As Elon Musk steps away from the so-called Department of Government Efficiency, the chaotic legacy of his aggressive assault on federal agencies continues to reverberate throughout the government. Musk's goal — slashing $1 trillion from the federal budget — has fallen far short. At most, it has cut $31.8 billion of federal funding, a number that the Financial Times reports is “opaque and overstated.” Notably, the richest man on Earth's businesses have received a comparable amount of government funding, most of it going to SpaceX, which remains untouched by DOGE's budget ax.Stepping in to carry the torch is Russell Vought, the director of the White House Office of Management and Budget, and a key architect of Project 2025, the sweeping conservative playbook to consolidate executive power. Under his stewardship, DOGE will continue its mission to dismantle the federal government from within.”Access to all of this information gives extraordinary power to the worst people,” says Mark Lemley, the director of Stanford Law School's program in law, science, and technology. Lemley is suing DOGE on behalf of federal employees for violating the Privacy Act. This week on The Intercept Briefing, Lemley and Intercept newsroom counsel and reporter Shawn Musgrave join host Jordan Uhl to take stock of the legal challenges mounting against the Trump administration's agenda. As the executive branch grows more hostile to checks on its powers, the courts remain the last, fragile line of defense. “ There have now been hundreds of court decisions on issues, some involving the Privacy Act, but a wide variety of the Trump administration's illegal activities,” says Lemley. Donald Trump has unleashed a "flood the zone" strategy: a cascade of executive actions aimed at rapidly reshaping the federal government and the country. The scope of changes is staggering: massive reductions in the federal workforce, the dismantling of USAID, signaling departments of labor and education are next, and the firing of Justice Department prosecutors. Trump granted Elon Musk's so-called "Department of Government Efficiency" team unprecedented access to the Treasury Department payment systems. Trump's executive orders aren't just changing policy — many appear to openly challenge existing laws and constitutional boundaries. The sheer volume of changes has left government watchdogs struggling to respond.Amid this whirlwind, a critical question emerges: Where is the opposition? What concrete steps are Democrats taking to counter this aggressive agenda? Currently, the answer is obvious: not enough.On this week's episode of The Intercept Briefing, foreign policy analyst and Voices contributor Sunjeev Bery says it has a lot to do with who makes up the party leadership. “I'll say that from my perch, what I'm seeing is a window into the broader culture of the elected officials of the Democratic Party. They are not organizers, by and large. They are not people who build and channel power to extract concessions from the powers that be. They are ladder climbers and aggregators of pre-existing power. And that's why the Democratic Party is losing. You have folks like Chuck Schumer, he's not a critic of concentrated wealth. He's a product of concentrated wealth.”Senior politics reporter Akela Lacy says there are some very obvious things the Democrats could be doing. “Movement people are asking the obvious question right now, which is: Why are there any Democrats — at all — voting to confirm a single Trump nominee? That's one of the lowest hanging pieces of fruit,” she says. The Democrats had no plan, Lacy says, despite there being “no confusion about the fact that these nominees were going to be coming up for a vote. And still there were Democrats who voted for several of Trump's nominees.” Bery, Lacy, and Jordan Uhl also discuss the messaging issues the Democratic Party continues to face, even post-election. “There still seems to be a fundamental failure to recognize that one party is telling a story as to why people are hurting and they are punching down in the naming of who's responsible,” says Bery. “It's undocumented migrants, it's DEI, it's transgender people, this is who Trump is punching down and blaming. The Democratic Party's not punching up. It's an album that Bryan has wanted to do since Day 1 of the show, and the day has finally come, as Jordan Uhl donated enough money to make it so! It's a classic POD Kast episode in that we talk a lot about the music, but we are just as fascinated with the band, as Orgy were another insane nu-metal story, from their inception to their eventual, extremely messy demise.   For an album that was released right in nu-metal's peak and was the first release on Jonathan Davis' album Elementree, it is really an outlier in the genre, one that managed to take the sad-mope 80s new wave and combine it with nu-metal into one sleek package. The music itself is pretty good, John decides (obviously Bryan loves it), but doing some research into the band reveals conflicting feelings for the Boys. We learn all about the band's take on why they wore makeup, why Jay Gordon gave up football to become a singer, why they broke up, and how Jay Gordon made money off of fellow band Lit. We also discuss Bryan's detailed history with this record, from loving it when it was originally released to the role that the song "Revival" played in his marriage. One of the most iconic figures in nu-metal, Wayne Static, is almost more of the focus of this episode than the band is, as we look into Static-X's start as a band, Wayne's eventual death, and the band's decision to dress Edsel Dope up in a Wayne mask and go on a 20th Anniversary Tour of this album. It's the first album we've reviewed from the side of nu-metal that also held a pretty large industrial influence, and both Bryan and John explain that it was one that largely passed them by at the time but one they are excited to revisit.   In a continuing series where Bryan Quinby (Street Fight Radio) and John Cullen (Blocked Party) review one classic nu-metal album per month, Static-X comes in from a listener donation, and for John at least, it feels like the only way this would've ever gotten a review from the P.O.D. boys. But Bryan and John are game for it, as the album shows some flashes of what Static-X could have been, were they not so focused on "evil disco" and building tracks strictly from the drums and programming up. And the weird legacy of the band proves almost more interesting, as the in-fighting over the name, Wayne Static's drug problems, and the introduction of Xer0 make them a more fascinating tale than most.
