How might artificial intelligence (AI) reshape the way trademark professionals evaluate "likelihood of confusion"? This is one of the most important—and rapidly evolving—questions in trademark law. INTA's recently released study, Exploring the Use of Artificial Intelligence in the Likelihood of Confusion Analysis, is the first major attempt to provide an answer.It takes a close look at how AI technologies—from machine learning and natural language processing to image and audio recognition—could be applied to one of the most fundamental critical aspects of trademark law: determining whether consumers are likely to be confused between two competing marks.The likelihood of confusion analysis is undertaken in three significant phases of the trademark lifecycle. The first use is made by a brand owner looking to adopt and likely register a new mark.  The second is in intellectual property (IP) offices where trademark registration decisions include this analysis. The third area where the likelihood of confusion analysis becomes critical is when a dispute arises.Likelihood of confusion is certainly a legal test, but that legal test is rooted in the core functions of a trademark, that is how brands build trust with their consumers and how the brand owner's investment in the trademark can be protected.  Turning to the report, what makes it particularly timely is the context? Firstly, IP offices around the world are facing increasing application volumes and growing complexity, from multilingual word marks to logos, sounds, and even motion-based trademarks. At the same time, AI is already transforming how we search, compare, and analyze data. Importantly, the study does not advocate for or against AI. Instead, it offers a practical, forward-looking framework, highlighting both the opportunities and the risks, from improved speed and pattern recognition to concerns around bias, transparency, and over-reliance on automation. This episode of Brand & New is hosted by David Gooder, former Commissioner for Trademarks at the United States Patent and Trademark Office (USPTO), who also contributed to this report. To explore and help explain the report's findings, he is joined by two colleagues who played a central role in developing this report.Lori Schulman is Senior Director of Internet Policy at INTA. Ms. Schulman has long been at the forefront of INTA's work on digital policy issues, including the intersection of emerging technologies and IP. She was part of the core INTA project team that worked closely with FTI Consulting to shape this report, contributing both policy insight and practical perspective on how AI is already affecting the IP ecosystem. Jose Londoño is Associate Senior Director for External Relations and Policy Development at INTA. Mr. Londoño also served on the report's internal project team and brings extensive experience working with IP offices and policymakers around the world. In this episode, host Rose Campbell speaks with UCLA social welfare scholar Dr. Tatiana Londoño about the psychological and social toll of immigration enforcement on Latine/x immigrant communities in the United States. Drawing on both her personal experience as a Colombian immigrant and her years of research, Londoño explains how immigration policies, from the 1996 Illegal Immigration Reform Act to post-9/11 security measures and more recent ICE expansions, have created a climate of chronic fear for many immigrant families. This climate of fear discourages families from accessing healthcare, schools, and other social services, creating long-term consequences for children's well-being. In the midst of these numerous challenges, Londoño emphasizes the resilience of immigrant communities and the importance of local advocacy and mutual aid networks. She encourages listeners to support community-based immigrant organizations, believe and validate the fears expressed by affected communities, and resist the normalization of policies and practices that produce widespread trauma.Tatiano Londoño is an Associate Professor of Social Welfare at UCLA. She is a first-generation Latina born in Colombia and raised in Miami, Florida. Throughout her career, she has received funding from various sources such as OLLI NOVA Diversity Scholarship, St. David's Foundation, Integrated Behavioral Health Scholars Program, and QuestBridge. Her work explores how Latine/x immigrant youth and families navigate and adapt to the psychosocial consequences of migration and resettlement. Her work is published in numerous academic journals including Family Process, The American Journal of Drug and Alcohol Abuse, Health Psychology, Journal of Adolescent Research, American Journal of Health Behavior, and Social Work in Mental Health.

Camila Londoño Obregón, quien ya estuvo con nosotros como invitada en la temporada 2, episodio 33, y hablamos sobre el rol de la ecografía fetal en el diagnóstico de cardiopatías congénitas. La Dra. Londoño Obregón forma parte del equipo de Cardiología Congénita y Fetal de la Universidad de Colorado. Ella realizó la especialidad de cardiología pediátrica en el Children's Hospital de Filadelfia, después trabajó en San Antonio, Texas por 8 años como Directora del Programa de Cardiopatías congénitas del adulto como cardióloga pediatra y fetal para posteriormente volverse parte del staff medico de Children's Hospital Colorado. La Dra. Londoño Obregón nació en Colombia y estudió medicina en la Universidad de San Francisco de Quito en Ecuador. Obtuvo una beca del gobierno holandés lo que le permitió ir a Holanda para hacer investigación en fallas del corazón y arritmias. New York Times reporter Ernesto Londoño joins co-hosts V.V. Ganeshananthan and Whitney Terrell to discuss the recent murder of Minnesota state representative Melissa Hortman, which has made headlines as local politicians in the U.S. are rarely targeted for assassination. Londoño describes how a gunman posing as law enforcement went to the homes of several state politicians, killing Hortman and her husband Mark and gravely injuring Democratic state senator John Hoffman and his wife Yvette. Londoño recounts how the No Kings Rally at the Minnesota capitol later that day honored the crime's victims in addition to protesting President Trump. Londoño details the alleged attacker's background and debunks conspiracy theories about possible motives. Comparing the current circumstances to his own childhood in Colombia, where political attacks on the local level were common, Londoño discusses how Trump “redrew the rules of acceptable political discourse,” and how increasing violence against lawmakers may impact who is willing to serve.
