In this two part Special Edition Series, we are going to look back at arguably the most effective public servant in Washington D.C. today. He is the senior Senator from the State of Kentucky, the current Republican Leader, and the man who rested away the Federal Court System from Democratic total control, making it a far less effective way for the Democratic Party to use it as a weapon to block conservative policy. His name is Mitch McConnell, and a good case can be made that he is the Senator of the Century as we approach the end of the first 25 years of the 21 Century. Mitch McConnell has wielded the power of his position, as both the Senate Majority and Minority Leader, to dominate the domestic agenda of all of the Presidents who have shared the stage with him, with the possible exception of George W. Bush, the others , Barak OBama, Donald Trump, and Joe Biden, have all found in McConnell a formidable adversary, or a most important ally, in getting anything they hoped to accomplish done. While President Trump has received the lionshare of the credit for the powershift in the Federal Judicial Branch, it would never have happened without the long , steady, hard work, that Mitch McConnell began back in 1987 to one day create the scenario that accomplished that goal. McConnell had promised to one day right the wrongs done Supreme Court Nominee Robert Bork and he achieved it on the day Supreme Court Justice Amy Coney Barrett filled her seat on the court. That is not the only battle Mitch McConnell has won over his 40 years in public life. As we will see he has been one of the most effective Senators in American History. There is literally no area in which his mastery of the Senate rules has not left a full stamp on American life over the past two decades. When it comes to the Senate rules and traditions, messing with them in a way to get around his formidable presence has resulted in disaster for one Democratic Leader after another. As he famously admonished Democratic Leader Harry Reid when he imposed the "Nuclear Option" changing how Judges were confirmed, " You will regret this decision, and it may be sooner than you think" , it was. In this episode we will look back at this amazing career, and show you, as well, the more human side of this champion of conservative governance. A federal judge rejected a lawsuit brought by six Republican-led states challenging President Joe Biden's student debt relief program. US District Judge Henry Edward Autrey said Thursday he was dismissing the case because the states had not overcome the procedural threshold known as standing, which requires that plaintiffs show that a policy is causing them direct and traceable harm. Student loan cancellations, worth up to $20,000 per eligible borrower, could begin on Sunday. The states are expected to appeal the judge's ruling, sending the case to the 8th Circuit Court of Appeals, where it is likely to face a panel of conservative judges. The lawsuit was filed in a federal court in Missouri last month by state attorneys general from Missouri, Arkansas, Kansas, Nebraska and South Carolina, as well as legal representatives from Iowa. The states had argued in court documents that the Biden administration does not have the legal authority to grant broad student loan forgiveness, as well as that the program would hurt them financially. Lawyers for the government have argued that Congress gave the education secretary the power to discharge debt in a 2003 law known as the HEROES Act. They also argue that the plaintiffs don't have standing to ask for an injunction. In another victory for Biden, Supreme Court Justice Amy Coney Barrett rejected a separate challenge to the administration's student loan forgiveness program on Thursday, declining to take up an appeal brought by a Wisconsin taxpayers group. The Biden administration faces other lawsuits from Arizona Republican Attorney General Mark Brnovich, and conservative groups such as the Job Creators Network Foundation and the Cato Institute. But the legal challenge filed by six states that was dismissed Thursday was widely seen as the most formidable. It was the "most plausible legal challenge to the Biden Jubilee," said Luke Herrine, an assistant law professor at the University of Alabama who previously worked on a legal strategy pushing for student debt cancellation, in a tweet Thursday. Biden's student loan forgiveness program, first announced in August, aims to deliver debt relief to millions of borrowers before federal student loan payments resume in January after a nearly three-year, pandemic-related pause. While the application officially opened on Monday, the Biden administration has agreed in court documents to hold off on canceling any debt until October 23. Once processing begins, most qualifying borrowers are expected to receive debt relief within weeks. Under Biden's plan, eligible individual borrowers who earned less than $125,000 in either 2020 or 2021 and married couples or heads of households who made less than $250,000 annually in those years will see up to $10,000 of their federal student loan debt forgiven. Lara Bazelon has a decades-long career as a public defender. She worked as a trial attorney in the office of the public defender in Los Angeles for many years and is currently a law professor at the University of San Francisco, where she directs programs focusing on juvenile criminal justice and racial justice. But she's also a journalist and novelist. This year she published A Good Mother, a legal thriller about a tireless public defender who cuts short her maternity leave to return to work to defend a client. That client, a 19-year-old mother with a baby roughly the same age, has been accused of killing her husband. For all the novel's twists and turns, the real tension is in the subtext, which wrestles with questions like why motherhood can feel exponentially more demanding than fatherhood, whether being a “good mother” is compatible with extreme professional ambition and, most unsettling of all, what makes a “bad mother.” Lara spoke with Meghan about how these questions have embedded themselves in her own career and why romantic notions of perfect motherhood can actually hurt families.They also talked about a complicated defense case she worked on with her sister, the journalist Emily Bazelon, Lara's controversial work defending men accused of sexual assault on college campuses, and their shared feelings about idealized depictions of the work-life balance of Supreme Court Justice Amy Coney Barrett. Guest Bio: Lara Bazelon is professor of law and the director of the Criminal Juvenile Justice and Racial Justice Clinical Programs at the University of San Francisco School of Law. How many Supreme Court Justices can you count as friends? Professor Stephen Yelderman, one of America’s leading IP scholars, was recruited to join the Notre Dame Law School faculty by future Supreme Court Justice Amy Coney Barrett, and clerked for Justice Neil Gorsuch before and after he joined the Supreme Court. Prof. Yelderman’s experience of having a personal connection to not one, but two Supreme Court justices, as well as having clerked at the Supreme Court, have provided him with a unique perspective into how the Supreme Court approaches patent and other IP issues. “One of the cool things about the court is there's usually nine justices and at least nine clerks, all thinking about the exact same legal issues at the exact same moment in time. And it really leads to a level of engagement, and conversation and debate. With the Senate's recent confirmation of Amy Coney Barrett to replace Ruth Bader Ginsburg on the Supreme Court, it is particularly important to understand the different philosophies of these two women. Justice Barrett, like her mentor Antonin Scalia, is an Originalist in how she interprets the Constitution and the law that governs the nation's entirety. Originalism was explained to us by our recent podcast guest Laura Wolk, senior associate at Kirkland & Ellis, who clerked last year for Clarence Thomas in the U.S. Supreme Court--where she was only the second blind clerk in the Court's history. While many consider Originalism exclusive, leaving out people who were not originally included in the Constitution, or as so narrow as to be useless, because there are so many questions that are not explicitly addressed in the text of the Constitution.
