About the author: David Dorado Romo, is an author, historian and musician with a Ph.D. in Borderlands History. He is the author of the award-winning Ringside Seat to a Revolution: An Underground Cultural History of El Paso and Juárez, 1893-1923 (Cinco Puntos Press, 2005) and Borderlands and the Mexican American Story (Penguin Random House, 2024), which was recently placed on the list of Best Books of 2024 by Kirkus Review and the School Library Journal. His historical essays have appeared in the Los Angeles Times, Washington Post, Texas Monthly, Texas Observer, and Mexico's City's Nexus. Borderlands and the Mexican American Story is his first non-fiction book aimed at middle and high school students.  David is a curator and co-director of the Museo Urbano, a public history project based in El Paso that exhibited “Uncaged Art,” a 2018 exhibit the featured the artwork of migrant children interned at a detention center in Tornillo, Texas.

In this case, the court considered this issue: Do Florida S.B. 7072's content-moderation restrictions comply with the First Amendment, and do the law's individualized-explanation requirements comply with the First Amendment? The case was decided on July 1, 2024. The Supreme Court held that The judgments are vacated, and the cases are remanded, because neither the Eleventh Circuit nor the Fifth Circuit conducted a proper analysis of the facial First Amendment challenges to the Florida and Texas laws regulating large internet platforms. Justice Elena Kagan authored the majority opinion of the Court. Under precedents like Miami Herald v Tornillo, Pacific Gas & Electric Co. v Public Utilities Commission, Turner Broadcasting v FCC, and Hurley v Irish-American Gay, Lesbian and Bisexual Group of Boston, when a private entity engages in expressive activity, including curating others' speech, government interference with that activity implicates the First Amendment. Specifically, the First Amendment protects entities engaged in expressive activities, including compiling and curating others' speech, from being forced to accommodate messages they prefer to exclude. This protection applies even when the compiler includes most items and excludes only a few. The government cannot justify interfering with a private speaker's editorial choices merely by claiming an interest in improving or balancing the marketplace of ideas. These principles likely apply to the content moderation practices of social media platforms like Facebook's News Feed, indicating that state laws regulating these practices may face significant First Amendment hurdles. However, this analysis may not apply to all of the laws' applications, so it is important for courts to conduct a thorough examination of the laws' full scope and their constitutional and unconstitutional applications in a proper facial challenge analysis. Texas's regulation of social media platforms' content moderation policies aims to alter the speech displayed on these platforms, reflecting the state's disapproval of the platforms' current content selection and moderation practices. However, under the First Amendment, Texas cannot impose its preferences on how private entities curate and present speech, as this would amount to government control over the expression of ideas. Justice Amy Coney Barrett joined the majority opinion in full and authored a separate concurrence. Justice Ketanji Brown Jackson joined the majority opinion in part and authored a separate concurrence. Justice Clarence Thomas authored an opinion concurring in the judgment. Justice Samuel Alito authored an opinion concurring in the judgment, in which Justices Clarence Thomas and Neil Gorsuch joined. Em uma das salas da Universidade de Columbia, em Nova York, um coro entoa uma das canções de Carolina Maria de Jesus, uma das mais importantes escritoras negras do Brasil. Autora do best-seller autobiográfico Quarto de Despejo: Diário de uma Favelada, Carolina foi a primeira brasileira negra a vender mais de um milhão de exemplares no mundo. Carolina faleceu aos 63 anos, deixando três filhos, dos quais apenas Vera Eunice permanece viva. Luciana Rosa, correspondente da RFI em Nova York"Quando minha mãe faleceu, ela me deixou uma carta, entregue um dia após sua morte. Dentre os pedidos, ela queria que eu propagasse sua memória. E é isso que eu tenho feito", conta Vera.Apesar de "Quarto de Despejo" ter sido traduzido para 13 idiomas e alcançado cerca de 40 países, esta é a primeira vez que Vera é convidada a falar sobre a mãe no exterior. Ela participou do ciclo de debates "Carolina - A Escritora do Brasil", celebrando a obra da autora em Nova York e Washington, uma iniciativa do coletivo Mulheres na Escrita. "Ela é uma pensadora do Brasil e representa, de alguma forma, a mulher, especialmente a mulher negra, fora do Brasil, como é o caso agora aqui nos Estados Unidos, em Nova York", disse Tom Farias, biógrafo de Carolina e também presente nos debates. Vera, uma das personagens principais de Quarto de Despejo, tinha apenas 21 anos quando Carolina morreu. Foi nesse momento que ela e seus irmãos deixaram de receber os direitos autorais da escritora no Brasil."O que ainda ajudava a gente a sobreviver eram os direitos autorais dos Estados Unidos, que nunca deixaram de pagar", conta Vera.Quarto de Despejo foi publicado nos Estados Unidos como Child of the Dark em 1962 e logo se espalhou pelo mundo. A iniciativa de Mulheres na Escrita, ao revisitar a obra da escritora, busca colocar Carolina de volta no radar literário e incluí-la como leitura obrigatória nos programas de faculdades que estudam obras brasileiras."Espero que, com essa abertura, Carolina volte a ser reconhecida mundialmente, como nos anos 1960", diz a filha, Vera.Quem foi Carolina de JesusCarolina nasceu na cidade de Sacramento, no início do século 1920. Tom Farias, que está reescrevendo uma biografia dea autora a ser lançada no ano que vem, afirma que, ao contrário do que se pensava, Carolina não nasceu em 1914, mas em outubro de 1915. Filha de uma família de lavradores, ela frequentou a escola por apenas dois anos, período no qual se apaixonou pela leitura. Os livros, no entanto, tiveram que esperar, já que ela precisava ajudar a sustentar a família."Ela começou a trabalhar cedo como empregada doméstica, babá e cozinheira, mas nunca perdeu o amor pelos livros e pela escrita", conta Tom.Carolina se mudou para São Paulo em 1937, depois de ser injustamente acusada de roubo em Minas Gerais. Na capital paulista, trabalhou como empregada doméstica na casa do renomado cardiologista Euryclides de Jesus Zerbini. Nas horas livres, saciava sua sede de leitura na biblioteca da casa."Foi em São Paulo que ela se revelou como escritora, morando na favela do Canindé e criando seus três filhos sozinha", relata o biógrafo.Durante esse período, Carolina acumulou muitos textos em seus diários, que foram descobertos pelo jornalista Audálio Dantas em 1958. Durante uma reportagem em Canindé, seu caminho se cruzou com o da escritora. Dantas ajudou Carolina a publicar suas obras, e em 1960, Quarto de Despejo: Diário de uma Favelada foi lançado."O livro se tornou um sucesso instantâneo, chegando a vender mais de dois mil exemplares por dia", relembra Tom.No mesmo ano, Carolina foi homenageada pela Academia Paulista de Letras e recebeu o título honorífico da Orden Caballero del Tornillo, na Argentina. Publicou outros livros de forma independente, como Pedaço da Fome (1963) e Provérbios (1964), mas nenhum alcançou o sucesso de sua primeira obra."Carolina foi uma figura importante para a literatura brasileira, porque era mulher, negra e favelada", celebra Vera, ao ressaltar que a mãe foi a primeira a contar a história do negro pobre brasileiro em primeira pessoa. Tom Farias destaca que Carolina, ao contrário de pensadores da época como Gilberto Freyre e Sérgio Buarque de Holanda, conseguiu pensar o Brasil sob a ótica da miséria."Minha mãe tinha tudo para não dar certo,mas ela era ousada. E agora estou aqui para ver sua ascensão no Brasil e no mundo", festeja Vera, que luta para reunir o acervo deixado pela mãe e concretizar o sonho de inaugurar um centro cultural, onde o público possa conhecer melhor a sua obra.

From her great-grandfather crossing the border, to an artist living and telling a transcendent story, and ultimately living Manuel's Destiny. Over the course of 11 wildly dazzling songs, the Texas-bred, Nashville/Mexico-based singer/songwriter sets her storytelling to a one-of-a-kind sound she's created and calls “Honky Tonk Mariachi”—a gorgeously orchestrated fusion of her Mexican roots and San Antonio, TX Hill Country upbringing, centered in the stunning vocal prowess she's shown in touring across the globe, sharing the stage with legends like Willie Nelson, and making history as the first artist ever to perform with mariachi at the Grand Ole Opry. The result is the most revelatory work yet from a truly visionary artist, one that leaves the listener newly emboldened to fearlessly follow their hearts and live a dreamer's tale. For Urbina Jones, the making of such an ambitious and all-encompassing album took decades of soul-searching and careful excavation of her family's history. Originally from San Antonio, she spent much of her early childhood at backyard barbecues at the home of her paternal grandmother, where she first heard the traditional Mexican music, she now describes as “a transmission of pure joy and love.” When her parents divorced, Jones moved to a small town in Texas, and as a young girl, frequented local honky-tonks, two-stepping to songs by all the country greats and listening to poets like Jerry Jeff Walker, Guy Clark, and Townes Van Zant carve out songs by the potbelly stove in Luckenbach, TX. (“Margie the bartender was my babysitter. I got to put the sawdust on the floors,” she recalls). But despite her many happy memories, that period of Urbina Jones' life also carried a heavy burden of pain. “After I was pulled away from my father, I was told to hide the fact that I was Mexican, which haunted me for a very long time,” she says. At age 18, however, Urbina Jones made her first trip to Mexico (accompanied by her father) and immediately felt a profound sense of revelation. “I fell madly in love with my culture—the people, the music, the food,” she says. “I finally realized, ‘This is who I am.' From this moment on, the direction of my life changed. I became passionate about telling a new story celebrating my roots. My pain turned into my passion and purpose.” As she unraveled her family's history, Urbina Jones learned of her great-grandfather, Manuel Anaya Urbina: a Mapimí, Hidalgo, Mexico native who went to the Vatican to study for the priesthood in the late 1800s. After two years in Rome, he rejected his childhood religion. “He returned to Mexico and crossed into El Paso in 1907— left his country, left his family, left his faith, left everything to embark on a new life for his own personal freedom,” she says. “He ended up becoming the first Mexican Baptist minister in San Antonio and spread the gospel all over the Southwest. Once I discovered his story, I became passionate about the idea of this dreamer crossing the border to follow his heart. I feel as if his dream has lived on through me, and now I want to share it as a source of inspiration for anyone seeking their own divine truth.” The follow-up to 2018's Tularosa (a powerhouse album stacked with mariachi-infused covers of country classics like “Ring of Fire” and “Jolene”), Manuel's Destiny finds Urbina Jones moving forward with her mission of introducing audiences everywhere to the unbridled passion and heart of Mexico. “As a little girl growing up listening to mariachi, the joyful sound of their voices singing together always felt like an instrument in itself, and I knew from the start that I wanted that to be woven into every song on this album,” she says. Produced by Urbina Jones and Preston Sullivan, and recorded live at Sonic Ranch in Tornillo, Texas—not far from where her great-grandfather crossed into El Paso—Manuel's Destiny achieves its lush and fiery sound thanks to contributions from over a dozen musicians, including guitarrón player Mike Hernandez (also the album's mariachi session leader), Urbina Jones' bandleader/longtime guitarist Patterson Barrett, and a lineup of esteemed mariachi players from all over Texas, Nashville, Los Angeles, and Mexico. With its resplendent selection of heart-on-sleeve ballads, hip-swinging Texican Americana anthems, and pedal steel-laced country- rock songs, Manuel's Destiny ultimately radiates an electrifying energy, adding even greater impact to the countless pieces of wisdom woven into her lyrics. In many ways a document of Urbina Jones' own whirlwind adventures in fulfilling her life's purpose, Manuel's Destiny opens on “Gypsy Dreams”—a fierce yet euphoric refusal to tame her free-spirited nature. “It took me a long time to honor who I was born to be — an artist, a dreamer and author of my own life. I'm gratefully reclaiming and sharing my joy with the world,” says Urbina Jones. Ever since she was a little girl, she's always been this way. You can be part of her world, but you can never make her change. (“Gypsy Dreams”) On the album's cinematic title track, meanwhile, Urbina Jones opens by recounting her great-grandfather's pilgrimage to the States in search of his truth and divinity, then looks back on her own leap of faith in leaving home to follow her heart and one day live the spellbinding epic, which is “Manuel's Destiny:” I got in my car with my Spanish guitar bound for Tennessee, As I drove through my fear, I felt his spirit near guiding me, I was strong, I was able, I waited on tables, said yes sir, no m'am, cause I knew I'd get the chance for my dreams to dance and do what I was born to do. Wendy Moten, a multi-talented Memphis-born singer, and another dreamer whose voice and career path are like no other, joins in for a triumphant update of Glen Campbell's iconic “Rhinestone Cowboy” (with a blessing from songwriter Larry Weiss on the cover's gender flip). Built on a near-symphonic arrangement of soaring violins, exultant trumpets, vihuela, and heavenly harp, “Rhinestone Cowgirl” emerges as a powerful account of overcoming the odds on the way to unfettered glory. “Both Wendy and I have been relentless in becoming who we were destined to be,” says Urbina Jones. “The fact that a Latina and a Black woman are stepping into this moment and singing this classic song together is incredibly meaningful to me—we're representing all dreamers of all ages, from all backgrounds, and hopefully encouraging them to bravely answer the calling of their own hearts.” On songs like “Falling Fearlessly,” Manuel's Destiny slips into a “Blue Bayou” romantic mood and spotlights the subtler nuances of Urbina Jones' beguiling voice. Co-written with Peggy Lynn (daughter of Loretta Lynn), the lilting and luminous track finds music legend Vince Gill pairing up with Urbina Jones to capture the rarefied magic of surrendering to love. “We wrote the song on the beach under a full moon in Mexico,” Urbina Jones remembers. “It's my homage to Linda Ronstadt, who's one of the few Latinas I had to look up to in country rock music.” And on “The Queen of the Angels (La Reyna De Los Angeles)/Cielito Lindo” Urbina Jones delivers a cumbia country, dance-ready, infectious serenade to another influential woman in her life: her paternal grandmother, who guided her toward a daring new direction with her music. “When my abuelita was dying, she called me to her side and told me I was going to be a messenger who shared the beauty of our culture with the world by making what she called ‘country music with chili peppers,'” says Urbina Jones. “At the time, I didn't believe I could do it, but after she died, I went to San Miguel de Allende and began recovering that connection to my roots. A mash-up of “Luckenbach, Texas (Back to the Basics of Love)” and “Let Your Love Flow,” these two hit songs reflect a coming of age during Urbina Jones' early years. “I was lucky to grow up in Luckenbach and the honky tonks of Texas during the Outlaw movement. My favorite song to sing along to was “Let Your Love Flow,” comments Urbina Jones. “I had the honor of touring in Europe with the Bellamys and was thrilled they agreed to re-record their song with my Honky Tonk Mariachi,” she adds. Since first dreaming up the culture-blending, genre-bending, sublimely exuberant sound that now imbues her music, Urbina Jones has established herself as a two-time Amazon bestselling author and teacher who leads spiritual pilgrimages all over the world. A former student of Don Miguel Ruiz (a teacher in the Toltec tradition and author of the seminal Four Agreements: A Practical Guide to Personal Freedom), she made her debut as a lead author with Shaman Heart: Turning Pain into Passion and Purpose, a 2022 title in which she details her experience in undoing her childhood pain and pursuing her true calling as an artist. In May 2023, Urbina Jones released her second bestselling book, Shaman Heart – Sacred Rebel. As she reveals that transformation was not without its daunting moments. “There was a reason to quit at every step along the way,” says Urbina Jones. “But every breakdown turned out to be a breakthrough, and the road kept miraculously rising up and meeting me every step of the way.” For the closing track to Manuel's Destiny, Urbina Jones chose a solo self-penned song called “Until We Meet Again”— a soul-stirring number that's equal parts full-hearted farewell, and loving acknowledgment of the way dreams endure from generation to generation. In a poignant symbol of that very phenomenon, Jones arrived at Sonic Ranch carrying the same Bible from 1876 that her great-grandfather had held upon crossing into the U.S. more than a century ago. “It's amazing to me that over a hundred years later, Manuel's great-granddaughter could come back to the same border with the same Bible, a seed of the dream he planted from so long ago,” she says. “It tells me that our dreams are by divine design. I hope that in sharing this album I'm able to bring a little joy, big magic, and some dancing to the world, as well as inspire someone to ask the big questions—to be brave, believe in themselves, and in their dreams. A Mexico border crossing in Texas for commercial truck traffic will reopen Aug. 7 after activity was suspended in May 2017. The Marcelino Serna Port of Entry in Tornillo, which is about 17 miles east of El Paso, is expected to see about 300 trucks weekly. At first, the cargo facility will operate Monday through Friday from 10 a.m. to 4 p.m., but hours may change depending on demand, according to the U.S. Customs and Border Protection.

Federal district judge Robert Pitman has enjoined enforcement of Texas's law regulating social media censorship. The ruling sparks a fight between me and Nate Jones that ranges from how much weight should be given to the speech rights of social media to the Kyle Rittenhouse verdict imposed by Facebook when it decided he was guilty and wouldn't let anyone disagree. On the merits, as before, we agreed that the Obama appointee was on solid ground (for now) in applying the Tornillo line of cases saying that the government should not directly regulate the editorial judgments of publishers. But the judge's ruling on the transparency and due process requirements of the law suggests that he wasn't prepared to give the law a fair shake. So, look for a competitive appeal on the topic and quite possibly a certiorari grant as well. By the time we stop beating this horse, he's long past any possible right of self-defense. Megan Stifel has an easier task: Explaining cybersecurity recommendations for rail and other surface transportation companies. The advice is mostly something that could have been offered in the 90s, so we both puzzle over the fierce resistance from industry. Maybe it's the 24-hour requirement to notify TSA of cyber incidents. Nate and I explore proposals from the Biden administration to muster a group of like-minded countries to curb sales of surveillance gear to authoritarian regimes. No doubt the initiative was reinforced by news that U.S. State Department phones were recently hacked by exported spyware from Israel. But I think the whole project fails for a simple reason: authoritarian governments can buy all the surveillance gear they need from China, which is happy to sell it. In the absence of credible enforcement, condemning such sales is empty virtue signaling.  I critique a new story from the Markup about PredPol crime prediction software, which claims the software is biased because it urges the police to patrol more Black neighborhoods than white neighborhoods. Speaking of stupid, Megan explains how a “smart contract”  turned out to be anything but, allowing hackers to steal $31 million in digital coin. I ask exactly how the hacker's feat differs from really good lawyering. Nate and I look at how well Russia is doing in bringing Twitter to heel with a mobile slowdown. Twitter hasn't broken yet, but it's clear that the authoritarians of the world are slowly winning their battle with Silicon Valley. Megan tells us how a cybersecurity professional at Ubiquiti decided to stop riding with the hounds and to ride instead with the fox. Of course, we all know how most fox hunts end for the fox, and this story is no exception. In updates, I remind listeners of the elaborate gas-lighting effort put on by Jeff Bezos in trying to blame the Saudis and the National Enquirer for his brother-in-law's leak of Bezos's deeply embarrassing text messages. All the investigations that Bezos managed to get started are done now, and the verdict is in: the Saudis didn't do it.
