Our Special Guest this week, returning for a fourth time, is Joanna Averley, Chief Planner at the Ministry of Housing, Communities and Local Government. We ask Joanna about the current and pending reforms to planning law and policy. An Appeal Decision involving Churchill Retirement Living against Bournemouth Christchurch and Poole Council regarding planning permission for redevelopment to form a multigenerational community comprising 177 open market, affordable and retirement living apartments, 237 square metres of Class E commercial space, communal facilities, access, car parking, landscaping and all associated works at the former Southern Gas Network Site, Christchurch. The appeal was made under section 78 of the Town and Country Planning Act 1990 (as amended) against a failure to give notice within the prescribed period of a decision on an application for planning permission.A Decision of the Secretary of State for Transport on the proposed expansion of Luton Airport. The application would grant development consent for the expansion of London Luton Airport to enable an increase in overall passenger capacity to 32 million passengers per year. The application also includes the construction of a new passenger terminal, additional aircraft stands and associated redevelopment of existing facilities and infrastructure. An Appeal Decision involving Galliford Try Investments (GTI) against the decision of Milton Keynes Council with the view to demolish a vacant 2-storey building (Class E) and the erection of a 33-storey building comprising commercial floor space (Class E) on the ground floor and mezzanine level with residential units on upper floors comprising up to 302 dwellings and associated works, at Jaipur and Orchard Lounge, 599 Grafton Gate, Milton Keynes. The appeal was made under section 78 of the Town and Country Planning (T&CP) Act 1990 (as amended) against a refusal to grant planning permission.Visit our Website:hwgpnfy.com

Back in March 2024 friend of the podcast Catriona Riddell gave a lecture at UCL's Bartlett School of Planning that she called ‘Strategic Planning in England - Where did we go so wrong?'. Sam Stafford couldn't be there that night, but Catriona shared her slides on LinkedIn and they read to Sam almost like a ‘Brief History of Planning 2010-2024', which he thought a good subject for an episode. As well as Catriona, who was Director of Planning at the South East England Regional Assembly when the Coalition Government came to power in 2010, Sam approached another friend of podcast, Steve Quartermain, Chief Planner between 2008 and 2020, who was also keen to be involved. Sam felt though that a political perspective on things was also needed so he approached Greg Clark. Greg was appointed Director of Policy for the Conservative Party in 2001 before being elected as MP for Royal Tunbridge Wells in 2005. He has held a number of senior Government roles, including, and of most relevance to planners, Minister for Decentralisation and Cities within the Department for Communities and Local Government between May 2010 and September 2012 and Secretary of State for CLG between May 2015 and July 2016. Greg was also briefly Secretary of State for Levelling Up, Housing and Communities between July 2022 and September 2022. Greg, pleasingly, was also keen to be involved, and the four of them finally got together at Soho Radio Studios in early October 2024. There were many, many topics of possible conversation in Sam's notes for the recording. They did not actually get to the latter part of the 2010-2024 period, so they did not get to, for example, the Standard Method, the 2020 White Paper, and the Theresa Villiers / LURB amendments brouhaha, but that was because they ended up dwelling on arguably the big three topics of that 2010-2024 period, which are the revocation of the Regional Strategies, Localism and the NPPF. They did also touch, right at the end of the conversation, on permitted development rights. On this episode, Nate is joined by Jennifer Keesmaat for a discussion around housing, transit, and the roles that each level of government can and should play. Jennifer is the former Chief Planner for the City of Toronto, she's worked around the world in urban design, and she's currently a partner at and co-founder of Markee Developments, doing the work of building affordable housing. It is past time for all levels of government to deliver on housing and transit. If we don't, we will see productivity and generational fairness challenges only further exacerbated.Now, we have a mayoral election ahead of us, and an opportunity for greater ambition here in Toronto. At the provincial and federal levels, we have upcoming budgets, and an opportunity to revisit and reinvest in our National Housing Strategy, for example.But as I think about Liberal and progressive politics more broadly, we have to send a strong message that we are ready to build and especially to build housing and transit. There is no reason for us to cede that ground to anyone else.

Joanna is a planner who has worked across all aspect of the town planning, regeneration, built environment and development process. She has worked in consultancy, charity and as a government adviser. Decisions of the Week: Decision of the Court of Appeal in R(oaf Blacker) v Chelmsford City Council [2023] EWCA Civ 25 dated 17th January 2023 dismissing an appeal against the decision of Mrs Justice Thornton who declined to quash a decision granting outline planning permission for housing on a part PDL /greenfield site in Roxwell. First resolution minded to grant but at a second meeting the decision was to refuse. Issues of inconsistency raised. A Minded to Grant Decision made on behalf of the Secretary of State dated 19th January 2023 giving the applicant, the Ministry of Justice, time to provide further evidence to address highway issues identified by the inspector, recommending refusal of the appeal against the dismissal by Chorley Borough Council of a hybrid application for a new prison on land adjacent to HMP Garth & HMP Wymott, Leyland, Lancashire in the Green Belt. Decision of an inspector dated 9th January 2023 allowing an appeal by Ainscough Strategic Land against the decision of West Oxfordshire DC to refuse an outline application for up to 120 dwellings on greenfield land at Witney Road, Ducklington. Land said to be in a gap between Ducklington and Witney, impact on landscape character and setting of conservation area, no 5 yr HLS. NPPF 202 exercise engaged. Decision of an inspector dated 18th January 2023 dismissing an appeal by Senior Living (Freelands) Ltd against the decision of West Oxfordshire DC to refuse an outline application for up to 160 C2 extra care units & retention of veterinary practice in Coach House on a 4.3 ha site in the grounds of Freeland House, a NDHA and itself in use as a Care Home. Decisions of the Week: Decision of the Supreme Court in DB Symmetry Ltd & anor V Swindon Borough Council [2022} UKSC 33 dated 14th December 2022 dismissing an appeal against the decision of the Court of Appeal which declined to confirm that the Court of Appeal in Hall & Co Ltd V Shoreham-by-Sea UDC [1964] 1WLR 240 erred in law in that case that held that a LPA could not lawfully require a landowner by means of a planning condition to dedicate land as a public highway and thereby avoid the payment of compensation. Decision of the High Court in R (oao Philip Addison) V London Borough of Southwark & Anors [2022] EWHC 3211 (Admin) dated 6th December 2022 dismissing a challenge to the grant of planning permission for the redevelopment of Champion Hill Stadium & neighbouring astroturf pitch, raising issues about mistake of fact, failure to apply planning policy and failure to discharge the Public Sector Equality Duty. Decision of the Minister of State for Housing dated 14 December 2022 allowing an appeal made by Redrow Homes (Yorkshire) against the failure of City of York Council to determine an application for circa 970 dwellings, associated demolition, infrastructure, primary school, community facilities and A1 store on land allocated in the emerging Local Plan ST8, in the context of Huntingdon NP & the saved policies of the otherwise revoked Yorkshire & Humber RSS 2008. Land in GB and VSC demonstrated. Decisions of an inspector dated 28 November 2022 allowing one appeal by Berkeley Homes (Southern) Ltd against the decision of Guildford BC relating to a hybrid application on Lower Road Effingham for 4 self-build & 110 units and dismissing another appeal against the refusal of RMA for the erection of 99 dwellings on Howard of Effingham School. Land in GB, issues of viability raised.

Decision of an inspector dated 17 May 2022 allowing an appeal by against the decision South Somerset DC to grant permission on two fields north of Ansford & Castle Carey, for 200 dwellings ( 70 affordable & 130 open market) with associated highways, drainage & landscape. Issues around impact on character & appearance, HLS, the effect on phosphate & suitability of the site falling outside the defined direction of growth. “We should aspire to pass on our heritage to our successors, not depleted but enhanced. In order to do that, we need to bring about a profound and lasting change in the buildings that we build, which is one of the reasons we are placing a greater emphasis on locally popular design, quality and access to nature, through our national planning policies and introducing the National Model Design Codes.” So said Robert Jenrick when announcing at the end of January 2021 the Government's response to the report of the Building Better, Building Beautiful Commission. As well as the creation of an ‘Office for Place', which is to support local communities in determining the standard for all new buildings in their area, the NPPF is to be revised to place greater emphasis on beauty, place-making and, of course, tree-lined streets. In addition, a new paragraph 127 of the NPPF will state that all LPAs should prepare design guides or codes consistent with the principles set out in the National Design Guide and the new National Model Design Code (NMDC). The NMDC itself though, as one of it's authors, David Rudlin of URBED has admitted, is not a code at all but a guide to writing codes.  An increased emphasis on the design quality of new development, and a national framework for design standards for LPAs to set policy and determine individual decisions by, can only be a good thing. There seems to be a huge leap though from where we are now to all LPAs having a design code or guide in place within three years, which the Chief Planner has written to them requesting. And what, for example, is the Code's relationship with the White Paper? Are Codes for every street or just ‘Growth' and ‘Renewal' areas? And whilst agreement on what constitutes a good design code should be easy to achieve, agreement on what constitutes good design, let alone beautiful design, is perhaps harder achieve. Are expectations for what a NMDC can achieve being set unrealistically high? Joining Sam Stafford to discuss these issues in this episode are Paul Smith, Vicky Payne, Louise Wood and Ben Woolnough. Our Very Special Guest this week is Joanna Averley, the new Chief Planner at MHCLG. Court Judgments of the Week Wainhomes v SOSHCLG [2020]EWHC 2294; a decision of Dove J who quashed a decision of the Secretary of State to dismiss an appeal for 100 homes and remitted it for redetermination. The case centred upon a failure of reasons to explain why a policy agreed by three authorities was considered to be up to date despite the authorities agreeing a subsequent redistribution based on an MoU based on an aggregated Standard Methodology figure. Peel Investments v SOSHCLG [2020] EWCA Civ 1836 a decision of the Court of Appeal upholding the decision of Dove J. who in turn upheld an Inspector's decision to dismiss appeals in respect of residential development up to 600 dwellings. The case turned upon how to approach whether policy is out of date which is fundamentally a matter of planning judgment – so here policies in a plan without saved strategic policies could still be up to date. Vidyadhar Phatak, is one of the leading urban thinkers in the country with rich practice and teaching experience. He is the former Chief Planner of Mumbai Metropolitan Region Development Authority and also the former Dean of Faculty Planning, CEPT University. Mr Phatak was the director of National Housing Bank from 2006 to 2012 and also worked on several urban planning reforms as a consultant with the World Bank. Over the last 40 years, he has worked on land markets, land-based Fiscal Tools, urban Planning reforms and housing. A. Srivathsan is an architect and urban designer, and currently Director, Center for Research on Architecture and Urbanism, CEPT University Ahmedabad. He was previously the Academic Director of the University, and before that taught for a decade and worked as a senior journalist with The Hindu, the national newspaper. His research and writings include the themes of urban history, planning policies and contemporary architectural practices. Srivathsan's recent work includes work on evidence based affordable housing policies for Chennai, a study conducted for Tamil Nadu State Planning Commission. In this final episode of land related subjects, Vidyadhar Phatak in conversation with A. Srivathsan, explains the idea of Land value Capture (LVC) and Value Capture Financing (VCF) pointing out the fine-drawn differences between the two concepts. He explains the importance of these financing tools in generating hitherto untapped land value gains for financing infrastructure projects particularly the metros. Further, he explains two broad approaches to LVC viz. Land developmental and fiscal tools. He briefly elaborates the fiscal measures. In the end, he highlights the challenges in adopting LVC practices in a manner that integrates the urban planning, legal and public finance dimensions of the land market.

This episode highlights the transformation of FSI as a physical planning tool to a complex fiscal tool. He discloses the ill-effects of first creating scarcity of development rights through low uniform FSI and then using the scarcity value for achieving development objectives. Further, he explains the failed attempt to reform the FSI regime in Mumbai. He raises the legal question of ownership of development rights and the state's right to assign such rights at a price. In the end, he has some cautionary words for other cities that wish to emulate Mumbai in using FSI as a policy tool.

Mr.Phatak points out the fallouts resulting from ignoring or remaining oblivious to land as private property and market forces. Further, he explains how planning has implicitly presumed large scale public ownership of land. Things have changed, he explains. After the 1990s that is the post-economic liberalisation era, the planners are compelled to take into account the land market in formulating city plans and in evaluating development control measures.

The most obvious choice is my friend Brent Toderian, urban planner and former Chief Planner for the City of Vancouver. We spoke in the Olympic Village - one of the projects Brent is most proud of - about the urban development in Vancouver. He tells me what Vancouver learned from the world and - more importantly - what the world can learn from Vancouver. In this episode, I had the pleasure of speaking with Brad Bradford. I first met Brad in 2011 when he was the President of the Canadian Association of Planning Students, and I was speaking about Resilience in the face of Climate Change Impacts at the annual CAPS conference he had helped organize. I distinctly remember being very impressed when I first met Brad, especially by his keen awareness of the planning issues associated with Climate Change, as well as complex realities of trying to address these issues. Brad is now an urban planner and community activist, with specialty expertise in sustainable and district energy planning, a passionate cyclist and competitive bike racer, and he is now entering the world of politics by running for Toronto City Council in Beaches-East York (Ward 19).  Until leaving the City of Toronto to run for City Council, Brad was responsible for Stakeholder Engagement and Special Projects in the Office of the Chief Planner at the City of Toronto where he spent his time working with government, the private sector, non-profits, and community groups to broaden discussions around the kind of city we want to be. Brad is passionate about in the interconnected issues of inclusivity, affordability, transit and the environment. Through his role at the City, and as a future City Councillor, Brad is working to diversify voices in decision-making and bring more people to the table to discuss city-building issues. In 2016 Brad won the Canadian Institute of Planners President’s Award for his work on the FutureFORWARD Task Force. And as an avid cyclist, Brad launched the Toronto Hustle project in 2017 to develop the next generation of Canadian athletes, while providing a platform for active transportation advocacy across North America.
