Known by many as "the most at-large Montanan," Steve Held is a rancher, a civic leader and dedicated advocate for the environment – not to mention a former Hollywood star. This month, he took time out to speak with Mary about how the world looks to him.Steve's ranch covers 7000 acres at the southeastern edge of the state. It's a sprawling, magnificent landscape, one that's been shaping him since he was just a boy. Steve lives a deeply connected life – both to his hometown of 450 people, as well as to rural lands and communities across the state.He spent 25 years in Hollywood as an actor, but always knew one day he'd return to his homeland. His children were raised on the land. One of them, Rikki Held, joined 15 other Montana youth to become the lead plaintiff in Held v. Montana, a landmark 2023 lawsuit in which they successfully argued all the way to the Montana Supreme Court that the state had violated their constitutional right to a clean and healthful environment.Steve whole-heartedly supported Rikki and her peers in their legal case. He then built on their energy, brilliance and focus to encourage citizens around the state to learn and join in the climate advocacy movement. Steve sees himself as an energized Elder, devoting himself to organizing for social and environmental justice. Today we're diving into the seventh installment of our eight-part, issue-based podcast series, and we will explore how nonprofits that operate in the health and disability rights space can boldly advance their missions through advocacy. Not only will we touch on recent developments in the news, but we'll also discuss various lobbying and non-lobbying strategies currently being used by nonprofit advocates working to improve healthcare access and disability rights. Attorneys for this episode Natalie Ossenfort Monika Graham Victor Rivera Shownotes Current Events / Executive Orders · Trump Administration Directives on Health & Disability Rights o The One Big Beautiful Bill introduces new eligibility requirements that will exclude an estimated 5.2 million adults from receiving Medicaid benefits. In total, over 8.6 million adults could lose healthcare coverage as a result of this bill. o Health and Human Services Secretary Robert F. Kennedy Jr. recently dismissed the 17-member Advisory Committee on Immunization Practices. o Reports estimate that the Department of Health and Human Services has cut over 10,000 employees. o The Trump administration has also taken recent actions that limit healthcare coverage for gender-affirming care in its crusade against gender ideology. · Supreme Court victory for disability rights o The US Supreme Court unanimously held that children with disabilities should have an easier path to sue or seek recourse against schools for failing to provide ADA-compliant accommodations. This lower barrier of entry to bring legal claims represents a significant victory for disability rights groups. Non-lobbying Advocacy Advocacy can take many forms, and lobbying is just one form. Your organization can engage in non-lobbying activities like: Organizing, educating the public, conducting research, executive branch and regulatory activities, working with your local state board of elections, training and litigation are just a few examples. · Educating the Public o The Arc's North Carolina chapter, an AFJ member organization, continues to shed light on how recent actions by the Trump administration may have a lasting impact on the rights of students with disabilities. · Holding a Rally o This February[GU1] [VR2] [VR3] [GU4] , several health and disability rights groups held a Disability Advocacy Day at the Missouri Capitol. During the event, attendees urged the state to withdraw from a lawsuit brought on by 17 attorneys generals, including the Missouri AG. The groups want to keep federal protections for people with disabilities under Section 504 of the Rehabilitation Act. Section 504 provides funds for special accommodations for students and protects qualified individuals with disabilities. · Litigation as Advocacy o Planned Parenthood of Montana is celebrating a recent legal victory in the abortion space. by The Montana Supreme Court blocked several anti-abortion laws from taking effect in Montana that would institute a 20-week abortion ban and place significant restrictions on abortion-inducing medications. o A federal district judge granted a preliminary injunction temporarily blocking a Trump executive order that prohibits prison officials from providing gender-affirming hormone therapy and other accommodations to transgender people. The lawsuit was filed by the ACLU, the ACLU of DC, and the Transgender Law Center. Lobbying · Advocacy Days o The Arc Minnesota recently organized a rally day at the Minnesota Capitol to protect disability funding. · Legislative Wins o California: A coalition of nonprofit organizations successfully pushed SB634, the Unhoused Service Providers Protection Act, off the Senate floor. This bill is designed to increase protections for people and organizations that provide support to the unhoused. o New York: The New York State Senate approved a bill that allows people facing terminal illnesses to end their lives on their own terms, which the bill's proponents say will ensure a measure of autonomy to New Yorkers in their final days. The bill has the support of several health and disability rights groups like Compassion and Choices. We interview new faculty member Jeremiah Chin, an expert on children's rights and constitutional rights, about Held v. Montana, the first constitutional climate trial led by children in U.S. history. The Montana Supreme Court ruled in favor of the 16 youth plaintiffs in December 2024 that Montana's fossil fuel energy policies and actions violate the children's state constitutional rights. An expert in children's rights and constitutional rights, Professor Chin joined the UW Law faculty in fall 2024. He is an assistant professor of law with a J.D. and Ph.D. in justice studies from Arizona State University. We discuss the landscape of children's rights, focusing on the youth plaintiffs' expression of their need for protection around climate change and how they have mobilized to participate in litigation. Dr. Chin also examines the strongest arguments for and against the verdict. Finally, he explains why this ruling was achieved more quickly than one still pending from a 2015 federal constitutional claim, Juliana vs. United States, in which 21 young Americans challenge the U.S. government's role in driving climate change and request declaratory relief from federal fossil fuel policies causing harm to their physical health and safety.

In the last few weeks, there has been two excellent podcasts that showcase the depths of what legal learning could provide. Fortuitous as it is, we have supplemented on this Christmas Day with a third dimension of legal education, which is the question of access to justice and the role of lawyers in improving the lives of their neighbors. My guest is Kevin T. Frazier, who has written an excellent, short piece for the Federalist Society (here) entitled Artificial Intelligence Can Improve Access to Justice, But the Legal Profession Has a Role to Play. Kevin and I talk about a number of things, including what access to justice means, what are legal deserts, why representation is so important, the various digital tools already out there, and more. Kevin joined St. Thomas University Benjamin L. Crump College of Law as an Assistant Professor of Law in 2023. He teaches administrative law, constitutional law, and civil procedure. Prior to joining STU Law, he served as a Judicial Clerk on the Montana Supreme Court and conducted research on regulating AI as a Research Fellow with the Legal Priorities Project. Over 2,400 protesters have been arrested — and, tragically, 23 have died in the protests. 52 countries lost freedom Freedom is disappearing around the world. Freedom House's latest report on worldwide freedoms released in 2024, indicate a loss of freedoms in 52 countries, and a gain in 21 — for an overall loss in 31 nations of the world. The agency indicates a steady decline in freedom every year since 2006. The organization explains that “Election manipulation was a major driver of declining freedom in 2023 and continued into the first half of this year.” But keep in mind that freedom comes through Jesus. In John 8:36, He said, “If the Son will make you free, you will be free indeed.” Montana Supreme Court calls parental notification unconstitutional The Montana Supreme Court has ruled that a parental notification law for minors considering an abortion is unconstitutional. The 2013 law has been in litigation for over a decade. The court's decision held that a minor's right to “kill her own baby” or, in the ruling's language, “control her reproductive decisions” is “among the most fundamental of the rights she possesses.” Only 35% of Evangelicals have Biblical worldview Only 10% of Americans are Evangelical, and only 35% of these possess a Biblical worldview, according to a recent survey by the Cultural Research Center and pollster George Barna. According to Barna's description, Evangelicals are those who recognize their sinful lives, rely upon Jesus Christ for their redemption, and receive practical life guidance and wisdom from the Bible in their quest to live under the Lordship of Jesus. Disturbingly, 60% of people attending “Evangelical” churches have accepted the popular idea that animals, plants, water, and the wind all have a unique spirit. And almost half of the adults attending Evangelical churches, 44%, believe that there is no absolute moral truth. Joe Biden and Hillary Clinton opened the DNC last night The Democratic National Convention opened last night in Chicago, with addresses from President Joe Biden and the 2016 Democrat nominee for president, Hillary Rodham Clinton. Trump – 49%; Harris – 45% Among the most accurate and reliable polling organizations, Rasmussen Reports, has issued the results of a survey of the U.S. presidential race conducted last week. Donald Trump is still ahead of Kamala Harris -- 49% to 45%. The results are similar to the Rasmussen survey conducted on July 10th — placing Trump ahead of Biden, 46% to 40%. Nasdaq's gains The Nasdaq Composite is regaining ground since its drop in early August — still enjoying a 36% gain from early in 2021. However, the Russell 2000 Index of small cap companies, which represents the rest of the American business world, has not gained any since January 2021. The dominant forces in the market are still the Magnificent 7 stocks of Apple (AAPL), Alphabet (GOOGL, GOOG), Microsoft (MSFT), Amazon (AMZN), Meta (META), Tesla (TSLA), and Nvidia (NVDA). Those stocks continue to do well, rising from taking up 7.5% of the total S&P 500 capitalization to now around 34% of the total S&P capitalization in the U.S. stock market. Phil Donahue dead at 88 Hebrews 9:27 says, “It is appointed once for man to die and after that the judgment.” Iconic TV talk show host Phil Donahue, who hosted the Phil Donahue Show from 1967-1996, is dead at 88 years of age after a long illness, reports NBC News. He was a life-long Catholic, and “not a very good one,” in his own words. Since we don't know about this, since none of us know.” DONAHUE: “Know what?” O'HAIR: “How it began, or why, or when, or if it began at all. What we have to do is take all of the evidence. If we pile the evidence up, and all of the evidence of science -- and it's really massive -- is on one side, and on the other side is a book that we know, for the most part, when it was written and how it was written, etc. -- and this flies in the face of all of the other evidence, then you discard the book. You say, ‘It's no good.'” DONAHUE: “But discarding the book doesn't necessarily prove that there is no God. Let's talk about a higher being.” O'HAIR: ‘No, not a being.” DONAHUE: “What do you call it?” O'HAIR: “Some higher entity.” DONAHUE: “Alright, a higher entity. You are saying you don't know if there is one, aren't you?” O'HAIR: “That's right.” DONAHUE: “That's not atheism. That's agnosticism.” (O'Hair giggles) Donahue was married to Margaret Cooney, his first wife, for 17 years with whom he had five children. Then, Donahue married actress Marlo Thomas, his second wife, for 44 years. The Montana Supreme Court recently reversed a decision that would have blocked a copper mine on the headwaters of the Smith River. Where we thought we had a win in preventing a mine in the wrong place, we now may have to live with that mine. David Brooks [33:02] on Montana TU tells us how, at the very least, TU and other organizations convinced the mine to put in a number of mitigation solutions that were not in their original plan. Trout Unlimited has one more hail Mary on this issue, which you can learn about in the podcast. This is a tough subject to listen to, but we learn that we can never give up on environmental issues, even when it looks like we've won.
