De cryptomarkt blijft net zo grillig als de geopolitieke spanningen die haar beïnvloeden. Na een flinke terugval richting 75.000 dollar, veerde de koers van Bitcoin plotseling op richting de 82.000 dollar. Dat lijkt mede te danken aan uitspraken van Donald Trump, die terugkwam op eerdere ferme standpunten in de handelsoorlog. Analisten zien 75.000 dollar als een kantelpunt: daaronder dreigt het einde van de bullmarkt, daarboven gloort hoop. Wie verder uitzoomt, ziet dat Bitcoin het in deze periode van economische onzekerheid beter doet dan veel traditionele aandelenindices. Mogelijk omdat het al eerder harde klappen heeft gehad, of omdat beleggers het verhaal van Bitcoin als digitaal goud toch niet helemaal loslaten. Altcoins volgden woensdagavond het positieve sentiment, maar hebben de eerdere verliezen nog lang niet goedgemaakt. Ondertussen groeit de overnamedrift in de cryptosector. Ripple heeft voor ruim een miljard dollar het handelsplatform Hidden Road overgenomen. Het platform is actief als zogeheten prime broker: een tussenpersoon tussen grote financiële partijen. Hoewel er weinig bekend is over het klantenbestand, is de verwachting dat de meeste grote spelers op de markt ermee werken. Ripple was al eerder als investeerder betrokken, net als partijen als Coinbase en het inmiddels failliete FTX. Nu neemt Ripple de volledige controle over. De deal past in een breder patroon van consolidatie op de Amerikaanse cryptomarkt. Eerder dit jaar nam exchange Kraken het derivatenplatform NinjaTrader over. Coinbase zou op zijn beurt in gesprek zijn over de overname van het Nederlandse Deribit, voor een bedrag tussen de vier en vijf miljard dollar. Die gesprekken zijn nog niet afgerond, maar volgens bronnen in de sector lijkt een overeenkomst slechts een kwestie van tijd. Dat Ripple zich nu ook nadrukkelijk mengt, maakt de consolidatieslag extra zichtbaar. Verder is Ethereum-ontwikkelaar Virgil Griffith vrijgelaten uit een gevangenis in Michigan. In 2019 gaf hij een presentatie in Noord-Korea over blockchaintechnologie, waarbij ook werd besproken hoe sancties mogelijk konden worden omzeild. Dat leidde tot een veroordeling tot 63 maanden cel en een geldboete. Griffith heeft nu geen gratie gekregen, maar mag zijn straf voortzetten in een reïntegratievoorziening. De sanctielijst van het ministerie van Justitie is aangepast, lopende rechtszaken worden stopgezet en meerdere gedetineerden uit de sector zijn inmiddels vrijgelaten. And welcome back to the Crypto Overnighter. I am your host, Nick. The cover model for this podcast is Tex and together we take a nightly look at the crypto, nft and metaverse space and the industry that surrounds it.And keep in mind, nothing in this show should ever be considered financial advice.  More than 5 years in prison. 63 months. That's what you get if you break sanctions and give aid to North Korea. Specifically when you plead guilty to a count of conspiracy to violate international sanctions.  So this guy, Virgil Griffith is an Ethereum developer. Well, was. You see, last September he pled guilty to the conspiracy charge. That's after being arrested in November of 2019. He gave a talk at a cryptocurrency conference in the North Korea capital of Pyongyang in April of 2019. Now, you can get a lot more time than that. This 63 month sentence was after his plea deal. He's gonna get some credit for time served. And there's been a lot made of his idealism, I guess he was diagnosed with narcissistic personality disorder. And he wanted to be a hero, standing up to government over reach, blah blah blah But really what he did was help one of the most oppressive regimes on Earth. We've talked about it in the past. North Korea uses stolen cryptocurrency to fund their nuclear weapons research. And he taught these people how to evade sanctions using crypto. The judge read text messages and email where Griffith admits it.. He admits to intentionally helping them evade sanctions. I mean, there was a picture of Griffith at this conference. And keep in mind, he had zero permission to go to north Korea to begin with. So he's at this blockchain conference in Pyongyang. This picture has him in front of a blackboard that says “No Sanctions”. And the timing really didn't help him any. People are a bit sensitive around the issue of crypto and sanctions. They're eager to point out villains and say “See? Crypto is a tool to evade sanctions”. And Griffith's crime makes their case for them. Bitcoin has even been described as a libertarian nirvana and many cryptocurrencies have an almost cult-like status amongst some of their proponents. On top of this, there is plenty of mis-information based on a lack of transparency – which of course can lead to fraud as much as (if not more than) riches. What I have long thought is that there was a lack of explanation for the cryptocurrency phenomenon based on the human condition. That is, until now. Meet Ethan Lou. Ethan is a journalist at Canada's Financial Post, an early crypto investor, and the author of a fabulous new book called Once a Bitcoin Miner – Scandal and Turmoil in the Cryptocurrency Wild West. I came across Ethan upon reading his opinion piece in Canada's Globe and Mail in which he equates the world of crypto to the “frontier myth” in which participants are motivated not just by greed and speculation but also by a sense of adventure and even fantasy. That entails good and bad things, particularly when that fantasy comes up against reality. Ethan has met a range of colourful and sometimes dodgy characters during his crypto journey and he shares of some of that in this episode. This path even took him to North Korea, and we discuss that too. He also discusses whether or not these assets are in a bubble and shares advice for the crypto-curious. It's no secret that I have been exploring some of the ideas of crypto currencies like Bitcoin and Ethereum on this show. North Korea is also a fascinating story to me, I've been thinking about it a lot since the string of interviews conducted by North Korean defector Yeon-mi Park. This is the meatiest episode in a long time, as Dmitri Alperovitch, Dave Aitel, and Mark MacCarthy go deep on the substance of a dozen stories or more.  First up, Dmitri and I speculate on possible outcomes from the newly announced administration plan to convene 30 countries to crack down on ransomware. We also report on what may be the first conformed death resulting from the equipment failures caused by ransomware—a newborn strangled by its umbilical cord without the usual electronic warnings.  Dmitri also recaps and explains a new cryptocurrency regulatory topic that doesn't concern its use in ransomware schemes—the move to ensure the financial stability of stablecoins.  Dave weighs in on two surprising provisions of the House intel authorization bill. The first would respond to the Project Raven incident by imposing new controls on ex-spies working for foreign governments. No one is against the idea, but no one thinks that the problem is limited to alumni of a few intelligence agencies. And the bill's sweep is far broader than cases like Project Raven. I make the argument that it may criminalize ex-spies giving security advice to Airbus, or perhaps even the Atlantic Council. The second imposes reporting requirements on U.S. government purchases of vulnerabilities from foreign vendors. This leads to a discussion of which nation has the best offensive talent. Dave thinks the old champ has been decisively dethroned.  In other legislative news, Dmitri covers the three committees producing bills to require cyber incident reporting, with special emphasis on the recently leaked bill from Senate Intel. It's a very aggressive bill, perhaps designed to stake out negotiating room with the Homeland committees. I ask, “What's the difference between Europe's staggering fines for General Data Protection Regulation (GDPR) violations and the fines for violating U.S. cyber reporting obligations?” The answer: about two weeks, at which point the maximum fine due to the U.S. will exceed the top European fine. Mark gives an overview and some prognostication about Google's effort to overturn the EU's $5 billion antitrust fine for its handling of Android.  Dmitri and I find ourselves forced to face up to the growing soft power of Russia and China, which are now increasingly forcing Silicon Valley companies to project Russian and Chinese power into the West. Russia, having forced Apple and Google to send hostages in the form of local employees, are trying to use their leverage to control what those companies do in countries like Germany.  And Linkedin, the last Western social media company still standing in China, is trying to keep that status by asking Americans to self-censor their accounts. At Dave's request, we visit a story we missed last week and explore all the complex equities at work when the FBI decides whether to use ransomware keys for remediation or disruption. Mark gives an overview of the new Federal Trade Commission, where regulatory ambition is high but practical authority weak, at least until the Senate confirms a third Democratic commissioner. Waiting in the wings for that event is even more antitrust action, possible new online privacy rules and Commissioner Slaughter's enthusiasm for addressing racial equity quotas under the guise of algorithmic fairness. Dmitri offers his best guess about the recent Russian arrest of a cybersecurity executive for treason (that's the second in five years if you're counting) and the U.S. decision to send a Russian scammer back to Russia after bitterly fighting to extradite him from Israel (it's the magic of time served awaiting extradition, I speculate).  In quick hits: Dmitri makes a public service announcement about the ways that Two-Factor Authentication (2FA) can be subverted.  I celebrate some good news for the U.S.: China is planning to encourage provincial controls on the design and use of user algorithms. That's bound to give US companies a new competitive advantage in a field where TikTok has passed them. Dave and I dissect the guilty plea of former Ethereum developer Virgil Griffith to violating U.S. sanctions to offer a bland speech on cryptocurrency in North Korea.  I give the highlights of two new and eminently contestable cyberlaw rulings: In U.S. v. Wilson, the Ninth Circuit decided that law enforcement needs a warrant to open files that it knows from hashes are 99.9 percent certain to be child porn. The decision would be unfortunate if it weren't meaningless; the hash itself provides probable cause, so warrants will be quickly and routinely issued. Thanks for the make-work, EFF!  And a magistrate judge clearly gunning for promotion has written a Stored Communications Act opinion that would fill me with concern about the way it empowers Silicon Valley's biased Trust and Safety operatives to de-platform people and then turn their posts over to law enforcement without the subpoena they usually demand. I would worry more about those troubling consequences if I thought the opinion would survive.   And, finally, Dmitri is pleased to find one field where AI is succeeding without controversy, as machine learning declares a famous Peter Paul Rubens painting, Samson and Delilah, to be a fake. But how long, I wonder, before this AI is forced by the FTC to correct its notorious anti-Flemish bias? And more! In this episode, Anna Baydakova, Tanzeel Akhtar and Danny Nelson discuss possible crypto restrictions in India, fresh darknet market research from Chainalysis and the newest chapter in Virgil Griffith's North Korea saga. Will India ban crypto? The move by the government, rumoured for months, may be not as bad as expected. For now, it's only about illegal activities involving crypto and using it to pay for things, as Minister of State for Finance Anurag Singh Thakur told the nation last week. India had cracked down on cryptocurrencies: In April 2018, the Reserve Bank of India barred India's banks from serving crypto exchanges and related businesses. The ban was successfully challenged in India's Supreme Court and lifted last March. Whether you can really ban crypto in any form is another question, though.As for illegal use cases, Chainalysis new report on darknet markets and crypto says Russia, the U.S., Ukraine and China are the countries that pump the most money into the illegal goods marketplaces. Per the previous Chainalysis' report on global crypto adoption, Ukraine and Russia also lead the global retail adoption of crypto. Does it mean most of the crypto adoption in these countries are “dark”? One thing is clear: Both these countries are user bases of Hydra, the world's most successful drug marketplaces, pocketing about 75% of the entire darknet markets' revenue, Chainalysis said. In the meantime, the court case of Ethereum dev Virgil Griffith is moving along – and it doesn't look good. During the latest hearing, on Jan. 27, the judge rejected Griffith's motion to dismiss charges he violated U.S. sanctions law in North Korea. Griffith's lawyers' argument that his speaking at a conference in North Korea is not equal to providing “services” to the sanctioned country apparently did not convince Judge Kevin Castel. Priscilla Moriuchi, director of strategic threat development at Recorded Future and non-resident fellow at Harvard Kennedy School, explains North Korean usage of the internet and how it has changed over time, how it is reserved only for the few most senior people in the regime, and what the mobile devices of the other 25 million citizens connects to, and who is watching the activity on those devices. She also describes the various ways North Korea has shown an interest in cryptocurrency, how it's been determined that North Korea is engaging in those activities, such as cryptocurrency exchange hacks and malware, and its seeming interest in Monero. We also discuss how they convert crypto to fiat, and how well the government seems to have connected its cryptocurrency activities with its other real-world criminal networks used for other activities such as smuggling, drugs and counterfeiting cigarettes and US dollars. We also talk about which North Koreans have been trained to carry out such attacks and how and why they carry them out abroad rather than in North Korea. She also covers why Ethereum researcher Virgil Griffith's visit to North Korea, even if he were dispensing "public" information, would have been helpful in a country where everyone but a tiny elite is denied access to the internet. In light of the questions around whether or not Virgil Griffith's talk at a blockchain conference in Pyongyang could have helped everyday North Koreans, Yeonmi Park, a North Korean defector, human rights activist, board member of the Human Rights Foundation and author of “In Order to Live, A North Korean Girl's Journey to Freedom,” talks to Unchained. She tells us about her life growing up in North Korea, how she thought the "dear leader" could read her thoughts, why freedom of thought is not allowed in North Korea, and how a South Korean had to teach her that Kim Jong Il was fat and not starving for the North Koreans, as she had been taught. She talks about what happened after her father was sent to a prison camp for selling copper, silver and nickel, how three generations of her family were then tainted and put in the "hostile" class of the caste system, and how watching the movie Titanic introduced her to the concept of romantic love. She tells the story of how, because of hunger, she fled to China — right into the hands of human traffickers, but decided to stay because of what trash cans in China signified to her, and describes the first time she heard the word "free." She also covers the difficulty of her transition to freedom and how reading George Orwell's Animal Farm was a turning point for her.  We discuss why the strategy for liberating North Korea is mostly about getting outside information in, who benefits from tours to North Korea and why lifting sanctions would only help the regime. She also explains why the only people who would have benefited from Griffith's talk would have been North Korean elite, and how any actions in line with what the dictator wants help him maintain power. The prominent hacker and Ethereum developer Virgil Griffith was arrested by the US government Friday after he spoke at an April conference on blockchain technologies in North Korea. The US government considers his presentation to be a transfer of technology—and therefore a violation of US sanctions. But Griffith's defenders, including Ethereum founder Vitalik Buterin, describe the arrest as a massive overreaction. Griffith worked for the Ethereum Foundation, and Buterin called him a friend.
