Jacque Jones grew up in San Diego and spent endless hours on the baseball diamond learning the fundamentals of baseball and foundational life lessons weaved into the game. His uncle encouraged Jacque play with the older, bigger kids at his local park which forced Jacque to toughen up and improve his skills. By the time he entered high school it was clear Jacque was an elite athlete with a future in baseball. Surprisingly he was looked by many college programs and not heavily recruited, until he was offered a full ride to USC by Frank Cruz and Mike Gillespie Jacque was in the starting line up as a true freshman and quickly established himself as one of the best players in the nation. In 1994 he hit legendary status after hitting 3 home runs against LSU in Baton Rouge in the NCAA regional finals. In 1995 he helped lead USC to a national championship where they were beat by Cal State Fullerton who had a kid named Mark Kotsay (currently the Oakland A's Manager) who was the 1995 college player of the year and had a extraordinary 17 year major league career. Jacque was drafted in the 2nd round by the Minnesota Twins and selected to team USA in 1996 where he put up video game numbers hitting .404 with 15 home runs and 49 RBIs in 37 games. Jacque had an impressive 10 year big league career with a career batting average of .277, with 165 homers, 630 RBI, .326 OBP and a .448 SLGs selected. A long with Torii Hunter and Shannon Stewart he made up what was known to be the best outfield in Major League Baseball. He was put on the Hall of Fame ballot in 2014 but did not receive enough votes. After retiring from Baseball he spent a few more years in the game as a hitting coach before moving on to other entrepreneurial and philanthropic pursuits. In late 2022 Los Angeles Voted in the ULA Mansion Tax to “force millionaires and billionaires to pay their fair share” on all real estate transactions over $5M which includes all residential, commercial, retail, industrial, office, land and multifamily real estate. The ULA initiative was sold as a new “Homelessness and Housing Solutions” tax to end homelessness and create affordable housing in Los Angeles. In reality, the ULA initiative was proposed by, among others, labor unions seeking to profit 4% on all sales over $5M and 5.5% on all sales over $10M regardless whether the seller made any net profit on the sale and/or whether the proceeds would be split among several, sometimes 10 - 20 family members, who are middle to low income earners. Instead of these funds being used to for the homeless crisis, the funds will actually be used to provide attorneys for tenants who are not paying rent to fight their landlords regardless whether they are employed and able to afford rent. The limited amount of homeless housing that will be built by the labor unions will cost at least $600,000 per unit which is about double the cost of building the same unit using large, professional building contractors that are non union. The narrative to help the homeless is an emotional trigger for all of us as we all want to help solve this horrendous crisis eating at the core of our beautiful city. Yet the city politics behind the narrative continue to cloud the facts and true intentions of the ULA initiative. All one needs to do is look at the amount of tax payers money collected for homeless and homeless housing and services over the past decade and reconcile that with what we see in our streets and on our sidewalks and parks everyday. Today's conversation is with Keith Fromm the lead attorney from Fight ULA (www.FIGHTULA.com) also known as the Newcastle Lawsuit which is one of the two lawsuits against the city of Los Angeles to overturn this unfair tax. The second lawsuit is led by well known tax payer advocate by Howard Jarvis whose lawsuit hangs on a single argument compared to Fight ULA whose claim has 17 different argument including the Howard Jarvis argument In this informative discussion, Keith and Danny shed light on the ULA landscape and the urgency to get behind FIGHT ULA so that Keith Fromm and his partners have the resources to continue to fight this case. Up to this point, Keith and his partners have taken this case on spec and have not been paid for their time and work. The hearing October 23rd on ULA is only the beginning of the ULA fight as there will be several more rounds of appeals over the next year or two, and if successful eventually a trial that very well could end up in front the Supreme Court of the United States. When I had Scott Gibson, managing Director of Compass Southern California, on the podcast last May he said, “We are in a recession and no one knows about it yet.” A few months later it was clear we were in a real estate recession as interest rates climbed to 7% at the fastest pace in history. The housing market slowed to a halt in the 4th quarter of 2022 and then something interesting happened in the new year. With interest rates dropping below 7% the housing market snapped back abruptly and the shortage of inventory, or at least, well priced blue chip options were few and far between. The multiple offers came back with vengeance and the buyers were bidding homes up back to peak prices. Over the past 30 days it seems like the market has settled down again. Great homes priced about 3-5% below the last comp are selling and selling rather quickly, everything else is sitting and not selling, except for exceptional properties in the best locations. Scott's advice to realtors today is to, “stay alive until 25!” For the next 18-24 months he anticipates a choppy market until interest rates settle and we get through the inflationary head winds. No one has a crystal ball and the market is changing everyday but Scott has as much insight, experience and knowledge as anyone in the residential industry. Sit back and enjoy the show. Scott Gibson was born and raised in Los Angeles and jumped into the real estate industry right after graduating from UCLA. He became aone of the industries youngest sales manager at the Fred Sands brokerage and eventually went on to manage the Jon Douglas Company where he oversaw 23 branch offices and 1300 agents throughout California in the 1990s. When Jon Douglas merged with Prudential and was eventually acquired by NRT (Coldwell Banker) in 1997 Scott became the Senior VP of Coldwell Banker. A few years later he was named the president of Coldwell Banker in Southern California where we oversaw 63 offices and $20 Billion in annual sales. In 2004 NRT asked Scott to move across the country and bolster their East Coast operations overseeing 9 states for their Coldwell Banker, Cochran and Era brands including their most competitive markets in New York City, Long Island, The Hamptons, Palm Beach, Connecticut and New England. Scott returned to Los Angeles and founded his own brokerage Gibson International in West Los Angeles in 2008 and after weathering the storm during the great recession Gibson expanded and flourished with the Gibson international Brand. In 2018 Gibson merged with Pacific Union in a roll up which included Partners Trust and the John Aaroe Group, and acquired by Compass in 2018. This conversation was recorded in April 2022 and Scott may be the first high level residential real estate professional to say “we are probably in a recession” at a time when the Dow as hovering at 35,000 and houses on the Westside of Los Angeles were selling in multiple offers at every price point. The Los Angeles West side market continues to flourish despite the war in Ukraine and the rapidly rising interest rates which have inched up to 5%. The luxury market over $5 million and certainly over $10 million do not seem to be impacted by either so far as many buyers are all cash and feel that real estate and Holmes are a safe shelter and hedge against inflation and other economic factors. The high end housing market on the Westside continues to churn with sales over $5M up 90% from this time in 2020. The highest priced sale on record just closed recently in Malibu where Marc Andreessen bought a seven acre estate in Paradise Cover for $177M. There's been 939 sales this year vs 569 last year. 87 of these sales are over $20M which is up 89% from last year. 28 of these sales are over $30M which is up 115% from last year. 16 of these sales are over $40M which is up 166% over last. Buyers are running around in circles pulling their hair out in frustration in this frenetic housing market. They are making good offers and not getting the houses they want. Why does this happen? It all starts with who is the agent who is representing you and how are they received by the brokerage community and community at large. If you are not working with a great agent who is well liked and popular among their peers who are putting yourself at a huge disadvantage. Going direct to the listing agent is not the best strategy and usually results in a buyer over paying for a home and/or not doing the proper due diligence and losing all leverage in their repair renegotiation. Saving 1% on the commission which is the standard discount a buyer receives from the listing agent is a drop in the bucket compared to over paying by 3-5% and not having an arsenal of the best inspectors, contractors and specialists picking a part the house, and a strong agent who has your best interests at heart negotiating another 1-2% back in repairs and discovering nuanced repair disclosures that were not presented clearly and will cost buyers hundreds of thousands down the road. It is not surprising that all of our most savvy, sophisticated clients always want us to represent them when they buy and never go direct to the listing agent. DON'T BE SHORT SIGHTED! The state of California and governor Gavin Newsom signed into law SB8 and SB9 which will attempt to eliminate single family zoning in residential neighborhoods to increase density during a housing shortage crisis. The laws state that an owner can build up to 4 units on a Single family lot. Does this mean they can build 4 units in Beverly Hills and Brentwood park? It's not clear and convoluted at best as local zoning rules will come into play in each community and you can expect significant legal conflicts to jam up the court system as developers, residents, activists and politicians will battle it out in the months and years to come to establish legal precedents in different communities and which will clearly create mass confusion and more obstacles and loop holes to contend with.
