With an unanimous ruling, the Court determined that states do not have the power to enforce section 3 of the 14th Amendment, which deals with the eligibility of federal candidates. Join us as Jessica dissects the details and disagreements within the Court's opinion and explores its potential impact on future elections and congressional power. Here are three key takeaways you don't want to miss:1️⃣ The Supreme Court Ruling: The Colorado Supreme Court's decision was overturned unanimously by the Supreme Court, which held that the state exceeded its authority in determining a federal candidate's eligibility under a specific constitutional amendment.2️⃣ Implementation and Implications of Section 3: The court's opinion was delivered per curiam, representing the entire bench, with the conservative and liberal justices offering differing perspectives on how Section 3 of the 14th Amendment can be enforced.3️⃣ Disagreement Between Conservative and Liberal Justices: The ruling highlights the fracture lines within the court, with disagreement on the extent to which Congress can exclude an individual from holding office based on Section 3.Follow Our Host:On Threads: @LevinsonJessica

BREAKING NEWS: Supreme Court Overturns Colorado Decision Barring Trump from Ballot

Play Episode Listen Later Mar 4, 2024 11:16

BREAKING NEWS: The United States Supreme Court has made a groundbreaking decision, overturning Colorado's lower court's ruling that barred former President Donald Trump from appearing on the ballot in Colorado. However, this decision diverges from a strict interpretation of the law, as it hinges on subjective interpretations rather than adhering strictly to legal precedent. The justices opted for an approach that emphasizes inferred implications rather than a direct measure of the law, setting a precedent that is both unprecedented and ominous in its potential ramifications. The US Supreme Court's decision to overturn Colorado's lower court's ruling to bar Trump from the ballot was based, in my estimation, on the implication of the law and not the spirit or measure of the law and constitution. This therefore sets a precedence imbuing the justices with the powers to challenge the Constitution by asserting their subjective opinions on the implications of following the spirit of the laws. Now let us see what their decision means for our lives going forward. In effect, that is what pertains from their finality on whether Trump violates the Constitution and deserves to run again. It opens the door for opportunists who may want to repeat January 6. While the courts kicked the matter to the politicians, it is important to point out that politicians are never best at making laws about themselves that limit their powers and while we wait for that to happen a repeat offender has the green light to do so again following their decision. Furthermore, what about state's rights and individual's rights? we are quick to appeal to states rights but now we are limiting states rights? According to reports from the Associated Press, the Supreme Court's decision marks a turning point in the ongoing debate over Trump's role in the 2024 presidential primaries. Rejecting efforts by several states to exclude Trump from the ballot due to his involvement in the Capitol riot, the Court emphasized that the authority to regulate presidential candidates lies within the purview of Congress, rather than individual states. This case represents a pivotal moment in constitutional interpretation, as it grapples with the implications of the 14th Amendment's post-Civil War provisions. Specifically, the Court's ruling addresses the amendment's intent to disqualify individuals who have "engaged in insurrection" from holding public office again. Hour 1 of The Dawn Stensland Show: An off-duty police officer was killed in a car crash in Northeast Philadelphia. The officer, whose name has not yet been released to the public, was on his way home from work when his vehicle was struck by a BMW sedan. Two teens have been charged in the murder of Sean Toomey—a 15-year-old boy who was senselessly shot and killed while carrying groceries into his family's Philadelphia home. In response to the U.S. Supreme Court's decision in New York State Rifle & Pistol Association Inc. v. Bruen—which struck down restrictions on concealed carry permits—New Jersey Governor Phil Murphy condemned the court, referring to the decision as “deeply flawed” and “tragic.” The U.S. Supreme Court has overturned Roe v. Wade with its 6-3 decision in Dobbs v. Jackson Women's Health Organization. In the groundbreaking decision of Dobbs v. Jackson Women's Health Organization, Chief Justice John Roberts voted with the court's conservative majority, writing a concurring opinion, according to The New York Times. In a leaked draft of the decision, Roberts had sided with the dissenting justices. Speaker of the House Nancy Pelosi spoke about the Supreme Court's decision to effectively end Roe v. Wade—calling the decision a “slap in the face” to women and “cruel.” She stated that a women's right to choose is on the ballot in November, alleging that the court's end goal is to criminalize individual “health decisions” made by women.

Breaking News: Supreme Court Overturns Roe Vs. Wade & The U.S. Senate passes Safer Communities Act

The NeoLiberal Round

Play Episode Listen Later Jun 24, 2022 34:01

This episode is broken up in two segments and each explores two major issues in the news and are breaking news: 1. Supreme Court Overturns Roe Vs. Wade & 2. The U.S. Senate passes Safer Communities Act. In Segment one we ask-Is the right to abortion an inalienable right of every American? Is it a right that is shared by all Americans? Is this right rooted in tradition, history and culture? The answer is what helped to shape today's decision of the Supreme Court to overturn Roe Vs. Wade. We all have a right to life and we must also protect the right to life not just for self but the right of others to live. But when that right to life clashes with the right to choose then we must ask what is the highest ethic? Is it not the right to life. But is abortion of a fetus tantamount to killing a person? Well, it all depends on your value as a conservative or a liberal and this is the sticking point. But if truth be told, the fetus is part of the continuation of life itself. So then one may argue that the fetus' life must be protected as in doing so one is protecting life itself and it's continued existence. Segment two: News Alert: Senate Passes Bipartisan Safer Community Act: And the senate passed a Bipartisan Safer Communities Act to begin tackling gun violence which expands background checks and close gun loopholes. But will this actually curb the gun violence plaguing communities like Philadelphia, Atlanta, Chicago, Uvalde Texas, Buffalo NY, etc? We are yet to find out but what we know is that guns don't kill people, people kill people and with the rise of extremism, poverty, declining median incomes and the challenge of parenting and socialization where the young are being primarily socialized by media that devalues the individual. So then then solution must be multifaceted, and does this bill provide a multifaceted and comprehensive approach to curbing gun violence? Further with the recent ruling of the Supreme Court that strikes down NY gun law there is now the question of what can this act do to come up with any gun policy that does not violate or is interpreted to violate a person's right to carry a firearm. The 6-3 ruling, with the conservative justices in the majority and liberal justices in dissent, struck down New York state's limits on carrying concealed handguns outside the home. The court found that the law, enacted in 1913, violated a person's right to "keep and bear arms" under the U.S. Constitution's Second Amendment. We will take these up when we invite Ms. Outland an expert on women's rights and a civil and rights advocate and activist. The Neoliberal Round is created by Rev. Supreme Court again delays on abortion law

In today's News: Supreme Court again delays on abortion law  Pro-life advocates are hopeful the Supreme Court will review an abortion law in Mississippi, even though the court once again delayed its decision on whether to hear the case. Lynn Fitch, the state’s attorney general, has asked the court to review its law, which bans abortion after 15 weeks of gestation and has been challenged by the Center for Reproductive Rights. The state’s only abortion clinic offers abortions until the 16th week of a pregnancy. Mississippi’s previous governor, Phil Bryant, signed the ban into law in 2018, but it was subject to immediate legal appeal and blocked by a District Court. In 2019, the 5th U.S. Circuit Court of Appeals found the law to be unconstitutional. Fifteen weeks is considered prior to fetal viability outside the womb. The Supreme Court had been expected to announce whether it would heat the case on Friday. The Court was due to conference regarding the law on Nov. 13, but instead announced on Monday that it had again delayed a decision. This is the fifth time since Sept. 22 that the conference has been rescheduled. No reason for the delay, or new date, was given.  Abortion security guard removed  According to pro-life organization Abortion on Trial, a security guard has been removed from his position at a New Mexico abortion facility owned by Franz Theard, an abortionist currently under investigation for abandoning a patient who suffered two concurrent botched abortions under his care. Bertram Wiles, employed by Securitas Security Services USA Inc. as a security guard, was placed at Hilltop Women’s Reproductive Clinic in New Mexico. In video which Wiles posted himself, which has since been removed, he was seen harassing pro-life women across from the abortion business. Though portions of the video used voiceovers, other portions showed him directly sexually harassing women. He is also accused of following one woman to her job and leaving his card on her car. Wiles has since scrubbed his social media accounts, which included multiple similar videos that included sexual remarks directed toward young women, racial slurs towards Latina women, and vulgar language directed at pro-lifers.  Forty percent of the world’s believers subject to persecution  Dictators are the worst persecutors of believers. This uncontroversial finding was verified for the first time in The Pew Research Center’s 11th Annual Study surveying restrictions on freedom of religion in 198 nations. He median level of government violations reached an all-time high in 2018, as 56 nations suffer “high” or “very high” levels of official restriction. The number of nations suffering “high” or “very high” levels of social hostilities toward religion dropped slightly to 53. However, the prior year the median level recorded an all-time high. Considered together, 40 percent of the world faces significant hindrance in worshiping God freely.

In today's News: Supreme Court to settle Title X dispute  Alliance Defending Freedom attorneys representing two pro-life medical associations filed a Friend-of-the-Court brief yesterday, encouraging The U.S. Supreme Court to take a case concerning a U.S. Department of Health and Human Services (HHS) rule that prevents federal family-planning funding under the Title X program from being used for abortions. The brief explains that the HHS final rule essentially revives one that the Supreme Court already found Constitutional in a previous case and should therefore be upheld. The U.S. Court of Appeals for the 4th Circuit blocked the HHS regulations in Maryland while a 9th Circuit decision in a separate case upheld them. The rulings create a split between the circuits that only the Supreme Court can resolve.  Biden promises funding for Planned Parenthood  Should Joe Biden become president after recounts and court cases involving allegations of massive election fraud, he says he will sign an executive order on week one of any potential presidency to force American taxpayers to fund the Planned Parenthood abortion business. Even though Biden may not be certified as the new president, he has already formed a presidential transition team and that team has released a set of priorities of the first things he would do in office. On the list is a promise to reverse President Donald Trump’s Protect Life Rule that make sure taxpayers aren’t forced to fund groups such as Planned Parenthood that perform and promote abortions in other countries. During a Town Hall in South Carolina Biden confirmed that one of his first acts as president would be using taxpayer dollars behind the global abortion agenda.  Global abortion giants praise Biden  Abortion giants around the world have celebrated Biden’s reported presidential victory by releasing a series of statements praising his pro-abortion position and policies. Biden was announced as the winner of the 2020 presidential election by media outlets during the weekend. Some remaining us states continue to count their votes. Following the announcement, global abortion giants took to social media to congratulate Biden and Vice President-apparent Kamala Harris for their commitment to expand abortion.  South African rector retires  The Rev. Dr. Carlos Walter Winterle has announced his retirement as rector of the Lutheran Theological Seminary (LTS) in Tshwane, Pretoria in South Africa. Winterle, who turned 70 earlier this year, said, “It is time to retire and give way to the younger generation.” Succeeding Winterle as rector of the LTS is the Rev. Dr. Heinz Hiestermann. Winterle served as president of the Evangelical Lutheran Church of Brazil from 1998-2006. He has spent the next 14 years serving throughout Africa: four years in Kenya; seven in Cape Town, South Africa; and the past three as the rector of LTS in Pretoria. He has also been heavily involved with missions and theological education in Mozambique.

In today's News: Supreme Court nominee praised by religious liberty group  This past weekend, President Donald Trump nominated Judge Amy Coney Barrett of the U.S. Court of Appeals for the Seventh Circuit to the United States Supreme Court to replace the late Justice Ruth Bader Ginsberg. The following statement in response to the appointment may be attributed to Kelly Shackelford, president, CEO and chief counsel for First Liberty Institute, who was in attendance at the announcement: “President Trump has nominated a judge to the Supreme Court who we are confident will protect the religious freedoms and constitutional rights of all Americans. Judge Barrett’s record demonstrates her commitment to the Constitution’s text and its purpose. Judge Barrett understands that government exists to protect the God-given rights of the people and the Constitution exists to prevent government from infringing on those rights.  She will make an excellent Supreme Court justice, and we expect the Senate to confirm her without delay.”  Pro-life speaker assaulted  Students for Life Action team member who is part of Students for Life’s “SCOTUS squad” was punched while peacefully advocating for the confirmation of Judge Amy Coney Barrett to the Supreme Court. Police were called and an arrest was made after a woman approached SFLAction Communications and Market Manager 23-year-old Autumn Schimmer, who was speaking on behalf of Judge Barrett. Schimmer spoke with police and reported that additional threatening behavior took place in the context of a crowd that included about 5 percent pro-life advocates and 95 percent abortion supporters. The woman who punched her fled into the crowd.  DA refuses to enforce a pro-life law  The district attorney of Nashville, Tenn., refused to enforce a new state law this week that informs women that a drug-induced abortion may be reversed to save their baby’s life. WLTV News 8 reports Davidson County District Attorney Glenn Funk said the law is unconstitutional, and he will not enforce it. Scheduled to go into effect Oct. 1, the pro-life legislation requires abortion facilities to display signs informing women that a chemical abortion may be reversed after the first dose of the two-drug abortion procedure. It also requires the abortionist to provide the same information during counseling 48 hours prior to the abortion.  Chinese Communists change the Bible  A Communist textbook that's being used in Chinese schools falsifies the Biblical account found in John 8:3–11. The textbook claims that Jesus murdered the woman who was found in adultery and said He, too, is a sinner. The textbook, published by the government-run University of Electronic Science and Technology Press, states: “The crowd wanted to stone the woman to death as per their law. But Jesus said, ‘let the one who has never sinned throw the first stone.’ hearing this, they slipped away one by one. When the crowd disappeared, Jesus stoned the sinner to death, saying, ‘I too am a sinner. But if the law could only be executed by men without blemish, the law would be dead.’”

Supreme Court rules 'sex' included sexual identity

In today's News: Supreme Court rules 'sex' included sexual identity The Supreme Court today issued its ruling on a historic case about LGBT employment discrimination, with the majority deciding that Title VII of the Civil Rights Act of 1964, which prohibits discrimination on the basis of sex, also applies to gay or transgender people. It was a 6-3 decision. One of the cases involved was Harris Funeral Home. This family-run funeral home fired one of its male employees when the employee changed gender to female. Although the court ruled that gender identity is sex as described by law and therefore may not face discrimination, it noted that Harris did not claim religious exemption in the firing. The court further noted that its ruling does not impact those with religious or moral objections. Boston accused of religious discrimination Liberty Counsel filed an opening brief to the First Circuit Court of Appeals on behalf of Boston resident Hal Shurtleff and his christian civic organization, Camp Constitution, arguing that the city of Boston violated the First Amendment by censoring a private flag in a public forum merely because it contained a cross. The city refers to its flagpole as a “public forum” and allows private organizations to temporarily raise their own flags on the flagpoles. Never has Boston censored any flag until the Christian flag. The city’s records show Boston has allowed at least 284 applications by private organizations on the city hall flagpoles without denial except for the Christian flag. Religious protection extended to healthcare workers The Department of Health and Human Services has just finalized a new rule that protects patients, aligns with current medical research, and complies with rulings from two federal courts. An older rule, imposed in 2016, had required doctors to perform gender transition procedures even if doing so would violate their religious beliefs and potentially harm their patients. That rule was struck down in two lawsuits brought by nine states, several religious organizations, and an association of more than 19,000 healthcare professionals. The new rule, finalized Friday, complies with those court decisions and ensures that sensitive medical decisions are kept between patients and their doctors without government interference. Christian giving remains strong When the U.S.economy shut down in March due to covid-19, financial predictions for churches and other ministries were dire. But a new survey suggests those predictions may have been overblown. Most evangelical churches and ministries saw giving remain steady or grow during the height of stay-at-home restrictions, according to a survey of more than 1,300 christian ministries released last week by the Evangelical Council For Financial Accountability. Among those surveyed, total cash giving in April 2020 equaled or surpassed April 2019 giving levels at 66 percent of churches and 59 percent of nonprofits. An even greater percentage of churches, 72 percent, and other Christian nonprofits, 61 percent, said their April 2020 cash gifts met or exceeded January 2020 levels, when the economy was booming and the stock market’s Dow Jones industrial average was approaching its all-time high.

Episode 15 of Inciting A Riot: the Podcast. This is my apology to you listeners who have had to listen to recent shows that merely showcased my opinion and not any new or challenging research. In that light I'm presenting two research articles that I've written for both our sociology segment and our spirituality segment. Make sure to keep your thinking caps securely fastened, because we're hitting the ground running. News: Supreme Court ruling on big business' ability to spend unlimited amounts of money on political campaigns and the California Supreme Court case that may define paganism as a 'second-tier' religion in America. Word of the Day: collude Sociology: Part 1 of 5 - Stating the problem of childhood sexuality and intolerance as it relates to education by parents and the school system. Spirituality: The Cult of Mary and the evolution of Mary as the Goddess. (I know you'll love this one.) Thanks go out to Chris Orapello of the Infinite and the Beyond for using my promo in a recent show.
