Guest Bio Ivy Cadle is the managing shareholder for Baker Donelson's Atlanta and Macon offices, and has established himself as a leading “dirt lawyer,” an advocate for property rights in the areas of real estate, eminent domain, land use, zoning, conservation easements and commercial lending litigation. Ivy is also a certified public accountant. Ivy represents companies of all sizes in complex business litigation and counsels them on regulatory compliance and data security, across a broad range of industries – including real estate, health care, financial services, and telecommunications.  His clients include oil and gas interests, fast food franchisors and franchisees, hotel investors, private medical practices, hospitals, insurance companies, cellular service providers, banks, mortgage servicers, commercial, shopping center and office developers, national drugstore chains, residential real estate developers, convenience store chains and a variety of individually owned enterprises, and business operations.   Ivy is a mediator and registered neutral with the Georgia Commission on Dispute Resolution. Outside of the office, Ivy serves as an adjunct professor of law at the Mercer University School of Law where he teaches Accounting for Lawyers. Today on the podcast, Robin and Lester interview Judge Alvin Wong, Georgia's first Asian American judge.   Guest Bio Judge Wong came to Richmond, Va. from Hong Kong when he was 14. His father enrolled him at Fishburne Military Academy in Waynesboro, Va., shook his hand and said he'd “see him next summer.” He followed a classmate from Fishburne to Auburn University without even knowing where it was. He graduated early and moved to Atlanta. He started taking night classes at John Marshal Law School and passed the Georgia Bar in 1976. He hung out a shingle and worked as a trial lawyer and then was a partner at Gambrell & Stolz (now Baker Donelson) for 20 years. Judge Wong was elected to the State Court of DeKalb County in 1999 and since his election in 1999, he's been reelected, unopposed, to six consecutive terms. With his election in 1999, he became the first Asian American judge in Georgia history. At that time, Asians made up less than two percent of registered voters in DeKalb County. In 2004, Judge Wong co-founded a DUI court to help people, calling it one of the most rewarding things he's done. He also sits on the board of the Lifeline Animal Project, a nonprofit that helps turn Atlanta animal shelters into no-kill shelters. He also brings to the courthouse Coco, a dachshund-chihuahua mix he rescued a decade ago. Jurors love to meet her after the trial is over. Judge Wong was elected by his peers in 2021 as president of the Georgia Council of State Court Judges, overseeing the entire state. His election marked the first time an Asian American served as president of any judicial council in Georgia. In 1993, Judge Wong and Professor Natsu Saito of Georgia State University Law School combed the State Bar Directory to find 10 attorneys to start an Asian American Bar Association. Today, the Georgia Asian Pacific Bar Association (GAPABA) has 750 members. In 2014, GAPABA named its top prize the “Judge Alvin T. Wong Pioneer Award”. It is given in his honor to a lawyer who demonstrates leadership to pave the way for the advancement of APA attorneys. He is the recipient of the 2017 Traditions of Excellence Award presented by the General Practice and Trial Section of the State Bar of Georgia. He received the 2022 Randolph Thrower Lifetime Achievement Award presented by the Committee to Promote Inclusion in the Profession of the State Bar of Georgia. Judge Wong serves the ABA Standing Committee on Ethics and Professional Responsibility – Judges Advisory Committee and as a Fernbank Museum of Natural History trustee and NAPABA (the National Asian Bar) Law Foundation board member, mentoring future leaders as co-director of its Thomas Tang National Moot Court Competition.

Steve Henry, founder of The Litigation Counsel of America (LCA)https://www.litcounsel.org/ joins Brian Roberts(https://www.linkedin.com/in/beeberts/) in the Attorney Lounge (https://linktr.ee/attorneylounge) to discuss his career and how and why he and his wife Dottie founded LCA in the early 2000s. Brian begins the show by remining Steve how he was able to cobble together a tuxedo together for the black tie dinner at the LCA event in Banff Canada last year by collecting various clothing items from different second hand stores in town. Steve discusses his upbringing on a farm outside of Tuscaloosa, Alabama and, as a first generation college graduate, he developed an interest in the law from watching Perry Mason on television. Steve shares that his tuition for the first semester of college at the University of Alabama was $255 in 1972. After Steve's first year of college he decided to enroll in the Air Force as a means to help pay for college through the GI Bill and, while in the Air Force, he married his high school sweetheart, Dottie. After graduating college he attended Texas Tech law school where tuition was $190 per semester. A dedicated worker, Steve shared that he painted billboards while growing up in Alabama and worked as a waiter in law school. With the money he earned while working as a waiter while attending law school, together with income earned from an investment in a Texas oil well, Steve was able to graduate from law school with no debt and drive himself to the graduation ceremony in a red Mercedes convertible! Steve had no interest in a desk job after graduating from law school and he loved the aesthetics of being a lawyer – the courtroom, the atmosphere, the judges and juries. And, as a result, Steve's first job out of law school was as a prosecutor in Texas. Steve recounted his first jury trial where he was told to go to the courthouse and another assistant district attorney would be over in a little while to help handle the case, but the other attorney never showed up. Steve, the fearless young attorney, went ahead and struck the jury, tried the case and won! Upon returning to the office, the other attorney said he got busy and forgot about the case. Having won his first case and recognizing that he could handle himself in the courtroom, the district attorney's office let Steve continue to try cases and he ended up trying roughly 40 cases in his first year out of law school. In 1983, Steve moved back to Alabama with the goal of providing a better lifestyle for his family where he practiced for the remainder of his career in private practice as a trial attorney.Steve and Brian discuss the changes in the practice of trial law over the course of many decades moving from a process that would quickly go to court with the same attorney handling the filing of the case, discovery, trial and appeal to a process today that is significantly longer and highly specialized. Steve discussed the lack of characters that exist in the law today compared to several decades ago, including famous attorneys like Bobby Lee Cook who was an LCA Fellow and the inspiration for the main character in the Matlock television series. Steve also discussed the art of reading a jury, noting his belief that it is becoming a lost art. Steve mentioned former two-time LCA President, Thomas Mesereau, who represented Michael Jackson and other high profile celebrities, as someone who was brilliant at reading a jury. Steve talked about the changes in juries and the differences in relating to millennials who are serving on juries today with boomers and the ability of a good trial attorney to relate to both generations.Steve shared his motivation for starting LCA when one of his female partners at Baker Donelson attempted to join an elite society of trial lawyers but was denied despite her skills as an elite attorney. When Steve shared this story with Dottie and, having three daughters of their own, Dottie recommended that Steve do something to rectify this injustice and start a society that prioritized and welcomed women and minorities. Dottie took the initiative on this effort and identified several attorneys that would make great members of this new society that they were founding, originally called The American Academy of Trial Counsel. After sending several invitations with acceptances from many notable lawyers across the country, the interest from other lawyers in joining this new society grew quickly. The dramatic rise in popularity of this new society soon drew the ire of an older, similarly named society who insisted they change their name to avoid confusion, which ultimately resulted in Steve and Dottie changing the name to Litigation Counsel of America. Given an ultimatum by his firm at the time to either choose to continue practicing at the firm or continue building LCA, Steve chose to focus his full-time attention to LCA where he continues to focus his efforts today.Steve's advice to young lawyers interested in trial practice is to volunteer to perform any task in a trial. Experience is the greatest tool to becoming a great trial attorney and Steve notes that the best trial attorneys are able to adapt under pressure, think on their feet, turn on a dime, and get past a moment that could otherwise kill their case. And the only way to develop these traits is to be comfortable in a trial setting, which comes from experience in the courtroom. Steve suggested that young lawyers simply sit in court and watch other cases, even if they are working on something else while there.LCA is a terrific organization that is an invitation-only trial lawyer honorary society that is limited to 3,500 Fellows, representing less than one-half of one percent of American lawyers. Justin worked as a corporate M&A attorney and started doing technology work, before eventually narrowing down to cybersecurity. In today's episode, he talks about cybersecurity in M&A transactions, explaining in depth his three-layer cake approach to cybersecurity in M&A and the importance of cybersecurity and privacy in all aspects of technology, from individual to business transactions. Justin begins by discussing the importance of cybersecurity and privacy for individuals and businesses, particularly in the context of smart contracts and digital wallets used in the crypto space. He emphasizes the need for individuals to shift their mindset and make intelligent choices about sharing their data. He also suggests that individuals take advantage of privacy and security settings on their phones and consider multi-factor authentication. He then shifts to cybersecurity in M&A transactions. Justin explains his "three-layer cake" approach to cybersecurity in M&A, which includes asking the right questions, having proper representations and warranties in the purchase agreement, and not integrating the target's network too quickly after the acquisition. He also discusses liability caps and super caps in technology contract negotiations. This week, we interviewed Tim Lupinacci. Tim spent the first 28 years of his legal practice focused on helping financial institutions solve complex problems arising in commercial restructuring and bankruptcy matters throughout the country. In this episode… Cybercriminals target law firms because they store valuable and sensitive information. In a security breach, ransomware could lock down the office's files for an extended period, making it impossible to perform routine operations. So, how can law firms protect themselves from cyberattacks? Regardless of a firm's size, all law offices are vulnerable. Tim Lupinacci, a chief leader at one of the most prominent legal firms in the US, advises implementing a strategic cybersecurity plan. Hiring a full-time CISO and security team could spearhead the program and strictly focus on managing cyber risks. Preventive measures like phishing simulations can prevent their colleagues from falling victim to cyberattacks. If a cohort fails the designated tests, they must attend additional training to protect themselves and the office's devices.
