This Day in Legal History: Furman v. GeorgiaOn June 29, 1972, in a narrow 5-4 decision, the Supreme Court delivered what many thought was a death blow to capital punishment in America. In Furman v. Georgia, the Court held that the death penalty, as it was then being administered, violated the Eighth Amendment's prohibition on cruel and unusual punishment because it was imposed arbitrarily and inconsistently.The case involved William Henry Furman, a man convicted of murder in Georgia. Furman was sentenced to death. But the critical issue wasn't whether Furman committed the crime—it was whether the death penalty itself was constitutional. The Supreme Court's nine justices were deeply divided. Five justices voted to overturn the death penalty as then applied, but they disagreed on why. Some thought the death penalty was always unconstitutional. Others thought it could be acceptable if applied fairly, but the current system was arbitrary.Here's why the decision was so important: Under the death penalty laws at the time, juries had nearly unlimited discretion in deciding who lived and who died. Two people could commit the same crime, but one would receive a death sentence while the other received life in prison. There was no clear standard. Race played a role—Black defendants were disproportionately sentenced to death. Geographic location mattered—you were more likely to be executed in the South than elsewhere. Whether you could afford a good lawyer mattered. The Supreme Court found this arbitrariness violated the Eighth Amendment. The Court didn't say states could never execute anyone, but it said the current system was too random and unpredictable.The Eighth Amendment says the government can't impose cruel and unusual punishment. If the death penalty is imposed so randomly that there's no consistency—no clear rules about who lives and who dies—then it becomes essentially random. It's like a lottery where the prize is death. That randomness itself violates the Constitution's guarantee that punishment won't be arbitrary.The immediate effect was stunning: Furman invalidated every death penalty statute in the country. Roughly 600 death row inmates had their sentences commuted to life imprisonment. For four years, there were no executions in America.But the story didn't end there. States quickly rewrote their death penalty laws to address the Court's concerns about arbitrariness. They created more detailed guidelines for when death was appropriate. They required separate penalty hearings where juries would hear aggravating and mitigating factors. By 1976, in a case called Gregg v. Georgia, the Supreme Court approved these new, more detailed death penalty statutes. Julie Henderson is the president of the North Carolina Bail Agents Association and has spent 24 years working in the bail bond industry.  She started in the field almost by accident after applying for what she thought was a legislative assistant job, and she has stayed because she cares about helping people get through one of the most stressful situations a family can face. In this episode, Julie explains what is really happening with bail bond scams, how scammers are finding people so quickly, and why these calls can feel so convincing.  We also learn what a legitimate bail process should look like, what families can do to verify whether someone is actually in jail, and why no one should be rushed into sending gift cards or app payments. In this episode of Finding Common Battle Grounds, we have another guest: Ken W. Good, an attorney who specializes in bail bonds. We take advantage of Ken's expertise to discuss a movement spreading across the US to end bail bonds under the premise that bail bonds can result in poor people being imprisoned because they cannot afford even low bail amounts. We discussed a Politifact article that investigated (and rated mostly true) a claim by Governor Gavin Newsom that only the US and the Philippines use for-profit or corporate bail bond systems. We used this as a launching point to discuss the consequences of changes to the bail system and whether they contribute to higher crime rates. Conveniently, we all agree that we don't want more crime and that crime has gotten out of control in some locations, but don't agree that we should retain bail for everyone or that our prisons are punitive and too full. We then turn to Google's Gemini glitch that ended up creating inaccurate historical images that reflect a diversity bias over accuracy. We agreed that historical accuracy is important and that Google needed to fix it's AI. We did not end up agreeing that truth is always more important than diversity, with Ryan arguing that truth is complicated and, while it is should always be pursued, it's not always clear what truth is. Ken disagreed and argued that there are capital-T "Truths" and they will always be more important than diversity.

The plaintiff accuses the defendant of stealing money from her bank account. The plaintiff says she gave the defendant her bank card to get money for bail, but she claims the defendant stole money and will not pay her back. The defendant is countersuing for defamation.  Then, the plaintiff used to work and live with the defendant. She claims the defendant asked her to pay rent early, but the defendant didn't pay and then said she was moving out, so the plaintiff is suing her for the cost of prepaid rent. The defendant doesn't think she owes the plaintiff money because the plaintiff changed their move out agreement.  Plus, the plaintiff pawned jewelry at the defendant's pawn shop. She claims the defendant's store lost her jewelry, so she's suing for the value of her items. The defendant says he has no idea what happened to her jewelry, and they are not responsible for theft or loss. The defendant claims he offered her money and items from his catalog. Alex is a nationally recognized expert on the Art of Skip Tracing with over 35 years of experience in the skip-tracing, FinTech and Bail Bonds industries. He is a keynote speaker and author of the Skip-Tracers National Certification Program, Florida Public Records Guide, and the Military Installations Guide. Alex is a contributor for several industry magazines and post-pandemic, has become a popular content matter expert podcast guest.  Currently he is the Director of Training and Development for LocateSmarter.   He has become a highly sought-after speaker in the bail enforcement, private investigations and FinTech space. He combines old school skip-tracing methods with new age cyber-tracking technology to equip attendees with the tools that he gained through invaluable experience.  Alex balances the hard facts about skips with just the right amount of humor and a touch of southern charm.
