Respondent Joseph Power was convicted of two criminal offences in the 1990s. He served a term of imprisonment. In 2010 Mr. Power made inquiries about the process to obtain a pardon, but did not apply for one. In 2011, Mr. Power's employer learned of his criminal record. He was suspended from work. Mr. Power applied for a pardon — now called a record suspension — in 2013 in order to continue working in his chosen field. However, two enactments since 2010 — the Limiting Pardons for Serious Crimes Act and the Safe Streets and Communities Act — had amended the Criminal Records Act. Transitional provisions in both of the amending acts gave them retrospective application to offences that had occurred before their coming into force. The combined effect of these enactments and their transitional provisions was to render Mr. Power permanently ineligible for a record suspension. Mr. Power lost his job and became ineligible for membership with provincial bodies governing his field of employment. The transitional provisions of both the Limiting Pardons for Serious Crimes Act and the Safe Streets and Communities Act, which gave them retrospective application to offences committed prior to their enactment, were later declared unconstitutional. Mr. Power brought an action against the Crown, alleging that the adoption and application of the transitional provisions constituted conduct that was clearly wrong, undertaken in bad faith, and abusive of government power. He sought damages pursuant to s. 24(1) of the Canadian Charter of Rights and Freedoms. Prior to trial, the appellant Attorney General of Canada sought a determination of questions of law, concerning whether the Crown could ever be held liable in damages in respect of the enactment of legislation that is later declared unconstitutional. The Court of Appeal of New Brunswick upheld the application judge's determination of those questions, and dismissed the Attorney General's appeal. This episode is broken up in two segments and each explores two major issues in the news and are breaking news: 1. Supreme Court Overturns Roe Vs. Wade & 2. The U.S. Senate passes Safer Communities Act. In Segment one we ask-Is the right to abortion an inalienable right of every American? Is it a right that is shared by all Americans? Is this right rooted in tradition, history and culture? The answer is what helped to shape today's decision of the Supreme Court to overturn Roe Vs. Wade. We all have a right to life and we must also protect the right to life not just for self but the right of others to live. But when that right to life clashes with the right to choose then we must ask what is the highest ethic? Is it not the right to life. But is abortion of a fetus tantamount to killing a person? Well, it all depends on your value as a conservative or a liberal and this is the sticking point. But if truth be told, the fetus is part of the continuation of life itself. So then one may argue that the fetus' life must be protected as in doing so one is protecting life itself and it's continued existence. Segment two: News Alert: Senate Passes Bipartisan Safer Community Act: And the senate passed a Bipartisan Safer Communities Act to begin tackling gun violence which expands background checks and close gun loopholes. But will this actually curb the gun violence plaguing communities like Philadelphia, Atlanta, Chicago, Uvalde Texas, Buffalo NY, etc? We are yet to find out but what we know is that guns don't kill people, people kill people and with the rise of extremism, poverty, declining median incomes and the challenge of parenting and socialization where the young are being primarily socialized by media that devalues the individual. So then then solution must be multifaceted, and does this bill provide a multifaceted and comprehensive approach to curbing gun violence? Further with the recent ruling of the Supreme Court that strikes down NY gun law there is now the question of what can this act do to come up with any gun policy that does not violate or is interpreted to violate a person's right to carry a firearm. The 6-3 ruling, with the conservative justices in the majority and liberal justices in dissent, struck down New York state's limits on carrying concealed handguns outside the home. The court found that the law, enacted in 1913, violated a person's right to "keep and bear arms" under the U.S. Constitution's Second Amendment. We will take these up when we invite Ms. Outland an expert on women's rights and a civil and rights advocate and activist. The Neoliberal Round is created by Rev. We're less than two weeks away from hitting the debt ceiling, an unnecessary risk especially during a historically precarious time. But here we are. Writing in a Washington Post Op-Ed, Zachary D. Carter (who was on this show just last week), said of this situation, "There is no economic rationale for this threat, and its consummation promises no political advantage to anyone. It is a preposterous, silly and breathtakingly dangerous situation." So he proposed meeting it with an equally "preposterous, silly and perfectly painless legal trick: minting a single platinum coin with a face value of $1 trillion or more." Actually, the idea foe minting a platinum coin has been floating around for a few years now. Today's guest, Rohan Grey, actually wrote the "Automatic BOOST to Communities Act" with Congressman Rashida Tlaib's office. The bill was introduced last year, as the COVID-19 pandemic had just taken hold and forced a nationwide shutdown. Tlaib's bill proposed sending every person residing in the US a debit card loaded with $2000, and refilling then with $1000 each month until we were clear from the pandemic. It would be funded directly from the Treasury, using its legal authority to create money via coin seigniorage, by minting two Trillion-dollar platinum coins. The main logic behind this idea is that no government debt issued to pay for the program-- it's paid for by the platinum coins. Rohan Grey is an Assistant Professor at Willamette Law, and is president of The Modern Money Network (https://modernmoneynetwork.org), and a proponent of Modern Monetary Theory. The U.S. Senate has been in the final hours of debating a 2,700-plus-page infrastructure bill. The bill is part of a compromise between Senate Democrats and Republicans, and has thus been subject to heavy negotiations. One of the things put forth by the administration into the original American Jobs Plan was the idea of a “Reconnecting Communities Act,” which would use $20 billion to undo some of the damage that had been done to urban neighborhoods (and particularly minority neighborhoods) in the early days of highway building. However, that figure of $20 billion has now been brought down to $1 billion. In other words, out of a $1 trillion bill, a token amount of money has been dedicated to the Reconnecting Communities initiative. Naturally, people are disappointed. This week on Upzoned, regular host Abby Kinney is out on vacation, so Chuck Marohn takes up the mantle of host and invites Strong Towns Board Member John Reuter on to “upzone” this story about the Reconnecting Communities Act—i.e., they discuss it through the Strong Towns lens. They talk about how advocates are pushing back on the Senate's decision, and the disillusionment people are feeling over what has been promised by the infrastructure bill versus what's being delivered. Perhaps 100 young people may be prescribed opioid pain killers for extracts wisdom teeth or a broken bone and only a handful may feel a strong pull of addiction after a single pill.  The problem is we do not know who that vulnerable handful is.  That is why prevention of exposure is important. It does not mean prohibition of opioids, but it does mean innovations in pain management that avoid opioids when possible. The opioid epidemic has a silver lining. It engaged the medical community in solution. All medical specialties have been activated in the issue of addiction and pain. And the medical community is rallying – with solutions and innovation in managing pain better with less addiction. Alexis M. LaPietra, DO, FACEP Dr. Alexis LaPietra is System Chief for Pain Management and Addiction Medicine as well as the Fellowship Director of the Emergency Medicine Pain Management Fellowship and Emergency Medicine Addiction Medicine Fellowship at St Joseph's Health in NJ. She created the St Joseph's Health Alternatives to Opioids (ALTO SM) program and founded the Pain Management/Addiction Medicine Section of the American College of Emergency Physicians (ACEP). She has been involved in multiple national educational initiatives with ACEP and is the current Chair for the PACED (Pain and Addiction Care in the ED) Accreditation Program. In 2016 she received the Emergency Care Innovation of the Year Award from G.W. University Center for Healthcare Innovation as well as the American College of Osteopathic Emergency Physicians Practice Innovation Award. Dr. LaPietra's work has been highlighted in The Annals of Emergency Medicine, NPR, NBC, The New York Times, Fox News, and CNN. Her work was the basis for the “ALTO in the ED Act,” part of the legislation included in the H.R.6- SUPPORT for Patients and Communities Act signed into law by President Trump in October 2018.

At the 2018 Department of Justice (DOJ) Opioid Summit, then-Attorney General Jeff Sessions remarked that opioid prescribing had reached its lowest point in 18 years. Still, the DOJ is committed to reducing opioid analgesic prescriptions an additional 30% to 33% within the next 3 years. More than ever, prescribers of controlled prescription medications are under intense scrutiny from lawmakers, regulators, and payers. At the same time, some 50 million adults in the US have persistent pain, nearly 20 million of whom experience pain that interferes with daily life or work activities. As noted by the Pain Management Best Practices Inter-Agency Task Force (PMTF) in its December 2018 draft report, the trend of healthcare professionals opting out of treating pain has exacerbated the shortage of pain management specialists, leaving some patients without access to individualized care. In this session, a partner in a Washington, DC based health law firm will discuss recent legislative and regulatory activity at the federal level and trends in criminal enforcement. He will also discuss noteworthy developments at the state level and analyze the anticipated benefits, drawbacks, and unintended consequences of such actions on people with pain and those who treat them. Topics will include the implications of recently passed comprehensive opioid legislation—the SUPPORT for Patients and Communities Act; a draft report on pain management best practices by PMTF and the pushback against it; and efforts to reform the federal approach to investigating controlled-medication prescribers.

Joe and I first talk about our personal experiences during these first weeks under the new normal of the coronavirus quarantine. We then move onto a discussion of the origin, history, and basics mechanics of #MintTheCoin, concluding with Michigan Representative Rashida Tlaib's coronavirus relief bill, The Automatic BOOST to Communities Act, written in consultation with Modern Money Network founder Rohan Grey (Twitter/@rohangrey). The bill is funded by two platinum coins worth one trillion dollars each. We then end with a hearty dual rant about the profound unfairness of the 2020 Democratic primary, highlighted by the Democratic Party and its frontrunner Joe Biden encouraging millions to vote in person, in the middle of a now-raging global pandemic. One of these states, Florida, on the very same day its primary was held, announced that all its schools would be canceled for a month, and perhaps for the rest of the school year. On the same day. The state of Wisconsin held its own in-person primary the day before this episode was released, despite the CDC now classifying the state's community transmission of coronavirus as "widespread." As of last week, this decision resulted in the resignation of poll workers across the state, funneling more voters into even fewer polling sites, sharing even fewer door handles, pens, and voting touchscreens. The goal is not to prevent people from getting sick in an overall sense, but to prevent too many from getting sick all at once. So much so that our healthcare system cannot handle it. Healthcare workers getting infected does not just decrease the number of healthcare workers, it also increases the remaining healthcare workers' load. It's a doubling effect. Means testing done on the front end puts the burden on the people. They must fill out forms to prove to an anonymous faraway bureaucrat that they are poor enough to deserve that benefit. Only then do they receive it. America’s Crisis Daddy, Andrew Cuomo, is quickly becoming a dark horse candidate for president with his calming and soothing press conferences during the current pandemic.  Have the Dems found their Messiah?  Are you willing to risk your life for the economy? Fox News and Wall Street bankers want to send people back to work during the pandemic in order to protect the wealthy.  Some will live and some will die is their thinking. The Senate passes a $2 Trillion stimulus package. The House begins debate today and may vote on the package soon, although there are some rumblings that there may be a delay after Republican Representative Thomas Massie of Kentucky sought to force members to return to DC for the vote. We think we just go with Rashida Tlaib’s proposal, the “Automatic BOOST to Communities Act,”  which calls for minting two $1 trillion coins to fund the relief package without taking on debt. That can be done without taking on any debt under the legal authority of the Treasury Department.  Joe Biden has finally spoken to masses from his coronavirus bunker.  And well, at this point Joe should not go on TV.    UK Prime Minister Boris Johnson tests positive for the novel coronavirus. And what will Trump pivot to in order to try to win reelection? PA Governor Wolf went hard on the lockdown then backtracked due to pressure from the business sector. On October 24, 2018, President Trump signed The Support for Patients and Communities Act or H.R.6. into law. This podcast is the second part of our series on this historic piece of legislation. H.R.6 includes support for three successful programs we have featured on earlier podcasts in our series. On today’s show, we’ll revisit our ALTO, Lily’s Place and AnchorED programs to highlight how each of these successful programs got started and how they are making a difference in the opioid epidemic. On today’s podcast, you’ll hear how H.R.6 promotes the ALTO program, that’s alternatives to opioids, a program developed at St. Joseph Healthcare in Patterson New Jersey. 75% of patients at St. Joseph Healthcare have said their pain has been managed effectively without the use of opioids. We will also revisit our show on neonatal abstinence syndrome and Lily’s Place , an organization dedicated to treating babies that are born with NAS by providing medical care for these newborns suffering from NAS and instruction on their specialized care requirements for mothers . Also featured in this episode is a program called AnchorED which connects overdose victims in the ED to certified recovery coaches. Headlines: The Sports Medicine Licensure Clarity Act is on the President's desk for signature. The SUPPORT for Patients and Communities Act (or, the major opioid legislation everyone is talking about) is also awaiting the President's signature. The legislation does the following: Improves and expands access to treatment and recovery services Encourages the use of non-addictive opioid alternatives Gives law enforcement tools to better remove illicit drugs from communities Provides grants to communities to combat Fentanyl (Click here for the one page overview) Pain specialists are speaking out about forced tapering, noting that current language put out by the CDC could result in patients experiencing severe and prolonged withdrawal, as well as debilitating functional limitations. Dr. Beth Darnall, Stanford pain specialist, submitted a petition signed by those who treat patients with chronic pain. You can find her on the Healthy Wealthy & Smart podcast on episode 379 (Roadmap to Pain Relief) and episode 221 (The Opioid Epidemic). Health Professionals for Patients in Pain has a similar letter. The Centers for Medicare and Medicaid is due to release the 2019 rule soon; in the meantime, check out the comments provided to CMS by the APTA.  A timeline for TRICARE changes has been released; the timeline is dependent on when the rule is released to the US Office of Management and Budget for review.
