Cuando empezamos a imaginar nuestro emprendimiento, una de las primeras cosas en las que pensamos es en el nombre. Como se sabe, la elección de un buen nombre será importante para posicionar la marca, aunque un error muy común al momento de elegirlo es no registrarlo y, en algunos casos, ni siquiera verificar si está libre. También existe el riesgo de que otros puedan copiar el diseño de tu producto o servicio, sus características o tu sitio web y hasta el texto de tus listings. Para evitar todas estas experiencias desagradables, en este episodio contamos con el conocimiento de Julian Gonzalez, abogado y experto en propiedad intelectual en la firma Goldstein Patent Law. Él nos explica que la propiedad intelectual refiere “a las marcas comerciales, patentes y también copyright”. En el caso de una marca comercial, se trata de “una forma de propiedad intelectual en forma de signo, palabra o frase que usas para distinguir en el mercado los productos o servicios que ofrece tu empresa”. “Necesitas una marca para identificar de dónde vienen tus productos. El objetivo es crear una identidad de tu negocio y distinguir tus productos y servicios de la otra gente que está haciendo cosas similares a las tuyas”, expresa. Pero… ¿qué sucede si no registras tu marca? “Alguien puede usar la misma palabra, signo o frase que tú usas para identificar tus productos. Y, si los productos son buenos, van a confundir el público y van a aprovecharse de lo que tú ya construiste”, alerta Julian. Lo mismo sucede dentro de Amazon, donde hay una sección llamada Brand Registry, la cual es un programa diseñado para brindar a los propietarios de marcas un mayor control de sus productos en el sitio. “Por eso es importante registrar la marca para ponerla ahí y quitársela a la otra gente que se está copiando o la está usando para vender productos o servicios similares a los tuyos”, remarca el abogado. Es indispensable registrar la marca lo más pronto posible, porque “si cada día tienes gente copiando tu producto o servicio estás perdiendo dinero”. Las marcas no se patentan, tan sólo se registran. Lo que se patentan son las invenciones. En ese caso, según Julian, “una patente otorga al inventor durante un período determinado la protección de una divulgación completa de la invención. Tienes el derecho legal de excluir a otros de hacer, usar, vender o importar el producto que está sujeto a la patente”. Hay diferentes tipos de patentes. En el caso de los emprendedores de E-Commerce, las que más les interesan son las patentes de utilidad y diseño. “El diseño protege el diseño ornamental de su producto y la de utilidad protege un nuevo producto completamente”, aclara Julián. Cuando consigues una patente de utilidad, tienes una protección de 20 años, mientras que la patente de diseño dura 15 años. Para las marcas, la protección es por siempre, pero tienes que pagar mantenimiento. “Cada cinco años tienes que dar prueba a la oficina de marcas que todavía estás usando la marca para vender”, informa el letrado. Dentro de Amazon se puede presentar una patente para que, en caso de que “estés vendiendo un producto con un diseño nuevo y otro lo copia y lo vende, puedes presentar tu patente en Amazon para que le saquen el listing a esa persona”. “En la copia de una marca es más fácil cambiar un nombre y vender los mismos productos, pero con la patente ya no pueden vender esos productos. Amazon los quita totalmente”, afirma Julian. Para saber si un producto tiene o no una patente, lo mejor es contratar un abogado especializado en el tema. “Es importantísimo antes de vender un producto que confirmes que nadie tiene patente de eso”, clarifica Julian, y añade: “Nosotros sabemos a dónde ir para buscar las patentes que están pendientes o archivadas y podemos aconsejar si conviene vender o no ese producto”. Asimismo, un abogado puede hacer recomendaciones sobre posibles cambios en caso de que tengamos un producto o servicio similar a otro “para tener más chances de conseguir la patente”. Lo importante es gastar el menor dinero posible e investigar previamente. Sin embargo, hay requisitos mínimos que hay que cumplir para que un producto pueda ser patentado. “El producto tiene que ser nuevo y no puede ser obvio o similar a los productos que ya existen”, subraya Julian. Aunque cuando realizas una solicitud de patente, siempre pasa por un examinador y finalmente se confirma la patente si pasan los requisitos que exige el organismo correspondiente de cada país. Tanto el registro de una marca como una patente le aumentan el valor al negocio. Muchos emprendedores y empresarios deciden vender su tienda o marca cuando adquieren un buen posicionamiento. La ganancia puede ser mucho más alta cuando el nombre del negocio, producto o servicio tiene un registro oficial, y eso es porque “cada persona que va a comprar tu compañía sabe que la propiedad intelectual le da derechos increíbles”. “Dependiendo de cuantas marcas y patentes tienes, es el valor de la compañía”, asegura Julian. Finalmente, tenemos también el copyright, que es el derecho exclusivo de un autor, editor o concesionario para explotar una obra literaria, científica o artística durante cierto tiempo. De acuerdo con lo que dice Julian, “el copyright también protege las palabras que usas, como los listings que creas cuando estás vendiendo en Amazon”. “El copyright lo obtienes cuando haces el listing. En Amazon no tienes que tener un copyright registrado con el gobierno. Ya cuando está fijo puedes hablar con Amazon para sacar a los que te están copiando”, comenta el abogado, y resalta: “Si tú puedes mostrar que tuviste el listing primero antes que otros, eso prueba que eres el dueño del listing”. El proceso para hacer el registro del copyright es el más sencillo de todos. Tienes que ir al organismo correspondiente de cada país, llenar un formulario y esperar el análisis de un examinador. El proceso del copyright tarda sólo de tres a cuatro meses, pero el de la marca tarda de seis meses a un año y el de las patentes de un año y medio a tres años. Asimismo, el copyright mantiene la protección durante 70 años más después de que su autor haya fallecido. No es el caso de los emprendedores que recién comienzan con su empresa, pero cuando esa compañía crece de manera exponencial, es conveniente registrar la LLC, es decir, la entidad comercial, lo cual es distinto a registrar una marca. “La LLC es crear un negocio y lo de la marca es establecer la identificación del negocio”, detalla Julian. “Cuando la compañía es muy grande y vendes muchos productos diferentes en distintas categorías puedes registrar la marca de tu compañía porque cubre a todos los productos”, asevera el abogado. Un detalle importante a tener en cuenta es que cada país tiene sus reglas, pero uno no te protege si en otro país se está vendiendo tu producto o servicio. “Ningún país puede forzar a otro. Tienes que conseguir la protección en cada país que quieras”, informa Julian. En el caso de que seas extranjero, puedes registrar la marca sin problemas, pero tienes que obtener un abogado de ese país para procesar la aplicación. Es mejor estar bien preparado antes de lanzar tu marca, producto o servicio o configurar tu sitio web para evitar problemas legales más adelante.
