In June, the Supreme Court issued a 6-3 decision in Loper Bright Enterprises v. Raimondo,  overturning the 40-year-old legal precedent known as the "Chevron doctrine." This doctrine  had allowed federal agencies to interpret ambiguous statutes within their jurisdiction. The  ruling marks a significant shift in the regulatory landscape, with major implications for how  federal agencies operate and how regulations are enforced—particularly in health care.  The decision presents both challenges and opportunities for the health care industry,  making it crucial for policymakers, health care leaders, and businesses to understand the  evolving regulatory environment. Joining Hospitals in Focus to unpack the potential effects of this ruling on health care  policy making is Thomas Barker, a partner at Foley Hoag and former General Counsel at  CMS and Acting General Counsel at HHS.  In this episode, we explore: Impact on Congress: How does the ruling affect Congress's legislative process and its  relationship with federal agencies? Hon. Jim Carroll has substantial experience as a legal advisor to two White House administrations, federal government agencies, and a Fortune 25 company. He counsels clients on complex and sensitive issues involving government and internal investigations, corporate ethics and compliance programs, and white collar defense. In his 30-plus years as an attorney and a Washington insider, Jim has also built a reputation as a go-to choice for strategic business and policy counseling. In addition to his role as a Partner at Michael Best, Jim is also a principal at Michael Best Consulting LLC. Previously, Jim was a co-founder and principal of DC Consulting LLC, a consulting firm specializing in public health, pharmaceutical and substance abuse and regulatory risk involving law enforcement issues. Earlier in his career, Jim spent a decade as in-house counsel at Ford Motor Company where for many years he was the Company's Global Director of Compliance. On June 30, 2022, the Supreme Court decided West Virginia v. EPA. In a 6-3 decision, the Court held that EPA exceeded its authority under Clean Air Act Section 111 when it issued the 2015 Clean Power Plan, which sought to control carbon dioxide emissions from existing fossil fuel-fired power plants by imposing limits based on a “system” of shifting power generation away from fossil fuels and towards renewable fuels at the grid-wide level. Although the Supreme Court stayed the Clean Power Plan in February 2016 before it could take effect, the Court's decision in West Virginia v. EPA was the first time it pronounced on the Plan's merits.This case is a major development in administrative law. For the first time, a majority opinion of the Supreme Court used the phrase “major questions doctrine” to describe its methodology. The Court determined that the Clean Power Plan dealt with issues of such “economic and political significance” that it required a clear statement of Congressional intent to authorize this specific type of action. Because the CAA contains no such clear statement, the Clean Power Plan was unlawful.Justice Gorsuch, joined by Justice Alito, wrote a concurring opinion expanding on the “major questions doctrine” and its relationship to the constitutional principle of non-delegation. For more information visit: Hightruths.com James “Jim” Carroll Director, White House Office of National Drug Control Policy The Honorable James W. “Jim” Carroll was sworn in as the Director of the White House Office of National Drug Control Policy (ONDCP) on January 31, 2019 following a unanimous confirmation by the United States Senate. Mr. Carroll previously served as the Acting Director and Deputy Director of ONDCP from February 2018 to January 2019. His strategic vision for the organization is best summarized in two words: “Be Relentless.” It's the advice President Trump gave Director Carroll when he nominated him to lead ONDCP, and the North Star that drives his vision in support of the organization's mission to stop the flow of illegal drugs in the United States and connect those suffering from substance use disorder with the tools they need to be put on the path to recovery. Under the leadership of President Trump and Director Carroll, the United States saw its first annual decrease in overdose deaths for the first time in 30 years; the amount of drugs seized by law enforcement at our Nation's borders stands at all-time highs; and record Federal grants have been awarded in support of drug interdiction and public health programs. In his role as “Drug Czar,” Director Carroll serves as the principal advisor to the President of the United States on drug policy and oversees a passionate staff of approximately 100 professionals. He oversees a budget of more than $35 billion and coordinates the activities and related funding of sixteen Federal government agencies and departments to reduce the supply of and demand for illicit substances. Previously in the Administration, Mr. Carroll served as General Counsel of the Office of Management and Budget and as Deputy Assistant and Senior Counsel to the President. Before joining the Trump Administration, Mr. Carroll served as Washington Counsel at the Ford Motor Company and as General Counsel of the Ford Motor Company Fund, the company's philanthropic arm that supports non-profit organizations and initiatives. This is Director Carroll's second time serving the American people in support of the President of the United States. During the George W. Bush Administration, Mr. Carroll held several positions including Special Assistant and Associate Counsel to the President at the White House, Deputy General Counsel and Acting General Counsel at the U.S. Department of the Treasury, and as an attorney at the U.S. Department of Justice. Mr. Carroll began his career as a state prosecutor in Virginia after earning his bachelor's degree from the University of Virginia and his J.D. from the George Mason University School of Law.

On March 21, 2017, the Supreme Court decided National Labor Relations Board v. SW General, Inc. SW General, Inc. provides ambulance services to hospitals in Arizona. A union had negotiated longevity pay for SW General’s emergency medical technicians, nurses, and firefighters. In December 2012, between the expiration of one collective bargaining agreement and the negotiation of a new one, SW General stopped paying the longevity pay. The union filed an unfair labor practices claim with the National Labor Relations Board (NLRB), which issued a formal complaint. An administrative law judge determined that SW General had committed unfair labor practices, but SW General contended that the NLRB complaint was invalid because the Acting General Counsel of the NLRB at the time, Lafe Solomon, had been serving in violation of the Federal Vacancies Reform Act (FVRA). President Barack Obama had nominated Solomon--who had then been serving as Acting General Counsel after the General Counsel had resigned--to serve as General Counsel, but the Senate had not acted on the nomination. The president had ultimately withdrawn the nomination and replaced it with that of Richard Griffin, who was confirmed. In the intervening period--including when the NLRB complaint had issued against SW General--Solomon had continued to serve as Acting General Counsel. SW General argued that under the FVRA, Solomon became ineligible to hold the Acting position once nominated by the president to the General Counsel position. The U.S. Court of Appeals for the D.C. Circuit agreed and vacated the NLRB’s enforcement order. The NLRB then obtained a writ of certiorari from the Supreme Court. -- By a vote of 6-2, the Supreme Court affirmed the judgment of the D.C. Circuit. In an opinion by Chief Justice Roberts, the Court held that (1) subsection (b)(1) of the Federal Vacancies Reform Act of 1998, which prevents a person who has been nominated to fill a vacant office requiring presidential appointment and Senate confirmation from performing the duties of that office in an acting capacity, applies to anyone performing acting service under the FVRA and is not limited to first assistants performing acting service under Subsection (a)(1); and (2) Subsection (b)(1) prohibited Lafe Solomon from continuing his service as acting general counsel of the National Labor Relations Board once the president nominated him to fill the position permanently. The Chief Justice’s majority opinion was joined by Justices Kennedy, Thomas, Breyer, Alito, and Kagan. Justice Thomas filed a concurring opinion. Justice Sotomayor filed a dissenting opinion, in which Justice Ginsburg joined. -- To discuss the case, we have Kristin Hickman, who is the Distinguished McKnight University Professor, Harlan Albert Rogers Professor of Law, and Associate Director, Corporate Institute at the University of Minnesota Law School.
