Racial minorities are sometimes removed from prospective juries—just like everybody else. But the Legislature is so concerned that this could happen on the (obviously improper) basis of race that the Racial Justice Act prohibits a challenge to a racial minority even on the basis of proper factors, such as lack of life experience. And if that happens, the Legislature has declared not only that this is against law, but operates as a get-a-new-trial-free card. But the California Constitution prohibits get-a-new-trial-free cards. Instead, no judgment may be reversed—even if the judgment is rife with error—unless the error results in a “miscarriage of justice.”Consider how these opinions might be reconciled:People v. Uriostegui (D2d6 Apr. 5, 2024 No. B325200) ___ Cal.App.5th ___ held violations of the Racial Justice Act are per se reversible. In People v. Simmons (2023) 96 Cal.App.5th 323, Justice Yegan argued in dissent that a attempting to bind the courts to a legislative definition of the constitutional term “miscarriage of justice” violates the doctrine of separation of powers. The Supreme Court in F.P. v. Monier (2017) 3 Cal.5th 1099 held that, although the Legislature mandates that trial courts make express findings on principal controverted issues, a court's failure to do so is not per se reversible because the Constitution first requires a finding that the failure worked a miscarriage of justice. In Abdelqader v. Abraham (Cal. Ct. App. Mar. 10, 2022 No. D078652) --- Cal.Rptr.3d ----, failure to make the statutorily-required findings under F.C. 3044 to support awarding custody to a person previously found to have committed domestic violence was per se reversible. In re Marriage of Steiner and Hosseini (2004) 117 Cal.App.4th 519 held that, although the Legislature purported to make inadequate disclosures in property-division cases per se reversible, the Legislature cannot provide “a ‘get-a-new-trial-free' card” in light of the constitutional requirement to show a miscarriage of justice.Appellate Specialist Jeff Lewis' biography, LinkedIn profile, and Twitter feed.Appellate Specialist Tim Kowal's biography, LinkedIn profile, Twitter feed, and YouTube page.Sign up for Not To Be Published, Tim Kowal's weekly legal update, or view his blog of recent cases. The California Appellate Law Podcast thanks Casetext for sponsoring the podcast. In this episode, Cherise is joined by Joseph G. Tattoni, FAIA, Principal at Ikon.5 Architects. They discuss the Mori Hosseini Student Union at Embry Riddle Aeronautical University in Daytona Beach, Florida. You can see the project here as you listen along.Inspired by the gracefulness of birds in flight, the Mori Hosseini Student Union at Embry-Riddle Aeronautical University is an expression of the University's mission to teach the science, practice, and business of aviation and aerospace. A curving bowed roof on top of the structure not only provides solar shading from the harsh Floridian sun, but also invokes sinuous avian forms. Vertical, exposed struts convey a feather-like quality and are functionally the structural members that tie down the curved roof form from wind uplift, particularly, for hurricane resistance. Internally, an exposed 200-foot curving steel arch bisects the middle of the plan and supports a glass roof above, allowing the students of aviation the ability to look skyward while inside. If you enjoy this episode, visit arcat.com/podcast for more. Silvia Hosseini on tutkinut eroottista kirjallisuutta antiikista meidän päiviimme. Silvia Hosseinia haastattelee Nicklas Wancke. Vieraana on myös tietokirjailija-toimittaja Ville Hänninen.

De novo metastatic breast cancer represents 6% of all new breast cancer diagnoses. This figure has not changed at all over the past 20 years; however, systemic therapy options have evolved dramatically during this time and have significantly increased life expectancy for these patients. While surgical management of the primary tumor in the setting of metastatic disease has typically been reserved for palliative indications, surgeons are now being asked to consider resecting the primary tumor to potentially increase overall survival. In this episode, we will use a case study to examine the data that should inform our conversations and decisions when we encounter patients with metastatic breast cancer who are interested in having their primary tumor resected. For many, the fear of rejection halts the initial phone call from taking place. Is it possible to build confidence with yourself or your staff to follow up? Mostafa Hosseini knows that the follow-up call is not as scary as it seems. Through carefully crafted scripts and a marketing formula, Mostafa helps others get appointments or sales to grow their brand. In this episode of Access To Anyone, Michael Roderick sits down with Mostafa Hosseini, Founder of Persyo, to discuss activating your list of existing clients for lead generation. Sales Game Changers | Tip-Filled Conversations with Sales Leaders About Their Successful Careers
This is episode 583. Tips for sales success. Purchase "Insights for Sales Game Changers" here. MOSTAFA'S TIP: "As far as follow up goes, there's this couple of myth and in my experience, thought patterns that stop people from following up. First one people say is they say I don't want to bother them. When there's someone opts in and they raise their hand and say, "Hey, I have a problem, I need help or I'm interested in what you guys are doing", the stats are that about 50% of salespeople never follow up. Fact of the matter is when someone raises their hand and says, "I need help. I have a bleeding neck, I need you to save me." If you go out there and reach out and work on serving them, you're not actually bothering them, but the fact that you're not following up, you're bothering them. If they have a problem, they expect a solution and it's on you to follow up."

Have you ever felt like money is leaking out of your business? You're pursuing lead-gen in a few directions, but the revenue doesn't come… I'll go out on a limb and say…you have a follow-up problem. So many business owners skip the simple step of following up with leads… They're losing so much money and they don't even know it… Mostafa Hosseini is on the podcast today to show you how to make follow-up part of your strategy—without having to make those phone calls you dread. He'll also share: The top 3 places businesses lose money The best time to ask for a referral Why phone calls don't “bother” clients And even more…
Today, I'm interviewing my friend Mostafa Hosseini. He is talking about follow-up. So if you are a business owner, if you're in sales, if you're in pretty much any kind of business. You work for one or you own your own business. I feel like this will be a helpful conversation especially if an aspect of what you do involves sales. Mostafa is going to talk about the psychology of selling and the importance of follow-up. I love this conversation, so many breakthroughs. I felt like everyone I know, all the business owners out there could really benefit from this conversation. Enjoy. Mostafa shares with us his insight: “Hey? What's going on? What's happening in your life? What's going on with business? Are you happy with the products and services that we are providing? Again, depending on the portion of the list that we're calling. And then we always ask for a referral. That's the last question. 'John, who do you know that is having problems with their follow up? Who do you know that is having problems with their mortgage? Who do you know that is having problem with their neck or back? Right? And then, we always ask for a referral. If you ask that question every three or four months, you're like training and educating your audience to refer to you, and you're reminding them every three or four months. So you're creating a referral machine…” Mostafa Hosseini is the founder of Persyo Inc and creator of: Simple Retention Formula, Simple Marketing Formula, Simple Offer Formula. I don't think I have ever shared this on my podcast. I have a 7 Step sales process I use which is the premise of my #1 Best Selling book ESP: Easy Sales Process – 7 Steps to Sales Success. The last step in my process is called CPR follow-up. This means consistent, persistent, respectful follow-up. You get the idea. All relationships need CPR to keep breathing life into that relationship. Respectfully following up is such a key piece of generating new business, closing more sales, building the know, like, trust factor, and bottom line the easiest way to make more money…all done respectfully! Yet one of the mistakes I see with my clients and with other sales folks make is the lack of follow-up. And here is the funny thing, every salesperson, or business owner I speak with, knows how important follow-up is. Yet, when I ask what their follow-up process is, I usually hear things like I don't have a specific follow-up process, or I use my outlook calendar. Connie's motivational quote for today is by – Mark Suster “Persistence, persistence, persistence. I'm surprised how few entrepreneurs follow up.” YouTube: https://youtu.be/yP6YFRpQIgo About Mostafa Hosseini: Mostafa is the founder of Persyo Inc and creator of: · Simple Retention Formula · Simple Marketing Formula · Simple Offer Formula ·And more For the past 12 years, he has helped business owners and entrepreneurs build profitable businesses in various niche markets and industries. “Growing up, I remember entertaining my friends, my cousins, my siblings with storytelling. I would stage plays. I would write the play and they would act it out. It was my first love.”Not many of us can pinpoint the exact moment our lives changed forever. For Khaled Hosseini, the New York Times best-selling Afghan American novelist, author of The Kite Runner, as well as two other novels including One Thousand Splendid Suns, and The Mountains Echoed, it was December 27 1979.As a young boy watching the Soviet Union invade Afghanistan, Khaled knew this was a momentous event. Today Dr. Hosseini is an Ambassador for the United Nations High Commission on Refugees (UNHCR) and in this episode of Into The Magic Shop he talks about his experience as a refugee, his own survivor's guilt, and why the power of stories move us to take action. “I believe in the power of storytelling, Jim, I think stories, be they in the form of plays, or films or music, or I happen to be deeply partial to literature, I think they're the single best means we have of feeling empathy for others.”So what made a successful doctor change course and become a writer, and what is Khaled's take on war and the refugee crisis? To find out more, you'll have to download and listen to this podcast.
