Transcript: Intro: Lindsey: Welcome to the Personal Injury Marketing Minute, where we quickly cover the hot topics in the legal marketing world. I'm your host, Lindsey Busfield. As a legal SEO agency, the law firms we work with all have a dedicated interest in growing their firms with strategic marketing initiatives. As such, we field a lot of questions regarding which marketing strategies are worth investing in and which are more hype than results. One organization we have been asked about multiple times is PILMMA. Many of the clients we work with are already PILMMA members and they consistently praise the strategic marketing and business management strategies that they receive as a result of their membership. Additionally, I had the opportunity to meet Ken Hardison, the Founder of PILMMA at their annual summit last year. And while I could talk secondhand about the great work that PILMMA does, nobody is going to be able to explain the game-changing resources PILMMA provides as well as Ken can himself. Thank you so much for joining us today. Ken: Oh, thank you, it's my honor. How Did PILMMA Start? Lindsey: Well, let's start with a little bit of information just about you. Can you share a little bit about your journey from becoming a lawyer to a leader in the legal marketing and management industry? Ken: Yeah, so I started practicing in '82 in a little town called Dunn, North Carolina. And I was a partner in another firm from 82 to 96. And I wanted to start marketing because I had went to court one day, I used to do PI, disability and criminal, and one of the partners did estate, real estate and the other one did domestic. And I went to court and this guy came in with crutches and I said, "What happened, Joe?" He said, "Well, I got hit by a semi." I said, "Well, you know, I do PI." He said, "Yeah, but I hired this guy off the TV." And it just hit me. Well, I went and tried the case and we won the case and I drove back to the office and I told my partner, I said, "I wan to have a meeting," I said, "We have got to change with the times," I said, "We need to start marketing." And they said, "No, it's unprofessional. We're not going to do it." So we had a dialogue for about six months. I left, took one associate and three staff and I went out and kind of went out, spent three days with John Morgan, this is in '96. Back then he only had 25 lawyers. I went Ken Nunn up in Indiana, and I shadowed him for two or three days and then I went and got involved with Dan Kennedy and Jay Abraham, and I just learned everything, read everything I could about marketing and then tried it to law firms. And I went out and mortgaged everything I had to my name, half a million dollars at that time and went on TV and started Yellow Pages. And of course the Yellow Pages are dead now. But anyway, in five years we went from two lawyers, three staff to 13 lawyers, 47 staff, and the rest is history. 2010, I just got up one morning and I just wasn't challenged, I wasn't looking forward to going to work, and I said, "I think I'm ready to do something else." And so I sold a law firm and I was going to retire, and I moved down to Myrtle Beach from Raleigh, I was living in Raleigh then, and I fished in golf for about six months,

Litigation Update: Kluge v. Brownsburg Community School Corporation

Where should the line be drawn in the debate between the rights of persons to hold religious beliefs and transgender advocates when it comes to government policies? Whether teachers or others can be compelled to use names and pronouns for students who identify as transgender is becoming a common battleground. The school district in Brownsburg, Indiana ordered Mr. Kluge to use incorrect pronouns, which he believes are a lie. The school moved to fire him when he expressed a religious objection—without considering any Title VII religious accommodations, as the law requires. Once Mr. Kluge suggested he use all students’ last names like a coach, the district relented. But school officials changed their minds when some students and teachers complained, saying no future accommodations would be allowed. They forced Mr. Kluge to either violate his religious beliefs with his own words, face termination, or resign. Mr. Kluge resigned under protest and filed suit under Title VII for religious discrimination and retaliation. The district court granted summary judgment to the school district, and the Seventh Circuit affirmed, under Hardison’s more than a de minimise cost test for undue hardship. After the Supreme Court held in Groff that undue hardship requires more—a substantial burden in the overall context of the employer’s business, the Seventh Circuit reversed and remanded. But the district court’s analysis did not change. Mr. Kluge’s case is now back before the Seventh Circuit, which will be one of the first appellate courts to grapple with Groff’s new standard. First, this is a two-part Mystery to Die For. Half the story was in last week's episode with the rest of the story, the deliberation, and the big reveal in this one. So, if you missed Part 1, please go to it first.Second, murder and solving it is our thing here at Mysteries to Die For but today's story includes some real life topics that some audience members may be sensitive to including violence against children, bullying, and antisemitism. DELIBERATIONJawnie stand-in Steve Rockfish and his sidekick Estelle are chipping away at Karen Lazar's cold case, but there's still some work for us to do. Here is a list of the people living and working in Ewan, NJ back in 1976:Gladys and George Lazar, Karen's parents, who had recently moved to the small farming townMikey Hardison, the boy who had a crush on Karen and worked for CarlßonScott and Tommy, schoolyard bullies who sent Karen into the woods on a scouting missionHarry Hardison, Mikey's father, a drinker who had issues with the Lazar's Jewish faith and his own lusting after Gladys.Vern Gicobe, a friend of Hardison and loner who discovered Karen's body while huntingManfred Carlßon, German owner of Carlßon Game Processing, who kept a poster of Karen in his shopHere is what Rockfish and Estelle (and Jawnie, too) have discovered:Karen's body was found five years after she disappeared. It had not decomposed. She was killed by strangulation. While there was little documentation on the body, photos showed cuts inflicted post mortem covered her. A single large, deep cut was on her back.No autopsy was performed but DNA samples were taken and preserved. No matches were found through CODIS.The older boys Karen was playing Army with—Mikey, Tommy & Scotty—were the last to see her alive. The local police cleared the last two boys at the time, noting they were seen in town.Mikey admitted going after Karen that day and finding her next to a creek, crying. When he tried to kiss her, she punched him, sending him into the creek. She ran off and he said he didn't see her again. Rumor had it the married couples of Ewan like to trade partners. Harry Hardison was reported to be very fond of Gladys Lazar, despite him being antisemitic and she being Jewish.Hardison disapproved of his son's crush on Karen and sent him to work with Carlßon, saying the hard man would straighten Mikey out.Vern Gicobe said Mikey would stare at the missing person picture of Karen that hung in Carlßon's. Welcome to Supreme Court Opinions. In this episode, you'll hear the Court's opinion in Groff v DeJoy. In this case, the court considered this issue: Is inconvenience to coworkers an “undue burden” under Title VII of the Civil Rights Act of 1964 such that it excuses an employer from providing an accommodation requested for religious exercise? The case was decided on June 29, 2023. The Supreme Court held that Title VII requires an employer that denies a religious accommodation to show that the burden of granting an accommodation would result in substantial increased costs in relation to the conduct of its particular business. Justice Samuel Alito authored the opinion for the unanimous Court. Title VII of the Civil Rights Act of 1964 prohibits discrimination based on religion, and subsequent regulations issued by the EEOC required employers to make reasonable accommodation of an employee's religious beliefs unless doing so would cause “undue hardship” to the employer. In Trans World Airlines, Inc. v Hardison, 432 U.S. 63 (1977), the Supreme Court held that Title VII does not require an employer who uses a seniority system to assign shifts to deprive senior employees of their seniority rights in order to accommodate a junior employee's religious practices. The Hardison decision also inadvertently established a “more than de minimis” test for hardship; courts interpreted that decision to mean that any cost or hardship “more than de minimis” justifies denying a religious accommodation. Revisiting that interpretation, the Court rejected the “de minimis cost” standard and adopted instead a “substantial increased costs” standard consistent with the spirit and language of Title VII. Justice Sonia Sotomayor authored a concurring opinion, in which Justice Ketanji Brown Jackson joined. The opinion is presented here in its entirety, but with citations omitted. In this week's episode of the Black Girl Nerds podcast, we welcome actor Kadeem Hardison. Kadeem Hardison plays Professor Gardner, a college literature professor in the current Showtime series The Chi. Hardison became known for his role as the fast-talking, flip-sunglass-wearing, girl-watching "Dwayne Wayne" on NBC's hit show A Different World alongside Lisa Bonet, Jasmine Guy and Debbie Allen. This role made him an instant ‘90s icon and a memorable television figure, and he even directed several episodes of the show. Before his breakout role, Kadeem began his acting career in 1981 on the ABC After School Special The Color of Friendship. Kadeem most recently starred in Moonhaven for AMC, was a series regular on Teenage Bounty Hunters for Netflix and recurred on the comedy series Black Monday for  Showtime. In 2018, he starred in Love Is… for OWN. He also starred in Disney Channel's K.C. Undercover opposite Zendaya for three seasons. He has guest starred and recurred on various shows such Grownish, NBC's Parenthood, The CW's Supernatural and the CBS comedy 9JKL, Between Brothers and House M.D, UPN'S Girlfriends and Everybody Hates Chris on CBS, along with many others. Kadeem made his motion picture debut in Stan Lathan's 1984 adaptation of James Baldwin's classic Go Tell it on the Mountain and worked again with Lathan that same year in Beat Street. From there, he took several comedic supporting roles in films such as Spike Lee's School Daze, Keenen Ivory Wayans' Blaxploitation tribute I'm Gonna Git You Sucka, and Ron Shelton's White Men Can't Jump. He also co-starred alongside Eddie Murphy and Angela Bassett in the comedy Vampire in Brooklyn.  Kadeem currently resides in New York and Los Angeles, and has a daughter named Sophia. The History of Black Writing project is an excellent example where an internationally renowned source for information converted from a distributed online database to a blockchain. A conversation with English Professor Ayesha Hardison, the Director of the History of Black Writing, and Engineering Professor Drew Davidson who implemented the technology.   We explore this unique collaboration between University of Kansas faculty that resulted in applying blockchain to better expose students, instructors and audiences to reading literature by Black authors and further building the community to engage in dialogue about the history and future of the books, recovery and preservation.

Despite the rise in scrutiny of bachelor's degrees, research shows that having access to college is a key indicator of future economic and financial success as well as physical and emotional well-being. Studies show that people with bachelor's degrees have 57% more job opportunities than people with high school diplomas, and 60% of workers with bachelor's degrees reported being highly satisfied at work, while only 38% of workers without college degrees reported being highly satisfied. If a degree can play such a pivotal role in someone's overall future success, how can access to college be expanded so that students can not just get in but thrive while they're in school and graduate? Tara Hardison, assistant dean for undergraduate programs at the David Eccles School of Business, works on that question every day. She joins host Frances Johnson to chat about the real-world impacts a college degree can have on someone's life, the ways Eccles is helping first-generation and low-income students, and why that support doesn't end after students have been handed a degree. Eccles Business Buzz is a production of the David Eccles School of Business and is produced by University FM.Episode Quotes:Access critical to business education[08:32]: Access is so critical for what we do here, and when we talk about a business education, we've got a large chunk of business-specific courses, but it's nestled in a broader liberal arts education, which does a lot for our students in everything that they'll do. But the liberal arts piece is incredibly helpful, too. Because I don't think we can have good student experiences if we don't have good staff experiences and faculty experiences, right?
