April 17, 2025 ~ A federal judge's ruling has found probable cause that the Trump administration is in criminal contempt for violating court orders related to planes leaving for El Salvador. The United States is set to begin negotiations with Japan in Washington on Wednesday on tariffs and the cost of U.S. military support. "I will attend the meeting, along with Treasury & Commerce Secretaries," President Donald Trump wrote in a post on social media platform Truth Social.A federal judge on Wednesday said he has found probable cause to hold the Trump administration in criminal contempt of court for violating his orders to turn around planes carrying deportees to El Salvador. U.S. District Judge James E. Boasberg said he the administration must try to “purge” itself of a contempt finding or he will launch hearings and potentially refer the matter for prosecution.The Department of Justice is seeking a federal court injunction requiring Pine Tree State schools to immediately stop transgender boys from competing in girls' sports and return all athletic records and titles to their rightful female owners.

Summary of Criminal Procedure – Day 2 Introduction Day 2 covers criminal defenses and an introduction to criminal procedure, focusing on legal justifications and constitutional protections under the Fourth Amendment. Key Topics: Defenses to Crimes: Insanity, infancy, intoxication, self-defense, duress, necessity, and entrapment. Fourth Amendment: Search & seizure rules, warrant requirements, and exceptions. Exclusionary Rule: Preventing use of illegally obtained evidence in court. I. Defenses to Crimes Criminal defenses fall into two categories: capacity defenses and justification/excuse defenses. A. Capacity Defenses Insanity: Defendant lacked mental capacity to understand wrongdoing. Tests: M'Naghten Rule, Irresistible Impulse Test, Durham Rule, MPC Standard. Infancy: Juveniles may not be held criminally responsible (common law: under age 7 presumed incapable). Intoxication: Voluntary intoxication: Not a defense unless it negates specific intent crimes. Involuntary intoxication: Can be a defense if it causes loss of control or awareness. B. Justification & Excuse Defenses Self-Defense: Use of force must be proportional and necessary. Deadly force allowed if defendant faces imminent threat of death or serious harm. Defense of Others & Property: Same rules as self-defense, but no deadly force to protect property. Duress: Defendant coerced into committing a crime under threat of death or serious harm. Not a defense for homicide. Necessity: Defendant committed a crime to prevent a greater harm (e.g., breaking into a cabin during a blizzard). Entrapment: Law enforcement induced crime that defendant was not predisposed to commit. II. Introduction to Criminal Procedure The Fourth Amendment protects against unreasonable searches and seizures by law enforcement. A. Probable Cause & Warrants Probable cause: Reasonable belief that a crime has been committed. Warrant requirements: Issued by a neutral judge, based on sworn affidavit, specifying place and items to be searched. Arrests require probable cause, but warrants are not always needed if arrest occurs in public. B. Warrant Exceptions Some searches do not require a warrant due to public safety concerns or exigent circumstances: Search Incident to Arrest – Limited search of arrestee and immediate surroundings. Exigent Circumstances – Immediate threat to safety or evidence destruction. Consent Searches – Voluntary consent waives Fourth Amendment rights. Automobile Exception – Cars have reduced privacy, allowing searches with probable cause. Plain View Doctrine – Officers can seize evidence in plain sight if lawfully present. Stop and Frisk (Terry Stop) – Officers may briefly detain and pat down suspects if there is reasonable suspicion of criminal activity. C. The Exclusionary Rule & Fruit of the Poisonous Tree Illegally obtained evidence is inadmissible in court (Mapp v. Ohio (1961)). Exceptions: Good Faith Exception: Police relied on a warrant later found invalid. Inevitable Discovery: Evidence would have been found legally. Independent Source: Evidence came from separate, legal investigation. Conclusion Day 2 covered criminal defenses and the Fourth Amendment's search and seizure protections. These legal principles help determine when a defendant is legally excused and when law enforcement actions violate constitutional rights. Majorjon Kaylor is a man from Idaho who allegedly executed four of his neighbors after one of them allegedly exposed himself to his wife and child. The police were dispatched to investigate and when the alleged suspect wasn't punished, Majorjon allegedly told his wife and the police that he would take care of it himself if it happened again. Accoring to the affidavit, that's exactly what he did. Encountering law enforcement can be a nerve wracking situation, even if you've done nothing wrong. Imagine you've pulled over to safely deal with something in your vehicle, then have a police officer pull up behind you. Nothing to worry about, right? Then imagine, after providing your drivers license, you're pulled out of your car, searched, handcuffed, and "stuffed" into the back of the police cruiser while the officer searches your vehicle from stem to stern, even though you've done nothing wrong. Now image, after this arrowing abuse of power, the officer claims "qualified immunity" and asks the court to dismiss the case. That is what happened to Basel Soukaneh in Waterbury, CT. The current state of that case is certainly worth looking into.

No family members were present and Heuermann's estranged wife, Asa Ellerup, confirmed that the home had been searched. It isn't clear what prompted police to search the home or what specific information they were seeking. The medical examiner arrived at the home later in the morning and NewsNation's Laura Ingle saw very large evidence bags being carried out of the home. Last month, authorities conducted a multiday search of the woods in Manorville, New York, though it's not clear if this second search is connected. (News Nation)

Kansas Moms probable cause affidavit Veronica Butler, and Jilian Kelly AMARILLO, Texas (KFDA) - Court documents show the details of the investigation that led to the arrest of four suspects in the murders of Veronica Butler and Jillian Kelley. The affidavits of probable cause for the arrest warrants were released on 4/15/24. On Saturday, March 30, the Texas County Sheriff's Office requested the Oklahoma State Bureau of Investigation services with the suspicious disappearance of Veronica Butler and Jillian Kelley. Court documents say it was discovered that Butler was in a problematic custody battle with Tifany Adams for the custody of Butler's two children. The father of those children was Wrangler Rickman, Adams' son. Butler's visitation with her children was court ordered to be supervised every Saturday. It was arranged for Kelley to supervise the visit. Butler told family members she was going to pick up her children from Adams at Four Corners in Texas County. Butler and Kelley left Hugoton, KS and traveled to Highway 95 and Road L. Documents reveal Butler planned to bring her daughter to a birthday party but after they did not arrive, the family began looking for Butler. Family members located the abandoned vehicle just west of the intersection. The family members then contacted law enforcement. An examination of the vehicle and area surrounding the vehicle found evidence of a severe injury. On September 28, 2000, former Indiana State trooper David Camm returned to his Floyd County, Indiana home to find his wife and children murdered. After three trials and thirteen years in prison, he was acquitted. Camm's case remains known as one of the most egregious wrongful convictions in Indiana's recent history. So what did happen to the Camm family? Why did investigators hone in on Camm despite the fact a violent felon's DNA was found at the murder scene? What was the real story of all the blood evidence used to arrest and convict Camm?Retired Federal Bureau of Investigation agent Gary Dunn was kind enough to share with us a copy of the probable cause affidavit in Camm's case. Dunn investigated Camm's case for the defense, and chronicled his experience in the book Their Bloody Lies and Persecution of David Camm: Part One. It's a great book that delves deeply into the crime. Following the arrest, an announcement was made that the Probable Cause Affidavit requesting that Judge Diener sign off on Allen's arrest would be sealed. Late last month a redacted version of this 8 page document was released to the media and public.
