1 Cop Killer in America.Her research began in 2016 when incidents of police involved shootings with unarmed black males were becoming frequent, prompting the onset of large protests. Feeling that the media portrayal of officers was inconsistent with her unique, personal experience but also wanting to get answers to questions like, “why can't you shoot people in the leg?”or “if officers are innocent, why the payouts?”, Erica embarked on a four-year journey of conducting candid interviews with police officers at training conferences. In 2017, she participated in the VirTra Use of Force Simulated Training at a FBI National Academy Associate (FBINAA) Conference. Forever changed by the physical experience of a shoot, Erica wondered if ‘police bias' had more to do with a physiological stress response than racism. With inadequate clinical research to pull from, in 2019, Erica created the world's most extensive ongoing study of Law Enforcement Officers and Cumulative Stress. Armed with data, in 2020, Erica created a 4-hour Peace Officer Standards & Training (POST) training course accredited through the National Certification Program (NCP) , developed by the International Association of Directors of Law Enforcement Standards and Training (IADLEST). The training program and fiscally sponsored non-profit, TacMobility: Controlling the Mind and the Machine, offers stress and trauma awareness, rehabilitative stretching, and self-awareness to police officers in the United States. A former Abington police officer, Joshua Heal, who allegedly had a sexual relationship with Sandra Birchmore, may soon be decertified by a state watchdog group, according to Abington Police Chief John Bonney. Chief Bonney, a recent addition to the department from Stoughton, confirmed he has recommended Heal's decertification to the Peace Officer Standards and Training (POST) Commission. Heal, who served as a school resource officer, came under scrutiny in connection with Birchmore's death after an internal investigation revealed disturbing details. Birchmore was found dead in her Canton apartment in 2021. Initially deemed a suicide, her death is now believed to be a homicide orchestrated by former Stoughton officer Matthew Farwell, who allegedly maintained a sexual relationship with her since she was 15. According to a federal indictment, Farwell is accused of staging her death to resemble a suicide. Three former Stoughton officers, including Farwell, have been named as defendants in a wrongful death lawsuit filed by Birchmore's estate. The lawsuit alleges that Farwell, his twin brother William, and former officer Robert Devine groomed Birchmore after she joined a youth explorers program at age 13. Although Heal was also named as a defendant in this suit in 2023, charges against him were dismissed in 2024. Heal's attorney, Pete Farrell, clarified Heal's position in the ongoing federal investigation, asserting that Heal is cooperating fully as a material witness. “Allegations are allegations, and it is speculative at best to suggest that Mr. Heal may be decertified,” Farrell said in a statement to Boston.com. He added, “The Court made specific factual findings. Those findings speak for themselves and are a part of the Court record. These facts reveal Mr. Heal and Ms. Birchmore were friends and met while both were adults.” Court documents reveal that Heal met Birchmore in 2016 when she was an adult, adopting a cat from the shelter where Heal worked as an animal control officer. According to the records, “Defendant Heal admitted he received oral sex from Ms. Birchmore on at least one known occasion.” Heal also reportedly described their relationship as close friendship in conversations with investigators. Although court findings indicate that Heal and Birchmore did not know each other during her youth, her estate argues that Heal exploited his position, exerting influence over a “vulnerable young adult.” Furthermore, the complaint alleges that Heal had detailed knowledge of Birchmore's prior abuse and that he was aware Farwell tracked her phone activity. The lawsuit claims, “Heal owed Ms. Birchmore a duty to protect her from abusive and grooming behaviors exhibited by M. Farwell, W. Farwell, and Devine, and to refrain from exploiting his status as the Animal Control Officer to obtain sexual contact with Ms. Birchmore.” According to the POST Commission, Heal resigned from his position with the Abington Police Department “in lieu of discipline” and currently holds certification as an unassociated officer, which is set to expire on July 1, 2025. While Heal's future as a certified officer remains uncertain, POST has already taken action against other former Stoughton officers connected to the case. Dr. Sandie Morgan is joined by Daniel Varon as the two discuss the important of retribution and restitution for victims of trafficking and abuse. Daniel Varon Daniel Varon joined the Zalkin Law firm in 2020 bringing his experience as an attorney in the Office of the District Attorney in Orange County.  He is an experienced trial attorney, having tried approximately 60 jury trials during his work as Deputy District Attorney. The California District Attorney Investigators Association recognized him as Prosecutor of the Year in 2017. While at the Orange County DA's office, Daniel worked in the Human Exploitation and Trafficking Unit (HEAT). He maintained a full caseload and tried the first human trafficking of a minor case, following the passage of Prop 35. As a Senior Deputy in the DA's office, he handled pre-trial writs in the California Court of Appeals, drafted and argued appeals in the California Court of Appeal and Superior Court appellate department, and drafted requests for review in the California Supreme Court. During his time with the Orange County DA, he was also deeply involved in developing and presenting comprehensive human trafficking training programs for law enforcement and prosecutors in 12 counties across California. He served as a subject matter expert for California's Commission on Peace Officer Standards and training for development of its human trafficking training video and the Post Institute of Criminal Investigations, advancing human trafficking investigations. Before his work at the Orange County District Attorney's office, he worked for the law firm of Gilbert, Kelly, Crowley and Jennett in Los Angeles. Key Points The vertical prosecution model is essential in ensuring effective outcomes for victims, as it dedicates prosecutors to human trafficking cases, encouraging collaboration with police and law enforcement. The success of the HEAT unit relied on building trust not only among law enforcement but also with juvenile defenders, victim service providers, and the courts, creating a comprehensive support system for trafficking victims.  Daniel now represents victims of childhood sexual abuse and human trafficking, and he stresses the significance of focusing on restitution for victims, highlighting the long-term impacts of sexual abuse. The criminal and civil justice systems have key distinctions, particularly regarding the representation of victims, with criminal prosecutors acting on behalf of the state. In contrast, civil attorneys advocate directly for the victims. Some of today's top storiesThe state agency in charge of certifying California law enforcement officers met yesterday in West Sacramento to decide the professional future of a former Kern County Sheriff's lieutenant.    David Hubbard, fired in 2022 by the Sheriff's Office and now an employee of the Kern County District Attorney's Office, was facing his permanent decertification as a peace officer.    17's Robert Price was there and attended a hearing of the Commission on Peace Officer Standards and Training, or POST.     He files this report.A salary increase for the Superintendent at Greenfield Union School District is stirring up a heated discussion online. Many say the money should have gone to teachers or even students, instead. At last night's district board meeting, the issue was not a topic of discussion, however, we spoke with those who attended the meeting on both sides of the issue. Superintendent Ramon Hendrix began his post in 2017, after serving on the board of trustees for eight years.     When he took the position, according to Transparent California, Hendrix's first reported salary in 2018 was more than $214,000 with pay and benefits.     That was bumped up to $250,000 a few years later.    Now under the new contract, Hendrix is set to receive around $330,000 with a more than 7,000 dollar increase in each salary tier. On that same salary schedule, a year-round teacher would begin at around $47,000 and continue to move up to around $61,000, seeing a nearly 15-hundred dollar increase each salary tier.Yesterday, protesters and counterprotesters took to the Kern County Superior Court... ahead of a hearing on unionization for farm workers.     The back and forth between UFW and Wonderful has grown messier... but at its core... it's about unionizing and how easy joining one should be.  Last year... California started a new union authorization method called a card check law. If a *majority* of employees sign an authorization card... *all* employees become part of a union. That's why Wonderful Nurseries and the UFW have been clashing now... for months.     The California Agricultural Labor Relations Board authorized UFW to represent Wonderful workers... saying a majority signed on.     But Wonderful and nearly 150 workers allege they were tricked by the UFW into signing a card. Now... Wonderful has filed a lawsuit against the ALRB... challenging the card check law itself. While there was no ruling during yesterday's three-hour hearing... the judge says he'll also decide if the hearings between Wonderful and the UFW continue... while the future of the card check law itself is debated.

As a Commissioner, Sheriff Moon will have a direct hand in setting law enforcement policy and determining how every prospective officer in California is selected. Sheriff Moon attended her first meeting today in Los Angeles. Cláudio Mendonça spoke with her recently to learn more.A new investigation found that thousands of people with serious mental illnesses are living in California nursing homes. The release of the data is being called ​​“a major milestone” in the effort to increase transparency and accountability in our state's law enforcement system. On Monday morning, there was a somber procession of law enforcement vehicles that escorted the body of Pope County sheriff's deputy, Joshua Owen, from the Twin Cities, where an autopsy took place, to Glenwood Minn., the seat of Pope County. There's a growing memorial of flowers and flags outside the Pope County Sheriff's office in honor of Deputy Owen who was shot and killed while two other law enforcement officers were injured during a domestic dispute call on Saturday. Kelly McCarthy is chair of the Peace Officer Standards and Training Board and the Mendota Heights Police Chief. She MPR News host Cathy Wurzer to talk about what this recent police killing means for officers and their mental health.

Did you know that on September 29th, 2022, new laws were set in place in the state of California that would allow non-citizens to become police officers?   Yeah…I didn't either.   In a new world where Defunding the Police has become commonplace, this new law also lessens the educational requirements needed to become a police officer.   Tune in as Coach Ashlie Walton breaks down some of the concerns and questions that we should all be asking ourselves.   I've included the abstract below. You can read the full SB 960 here.    SB 960:   ABSTRACT Existing law establishes the Commission on Peace Officer Standards and Training within the Department of Justice to perform various functions involving the training of peace officers. Existing law requires peace officers in this state to meet specified minimum standards, including, among other requirements, being at least 18 years of age, being of good moral character, as determined by a thorough background investigation, and being either a citizen of the United States or a permanent resident who is eligible for and has applied for citizenship, except as prescribed. This bill would provide that those standards shall be interpreted and applied consistent with federal law and regulations, as specified. The bill would remove the provision that requires peace officers to either be a citizen of the United States or be a permanent resident who is eligible for and has applied for citizenship, and would instead require peace officers be legally authorized to work in the United States, and make conforming changes. Under existing law, the minimum education requirement for peace officers is high school graduation from a public school or other accredited high school, passing an equivalency test or high school proficiency examination, or attaining a 2-year, 4-year, or advanced degree from an accredited institution. Existing law requires accreditation to be from a state or local government educational agency, a regional accrediting association, an accrediting association recognized by the United States Department of Education, or an organization holding full membership in specified organizations, including AdvancED. This bill would revise the accreditation standards to include an organization holding full membership in Cognia. (2) Existing law establishes, within the Transportation Agency, the Department of the California Highway Patrol, under the control of the Commissioner of the California Highway Patrol. Existing law, with certain exceptions, prohibits a person who is not a citizen of the United States from being appointed as a member of the California Highway Patrol. This bill would remove that prohibition, and would make conforming changes. The Peace Officer Standards and Training Commission (POST) as part of their recertification process has been seeking to have officers fill out a questionnaire to determine if they have “good moral” character. On said questionnaire it asks the officer questions such as if they've posted anything on social media that “you believe could be perceived as bias against anyone”. A group of law enforcement organizations took aim with these questions and challenged the “boy scout standard”. A judge has now thrown out two questions on the POST's questionnaire. President of the MASS C.O.P. Scott Hovsepian joined Dan to discuss.

Good Morning, Colorado, you're listening to the Daily Sun-Up with the Colorado Sun. It's Tuesday July 20th,   Today - Officials are saying there'll be 2.5 million fewer acre-feet of natural runoff flowing into Lake Powell this year.    Now, water engineers are now forced to switch gears, meaning they'll be pulling water from other sources.   But before we begin, let's go back in time with some Colorado history adapted from historian Derek R Everett's book “Colorado Day by Day”:   Today, we're taking you back to July 20th, 2012 when a movie theater in Aurora filled with patrons for the debut of “The Dark Knight Rises”. But what started as excited escapism turned into an infamous moment of domestic terrorism when a gunman opened fire on the crowd, killing 12 people and injuring others.    Now, our feature story.   The on-going drought in the West has become so severe that federal officials predict there will be 2.5 million fewer acre-feet of natural runoff flowing into Lake Powell this year. Water levels are in danger of falling below the electric turbine intakes for the lake's Glen Canyon Dam, which is alarming news for the power grid. Federal water engineers are now forced to switch to Plan B, which means pulling water from other sources — including Colorado's Blue Mesa Reservoir. Colorado Sun's social editor Danika Worthington talks with reporter Michael Booth about the dangerously low water levels.   To read more of Michael's reporting on the impact of the drought on the West, go to coloradosun.com.  And Before we go, here are a few stories that you should know about today:   A 24-year-old man has been convicted of vehicular homicide after prosecutors say he hit a car while driving around 120 mph during a Facebook livestream showing him speeding. Bryan Kirby was accused of driving as fast as 167 mph during the stream on a highway near Denver while making comments to viewers about his speed. He rapidly crossed from the left lane to the right and crashed into a sedan from behind. The driver of the sedan died at the scene.   In 2018, former Georgetown police officer Jon Geiger was convicted of excessive force. It triggered an automatic revocation of his officer's state certification, which is supposed to prevent him from working as a police officer in Colorado. But now he's serving as an interim police chief for the small town of Nunn in Weld County. How? A loophole that allows the Peace Officer Standards and Training board to keep officers who have been convicted of crimes in their jobs. His case highlights the power of the POST board as state lawmakers work to increase police accountability.    The total number of marijuana arrests dropped 68% between 2012 and 2019, according to a new report from the Colorado Department of Public Safety. The report, which aimed to track the impact of marijuana legalization, said the disparity of arrests by race and ethnicity had not changed in any meaningful way since legalization. For White Coloradans, the number of arrests dropped by 72 percent. For Black Coloradans, it dropped by 63 percent and for Hispanic Coloradans, it dropped by 55 percent. Although it's important to note that report writers said it was difficult to find definitive impacts of legalization because of a variety of factors, including data sources that vary considerably, a lack of pre-commercialization data and a decrease in social stigma.     For more information on all of these stories, visit our website, www.coloradosun.com. While an unlikely candidate to advocate for police, this dark-skinned, multi-racial woman from Phoenix, AZ, continues to use her voice to talk about trauma recovery, self-awareness, and Suicide: the #1 Cop Killer in America.Her research began in 2016 when incidents of police involved shootings with unarmed black males were becoming frequent, prompting the onset of large protests. He was responsible for the oversight of 39 POST Certified academies that delivered the state-mandated training standards for new police officers, the development of secured testing procedures and protocols, background investigation standards, in-service training programs, the development and delivery of learning technologies, maintaining effective liaison with State Legislative members, ensuring the timely development of legislatively mandated law enforcement training programs, ensuring the compliance of POST standards with approximately 600 law enforcement agencies within the State of California, and maintaining an effective dialogue among Chiefs, Sheriffs, labor and managerial and academic interests statewide. California lawmakers entered the end of session Monday facing a number of important bills fashioned to curtail police violence against state residents. Sadly, given the madness of the evening, some bills--such as SB 731, which would have stopped problem cops from finding work in the state, SB 776, which would have made more police misconduct records publicly available, and AB 66, which would've restricted cops' use of rubber bullets and pepper spray and banned tear gas against demonstrators--didn't even make it to a final vote. A few cop reform bills will be crossing Governor Gavin Newsom's desk, however: AB 1299 - Would make police agencies alert the Commission on Peace Officer Standards and Training if an officer resigns or is fired during a misconduct investigation. The department would then have to complete its review and follow up with details of the findings, which would create records that would be disclosed of the cop tries to find another job in policing. AB 846 - Would make departments include in evaluations of prospective cop hires any bias against demographics like race, gender, sexual orientation or religion. It would also make police recruiting materials highlight 'community relations' as part of the job. AB 1196 - Bans carotid artery restraints and choke holds. AB 2054 - Creates a pilot grant program for community organizations to handle certain first-response crises instead of law enforcement. (See our episode with Asantewaa Boykin of MH First to learn more on this concept.) SB 629 - Lets media representatives into areas closed off by law enforcement during demonstrations and rallies, and would prohibit cops from citing the press. AB 1506 - Elevates more cases of cops killing unarmed people to state attorney general investigations (as opposed to just the local county district attorney addressing them). AB 1185 - Allows voters and county boards of supervisors to create oversight committees on sheriff's departments with actual subpoena power. Here in Sacramento County, Supervisor Pat Kennedy is already moving to create such an oversight committee, publishing this op-ed in the Sacramento Bee two days after AB 1185's passing through the legislature.   You may have seen this heartening article on California's firefighting inmates seeing a law pass through the legislature that would give them a path toward becoming firefighters after their release from prison. Matt Scharper is a Deputy Chief with the California Governor’s Office of Emergency Services - Law Enforcement Branch and is the California State Search and Rescue Coordinator.  Matt is headquartered out of the Region V office, located in Fresno, CA and is also the Law Enforcement Mutual Aid Coordinator for Region V.   In this episode Scharper takes pride in lives saved over his 30+ years with SAR, and talks about one of the most recent rescues and how it nearly turned into a recovery mission. He also talks about how inexperienced outdoor enthusiasts put too much reliance on Personal Locator Beacons (PLBs and SEND) which unnecessarily puts other lives at risk. And there's the technology and military mutual aid that has made night SAR missions possible.  Sharper is a recognized expert in the field of Search and Rescue, he spent 13 years as the Search and Rescue Unit Coordinator for the Mariposa County Sheriff’s Department and has over 34 years of combined search and rescue experience.   He has coordinated literally hundreds of searches, rescues, and large and small-scale disasters.  A previous college instructor for search and rescue topics of: Search Management and Tactics, Technical Rope Rescue, Swift water Rescue, Man Tracking, and Law Enforcement Incident Command Systems along with other Law Enforcement topics.  He is the lead instructor for the Cal EMA Search and Rescue Instruction Program, instructing the “Direction and Control of the Search Function Course” and the “Winter Operations SAR Management Course” and is responsible for all State of California SAR programs.  Matt’s 30 year law enforcement career has earned him California’s Commission on Peace Officer Standards and Training (POST) certificates of “Advanced, Supervisory, and Management”.  The Law Enforcement Branch is responsible for coordinating state mutual aid for search and rescue in California. In addition, it receives and coordinates interstate requests under the auspices of the National Search and Rescue Plan. The branch also coordinates all local requests for state and Federal agency assistance. He graduated from the Riverside County (California) Sheriffs Academy and holds a valid Peace Officer Standards and Training Certificate and a qualified Drug Abuse Recognition Expert, attaining a D.A.R.E. Certification while working as a Police Officer. Although Lawrence John is not an attorney, he's been asked to provide public commentary addressing a wide range of family law/legal and social topics and issues.
