Raha Jorjani is an Immigration Defense Attorney at California's first public defender Immigration Representation Unit. Because our immigration law is founded on the principle that deportation is a civil issue and not a criminal proceeding which, there are few immigration specific public defender units. This denies millions of people the basic right of public defense. This episode covers the ideals of America and how our government is willfully disregarding its responsibility to help the people fleeing the countries we have destabilized. Raha shares her personal experience working with clients who may appear like criminals on paper but are often victims of wider circumstances enacted by our own government. To tell their story without those crucial details is not just dishonest but dehumanizing. Raha hopes that by sharing these stories and making Americans aware of the reality of what immigrants go through, just to have the opportunity to plead their case, we can break down these antiquated systems. Her office is the first of its kind and is being replicated across the country, hopefully to one day become the standard. Você declara o seu amor pelas pessoas? Ou prefere “deixar para amanhã”? Mais cedo, eu navegava pelo Facebook e li a homenagem de uma pessoa para um amigo que havia partido. Seu texto era carregado de gratidão pelo convívio que havia tido, mas também de pesar pela dor da perda. A mensagem era bonita e, por isso, a reli algumas vezes. O autor daquelas palavras havia construído um texto tão detalhista e amoroso que, ao final da leitura, havia um sorriso no meu rosto por imaginar o quão especial deveria ter sido aquela pessoa. Será que ela, em vida, sabia o quanto era amada e única para aquele amigo? Costumo dizer, quase que diariamente para os meus filhos, o quanto eu os amo. E, também, com muita frequência para alguns amigos e sobrinhos. O “eu te amo” sai com facilidade da minha boca. Mas nunca disse ao meu filho o motivo de gostar tanto dele. Nunca expliquei que, quando ele está em casa, o ambiente fica mais leve e alegre. Também não disse que o escuto cantando enquanto toma banho e que sua voz gostosa chega até a cozinha, mesmo com o barulho da panela de arroz. Em todos esses anos, não me passou pela cabeça dizer o quanto adoro o seu senso de humor e o quanto fico orgulhosa quando ele chega da escola e me pergunta, ainda com a mochila nas costas: “mãe, quer ajuda?”. Ah, meu filho, não posso demorar mais. Hoje mesmo preciso te dizer o quanto você é único e importante para mim. Tenho vontade de fazer o mesmo com tantas pessoas. Dos meus irmãos ao funcionário da universidade que me ajuda com as impressões no intervalo das aulas. Ele é muito solicito e calmo. Ele sempre me explica como usar a fotocopiadora como se fosse pela primeira vez. Ao apertar os botões da máquina, seus movimentos são gentis e ele o tempo todo faz contato visual comigo. Duarte parece ter bebido o elixir da presença. Nossa mente adora o “mas”, o “entretanto” e o “todavia”. Tem o hábito de enxergar as pessoas e as situações de uma perspectiva divergente. Ela provavelmente faz isso para nos proteger. Avisa que a namorada apesar de carinhosa, tem o gênio difícil e que a vizinha mesmo sendo educada quando entra no elevador, frequentemente grita com o gato mostrando uma certa tendência para a instabilidade. Só que hoje decido dizer: “Agradeço, mente querida, pelo seu esforço de me mostrar a ‘verdade', mas hoje dispenso esse exercício. Quero apontar minha lanterna interna só para as coisas boas daqueles que conheço. Nesse momento, não me interessam os defeitos e, sim, só as virtudes. Não me interessam as chatices, mas só os deleites que tenho quando estou perto deles.” Hoje estou assim… Querendo dizer aos meus, em forma de poesia e homenagem, como são únicos em seus pequenos gestos e formas. Meu convite é para que hoje você se junte a mim e se transforme em um detetive das qualidades e lindezas que os outros têm. E mais, que o diga, sem cerimônias ou ressalvas. Hoje, a gente pode escrachar, sem medo de ser exagerado ou mal interpretado. Não se demore. Hoje é o melhor dia para dizer que ama e porque ama. Você declara o seu amor pelas pessoas? Ou prefere “deixar para amanhã”? Mais cedo, eu navegava pelo Facebook e li a homenagem de uma pessoa para um amigo que havia partido. Seu texto era carregado de gratidão pelo convívio que havia tido, mas também de pesar pela dor da perda. A mensagem era bonita e, por isso, a reli algumas vezes. O autor daquelas palavras havia construído um texto tão detalhista e amoroso que, ao final da leitura, havia um sorriso no meu rosto por imaginar o quão especial deveria ter sido aquela pessoa. Será que ela, em vida, sabia o quanto era amada e única para aquele amigo? Costumo dizer, quase que diariamente para os meus filhos, o quanto eu os amo. E, também, com muita frequência para alguns amigos e sobrinhos. O “eu te amo” sai com facilidade da minha boca. Mas nunca disse ao meu filho o motivo de gostar tanto dele. Nunca expliquei que, quando ele está em casa, o ambiente fica mais leve e alegre. Também não disse que o escuto cantando enquanto toma banho e que sua voz gostosa chega até a cozinha, mesmo com o barulho da panela de arroz. Em todos esses anos, não me passou pela cabeça dizer o quanto adoro o seu senso de humor e o quanto fico orgulhosa quando ele chega da escola e me pergunta, ainda com a mochila nas costas: “mãe, quer ajuda?”. Ah, meu filho, não posso demorar mais. Hoje mesmo preciso te dizer o quanto você é único e importante para mim. Tenho vontade de fazer o mesmo com tantas pessoas. Dos meus irmãos ao funcionário da universidade que me ajuda com as impressões no intervalo das aulas. Ele é muito solicito e calmo. Ele sempre me explica como usar a fotocopiadora como se fosse pela primeira vez. Ao apertar os botões da máquina, seus movimentos são gentis e ele o tempo todo faz contato visual comigo. Duarte parece ter bebido o elixir da presença. Nossa mente adora o “mas”, o “entretanto” e o “todavia”. Tem o hábito de enxergar as pessoas e as situações de uma perspectiva divergente. Ela provavelmente faz isso para nos proteger. Avisa que a namorada apesar de carinhosa, tem o gênio difícil e que a vizinha mesmo sendo educada quando entra no elevador, frequentemente grita com o gato mostrando uma certa tendência para a instabilidade. Só que hoje decido dizer: “Agradeço, mente querida, pelo seu esforço de me mostrar a ‘verdade', mas hoje dispenso esse exercício. Quero apontar minha lanterna interna só para as coisas boas daqueles que conheço. Nesse momento, não me interessam os defeitos e, sim, só as virtudes. Não me interessam as chatices, mas só os deleites que tenho quando estou perto deles.” Hoje estou assim… Querendo dizer aos meus, em forma de poesia e homenagem, como são únicos em seus pequenos gestos e formas. Meu convite é para que hoje você se junte a mim e se transforme em um detetive das qualidades e lindezas que os outros têm. E mais, que o diga, sem cerimônias ou ressalvas. Hoje, a gente pode escrachar, sem medo de ser exagerado ou mal interpretado. Não se demore. Hoje é o melhor dia para dizer que ama e porque ama. A Bíblia diz que Jesus voltará para buscar o Seu povo e proclamar o juízo sobre o mundo iníquo. Porém a Bíblia não diz exatamente quando Jesus vai voltar. Na verdade, o texto bíblico se concentra principalmente em informar os objetivos da volta de Jesus, e ensinar os cristãos acerca de como eles devem esperar por esse momento.Também é fato que muita gente não acredita que Jesus voltará. Conforme o tempo vai passando, parece que a incredulidade da humanidade vai aumentando cada vez mais. A questão é que pecado gera pecado, e quanto mais endurecido estiver o coração do homem para as coisas de Deus, mais Deus o entrega à sua própria miséria (cf. Romanos 1:21-24).É por isso que nos momentos finais que precederão a volta de Jesus o mundo estará vivendo imerso numa grande apostasia. Mas não se engane! No momento mais agudo da descrença, quando os incrédulos menos esperarem, Jesus vai voltar!Por isso o apóstolo Pedro escreve que nos últimos dias será cada vez mais frequente o aparecimento de pessoas escarnecedoras que questionarão: “Onde está a promessa de que Jesus voltará?” (2 Pedro 3:4).Mas essas pessoas são semelhantes aos incrédulos que viveram no tempo do dilúvio como se o juízo de Deus nunca fosse chegar. Mas assim como na antiguidade o dilúvio veio e trouxe o juízo de Deus sobre o mundo, no tempo determinado por Deus também Jesus voltará vitorioso trazendo paz e alegria aos redimidos e juízo aos ímpios (Mateus 24:37-39).Aqui alguém pode perguntar quando será esse tempo determinado por Deus. Sobre isso Pedro nos lembra de que “que um dia para o Senhor é como mil anos, e mil anos, como um dia”. Mas Deus é fiel à Sua Palavra, “Ele não retarda a Sua promessa, ainda que alguns a têm por tardia” (2 Pedro 3:8,9). Demore o tempo que for, Jesus voltará.Eu creio firmemente nessa promessa, mas vez por outra me pego pensando que a data dessa volta é o que menos me importa, o que realmente me preocupa é o fato de que a palavra de Deus declara que o tempo que eu tenho para me preparar para essa volta é o tempo que eu tenho de vida.Jesus pode voltar para mim a qualquer momento, não sabemos qual é a data reservada para que sermos promovidos ou rebaixados.Pois a palavra nos alerta no evangelho segundo Mateus no capítulo de número 10 verso 28;Não tenham medo dos que matam o corpo, mas não podem matar a alma. In the Nielsen v. Preap decision, released on Wednesday, March 20, Justices Thomas, Gorsuch, Kavanaugh, and Roberts joined Justice Alito in finding that a mandatory detention statute regarding potentially removable immigrants applied to a wider class of persons than previously found in Demore v. Kim (2003). The Constitutional issue surrounds 8 U.S.C. § 1226(c)(1), known as the “mandatory detention provision” of the Immigration and Nationality Act, states that “The Attorney General shall take into custody any alien who—when the alien is released, without regard to whether the alien is released on parole, supervised release, or probation, and without regard to whether the alien may be arrested or imprisoned again for the same offense.” Immigrants who commit certain crimes, specified in the statute, are not entitled to a bond hearing and once detained can be held in federal custody until their removal proceedings are resolved.In two Ninth Circuit decisions, Preap v. Johnson and Khoury v. Asher, it was ruled that criminals released but not immediately detained were entitled to a bond hearing. The ruling in Nielsen reverses these holdings, insofar as Justice Alito concluded that so long as the immigrants meet the criteria set forth in 8 U.S.C. § 1226, the period of time between release and detention is irrelevant. (DHS did not take Preap “into custody” until about seven years after Preap was released from criminal custody.) Justice Alito, writing for the majority, stated that it was “better late...than never” with regard to detention, supporting this conclusion with a grammatical analysis. Specifically, because “an adverb cannot modify a noun, the “when released” clause cannot modify ‘alien’”. In other words, nothing in the plain meaning of the text supports the Circuit Court’s decisions to differently apply the statute to those aliens who were not detained immediately on release from prison. Preap decision, released on Wednesday, March 20, Justices Thomas, Gorsuch, Kavanaugh, and Roberts joined Justice Alito in finding that a mandatory detention statute regarding potentially removable immigrants applied to a wider class of persons than previously found in Demore v. Kim (2003). The Constitutional issue surrounds 8 U.S.C. § 1226(c)(1), known as the “mandatory detention provision” of the Immigration and Nationality Act, states that “The Attorney General shall take into custody any alien who—when the alien is released, without regard to whether the alien is released on parole, supervised release, or probation, and without regard to whether the alien may be arrested or imprisoned again for the same offense.” Immigrants who commit certain crimes, specified in the statute, are not entitled to a bond hearing and once detained can be held in federal custody until their removal proceedings are resolved.In two Ninth Circuit decisions, Preap v. Johnson and Khoury v. Asher, it was ruled that criminals released but not immediately detained were entitled to a bond hearing. The ruling in Nielsen reverses these holdings, insofar as Justice Alito concluded that so long as the immigrants meet the criteria set forth in 8 U.S.C. § 1226, the period of time between release and detention is irrelevant. (DHS did not take Preap “into custody” until about seven years after Preap was released from criminal custody.) Justice Alito, writing for the majority, stated that it was “better late...than never” with regard to detention, supporting this conclusion with a grammatical analysis. Specifically, because “an adverb cannot modify a noun, the “when released” clause cannot modify ‘alien’”. In other words, nothing in the plain meaning of the text supports the Circuit Court’s decisions to differently apply the statute to those aliens who were not detained immediately on release from prison. A male product manager at a tech company gives his take on the Google Memo that's been a big topic of discussion in recent weeks.To bring you up to speed: a software developer at Google called James Demore wrote a memo about the company's diversity policies. This memo spread fast internally before making it's way outside Google and causing a lot of controversy, and led to him being fired by Google. Demore wrote largely about so-called scientific and psychological differences between men and women and how they explain the gender balance in tech, and provdes research to back up his claims.
