Even Trump-friendly Justice Neil Gorsuch questioned Trump Administration lawyers on their claim that tariffs are foreign policy, so the President can do what he wants. Oregon is one of the states suing the Trump administration over tariffs. Today's Headlines: More election results are in, and Democrats are mostly keeping their momentum from Tuesday. Minneapolis Mayor Jacob Frey was re-elected, fending off a challenge from democratic socialist Ahmed Fatah. In Maine, voters approved a new red flag gun law and Colorado passed a statewide measure to fund free school lunches for all kids—because Colorado stays ahead of the curve. Meanwhile, California Republicans have already filed a federal lawsuit to block the new congressional map voters approved under Prop 50, claiming it violates the 14th and 15th Amendments. And in Maine, Democratic Rep. Jared Golden—one of the few Dems who could win a red district—announced he won't seek reelection, citing threats made against his family. The government shutdown officially hit day 37, breaking Trump's own previous record. The Transportation Department says it'll start cutting air traffic by 10% if the standoff doesn't end by Friday. Trump's still calling for Senate Republicans to scrap the filibuster to end it, but a bipartisan group is reportedly working on a short-term fix that would reopen the government and roll in some of the annual funding bills. Translation: they could've solved this if they wanted to. At the Supreme Court, justices heard three hours of arguments over whether Trump can unilaterally impose tariffs. Judging by their questions, they're not exactly buying it. And finally, investigators say the UPS cargo plane crash in Louisville that killed nine people began when the left wing caught fire and an engine fell off just after takeoff—sending debris and explosions half a mile downrange. This Day in Legal History: Economic Opportunity ActOn August 20, 1964, President Lyndon B. Johnson signed the Economic Opportunity Act into law, marking a major legal milestone in the federal government's efforts to address systemic poverty. The Act authorized $1 billion to fund a wide range of social programs aimed at improving education, employment, and economic security for low-income Americans. It was the legislative backbone of Johnson's "War on Poverty" and a cornerstone of his broader Great Society agenda.The law created the Office of Economic Opportunity (OEO) to oversee a suite of initiatives, including Job Corps, Head Start, and Volunteers in Service to America (VISTA). These programs sought to address poverty through direct services, job training, and community empowerment rather than traditional welfare.Legally, the Act reflected a dramatic expansion of federal authority in the realm of economic and social rights, shifting the understanding of poverty from a local issue to a national legal and policy concern. It encouraged the formation of Community Action Agencies, which brought poor communities into the policy-making process—a novel approach for federal law at the time.Critics challenged the constitutionality and effectiveness of the programs, with some arguing the Act encroached on states' rights and created administrative overreach. The 5th U.S. Circuit Court of Appeals found that laws protecting NLRB board members and administrative judges from being removed at will by the president likely violate the Constitution's separation of powers. The court said these protections improperly restrict the president's authority over the executive branch.This decision is the first from a federal appeals court to challenge the NLRB's structure on these grounds, setting a precedent as similar lawsuits are pending. The ruling blocks the NLRB from continuing enforcement actions against SpaceX, Energy Transfer, and Aunt Bertha while the companies' constitutional challenges proceed. Circuit Judge Don Willett, writing for the panel, stated that the companies should not have to choose between following NLRB procedures and asserting their constitutional rights.The NLRB, an independent agency created by Congress, handles private-sector labor disputes, and its structure was designed to insulate it from political influence. However, this independence is now under scrutiny. Herndon said the creation of a specialized court would streamline corporate litigation and provide data to inform future legislative reforms. While a constitutional amendment to establish a fully independent business court is underway, that process will take years. The commission's work would serve as an interim step.This move follows a broader trend of states competing for corporate incorporations. Nevada and Texas are positioning themselves as more business-friendly venues, especially for Big Tech and firms led by controlling shareholders. Companies like Andreessen Horowitz and AMC Networks have already opted to leave Delaware in favor of Nevada. Recent changes in Nevada law now allow companies to waive jury trials via their articles of incorporation, aligning the state more closely with Delaware's procedures.Delaware, while still the leading venue for corporate law, has faced criticism over judicial bias and repetitive judge assignments. California Republicans wrapped up their statewide convention over the weekend in Burlingame. And they know that the road to keeping their House majority runs through several key Congressional districts here in California. The GOP has only a narrow 4-seat majority in the House and needed Democrats to help keep Speaker of the House Mike Johnson in power, staving off a conservative rebellion. A handful of closely contested races in California could help determine which party controls the next Congress. That was one of many key points of focus at this weekend's gathering of California Republicans, who had to weather a bit of controversy since their keynote speaker was South Dakota Governor Kristi Noem, a rising star who was at the top of many pundits' short list to be Donald Trump's running mate—until she revealed in her new memoir that she had shot and killed her own disobedient dog because she hated him so much. Los Angeles Times political reporter, Seema Mehta, joins us from the Ronald Reagan Presidential Library, site of tonight's debate, with a look at who needs to perform well in California in order to take the state's delegates as well as some of the important down-ballot races that could reshape the House of Representatives. Psychedelics Bill Awaits Gov. Newsom Signature Gov. Newsom is weighing hundreds of bills passed by the State Legislature. One bill would decriminalize some hallucinogenic drugs like psilocybin, which is found in magic mushrooms. From Oregon to Colorado and Washington D.C. laws surrounding the use of psychedelics have been loosened, decriminalized, or even legalized in a supervised setting. And more conservative states like Texas and Utah are exploring the therapeutic benefits of psychedelics for disorders from PTSD, depression, anxiety, as well as addiction. Newsom hasn't indicated whether he will sign this bill into law, which comes with pushback from law enforcement groups. But California is already home to the first accredited university training therapists, doctors and nurses in the benefits of psychedelics, and how to use them safely. We are revisiting a conversation we had in January with Dr. Janis Phelps, Director of the Center for Psychedelic Therapy and Research at the California Institute of Integral Studies in San Francisco, about the benefits of psychedelics in a supervised setting. Sacramento Exhibit on Lowrider History Lowrider culture is full of life, art, music and love. But for decades it was targeted by local communities as a nuisance and dangerous. A new exhibit at the Sacramento History Museum explores the long history of lowrider and cruising culture in California along with the discrimination associated with it. “Boulevard Dreams” is the largest exhibit yet at the museum and Executive Director Delta Pick Mello and Francine Mata with the Sacramento Lowrider Commission join us to explain what visitors will experience and the message behind the exhibit.
