The Voting Rights Act, enacted in 1965, and considered to be the most important civil rights legislation in American history, was effectively jettisoned by the ruling of the United States Supreme Court last week, according to our guest, David Daley, one of the leading experts in the country on the Act itself, and partisan and racial gerrymandering. The majority opinion in the case was written by Justice Samuel Alito and while he calls it an updating of the statute, others like Professor of law Richard Hasan, an elections law expert, begged to differ calling it an “earthquake” decision which sharply erodes the Voting Rights Act. With Section 5 of the Voting Rights Act already scrapped years back by the Roberts Court, and on the heels of the Louisiana vs. Callais decision last week, one is left to wonder what is left of protections for Black citizens across the South to ensure that their voices will count. I have had the privilege of interviewing Mr. Daley several times in the past. Never have I heard his words as impassioned and compelling as those he brings to this podcast. You will walk away with history surrounding this vitally important legislation, the immediate real- world impacts of this decision, and what the road ahead looks like for gerrymandering and voting rights. For decades, the DOJ has insisted that Epstein was thoroughly investigated, that the evidence was reviewed, that the case was handled—yet when transparency is finally required, the files suddenly become too numerous, too complex, and too sensitive to release on time. The contradiction is glaring: either these materials were already organized and understood, or the DOJ has been misleading the public for years about the depth and seriousness of its investigation.For survivors, this isn't just bureaucratic nonsense—it's a direct insult. Many of them waited decades to be believed, to see the system acknowledge what was done to them and who enabled it. The defense in the Kouri Richins murder trial has built its case around one central argument: Eric Richins had a history of substance use, and his death was a tragic accident. On the tenth day of testimony, a private investigator hired by Eric's own family took the stand and systematically dismantled that theory from every angle.Todd Gabler spent roughly a year investigating Eric's death independently before Kouri was arrested. Operating under rules that gave him access law enforcement couldn't get without a warrant, he pulled phone billing records and found that Carmen Lauber — the housekeeper prosecutors say sourced the fentanyl — was Kouri's third most frequent contact in the months surrounding Eric's death. He flagged Lauber's criminal history and drug court violations to the Sheriff's Office before detectives had identified her as a key figure. He placed GPS trackers on Kouri's car and her mother's vehicle. He conducted nearly 50 interviews. He handed over two hard drives of evidence. And when the defense asked whether other fentanyl sources in Summit County could explain Eric's death, Gabler said he looked into it and found no connection to this case.The defense noted he is not law enforcement. He agreed. He also made clear he doesn't need to be.That testimony came on a day when the jury also watched video of Kouri celebrating the day after Eric died, heard a forensic examiner say Eric's signature on a life insurance application was likely forged, listened to the full 911 call in which Kouri describes her husband as cold and dead weight, and heard a detective testify that Eric's sister flagged Kouri's potential involvement from the moment she arrived at the scene.The prosecution is nearly done. Trump's DOJ purge has removed approximately 300 FBI agents, most of them counterterrorism and counter espionage specialists, since the start of the second term. Cash Patel fired 45 of them directly, while thousands more have left the broader DOJ, gutting decades of institutional knowledge and expertise. Former FBI agent and national security contributor Christopher Olirri calls it an "institutional decapitation," warning the country is now dangerously exposed to sophisticated foreign adversaries. The timing could not be worse. Iranian state radio recently broadcast a series of random numbers in Farsi, believed by counterterrorism officials to be coded messaging to activate sleeper cells worldwide. A joint DHS, FBI and counterterrorism memo warning state and local law enforcement about heightened terrorist threats tied to the Iran conflict was blocked from distribution by the White House at the last minute. That five-page bulletin contained specific guidance for spotting and stopping attacks against American civilians. Hawk also covers the ISIS-inspired bombing attempt at Gracie Mansion in New York City, where two men lobbed incendiary devices that failed to detonate at an anti-Muslim protest organized by Jake Lang, who has since been exposed for attempting to contact who he believed was a 15-year-old girl. Lang is a prominent Trump and ICE supporter. The FBI agents and DOJ prosecutors who were fired were not volunteers on Trump-related cases. They were assigned by superiors. The retribution purge targeting anyone connected to the January 6th investigation, the Mueller probe, the Mar-a-Lago documents case, or Jack Smith's work has left national security dangerously undermanned. When Kouri Richins was arrested in May 2023 for allegedly poisoning her husband Eric with a fentanyl-laced Moscow Mule, the case against her seemed overwhelming. Financial desperation. Life insurance policies. A housekeeper who said she sold Kouri the drugs. A drug dealer who confirmed the fentanyl. Nearly three years later, as jury selection approaches for her February 2026 trial, the prosecution's case has been carved up by defense wins and judicial rulings. The drug dealer, Robert Crozier, has recanted — now claiming under oath he sold OxyContin, not fentanyl. Judge Mrazik severed 26 financial felony charges from the murder trial, meaning the jury won't hear about Kouri's alleged mortgage fraud, money laundering, or the nearly $5 million her business owed the day after Eric died. The prosecution's domestic violence expert was blocked. Their FBI behavioral profiler was limited to rebuttal-only testimony and cannot be used to suggest guilt. Statements Kouri made during a 2022 search were suppressed because detectives didn't Mirandize her. What prosecutors still have: Carmen Lauber's testimony, Eric's toxicology showing five times the lethal dose of fentanyl, an orange notebook allegedly detailing the night of his death, and the infamous "Walk the Dog" letter found in Kouri's jail cell that prosecutors call witness tampering. The defense says it was fiction. The Utah Supreme Court refused to move the trial out of Summit County despite surveys showing nearly 80% of residents recognize the case. In this episode, we expose how the Harper's letter, its transphobic signers, and the larger “cancel culture” panic helped shield figures like J.K. Rowling and Bari Weiss while the real threats to free speech exploded under Trump.More than 150 journalists, authors, and academics signed the infamous “Harper's letter” in 2020. Published in Harper's Magazine amid the George Floyd racial justice protests, the letter argued that the more serious threat to the nation was “an intolerance of opposing views, a vogue for public shaming and ostracism, and the tendency to dissolve complex policy issues in a blinding moral certainty”—aka “cancel culture.” At the time, trans people were some of the letter's biggest critics, highlighting its bigoted dog whistles.
