    Missouri and Texas are headed for direct access for physical therapy. Missouri is in the lead, with a bill that has passed the House and has been read in the Senate. The Texas Physical Therapy Association has a bill in the House and the Senate, both in committee. Both associations are encouraging physical therapists to contact their representatives. Physical therapists in North Carolina have won the battle for dry needling; the North Carolina Acupuncture Licensing Board (NCALB) has signed a settlement in which they acknowledge that dry needling is part of the physical therapist's scope of practice. This is a welcome end to 4 years of lawsuits over dry needling. Kentucky will begin issuing privileges for the PT compact this coming Thursday, March 21st. Twenty-three states are currently members of the PT Compact, and four states have introduced legislation this session. Headlines: Rehab providers at Oregon Health & Sciences University medical system are protesting a recent change to their productivity standards. Their union chapter, Local 328, outlines the complaints about productivity demands here, and the impact on patients here. You can check out the petition to OHSU Leadership here.  There are several deadlines coming up if you want to comment on rules and regulations! Go to the APTA's Regulatory Action Center. Some highlights:  Ending today is the comment period for modifying HIPAA. The Health & Human Services Office for Civil Rights is looking for information on how HIPAA laws may discourage or limit information sharing needed for care coordination or the evolution to value based care. The Department of Defense proposed rule adding PTAs and OTAs as eligible providers--the APTA is aware of the errors in this rule, and will be submitting comments for language and terminology changes.  Those comments are due by February 19th. The Pain Management Best Practices Interagency Task Force is looking for feedback on its draft report. This is a federal advisory committee established by the Comprehensive Addiction and Recovery Act of 2016 to propose updates to best practices and issue recommendations that address gaps or inconsistencies for managing chronic and acute pain. If you work with the chronic pain population, please submit your comments by April 1, 2019. The APTA provides form letters for comment. The APTA has released their 2019 Public Policy Priorities.     Headlines: The Sports Medicine Licensure Clarity Act is on the President's desk for signature. The SUPPORT for Patients and Communities Act (or, the major opioid legislation everyone is talking about) is also awaiting the President's signature. The legislation does the following: Improves and expands access to treatment and recovery services Encourages the use of non-addictive opioid alternatives Gives law enforcement tools to better remove illicit drugs from communities Provides grants to communities to combat Fentanyl (Click here for the one page overview) Pain specialists are speaking out about forced tapering, noting that current language put out by the CDC could result in patients experiencing severe and prolonged withdrawal, as well as debilitating functional limitations. Dr. Beth Darnall, Stanford pain specialist, submitted a petition signed by those who treat patients with chronic pain. You can find her on the Healthy Wealthy & Smart podcast on episode 379 (Roadmap to Pain Relief) and episode 221 (The Opioid Epidemic). Health Professionals for Patients in Pain has a similar letter. The Centers for Medicare and Medicaid is due to release the 2019 rule soon; in the meantime, check out the comments provided to CMS by the APTA.  A timeline for TRICARE changes has been released; the timeline is dependent on when the rule is released to the US Office of Management and Budget for review.     Today is the last day that you can access guideline.gov.Unless a non-governmental organization comes forward to fund the project, guideline.gov will remain offline. So….head on over and download all the CPGs while you can! Mississippi is now issuing compact privileges (starting at 9AM EST on July 16, 2018). The American College of Obstetricians & Gynecologists provided recommendations for the first 12 weeks postpartum, including a recommendation for physical therapy as warranted. CMS has a new proposed rule! It proposes: Adding PTs to MIPS, beginning in 2019 Eliminating Functional Limitation Reporting (G-codes) 2 therapy modifiers to identify services furnished in whole or in part by PTAs or OTAs. The APTA has teamed up with United Healthcare to help develop a study that answers the question: What would happen if payers encouraged patients with low back pain (LBP) to explore low-risk treatments such as physical therapy by waiving copays for initial sessions? United Healthcare will be choosing 10 sites for the pilot program, and the study results could be released as early as the end of this year.
