KATIE MALONEY & TOM SCHWARTZ – Vanderpump Rules stars KELLY CLARKSON & BRANDON BLACKSTOCK One of the hardest assets to deal with is the house. And when you're a celebrity, you probably have an expensive home and maybe several of them. Our two celebrity divorces are Kelly Clarkson, winner of American Idol, singer, and talk show host, and her music manger former husband (divorce final in September of last year) Brandon Blackstock; and Katie Maloney & Tom Schwartz of Vanderpump Rules, Sur Restaurant and Tom Tom nightlife spot. Real estate was part of their divorce and our topic for today. Real estate is expensive, most times the most valuable asset people have, and the hardest asset to move forward, in many cases, by the time the divorce can be final. It's emotional and financial. Emotions drive the initial decision. Then logic sets in. Or not. It just gets crazier, more complicated and back to emotional. Let's look at Katie Maloney and Tom Schwartz first. They had a very amicable split and mutual decision on selling the house. Katie was quoted in US Weekly saying that the decision was, in fact emotional at first, but then she went through the numbers to see if it was financially feasible for her to keep the house, and that logic became her determining factor to sell the house. It was too much of a financial burden for her to keep it and pay for everything herself, even with her cast member fee with Bravo for the reality show Vanderpump Rules. Now let's look at a more complicated situation, Kelly Clarkson and Brandon Blackstock. Many celebrities invest in real estate. It's safer and more lucrative than stocks, typically. It's also a tangible asset, which means that failing a flood, hurricane or fire, you always know how the asset is doing, and the volatility in the real estate market is far less than the volatility in stocks. There was a pre-nuptial agreement, and this one piece of property, a ranch in Montana, was solely Kelly's in the pre-nup. But Brandon, as so many spouses do at the time of divorce, wanted to contest the pre-nup as far as the community property status of the Montana Ranch was concerned. No contest; it went to Kelly. Here's what happens with most divorces when the house is the largest asset and some complicated situations arise: There are children, Mom wants to stay in the house, but can't afford it. Other spouse can continue to pay for the house until Mom can make more money and refinance the house to buy the other spouse out. Child and spousal support may not be enough for the loan-to-value ratio needed for a mortgage. Mom will have to earn more money, if possible, to be able to get a loan and refinance the house in her name and give Dad his equity share. One spouse doesn't want to get divorced, is addicted to drugs or alcohol, and won't sign the paperwork to put the house on the market. You'll need a lawyer to discuss how this works in your state. In California, you can request a Hearing and request the court to order the house to be sold and sign the paperwork if the addicted spouse can't. or won't The community property value isn't either agreed upon, or even that it is community property. It was owned by one spouse prior to the marriage, and the other spouse wasn't put on the Title. Lega; advice needed to see if it matters that both spouses aren't on Title. There are other factors that come into play to determine if the house is part community and part separate property. It was owned by one spouse prior to the marriage and the other spouse paid part of the mortgage, property taxes, or made some improvements to the property. Legal advice will explain how community property is created in your state. In California, the monies spouses make on their jobs from date of marriage to date of separation are community property dollars, and when spent on things used by both spouses, like paying the mortgage on a house, creates community property. The house was owned by one spouse during the marriage and that spouse had a separate source of money that existed prior to the marriage that was used to pay mortgage, property taxes, or improvements. Definitely need legal advice. Perhaps the house remains separate property, but the operative word is “perhaps”. There is a pre-nup that clearly states the house isn't community property but the mortgage was paid for with community property money. Ask a lawyer for legal advice. What does the pre-nup say about using community funds for the house? This is key in determining whether community property was inadvertently created with the house. Sell the house and reinvest the money. Clean, simple, easy. If there is enough money for each spouse to buy something else with their equity share, you've hit the jackpot! The house is under water, meaning the mortgage is more than the equity in the house. A short sale still requires the sellers to make up the difference in what the house sold for and what the current owners owe the bank. Curt Smith joins Behind the Setlist to talk about Tears for Fears' new album, The Tipping Point, his excitement to play the new songs live, how to choose songs for concerts, his opinion on encores and much more. Smith and bandmate Roland Orzabal first hit the charts in the U.K. in 1982 with "Mad World." For a time, the band performed the song to sound like the darker Gary Jules and Michael Andrews version that was featured on the soundtrack to the film Donnie Darko in 2001. They have also performed the song acoustically and with a full choir. "To me, it's the strength of a song that allows it to be done in many different ways. If the song doesn't fall flat, then obviously the song itself is the strength, it's not necessarily the recording," says Smith. To his point, "Mad World" has been covered by Adam Lambert, Kelly Clarkson, Pentatonix, Susan Boyle, Brandi Carlile and most recently Demi Lovato. These days, "Mad World" is one of a handful of tracks from the group's 1983 debut, The Hurting, that's certain to played on the band's current U.S. tour and the U.K. tour that begins in July. "Change," "Pale Shelter" and "Suffer the Children" are setlist standards. So are "Break It Down Again" from 1993's Elemental and two songs from 1989's The Seeds of Love: "Woman in Chains" and "Sowing the Seeds of Love." Fans will also hear the band's hits from the group's 1985 smash album, Songs From The Big Chair: "Shout," "Head Over Heals/Broken" and "Everybody Wants To Rule The World." In years past, Tears for Fears usually covered Radiohead's "Creep" in their sets. That may not make the final cut as the band makes room for new songs. As for new material, Smith is excited to find out how they transfer to the stage. "The fun part of the first week to two weeks of touring is, you may not have got it right," he says. "And you may want to change things for the first bunch of shows. So until you get in front of an audience, you don't know 100% what's going to work." We had the pleasure of interviewing Jennifer Decilveo over Zoom video!Since breaking through with Andra Day's 2015 hit “Rise Up,” Decilveo has carved out a place as one of music's most exciting and experimental new writer-producers, crafting critically-acclaimed tracks with Beth Ditto, Hinds, Miley Cyrus, Demi Lovato and more. Decilveo never planned on a career in music. She grew up in New Jersey and graduated from Pennsylvania's Lehigh University with a degree in finance. She scored a job at Deloitte, where she spent most of her days looking at Excel spreadsheets.Decilveo had recently seen a clip of hitmaker Kara DioGuardi on YouTube, singing a hit she'd written for Kelly Clarkson. “Oh, so this is a job, huh?” she remembers thinking. Decilveo quit her finance job to intern at a Manhattan studio. She spent a summer writing songs and teaching herself Logic. She moved to L.A., where her BMG publisher introduced her to Andra Day, a jazz-schooled powerhouse who was working on her first album. They wrote “Rise Up,” a four-chord gospel anthem about getting through dark times. The song was nominated for two Grammys and remains a modern standard: Per President Obama's request, she sang it at the Obama Foundation Summit concert in Chicago, and again on the steps of Washington D.C.'s Roosevelt Hotel during President Biden's inaugural parade.Decilveo has been gaining momentum ever since. She co-produced and co-wrote Melanie Martinez' "Play Date,” which became a sleeper hit in 2020, going platinum and scoring over 500 million streams. She produced and co-wrote Madrid indie band Hinds' third studio album The Prettiest Curse, and seven tracks on Ben Platt's acclaimed debut Sing to Me Instead (which she also executive produced). She recently co-wrote two deeply confessional hits; Demi Lovato's “I Love Me,” and Miley Cyrus' “High” off 2021's Plastic Hearts. In the process, Decilveo has created a lane for sonically wild and deeply personal stories on the radio.Decilveo has a huge 2021 lined up. She produced three singles on Marina Diamandis' new LP Ancient Dreams in a Modern Land, and executive produced and co-wrote Christina Perri's forthcoming studio album, due out in the near future. She is also working with the rising Memphis soul singer Valerie June, and wrote the upcoming lead single by Glassnote artist Taylor Janzen, which will be released ahead of Janzen's anticipated Lollapalooza set.We want to hear from you! For over 20 years, Cash Crawford has been involved in the music industry as a noteworthy vocalist, songwriter, and entertainer. Growing up in a rural area of Pritchard, Canada, Cash and her sister Sadie would sing every chance they got, even if it was walking down their driveway to the bus, or going to church on Sunday. In 2008, Cash participated in Canadian Idol, making it to the third round just before being televised. After Canadian Idol, Cash went on to travel across Canada performing as one half of the duo ‘Beyond the Mountain' with Theo Tams. This project won her the Toronto Independent Music Awards for Singer/Songwriter of the Year in 2012. During this time, Cash also worked as a voice actor and wrote solo music. Her original projects have earned her Rising Star, Female Vocalist of the Year, and Song of the Year nominations. Since moving to Nashville, Tennessee in 2016, she continues to hone her skills both on and off the stage. In 2019, Cash released “Stevie”, her single written about her idol Stevie Nicks, with David Tolliver. Most recently, she has been working with producer Don Miggs in Nashville, TN.
