Embracing Exile: The Case for Jewish Diaspora (Oxford University Press, 2025) analyzes biblical and rabbinic texts, philosophical treatises, studies of Kabbalah, Hasidism, and a multiplicity of modern expressions for a comprehensive history of Jewish responses to and justifications of their diasporas. It shows that Diaspora Jews through the ages insisted that God joined them in their exiles, that "Zion" was found in Babylon and Eastern Europe, and that, as citizens of the world, Jews could only live throughout the world. The result is a convincing assertion that lament has not been the most common Jewish response to diaspora and that Zionism is not the natural outcome of either Jewish ideology or history. David Kraemer is Joseph J. and Dora Abbell Librarian at the Jewish Theological Seminary, where he has also served as Professor of Talmud and Rabbinics for many years. As Librarian, he is at the helm of the most extensive collection of Judaica-rare and contemporary-in the Western hemisphere. He is the author of several books on Rabbinic Judaism and its texts, the social and religious history of Jews in antiquity, and Jewish rituals and their development. Transcript [music] Welcome to Food Safety in a Minute. The Cascadia Subduction Zone runs off our coast from British Columbia to northern California. We're overdue for a major earthquake that could disrupt water supplies for weeks, even months. Storing at least one gallon of water per day, per person and pet, for a minimum of 14 days is essential. Because that much water is heavy (116 pounds), it's good to choose smaller containers for storage. For instance, soda bottles with screw-on lids or food-grade, heavy-duty plastic containers with recycling symbols PETE and HDPE suitable for camping. Avoid milk jugs, they're made from biodegradable plastic and may leak. For more tips on building a safe, drinkable water supply, check out Oregon State University Extension's online guide: Survival Basics: Water. Federalism is the division of power between the federal government and the states. The Constitution establishes this framework by outlining enumerated powers for the federal government, reserved powers for the states, and the Supremacy Clause to resolve conflicts between federal and state laws. The Supremacy Clause and preemption ensure federal law overrides conflicting state law. Express preemption occurs when a federal statute explicitly states its supremacy, while implied preemption occurs when federal and state laws conflict or federal regulation occupies an entire field. The Commerce Clause grants Congress the power to regulate interstate commerce. Its interpretation has evolved, from expansive interpretations in cases like Gibbons v. Ogden and Wickard v. Filburn to modern limitations in United States v. Lopez and NFIB v. Sebelius. Key doctrines include the substantial effects test, channels and instrumentalities of commerce, and the aggregation principle. The Tenth Amendment reserves powers not delegated to the federal government for the states, emphasizing state sovereignty. Printz v. United States established that the federal government cannot compel states to implement federal programs. The Eleventh Amendment protects states from being sued in federal court without their consent, codifying the doctrine of sovereign immunity. Seminole Tribe v. Florida reinforced states' immunity from private lawsuits. The Dormant Commerce Clause prohibits state laws that unduly burden or discriminate against interstate commerce. The discrimination test and Pike balancing test are used to evaluate state laws. Granholm v. Heald struck down state laws favoring in-state wineries over out-of-state competitors. The State Action Doctrine distinguishes private conduct from government action for purposes of constitutional analysis. Shelley v. Kraemer and Burton v. Wilmington Parking Authority are key cases in this area. Understanding federalism and the powers of the states is crucial for analyzing constitutional issues and understanding the balance between national and state authority. --- Support this podcast: https://podcasters.spotify.com/pod/show/law-school/support

Summary of Chapter 12: Case Law and Practical Applications. Chapter 12 explores the key principles of property law through landmark cases, real-world case studies, and practical problem-solving exercises. It emphasizes the importance of understanding legal precedents, such as Pierson v Post, Kelo v City of New London, and Shelley v Kraemer, which have shaped modern property law doctrines related to possession, eminent domain, and anti-discrimination in housing. Landmark Cases in Property Law highlight the evolution of legal concepts like ownership, possession, and public use. These foundational rulings offer key takeaways, such as defining what constitutes possession (as in Pierson v Post), broadening the scope of public use for eminent domain (as in Kelo v City of New London), and prohibiting racially restrictive covenants (as in Shelley v Kraemer). These cases serve as crucial reference points for current property disputes and legal reasoning. Practical Application through Case Studies offers a look at common property law disputes and their resolutions. Case studies cover topics such as Residential Lease Disputes, where tenants might contest retaliatory eviction or demand repairs under habitability laws. Adverse Possession Claims discuss how long-term, open use of land can transfer ownership from one party to another. Zoning Challenges explore legal battles between property owners and municipalities over land use regulations, often involving requests for zoning variances. In Hypotheticals and Problem-Solving, the chapter introduces exercises that require drafting legal documents, negotiating property rights, and resolving disputes. For example, exercises in Drafting Lease Agreements focus on including clauses about rent, repairs, security deposits, and tenant rights. Negotiating Easements teaches how to balance landowner and easement-holder interests, while Analyzing Title Issues delves into resolving disputes over unresolved liens or boundary issues. Chapter 12 provides a comprehensive exploration of landmark cases in property law, real-world case studies, and practical exercises that highlight the application of legal principles. Understanding the evolution of property law through significant cases, such as Pierson v Post and Kelo v City of New London, allows legal practitioners to navigate the complexities of modern property disputes. The chapter also emphasizes the importance of practical problem-solving skills in legal practice, from drafting lease agreements to resolving title issues, offering a well-rounded approach to mastering property law. --- Support this podcast: https://podcasters.spotify.com/pod/show/law-school/support

In this episode, Kylee and Zoë explore the complicated history that humans have with alcohol and athletics. We dive into the deep past (shoutout to our simian ancestors!) and see why scientists think humans developed a taste for something that seems counterproductive to passing on our genes (looking at you, Smirnoff blue raspberry). We try to parse out why alcohol is so closely tied to endurance sports and take a deep dive into what the research says about this substance (spoiler alert: three shots of whiskey do NOT make you better at running on a treadmill.) Many people think of summer as the best time to read. On the beach, on the airplane to a vacation, in between semesters… Sounds like a perfect time to do a literature review. But there are many ways to do a literature review, and in all honesty, we think most people choose the wrong type of review – the “systematic” literature review where they select papers about a phenomenon, do a supposedly structured but not exhaustive search across IS journals, and then criticize the knowledge others have created. We discuss a few alternatives that we think hold more promise: qualitative and quantitative meta analyses, or narrative and integrative reviews. We also point to a few papers that have helped us organize the conversations we read about in the literature – which really, is what literature reviewing is all about.
