Welcome to Module 2, where we delve into the intricacies of the Fourth Amendment to the United States Constitution. This amendment forms the cornerstone of privacy rights and protections against unreasonable searches and seizures. We will explore the concept of reasonable expectation of privacy, the requirements and processes for obtaining search warrants, exceptions to these requirements, the legalities of stop and frisk procedures, and the important principles of the exclusionary rule and the Fruit of the Poisonous Tree Doctrine. Let's begin. Search and Seizure. Reasonable Expectation of Privacy. The Fourth Amendment protects individuals against unreasonable searches and seizures. Central to this protection is the concept of a “reasonable expectation of privacy.” This expectation exists when: An individual exhibits an actual (subjective) expectation of privacy; and Society is prepared to recognize that expectation as reasonable (objective). Illustrations of Reasonable Expectation of Privacy: In one's home, personal property, or private communications. In enclosed spaces like dressing rooms or private offices. In personal data stored on electronic devices. Cases Illustrating Expectation of Privacy: Katz v. United States: The Supreme Court ruled that the Fourth Amendment protected a person's conversations in a public phone booth. Carpenter v. United States: The court recognized a reasonable expectation of privacy in the location data of a person's cell phone. Warrant Requirements. A search warrant is a legal document authorized by a judge or magistrate, allowing law enforcement to conduct a search of a specific place for specific items. The Process and Legal Standards: Probable Cause: The officer must show probable cause, a reasonable basis to believe that a crime has been committed and that evidence relevant to the crime is likely to be found in the place to be searched. Sworn Affidavit: The officer must provide a sworn statement detailing the facts that establish probable cause. Specificity: The warrant must specify the location to be searched and the items to be seized. Judicial Approval: A neutral and detached judge or magistrate must review the affidavit and issue the warrant. Exceptions to the Warrant Requirement. There are several situations where law enforcement can conduct searches without a warrant: Consent: If a person voluntarily consents to a search. Plain View Doctrine: If the evidence is in plain sight of an officer legally present at the scene. Search Incident to Lawful Arrest: If a search is conducted immediately following a lawful arrest. Exigent Circumstances: In situations requiring immediate action, such as to prevent harm or the destruction of evidence. Automobile Exception: Due to the mobile nature of vehicles, searches may be conducted with probable cause but without a warrant. Stop and Frisk. Terry Stops. A Terry stop, named after the landmark case Terry v. Ohio, allows police to briefly detain a person based on reasonable suspicion of involvement in criminal activity. Legal Basis and Requirements: Reasonable Suspicion: A standard less than probable cause, based on specific and articulable facts. Limited Scope: The stop should be brief and limited to the purpose of confirming or dispelling the officer's suspicions. Pat-Down for Weapons: If the officer reasonably believes the person is armed and dangerous, a pat-down for weapons is allowed. Reasonable Suspicion. Reasonable suspicion is a legal standard, lower than probable cause, that is based on specific, articulable facts and rational inferences. Examples of Reasonable Suspicion: A person matching the description of a suspect in a recent crime. Evasive or unusual behavior under certain circumstances. Visible indications of illegal activity. Exclusionary Rule and Fruit of the Poisonous Tree Doctrine. Development and Application. In 2014, Lance Rodriguez was riding a bike around Queens, New York, when he was stopped by police.  Whether you know it or not, a very different legal precedent has been established for when police stop bike riders, versus when they stop drivers in motor vehicles. Do you continue to test for Marijuana in the workplace or not? We have recently seen an increasing "relaxed" stance on testing for Marijuana, more so in companies choosing NOT to Pre-Employment test for Marijuana saying that they are unable to find qualified applicants who can pass a drug test if they include Marijuana. What is more concerning and confusing, especially for employees is these same employers WILL test for Marijuana for Reasonable Suspicion or Post-Accident situations. We have had many employees refuse a test for reasonable suspicion or a post-accident citing not being tested for Marijuana when they got the job, so why are they worried about it now? Great question! This is continuing to be a major hurdle for employees and will become even more complicated with many states now in the process of legalizing Psychedelic drugs for the treatment of PTSD and other medical conditions. Hey guys, this is Anthony, Senior Legal instructor with blue two gold law enforcement training. Just got a question from an officer in Idaho. Two great questions, I want to share it and give you my thoughts about it. The question is, is if you have reasonable suspicion or probable cause that a passenger in a vehicle, right has committed a crime, can you stop the vehicle even though you have no reasonable suspicion? or probable cause that the driver has committed a crime? And the answer is yes. And let's look at why the answer is yes. First of all, we know that the US Supreme Court has already said that, when you have reasonable suspicion or probable cause that the driver has committed a crime, the car can be stopped, even though there's passengers in the vehicle, right. And so the Supreme Court has held that those passengers are legally seized under the Fourth Amendment, even though you have no suspicion that they've committed any crime. So we already know that. So we know, based on that logic, that the reverse is true, that if you have reasonable suspicion, or probable cause, that the passenger has committed a crime, let's say you think that they have a warrant, or they're not wearing their seatbelt, they throw a cigarette out the window, you know, that type of crime, we know that we can stop the vehicle because that's where the passenger is, even though the driver has not committed any crime. And so that's the that's the logic behind it. But there's a few things I want to kind of share with you before I end off and one is, remember, just that the driver has at this point not committed any crime. So, you know, demanding a license demanding registration insurance is maybe not appropriate, right? Because they are just they happen to be there, you have lawfully stopped them, but whether or not you can lawfully identify them, just because they're in the car, it may or may not be may not be required. I mean, because if you stop the driver, and for speeding, for example, can you demand that a passenger provided identification? The answer is generally no. Right? Because they just happen to be there, even though they are seized under the Fourth Amendment. They have not done anything wrong. So you're required your your requirement to identify themselves is really not applicable. I think the reverse is true for the driver. Now, if you ask the driver, can I see some identification or see a driver's license and they tell you, I don't have a driver's license? Well, guess what? They have now committed a crime in your presence. They just told you that they have no driver's license. So now that now you can take enforcement action on them, whether it's a citation, or an arrest. So that's the question. I hope this helps. In this archive episode, Dennis brings over Matt Lloyd in an off-the-cuff discussion describing the differences between reasonable suspicion and probable cause when stopping a vehicle. 01/08/2019.

In this archive episode, Dennis explains how a certain case did not disallow officers from making prolonged motor vehicle stops when there is PC or awaiting K-9 Units. Recorded on 05/23/2018. Rodriguez v US 2015 does not disallow Police Officers prolonging motor vehicle stops while awaiting the arrival of backup or a K9 Unit. It only required officers to have a Reasonable Suspicion of Criminal Activity before doing so. Remember the timelines change when a traffic stop turns into a criminal investigation. Citing Rodriguez - Criminal detentions generally require probable cause that the suspect is engaged in criminal activity, but an officer may conduct a traffic stop if the officer has a reasonable, articulable suspicion that the driver is engaging in criminal activity.[5] The Supreme Court of the United States has held that investigative detentions, including traffic stops, "must be temporary and last no longer than is necessary to effectuate the purpose of the stop."[6] Consequently, traffic stops may become unreasonable if they are unnecessarily prolonged.[7] When an officer conducts a traffic stop based on reasonable suspicion that the driver has committed a traffic violation, the Fourth Amendment permits the officer to conduct a number of investigative inquiries before resolving the traffic stop.[8] For example, officers may question the vehicle's occupants about matters unrelated to the traffic violation, and officers may walk a drug detection dog around the outside of the vehicle during the stop.[9] Officers may briefly prolong traffic stops to conduct these inquiries so long as the officer performs his tasks in an amount of time "reasonably needed to effectuate" the law enforcement purpose of the stop.[10]

In this archive episode, Dennis answers some group questions regarding K9 units and motor vehicle delays. Recorded on 10/13/2017. Illinois v Caballes (2005) US Supreme Court As found by the trial judge prior to the appeal, the dog sniff was sufficiently reliable to establish probable cause to conduct a full-blown search of the trunk. Caballes is the same as (2017) State v. Mark Dunbar (A-94-15; 077839) The Court adopts the federal standard barring unnecessary delays for the purpose of canine sniffs. Officers do not need reasonable suspicion of a drug offense provided that the canine sniff does not prolong the stop beyond the time required to complete the stop's mission. United States v Pierce (2010)- The United States Supreme Court has consistently held “That an exterior canine sniff of a car during a lawful traffic stop does not amount to a search under the 4th Amendment. It is also well established that, looking at the totality of the circumstances, a dog's positive alert while sniffing the exterior of the car provides an officer with probable cause.” Illinois v. Caballes - Amicus (Merits) | OSG | Department of Justice State v Sloan 2008 - Leaving a vehicle to be driven by a passenger or a third party allows you the right to check their driving credentials. (Criminal Wants / Warrants) This also allowed police officers to run warrant checks of passengers without Reasonable Suspicion. The police do not need a reasonable suspicion before they access the NCIC database. An NCIC check by the police is not a search under the federal or state constitutions. HELD: During a motor vehicle stop, the passenger, like the driver, is seized under the federal and state constitutions. Police do not need reasonable suspicion before they may access the NCIC database and, because accessing the NCIC database was within the scope of the traffic stop and did not unreasonably prolong the stop, there was no basis to suppress the evidence found. State of NJ v.
