UIM Statute Limited Coverage to Same as UM Coverage THE STATUTE CONTROLS Majdoleen A. Khattab, Administratrix of the Estate of Affan Mohamad Khattab, ("Appellant" or "the Estate"), appealed the district court's order granting summary judgment for Berkley Regional Insurance Company and Integon General Insurance (collectively, "the insurers"), and entering an order of declaratory judgment in favor of the insurers. In Majdoleen A. Khattab, Administrator, Estate of Affan Mohamad Khattab v. Berkley Regional Insurance Company; Integon General Insurance Corporation, No. 22-1462, United States Court of Appeals, Fourth Circuit (October 19, 2023) the Fourth Circuit interpreted the clear language of the statute and UM/UIM coverages. ISSUES At issue is an insurance policy issued by Berkley Regional Insurance Company. The policy has a general liability limit of $1,000,000 and an uninsured motorist coverage limit of $70,000. This case solely turns on the legal question of what the relevant coverage limit under the insurance policy is for an accident caused by a motorist whose insurance coverage is less than the amount of claimed damages and less than the amount of the general liability limit, but greater than the amount of the uninsured motorist coverage limit. Virginia mandates that an insurance policy's uninsured motorist coverage limits must match the policy's liability limits unless any one named insured rejects the additional uninsured motorist coverage by notifying the insurer as provided in the statute. There is no dispute that Berkley complied with the notice requirement for "uninsured/underinsured coverage limits" pursuant to the statute. There was no dispute that the insured properly limited the uninsured coverage to $70,000. With respect to underinsured coverage the statute provides that the policy shall also provide underinsured motorist insurance coverage with limits that shall be equal to the uninsured motorist insurance coverage limits and shall obligate the insurer to make payment for bodily injury or property damage caused by the operation or use of an underinsured motor vehicle to the extent the vehicle is underinsured. Appellant argues, the underinsured coverage limit remained at $1,000,000, equal to the policy's general liability limit. However, Appellant did not pay for a UIM coverage of $1 million. Statute of Limitations Bars Bad Faith Claim Loann T. Phan-Kramer and Jonerik Kramer sued American States Insurance Company for underinsured motorist coverage, won, and collected. Now, they have sued American States again asserting statutory bad faith, breach of contract/good faith and fair dealing, and loss of consortium. In Loann T. Phan-Kramer and Jonerik Kramer v. American States Insurance Company, No. 2:23-cv-01867-JDW, United States District Court, E.D. Pennsylvania (September 14, 2023) the USDC took away part of plaintiffs claim and allowed the rest to proceed in a Solomon like decision. BACKGROUND FACTS On April 15, 2016, an underinsured motorist rear-ended Loann T. Phan-Kramer. She suffered a full thickness tear of her rotator cuff, as well as other neck and back injuries. At the time of the accident, American States Insurance Company insured Ms. Phan-Kramer, including underinsured motorist (“UIM”) benefits. After suing then settling with the other driver, Plaintiffs filed their UIM insurance claim with American States. American States denied that claim and Plaintiffs sued. At trial, the jury returned a verdict in Plaintiffs' favor and the insurer satisfied the verdict. DISCUSSION The Tort of Bad Faith The statute of limitations bars Plaintiffs' claim. The statute of limitations on a bad faith claim is two years in Pennsylvania. The statute begins to run when the insurer first refuses to pay the claim. Breach of Contract/Loss of Consortium The Third Circuit has adopted a bright-line rule that res judicata cannot bar claims that are predicated on events that postdate the filing of the initial complaint. Because Plaintiffs' breach of contract and loss consortium claims both rely (at least in part) on American States's conduct following the filing of the initial lawsuit, res judicata cannot preclude these claims. American States acknowledged that the Amended Complaint “focus[es] . . . on the ways that American States supposedly acted in bad faith during the litigation and trial of the underlying UIM/consortium case.” Because the bright-line rule bars the application of res judicata, American States's Motion on the breach of contract and loss of consortium claims was denied. ZALMA OPINION Insurance companies, like every person and corporation, are imperfect. American States decided it did not owe UIM benefits to its insured, took the issue to trial and lost. It paid the judgment only to be sued for defending the original suit. The court found that the insured/plaintiffs filed their bad faith claim too late and dismissed that action only to allow the breach of contract and loss of consortium claims to proceed. Episode 14: On today's episode, Jim Desmond continues the discussion from his previous episode. He'll answer Frequently Asked Questions from clients. So many people are either confused by the legal system, or simply don't understand how it works. Today's discussion will hopefully help you to better understand issues related to auto accidents. Click here to listen to the previous episode (Episode 13). Does Texting and Driving Matter in an Auto Accident Case? Jim explains that the core issue is “fault.” Kentucky is a pure comparative fault state. The damages can be divided between the drivers, depending upon how much of the fault can be attributed to each of the drivers. Indiana is a modified comparative fault state. In Indiana, you can't be more at fault than the other driver (i.e. 51%) in order to be able to receive compensation for your damages. If it can be proved that one of the drivers was texting at the time of the collision, this can go directly to the issue of fault. Should I Hire an Attorney? Jim talks about what could happen if you don't. He uses the example of selling your home without a realtor. Yes, you can do it, but the realtor may be able to do it quicker and with better results. The law is very complicated. Your claim may involve senior adjusters who are very skilled at negotiating to minimize what the insurance company ultimately pays you. Find an attorney you'll be able to work with directly. You also want an attorney who deals specifically with your type of case. A divorce attorney may know that area of law, but it doesn't mean he/she is prepared to effectively handle a car wreck case. What Is the Kentucky State Minimum Amount of Insurance? The state minimum was established in the 1970s. Unfortunately, it hasn't been raised since then. The cost of medical treatment, the cost of repairing your car and many other expenses have significantly increased, since the 1970s. This presents a problem for people who are in an accident due to the other driver's negligence. The at-fault driver is driving legally as long as they have the state minimum amount of insurance ($25,000). The minimum for property damage coverage is $10,000. How Can I Avoid Getting Stuck with the Expenses if the Other Driver Only Has Minimum Coverage? Jim always recommends you carry a significant amount of Under Insured Motorist Coverage (UIM). This portion of your automobile coverage can be used to cover expenses, once the at-fault driver's insurance has been used up. UIM coverage is for your bodily injury, but doesn't apply to property damage. If the at-fault driver is driving without insurance, your Uninsured Motorist Coverage (UM) can be used to help cover your damages. Yes, both are policies you are paying for. However, remember, these coverages are extremely important when the at-fault driver either doesn't have enough insurance, or doesn't have any insurance at all. Jim explains that Kentucky has a statute the states your insurance rates won't go up because you used your UIM or UM coverage. Remember, you weren't the at-fault driver. You're simply trying to get your expenses covered. Additionally, you're paying for these policies, so why should your insurance company punish you for something you're paying them to cover? Can I Get Around the Fact that I Signed the Release? In a personal injury case, the release is a document that is signed by the injured person, at the end of the case. The release itself prevents any further financial responsibility for the insurance company related to the case. Once the release is signed, the case is done. If something else happens, such as a problem related to a surgery or other issue, the insurance company cannot be held responsible to pay for the medical expenses. Remember, you released them from future liability. This can be extremely problematic if you accepted a quick settlement offer from the insurance company. I that situation, it's possible you haven't competed your medical treatment. There are many complications that may still develop, as a result of the injuries you sustained in the collision. Once that release is signed, the insurance company is legally off the hook. Should I Sign the Paperwork the Insurance Company Sent Me? Jim explains that you need to be careful. You might not understand or realize what you're signing. If the company is your insurance company, it may be okay to sign. It could be a medical authorization giving them permission to request your medical records. If it's a property damage only release, it may be okay to sign. Again, it would be a good idea to have an attorney represent you so that you don't accidentally give away your rights. Be Careful of What You're Including and/or Excluding in the Release The release should include the phrase, “exclusive of the no-fault lien.” You want to make the no-fault carrier (PIP carrier) has to deal with the issue separately. Kentucky is a no-fault state which means you and your passengers typically each have an automatic $10,000 available to cover medical expenses and lost wages. You don't want to accidently forfeit those funds because you signed a legal document you didn't fully understand. Jim Desmond is very willing to work with people to review the documents to ensure they fully understand what's going on. This is why he provides his cell phone (502) 609-7659. What Happens if I Got Sued, but Never Received a Summons? This is a fairly common issue, believe it or not. Generally speaking, a subpoena is served to a witness and a summons is served to someone being sued. A summons is usually sent by certified mail or delivered by the sheriff. It will normally include the official complaint. Most people don't realize a summons normally doesn't include a court date or something to sign. You have to file a written answer in the proper court as a response to the complaint. It's best to have an attorney handle this for you. If you fail to properly file a response, the other party can move for a default judgement. In a default judgement, the other party argues that you failed to properly respond, since everything in my complaint is true, the judge should simply rule in their favor. If the judge grants the judgement, the other party now has the ability to collect against you. If there's a default judgement against you, they can get your driver's license revoked, potentially have your wages garnished or other measures. If you hire an attorney, you may have to deal with attorney fees to fight the default judgement. If you're in an accident and you have insurance, you should contact your insurance company and ask them to open a claim. You'll want to be sure they assign defense counsel to represent you. If I Have 2 Years to File an Injury Claim from a Car Wreck, Can I Wait A few Months to Contact a Lawyer? The short answer is you shouldn't wait. The 2-year period refers to the statute of limitations. This is the period during which you can file a claim. If you go beyond that specific period of time, you are barred from filing a claim. Kentucky and Indiana have different statues regarding when the time ends. In Kentucky, it may be extended beyond 2 years from the date of the collision. It's important to understand you're building your claim from day one. Your medical records and other evidence are important factors. The longer you wait to seek medical treatment, the easier it will be for the insurance adjuster to successfully blame some other issue for your injuries. Maybe you seek treatment, but then don't continue with the prescribed treatment, it may be used to minimize the extent of your injuries from the automobile accident. In serious accidents, your attorney may need to hire an accident reconstruction expert to document and recreate what happened. Evidence can fade away, get lost or simply be forgotten. The longer you wait to hire a lawyer, the more difficult it will be for him/her. This is why preserving evidence is so important at the accident scene. If you're able to take pictures of skid marks, the position of the cars or other facts, a photograph becomes valuable evidence. The same goes for cuts, bruises or other injury-related pictures. Doesn't the Police Report Provide the Evidence I'll Need? Actually, no. The police officer probably wasn't a witness to the collision. The officer will fill out a report based on the stories each person provides. The officer may include other comments about what was found at the scene. Legally speaking, the police report is hearsay. However, this is a factor in your auto accident claim. Can Back Child Support Affect an Automobile Accident Claim? In Kentucky, while you have a personal injury claim, the Child Support Division will have a lien against your case. They will often exempt medical expenses and attorney fees, but the can assert a right to maximum amount of your settlement required to satisfy the back child support. There's really nothing your attorney can do to prevent this from happening. However, you attorney may be able to negotiate some room for extenuating circumstances. After intense behind-the-scenes negotiations to find an agreement between coalition parties in the Johannesburg metro on the following executive mayor for Johannesburg, talks have collapsed, leaving the door open for the ANC/EFF, who have patched up their differences to take control of the council. Action SA issued a statement on Twitter stating that all former coalition members, ActionSA, the IFP Plus, ACDP, UIM, and the Patriotic Alliance, confirmed their willingness to support Funzi Ngobeni from Action SA for Mayor, but the Democratic Alliance refused. This week, please join author Amil Shah and Associate Editor Ntobeko Ntusi as they discuss the article "Stages of Valvular Heart Disease Among Older Adults in the Community: The Atherosclerosis Risk in Communities Study." Dr. Carolyn Lam: Welcome to Circulation on the Run, your weekly podcast summary and backstage pass to the journal and its editors. We're your co-hosts. I'm Dr. Carolyn Lam, associate editor from the National Heart Center and Duke National University of Singapore. Dr. Greg Hundley: And I'm Dr. Greg Hundley, associate editor, Director at the Pauley Heart Center at VCU Health in Richmond, Virginia. Carolyn, this week's feature, very interesting. Many times in older individuals we understand how to manage severe valvular heart disease, for example, severe aortic stenosis. But do we really know how to manage individuals with mild valvular heart disease, for example, mild mitral regurgitation or aortic valve sclerosis? Well, our feature today will address that issue. And so, listeners, grab a cup of coffee. We're going to go through some of the other articles in the issue first, and then we'll get to that really interesting, very practical feature discussion. Well Carolyn, now that I've got my cup of coffee, this paper's from your group. And I'm going to ask you, Carolyn, as if it was a feature discussion, what was the background information that went into this and what was the hypothesis that you wanted to address? Dr. Carolyn Lam: Oh, it's great because it's at least not a Carolyn quiz, so I'm very happy to talk to you about it. Sex differences, as you know, it's a passion of mine. And in response to heart failure pharmacotherapies, in particular, we know that there are sex differences, wherein women appear to benefit from newer hormonal modulators across a wider heart failure ejection fraction range compared to men. And this was particularly evident in the Paragon heart failure trial of Arne versus Valsartan. However, whether these considerations also apply to the sodium-glucose Cotransporter 2 inhibitors or SGLT 2 inhibitors, remains unclear. So along with the groups from the DAPA-HF and DELIVER trial, we therefore examine and assess the impact of sex on the efficacy and safety of dapagliflozin in a pre-specified pooled analysis of these trials. Dr. Greg Hundley: Very interesting, Carolyn. So, differences between men and women and evaluation of efficacy of SGLT 2 inhibitors. So what did you find? Dr. Carolyn Lam: In essence, women and men derived similar benefits from dapagliflozin for both the primary outcome of worsening heart failure or cardiovascular death. And for secondary outcomes, including improvement in health status across the full spectrum of ejection fraction in heart failure. Dapagliflozin was also safe and well tolerated in both sexes. So these findings are consistent with other SGLT 2 inhibitors and suggest a class effect. And in fact, this is very, very nicely discussed in an accompanying editorial by Dr. Ileana Piña. Dr. Greg Hundley: Ah, very nice, Carolyn. Well, my first study here comes from the world of preclinical science. And Carolyn, this study assesses the role of epsins in modulating endothelial to mesenchymal transition in atherosclerosis. So Carolyn, you may ask what are epsins? Well, epsins are ubiquitously expressed adapter proteins involved in the regulation of endocytosis. And then Carolyn, there's a second process addressed in this study. And Carolyn, it is known that chronic vascular inflammation, a hallmark of atherosclerosis, induces a process called endothelial to mesenchymal transition. And during endothelial to mesenchymal transition, the transition of non-smooth muscle cell-derived cells that are capable of maintaining indices of atherosclerotic lesion stability are lost. And this allows atherosclerosis to progress to a more advanced stage. So Carolyn, in this study led by Dr. Hong Chen, from Boston Children's Hospital, these authors wanted to know if impacting epsins could reduce endocytosis and thereby modify endothelial to mesenchymal transition and attenuate atherosclerosis progression. Dr. Carolyn Lam: Sounds like an important concept to address in the progression of atherosclerosis. So what did they find, Greg? Dr. Greg Hundley: Right, Carolyn. So the authors found that epsins are required for endothelial to mesenchymal transition, and that the loss of these proteins in the endothelium reduces endothelial to mesenchymal transition by permitting sustained fibroblast growth factor receptor-1 protein, FGRF1, signaling by inhibiting the degradation of this receptor complex. They also demonstrate the efficacy of blocking epsin FGRF1 interactions specifically in atheromas using systemic administration of a targeted epsin UIM containing peptide to inhibit endothelial to mesenchymal transition and atherosclerosis progression in APO deficient and PCSK9 mutant viral induced atherosclerotic models. So Carolyn, in summary, these authors show that blocking these epsin FGRF1 interactions could provide a new approach to combat atherosclerosis progression. Dr. Carolyn Lam: Wow, Greg, thanks. Well, this next paper is an important preclinical paper showing that agents that induce senescence in cells of pulmonary vasculature can unexpectedly worsen rather than ameliorate pulmonary hypertension. So this paper is from Professor Serge Adnot and colleagues from Hospital Henri-Mondor in France. And they began by showing that in human lung tissues from pulmonary hypertension patients, about 30% of lung endothelial and smooth muscle cells have elevated P16, an observation recently also reported by others, as further evidence of senescence. Many of the cells with elevated P16 also had an increase in unrepaired DNA damage. They then used multiple senolytic strategies in several animal models to remove senescent cells and then found unexpectedly that eliminating senescent cells aggravated rather than suppressed pulmonary hypertension development. As models of pulmonary hypertension, the authors examined a number of animal models of pulmonary hypertension. That included rats exposed to chronic hypoxia, rats injected with the toxin monocrotaline, and rats injected with a VEGF receptor blocker prior to exposure to chronic hypoxia. As well as mice over-expressing the serotonin transporter in smooth muscle cells. And mice with P16 over-expression that develop pulmonary hypertension with age. So lots of animal models were tested and these animals also received the senolytic ABT 263 or FOX04-DRI, that would be expected to remove senolytic cells with equivalent results. Dr. Greg Hundley: Wow, Carolyn, so multiple animal models highlighting that senescent cells in the pulmonary vasculature can worsen rather than attenuate pulmonary hypertension. So what are the clinical implications of these models? Dr. Carolyn Lam: Well, this is discussed in a beautiful editorial by Dr. Rabinovitch that accompanies this paper. And quoting from that editorial, "The study is therefore extremely important in pointing out the potential overkill of senolytics in promoting rather than reversing pulmonary hypertension. The study also has particularly important translational implications as it indicates that the potential efficacy of an emerging therapy relies on the underlying disease mechanism and animal model use, the cell specificity dose, and root of administration." So lots of translational implications of this paper. Dr. Greg Hundley: Wow, Carolyn, so we've got some other articles in this issue and it looks like you've got a great review of those to describe. Dr. Carolyn Lam: Sure, I'd love to tell you about them. First there's a letter from Dr. Liao regarding the article, "Association Between Device Measured Physical Activity and Incident Heart Failure: A Prospective Cohort Study of the UK Biobank Participants." There's also a Cardiovascular Case Series by Dr. Ostrominski on "Pulling Out All The Stops: A Case of Progressive Dyspnea." In Cardiology News by Tracy Hampton, there's a story of scientists creating spatial map of cardiac remodeling after myocardial infarction, published in Nature. Loss of Y chromosome in myeloid cells promoting cardiac fibrosis, published in Science. And details behind the DNMT3A and TET2 mutations linking atherosclerosis. And that's published in Immunity. There's also a Perspective piece by Dr. Somers on “Whom to Screen and How to Screen for Obstructive Sleep Apnea in The Cardiology Clinic?” And a Research Letter by Dr. Felker on the clinical implications of negatively adjudicated heart failure events, data from the Victoria study. Dr. Greg Hundley: Wow, Carolyn, this issue, it's just packed with information. Well, how about we get on to that feature discussion? Dr. Carolyn Lam: Let's go. Thanks. Dr. Greg Hundley: Welcome listeners, to this feature discussion on this February 21, where we're going to delve into the world of valvular heart disease. And we have with us today Dr. Amil Shah from Brigham and Women's Hospital in Boston, Massachusetts, and our own associate editor, Dr. Ntobeko Ntusi from Cape Town in South Africa. Welcome gentlemen. Well Amil, we'll start with you. Could you describe for us some of the background information that really went into the preparation of your study and what was the hypothesis that you wanted to address? Dr. Amil Shah: Well, thanks very much, Greg, and let me start by thanking you and the circulation team for the interest in this paper and the opportunity to discuss it with you today. So I think in terms of background, we know that the prevalence and incidence of valvular heart disease increases with age, and that severe valvular heart disease is associated with substantial morbidity and mortality. Sub-severe valvular heart disease is, of course, even more common and has also been associated with worse cardiovascular outcomes. So I'm thinking of earlier studies that have associated even aortic sclerosis in the absence of stenosis with worse outcomes. Acknowledging the progressive nature of valvular heart disease, the ACCHA valve guidelines adopted this framework of valvular heart disease stages, where stage A was really defined as at risk for valvular dysfunction based on valve morphology in the absence of hemodynamic perturbation. Stage B is progressive valve dysfunctions. This is commonly what we would clinically consider mild or moderate valvular lesions. And then stage C, severe asymptomatic valve dysfunction. Stage D, severe symptomatic valve dysfunction. And we believe that looking at valvular heart disease in the context of these stages, as opposed to just as the hemodynamic severity of the lesion, can provide important insights into the burden of valvular heart disease. And especially sub-severe valvular heart disease in at-risk individuals, and in particular in older individuals. But the prevalence of these stages in the community and their progression over time really prior to this, to our knowledge, hasn't been described. And so really our aims and our hypotheses in this paper was to understand the prevalence of valvular heart stages amongst older adults. And really what we anticipate is that a large proportion of individuals in late life would have at least stage A, if not stage B, valvular heart disease. To describe the prognostic relevance of these stages, and particularly the sub-severe stages, and we anticipated that even stage A or stage B relative to no stage would be associated with worse outcomes, based on the prior literature. And finally, to characterize the rate of progression in late life. Dr. Greg Hundley: So rather than just the hemodynamic significance, it sounds like we're going to investigate the stages of valvular heart disease in an elderly population and associate that with prognosis. So how did we do that? What was your study design and can you describe for us also your study population? Dr. Amil Shah: Sure, of course. So we ended up using longitudinal data from a large cohort of older adults who are participating in the Atherosclerosis Risk in Communities, or ARIC study. So ARIC is an NHLBI funded longitudinal epidemiologic cohort. It's actually been following participants from four communities in the US since 1986. So Maryland, Mississippi, North Carolina, and Minnesota. Echocardiography was performed in just over 6,000. So 6,118 individuals are participants in 2011 to 2013. And at that time the mean age was 76. Just under 3,000 of those individuals underwent a repeat echocardiogram in 2018 to 2019. So that's a time elapse of about six and a half years, at which time the mean age was 81. So we're really looking at how things are changing between the ages of 76 to 81 years of age. We really focused on the mitral and aortic valves and determined or ascertained the stage of regurgitation or stenosis in those valves using a combination of quantitative and qualitative criteria based on the study echocardiograms, which are all read and interpreted centrally. And of course, each valve gets its own stage. And so for the purposes of this paper, we classified individuals as an overall valvular heart disease stage based on whichever valve had the highest grade lesion. Dr. Greg Hundley: Very nice. So using the ARIC study and then following the stages. So describe for us, Amil, what were your study results? Dr. Amil Shah: So at the first assessment, so amongst these approximately 6,000 individuals who had imaging in 2011 and 2013, the prevalence of stage A valvular heart disease was about 39% of individuals. Stage B, which again would be progressive, was about 17% of individuals. And stage C or D, which is really severe valvular heart disease, which was just over 1% in this community based population. And again, another 1% had previously undergone valve replacement or repair. And not surprisingly, even amongst this older cohort, older age was associated with a higher prevalence of each one of these stages. Then over a median follow up of about six and a half years, we looked at the association of each one of these stages with incident cardiovascular events relative to that group of individuals who were free of valvular heart disease stage in this cohort. And in each one of these stages, including stage A, was associated with a higher risk of incident heart failure, incident atrial fibrillation, coronary heart disease, which is largely MI, and then all-cause mortality. And that was true after accounting for many of common cardiovascular risk factors we usually think about as being related to risk for these outcomes. Interestingly, there was not an association with incident stroke in this study, although I will say our numbers for incident events were modest. Dr. Greg Hundley: Now, did you find similar results for men and for women? Dr. Amil Shah: So these results were fairly consistent for men, for women. And then the other demographic subgroup we looked at is... One of the unique features of ARIC is that it is a biracial cohort. And so when we looked at demographic subgroups based on both gender and race group, these trends were similar. Dr. Greg Hundley: And I know, Amil, right at the beginning you were discussing the importance of the stages versus the hemodynamic consequences. Did you do any comparisons, for many of us that are following patients, for example, with aortic stenosis? Did you find a discrepancy between using the stage as the defining term for a patient as opposed to the hemodynamic significance of one of these valve lesions? Dr. Amil Shah: Yeah, that's an excellent question. And so I think the first point to make is the valvular heart disease stages, of course, that we are assigning are based on the highest stage lesion, and so, of the four lesions we assessed. And part of this is a little nuanced, I guess, based on how the guidelines have defined these stages. So interestingly, if you look at stage A valvular heart disease, the majority of those individuals are getting in due to mild mitral regurgitation, because mild mitral regurgitation is considered stage A. In contrast, if you look at stage B, the majority of those individuals are getting in because of mild aortic regurgitation, because mild AR is considered stage B. And then stage C/D is really driven by aortic stenosis, probably not surprisingly. So what we can do is look not only overall, but also by stage within lesion. And certainly for aortic stenosis and mitral regurgitation, which are the most common valvular lesions we encountered, we saw similar findings. For mitral stenosis we had very few cases. So I don't think we can really comment on that based on this study. And for aortic regurgitation, we largely had individuals with no regurgitation or mild regurgitation, only a few with moderate. So again, we're a little bit limited in commenting on that. Dr. Greg Hundley: Very nice. Well, thank you so much, Amil. And listeners, now we're going to turn to our associate editor, Dr. Ntobeko Ntusi from Cape Town, South Africa. Ntobeko, you have many papers that come across your desk. What intrigued you about this particular paper? Dr. Ntobeko Ntusi: Thanks, Greg. I'd like to start by congratulating Amil and his co-authors on this paper, which as an associate editor was an absolute pleasure to handle. And the reason why we liked it are two-fold. Firstly, it's a large study, simple science of over 6,000 people. Very well characterized cohort clinically. We also liked its prospective design, as well as the protocolized nature of the echocardiograms. We liked that there was a central facility for core reading of all of these echocardiograms. And the use of a well-validated system of categorizing valvular heart disease. And importantly, we also liked the fact that it is a very representative study in terms of ethnicity and sex. And for me, there were three important takeaway messages from this study which advance our concepts of valvular heart disease. The first is that we've known for a long time that most severe valvular heart disease is associated with poor outcomes. But for the first time, this study provides us with data that shows a clear created association between the valve stage and outcomes related to mortality incident at fila and incident AF. So this is a new contribution. The second important novel contribution from the study is the data they provided on disease progression between stages of valvular heart disease. And then thirdly, I really liked the figures, in particular figure three and figure four, which I think are going to be highly cited and used in many presentations. So figure three demonstrates the Kaplan-Meier curves and shows survival rates dependent on the stage of valvular heart disease. And figure four, beautiful alluvial plot showing disease progression. And for these reasons we thought this was a piece that we would like to include in Circulation. Thanks, Greg. Dr. Greg Hundley: Thanks so much, Ntobeko. Well Amil, based on all this work, where are you going next? What do you see as the next study to really be performed in this sphere of research? Dr. Amil Shah: So two major findings I think that may have downstream consequences for future studies, first relate to identifying a subgroup A. That these valvular heart disease stages progress fairly substantially over fairly limited periods of time in late life. And really identify older individuals with certainly stage B, but even stage A valvular heart disease as a group, not only that we should screen with follow up, as recommended by the guidelines when we do detect sub-severe valvular lesions. But also potentially for therapeutics to prevent progression as those become increasingly available. And so I think one place where this data may be very helpful is in thinking about at-risk groups to evaluate therapeutics in. I think the second place is this relationship of even stage A valvular heart disease with adverse outcomes, which I think suggests that when we see valve deformation on imaging, that is likely a marker of risks that we're not fully capturing using our other traditional cardiovascular risk factors. And potentially could begin to become incorporated into how we think about risk stratifying our patients. Dr. Greg Hundley: Very nice. Ntobeko, do you have anything to add? Dr. Ntobeko Ntusi: Indeed. So I think in terms of future directions, there are probably three questions that I think would be important in taking this work forward. The first one is that this is clearly a descriptive epidemiological study. And for me it would be interesting to look at some of the mechanisms that underlie the adverse clinical outcomes associated with different stages of valvular heart disease. Two, the follow-up is relatively short and I think that it will be interesting as these individuals continue to be followed up long term, to see how these observations are either strengthened or evolve over time. And then finally, which is probably not going to be possible with the ARIC cohort. I think it would be useful to also look at rates of disease progression, but also the associations with outcomes in a younger cohort. And so for me, those would be interesting future ways of taking this work forward in the future. Thank you, Greg. Dr. Greg Hundley: Very nice. No Good Deed Goes Unpunished GEICO Advantage Insurance Company and GEICO Choice Insurance Company (collectively "GEICO") appealed a decision of the Circuit Court of the City of Richmond granting summary judgment to Liosha Miles ("Miles") on the issue of whether each of the two insurance policies at issue provided separate tranches of insurance for uninsured motorist ("UM") coverage and underinsured motorist ("UIM") coverage. GEICO contended that the statute and each of the applicable policies provide only a single tranche of coverage applicable to both UM and UIM claims. In GEICO Advantage Insurance Company And GEICO Choice Insurance Company v. Liosha Miles, No. 220004, Supreme Court of Virginia (December 1, 2022) the Supreme Court interpreted the statute and the policies wording. BACKGROUND On April 18, 2019, Miles sustained extensive personal injuries in a single automobile accident caused by the negligence of two different drivers. One driver, Carlos Figuero, was insured under an automobile insurance policy issued by Integon General Insurance Company ("Integon") with a liability limit of $25,000. The second driver ("Doe") did not stop at the scene of the accident and was never identified, and thus, is considered an uninsured motorist pursuant to Code § 38.2-2206(B). At the time of the accident, Miles was insured under two policies: she was the named insured under a GEICO Advantage policy covering her vehicle and also was a covered insured under her brother's GEICO Choice policy by virtue of her being a "resident relative" of the named insured. A cap on UM coverage with no corresponding cap on UIM coverage-would represent an anomaly bordering on an absurdity. Although the conclusion was compelled by the words of the statute, the Supreme Court noted that it also was consistent with its prior cases addressing the UM/UIM statute. The circuit court's interpretation of the statute not only fails to address the evil sought to be corrected by the legislature it leads to the very anomaly that the 1982 statutory amendment was designed to eliminate. Under the circuit court's interpretation, Miles would be in a better position from an insurance coverage perspective because she was hit by one underinsured motorist and one uninsured motorist as opposed to two underinsured motorists. Both the text of the Code § 38.2-2206(A) and prior cases interpreting the statute lead inexorably to the conclusion that UIM coverage is a constituent part of UM coverage. Concluding that the circuit court erred in granting Miles' motion for summary judgment and denying GEICO's cross-motion for summary judgment the Supreme Court reversed the judgment of the circuit court and final judgment was entered in favor of GEICO. --- Support this podcast: https://anchor.fm/barry-zalma/support
Appellants should have filed their action no later than October 3, 2016, which they did not do. The October letter stated that UIM coverage is not available under the policy. Even Appellants' counsel admitted that upon receipt of the letter in 2012, he interpreted the letter as a denial of coverage. Therefore, the record supported the finding of a concession by counsel and an obvious failure to sue timely which defeated the suit. ZALMA OPINION When the lawyer for the plaintiff concedes that there was a denial in 2012 and the suit was not filed until 2018 he has conceded the statute of limitations applied and the suit was untimely probably because he agreed there was no coverage under the MBIC policy. No UM/UIM Coverage Supports Denial & Starts Running of Limitations Statute of Limitations Ran From Denial of Claim In Glenna L. Novak And Estate Of Jeffery Leonard Novak, A/K/A Estate Of Jeffery L. Novak By And Through Glenna L. Novak, Executrix v. Mutual Benefit Insurance Company, No. 1592 MDA 2021, No. J-S23016-22, Superior Court of Pennsylvania (October 14, 2022) when the plaintiffs lawyer admitted a letter was a denial of a UM/UIM claim that denial started the running of the statute of limitations. Glenna L. Novak and the Estate of Jeffrey Leonard Novak (collectively "Appellants") appealed from the order granting summary judgment in favor of Mutual Benefit Insurance Company ("MBIC"). FACTS In June 2011, Jeffrey Leonard Novak ("Decedent") was operating a motorcycle when a vehicle driven by Roy E. Wright made a left turn across Decedent's lane of travel, causing the motorcycle to strike the vehicle. Decedent was thrown from his motorcycle and sustained injuries, including severe head trauma, which resulted in death. Appellants sought recovery from Wright, who had an insurance policy through Progressive Specialty Insurance Company ("PSIG"). Wright's policy had a bodily injury limit of $50,000, which PSIG tendered. Appellants also submitted a claim for underinsured motorist ("UIM") coverage under Decedent's motorcycle policy ("motorcycle policy"). The motorcycle policy was issued by Progressive Advanced Insurance Company ("PAIC"). PAIC informed Appellants that Decedent had rejected UIM coverage. Appellants sued, contending the UIM rejection was ineffective, and they eventually reached an agreement to resolve the suit for $20,000. Appellants' counsel wrote to MBIC, which had issued insurance on two of Appellants' other vehicles, a car and a truck, seeking consent to settle the two claims. In a letter dated October 3, 2012, MBIC stated the motorcycle that Decedent was driving at the time of the accident was not insured by MBIC. Therefore, MBIC explained, UIM coverage was not available under its policy and its consent was not required for settlement. Appellants later made a claim to MBIC for UIM coverage under the personal auto policy. MBIC denied UIM coverage, stating it had previously denied coverage in the October 2012 letter, when it explained that its consent was unnecessary for the settlements. Appellants sued in February 2018 (six years after the first denial), and they filed a complaint in May 2019. After Reaching a Settlement of multiple claims presented against her insurer that was also the insurer of the third party, Connie Humes sued for bad faith and violation of the Unfair Trade Practices Act (UTPA). Humes appealed trial rulings by the trial court, excluding evidence of certain settlement amounts paid by Farmers Insurance Group, in a trial of her injury claims. In Connie Humes v. Farmers Insurance Exchange and Mid-Century Insurance Company, 2022 MT 148, No. DA 21-0422, Supreme Court of Montana (July 26, 2022) the Montana Supreme Court resolved the dispute. THE ISSUE BEFORE THE MONTANA SUPREME COURT Did the District Court abuse its discretion by excluding evidence of settlement amounts paid in a global settlement of multiple claims by Farmers Insurance Group in a subsequent trial of claims under the UTPA? FACTUAL BACKGROUND Barney Benkelman rear-ended Humes' vehicle at a stoplight in Helena, causing injury to Humes. Benkelman was covered by Farmers Insurance Exchange (FIE) for bodily injury liability. Don't Drive Off a Cliff, It May Not Be Covered https://zalma.com/blog Jimmy wanted a new pickup truck in the worst way. He decided to deliberately wreck his old car, make a claim against his insurance policy and use the proceeds to buy a new F150. Jimmy disclosed his plan to his best friend, Winifred. She agreed to help — as a lookout for oncoming traffic —on the night they chose to destroy the car. Jimmy, with his friend Winifred as a passenger, intentionally drove his pickup off the road and over a small cliff at 35 mph. He did not let her out of the truck to be his “look out” as planned. He thought it would be more realistic a claim — one that would not be questioned by his insurance company, if Winifred was in the car with him. As planned, the car did not survive the crash. Unfortunately, neither did Winifred. The heirs argued they were entitled to Under Insured Motorists (UIM) benefits under the Farmers and County Mutual policy because Jimmy was under insured. Furthermore, they claimed Winifred's death was “accidental.” Farmers and County Mutual's response was, translated from the lawyerese: “Give us a break.” The heirs argued that Jimmy and Winifred intended to destroy the truck, not Winifred. The death was accidental. In the Winifred's Heirs v. Farmers & County Mutual arbitration, Farmers and County argued that interpretation of “accident” in liability policies is hyper-technical and legalistic and should not apply to the same term in UIM policies. The arbitrator ruled in favor of the insurer. The heirs sued, lost at the trial court, that adopted the ruling of the Arbitrator. The heirs appealed and a Court of Appeals agreed, saying that, for UIM purposes, an “accident” is an “event” that, from the insured's and the underinsured motorist's perspective, is “unforeseen, unintended unexpected or the like.” An injury is not accidental, the appellate court explained, if the injury-producing event was intended or expected. It is not necessary that the insured intend or expect the injury. People who do wrong should not profit from it. Paying Winifred's heirs for her death while admitting that she was intentionally a part of a criminal act is the same as the police paying the heirs of an armed robber who is shot to death by the police in the course of his armed robbery. Kisat ovat Suomen Purjehdus ja Veneily ry:n alaisia tapahtumia, joissa noudatetaan SPV:n kansallisia ja kansainvälisen liiton UIM:n (Union Internationale Motonautique) sääntöjä ja määräyksiä. Savon Aalloilla tutustuimme tähän RaceWKND!- ratamoottorivenesarjaan sekä myös ratamoottoriveneilyyn lajina hitusen verran paremmin, kun vieraaksi saapui Nuppu Böhmig, joka toimii tapahtumakoordinaattorina RaceWKND:n toiminnassa.
