 Gościem Popołudnia Radia Wnet była Kinga Śliwińska‑Buśkiewicz, sędzia i przedstawicielka Ogólnopolskiego Zrzeszenia Sędziów Equitas. Rozmowa dotyczyła zapowiedzi Ministerstwa Sprawiedliwości dotyczących „przywracania praworządności” oraz reakcji środowiska sędziowskiego na publiczną krytykę orzeczeń przez ministra Waldemara Żurka. Sędzia nie kryła, że sposób, w jaki minister odnosi się do decyzji sądów, budzi głębokie zaniepokojenie.Trudno przyjąć takie słowa pozytywnie. Zawsze, gdy słyszymy krytykę od przedstawicieli władzy wykonawczej czy ustawodawczej, nie można uznać, żeby to było coś dobrego. Strony często są niezadowolone z orzeczeń, ale od tego są środki zaskarżenia. Taka publiczna krytyka w takiej formie żadnemu sędziemu nie może się podobać– mówiła. Jak podkreślała, niezawisłość sędziowska nie jest dziś zagrożona jednym działaniem, lecz całym zespołem rozwiązań systemowych.Ta niezawisłość jest zagrożona w kilku aspektach. Doskonałym przykładem jest segregowanie sędziów do określonych wydziałów czy możliwość odstąpienia od losowania składów kilkuosobowych. Kolejna sprawa to delegowanie sędziów do wyższych instancji – sędzia delegowany przez ministra jest zależny od władzy wykonawczej, bo delegacja w każdej chwili może być cofnięta– dodała. Sędzia zwróciła uwagę także na dramatyczne braki kadrowe w sądach i sposób ich uzupełniania, który podważa realną niezależność orzeczniczą.Brakuje nam około tysiąca sędziów. Etaty uzupełnia się delegacjami, mimo że orzecznictwo Trybunału Sprawiedliwości UE jasno wskazuje, że taka zależność od ministra budzi wątpliwości co do pełnej niezależności– alarmowała. Najostrzejsza krytyka dotyczyła jednak planów dotyczących sędziów powołanych po 2018 roku.Jedną grupę sędziów chce się zdegradować, a po dwóch latach pracy przymusowej na delegacji przywrócić na niższe stanowiska. Inną grupę – przedstawicieli innych zawodów prawniczych – po prostu wyrzucić z zawodu. To jest całe pasmo działań, które budzą nasz stanowczy sprzeciw– zaznaczała. Śliwińska-Buśkiewicz podkreślała, że zmiany personalne w sądach nie prowadzą automatycznie do poprawy ich funkcjonowania.Sama wymiana prezesa czy wiceprezesa sądu niczego nie przyspieszy. To tylko nadzór administracyjny. Co więcej, dokładnie w ten sam sposób prezesów odwoływał minister Ziobro. Ta sama procedura, te same przepisy– mówiła. W rozmowie padł również zarzut braku realnego dialogu Ministerstwa Sprawiedliwości z częścią środowiska sędziowskiego.Wielokrotnie zwracaliśmy się z prośbą o możliwość opiniowania projektów aktów prawnych. Nie jesteśmy zapraszani nigdzie. Jesteśmy całkowicie pomijani. Nie ma dialogu, nie ma nawet próby wysłuchania– podkreślała. Sędzia wskazywała, że krytyczne opinie ekspertów są konsekwentnie ignorowane, nawet wtedy, gdy pochodzą od międzynarodowych instytucji.W jej ocenie narracja o „neosędziach” została oparta na uproszczeniach i nie znajduje potwierdzenia w orzecznictwie europejskich trybunałów.Nie ma żadnego orzeczenia ETPCz ani TSUE, które kwestionowałoby status sędziów powołanych po 2018 roku jako taki. Chodzi o procedurę, a nie o sam status. Mówienie inaczej po prostu nie polega na prawdzie– zaznaczyła. Na zakończenie rozmowy sędzia nie ukrywała pesymizmu co do kierunku, w jakim zmierzają zapowiadane reformy.„Obawiam się, że oddalimy się od modelu idealnego. Zamiast stabilności prawa i zaufania obywateli mamy element rewanżyzmu. A przecież wcześniej, nawet przy poważnych problemach konstytucyjnych, zawsze znajdowano rozwiązania, które chroniły stabilność systemu”./fa

*Trigger warning Talks of mental health and suicide* Today's episode took me two attempts to record! I can't even blame technology for it either as I actually deleted the first recording myself! In today's episode I wanted to discuss how I recently hit 10k followers on Instagram and what that really means And the thing is... it doesn't mean a lot... it's just a number I speak about how before I would have equated my self-worth to things like likes or followers The tendency to think these numbers will change your life How it's not really a lot in the grand scheme of social media following That it's been a long journey to detach myself from these feelings I then speak about world suicide prevention day which is the day this episode goes out The guilt you can feel if you don't think "you have real problems" when you suffer from mental health The importance of reaching out to people if you are feeling this way and that as much as friends and family mean well sometimes you need a professional Checking in on friends and family when you haven't heard from them or even if you have just letting them know you're thinking about them Contacting charities who help people with mental health if you don't feel like you have anyone close to you I then come back to the 10k (did I mention I've 10k followers?) and things that I find will help if you are looking to grow your social media presence these are all also applicable to many areas of life. As Muireann sobbed her way to a riding lesson early on in life, scared to ride, little did she know that the sisters who owned the stables would change, shape and inspire her future both in and out of the saddle – her first experience of truly supportive women working together. With a career steeped in many equestrian experiences, Muireann jumped at the opportunity to combine the two things she loved; writing and horses, as she recalls the emotions when her first article was published in the Grassroots Gazette. A few articles later and a meeting request with the ‘boss' left Muireann thinking that she might get fired, but she needn't have worried, it was the beginning of something really big – Equitas was born. Today's episode brings together a trio of London Market leaders. Sheila Cameron is the CEO of the Lloyd's Market Association (the LMA) and was the guest on the very first Episode of the Voice of Insurance. Clyde Bernstein is the Head of Broking Technology at WTW, as well as being its Head of Broking in Great Britain. Clyde appeared in Episode 63, which was all about the broker of the future. Completing the line-up is someone who I have wanted to get on the show for a long time as he is a strong, really well-known exceptionally bright and eloquent executive who always has an interesting view of the market. Paul Jardine is an Actuary, the former Chief Actuary and Commutations Director of Lloyd's run-off vehicle Equitas and was one of Stephen Catlin's top executives for over 15 years. He currently has multiple interests, the most prominent of which is that of Non-executive Chairman of Lloyd's turnkey Managing Agency Asta. But what unites my three guests is that they are all members of the recently formed Data Council, chaired by Sheila, which has been brought together by overarching London trade body the London Market Group (LMG) to drive the digitisation of the Market. This episode gets to the heart of what the Data Council is and what it is tasked with doing It also dissects the Council's first major achievement which has been to codify the Core Data Record (or CDR) which will be the building block for making London Market contracts fully computable. Sheila, Clyde and Paul are a lively group and this podcast is a really good way to get up to speed for anyone who may sometimes find the reform process in the London Market difficult to follow. 08/11/2007 — No final de 2007, a bolsa brasileira amanheceu com um fato novo que colocou o país em posição de destaque no mercado internacional. Pela primeira vez o mundo olhou para o Brasil como a próxima potência do petróleo. A descoberta do campo Tupi, na camada pré-sal, levou o governo aos noticiários e os acionistas da Petrobras à euforia. Para as ações da estatal, este fato novo foi tratado como um divisor de águas. O estudo inicial da estatal apontava para um volume recuperável de óleo leve estimado entre 5 e 8 bilhões de barris de petróleo e gás natural. Para se ter uma ideia, as reservas totais da empresa acumulavam 13,7 bilhões de barris no final de 2006. O leilão de abertura daquela quinta-feira apontava expressiva valorização de 6% para as ações da estatal, com os investidores tentando mensurar a descoberta. No fim do dia, o fechamento marcou impressionante disparada de 14,16% das ações preferenciais da Petrobras, que sozinhas movimentaram R$ 3,3 bilhões na sessão. Mais impressionante que a resposta da ação foi a movimentação no mercado de derivativos. Os comprados em calls viram suas posições dispararem mais de 1.800%. Por outro lado, os vendidos em opções da estatal amargaram prejuízos impressionantes. The Roy Green Show Podcast Remembrance Day Special Ted Barris is an author of numerous books on the Canadian military and war. He joins Roy to discuss our country's military history, how Canadians impacted WWI, and the often forgotten role Canadian soldiers played in the Korean War. Countless Canadian military veterans live with Post Traumatic Stress Disorder, which was once known as “shellshock” in WWI. Support for these veterans and their caregivers is severely lacking. Our guest Jenny Migneault has battled for “the identity and the dignity of caregivers of wounded veterans.” The Afghani translator known as “Left Behind Alex” is one of the many of translators whose life is in danger after helping Canadian forces combat the Taliban. He, like the others, was integral in helping members of the Canadian forces to survive in so many ways. Yet because Sajad missed the small window of opportunity for immigration, he is now stuck in Afghanistan where he is hunted by the Taliban. On June 2, 2008, during his second tour of duty in Afghanistan, Major Campbell lost both of his legs to a target IED in a Taliban attack. He travelled for two hours via helicopter without any pain medication to a field surgical hospital where he was treated for his extensive injuries, and had to be resuscitated on the operating table. Major Campbell now joins Roy to discuss his life before and after the war. Canadians call in and share their stories, and their family stories, of military service. For many military veterans who fought for Canada, surviving on a day-to-day basis back home is a challenge they hadn't anticipated. Often, they endure battles with mental health issues like PTSD, suffer from the lasting scars of severe wounds or – in far too many cases – end up homeless. Meanwhile, Justin Trudeau told a town hall meeting that Canada's veterans are “asking for more than we can give right now”. The Equitas Society has organized the first annual Canadian Walk for Veterans, which will be held in cities across Canada on June 3, 2018. Prime Minister Justin Trudeau said those words during his town hall in Edmonton on Thursday. He was referring to the Equitas lawsuit, which sought to restore and protect disability pensions and benefits for veterans but was struck down late last year. Now the veterans and legal team behind the lawsuit are looking to take their class action complaint to the Supreme Court of Canada. The Roy Green Show "Why are we still fighting certain veterans groups in court? Because they're asking for more than we are able to give right now."   Prime Minister Justin Trudeau said those words during his town hall in Edmonton on Thursday.
