In this case, the court considered this issue: In cases subject to the Prison Litigation Reform Act, do prisoners have a right to a jury trial concerning their exhaustion of administrative remedies where disputed facts regarding exhaustion are intertwined with the underlying merits of their claim?The case was decided on June 18, 2025.The Supreme Court held that the Seventh Amendment requires a jury trial on Prison Litigation Reform Act (PLRA) exhaustion when that issue is intertwined with the merits of a claim that falls under the Seventh Amendment. Chief Justice John Roberts authored the 5-4 majority opinion of the Court.PLRA exhaustion operates as a standard affirmative defense subject to the usual practice under the Federal Rules of Civil Procedure. The usual practice requires factual disputes regarding legal claims to go to a jury, even when a judge could ordinarily resolve such questions independently. Because Congress legislates against the backdrop of established common-law adjudicatory principles, and because the PLRA remains silent on whether judges or juries should resolve exhaustion disputes, this silence constitutes strong evidence that courts should follow the usual practice of sending factual disputes to juries when they are intertwined with the merits.At the time Congress enacted the PLRA in 1996, well-established precedent required that factual disputes intertwined with Seventh Amendment claims go to juries. Two lines of cases support this principle. First, in cases involving both legal and equitable claims, Beacon Theatres established that judges may not resolve equitable claims first if doing so could prevent legal claims from reaching a jury, because judicial discretion must preserve jury trial rights wherever possible. Second, in subject matter jurisdiction cases like Smithers v Smith and Land v Dollar, courts may not resolve factual disputes when those disputes are intertwined with the merits, as this would risk deciding the controversy's substance without ordinary trial procedures, including the right to a jury. When the PLRA was enacted, the usual federal court practice across various contexts involved resolving factual disputes intertwined with the merits at the merits stage itself.Justice Amy Coney Barrett authored a dissenting opinion, joined by Justices Clarence Thomas, Samuel Alito, and Brett Kavanaugh, arguing that the majority's statutory interpretation contravenes basic principles because the PLRA's silence cannot confer a jury trial right, and that the jury trial right under the Seventh Amendment does not depend on factual overlap between threshold issues and the merits.The opinion is presented here in its entirety, but with citations omitted. The company's high-grade British Columbia property near Smithers represents a significant milestone in today's challenging regulatory environment, where typical mining permits can extend to 20 years.The 22,000-hectare property contains 15 known high-grade veins averaging 9 grams per ton, with current measured and indicated resources of 218,000 ounces concentrated on a single vein. Management projects a clear path to over one million ounces based on extensive drilling programs totaling more than 50,000 meters. Recent drilling 150 meters below known resources has yielded intercepts exceeding 18 grams per ton across multiple hits, with increasing copper grades suggesting proximity to the mineralization source.Blue Lagoon's strategic approach emphasizes cash flow generation over traditional equity financing. "I could have raised more money for this company a couple of years ago, but everybody was depressed," Vig explained. "Why dilute at that level? I'd be at 700-800 million-900 million shares." Instead, management plans to use production cash flow as an "ATM" to fund exploration and expansion activities.The company has invested approximately $40 million in infrastructure and assembled an experienced operational team, including Cobra Mining contractors familiar with the historical Noranda operations at the same site. Kate Ames is the Owner and Operator of Baller Foods. Chef Kate grew up foraging, fishing, and camping in Terrace, British Columbia. From a young age, she was drawn more to the arts than the sciences. In high school, she took “easy” academic classes like English and French correspondence during the summer to free up her schedule for the subjects she loved most—foods, choir, band, art, yearbook, and theatre.Kate began cooking at a young age after moving out and getting married at just 18. Her culinary journey started with a dishwasher job at a fishing lodge and evolved through roles at KFC, Pizza Hut, Denny's, and Mr. Mikes. By the age of 20, she was managing both a Subway and a hotel pub.At 23, Kate moved to Vancouver to study graphic design and marketing at Emily Carr University and BCIT. She went on to freelance for over 15 years with her former business, Ames Design Studio, and held marketing and graphic design positions at the PG Free Press and the Northern Health Authority.When the COVID-19 pandemic hit, Kate experienced major life upheavals, including the loss of childcare, employment, her design business, and her late partner. With resilience and passion, she pivoted toward her lifelong dream of owning a food truck. Leveraging her background in marketing and design, she launched Baller Food, a business born of both creativity and necessity.Kate began by making meatballs in the kitchen of Birch and Boar, where she found mentorship and support from chef and owner William Miller. Using guerrilla marketing tactics, she sold meatballs on the streets of downtown Prince George and gradually built a following. Over two years, she vended at community events, music festivals, weddings, and schools, eventually expanding into a full-fledged food truck operation.Since then, it's been “balls to the wall.” From May to October, Kate focuses on contract events, travels to northern B.C. music festivals—including Valhalla and Riverboat Days in Terrace, Midsummer in Smithers, ArtsWells near Quesnel, and Robson Valley Music Festival in Dunster—and serves outlying communities such as Quesnel, Vanderhoof, and Mackenzie. She also continues to grow retail sales, with products now available at PG Urban Shroomery and soon at Blackwood Gifts.To improve visibility, Kate has partnered with CO-OP and Superstore and has a regular setup at the Chevron Cardlock in the BCR site. She posts her monthly event schedule and weekly updates on Facebook and Instagram, encouraging followers to set alerts so they never miss where she'll be parked.In the off-season (October to May), Baller Food shifts its focus to hot lunch programs at local schools, event catering, and hot-and-ready meals. This fall, Kate will also launch cooking classes for kids at the South Fort George Family Resource Centre, continuing her mission to nourish and inspire the community through food.

Annie Smithers is a celebrated French chef in Australia who has achieved a wonderful work life balance living in the country French style, growing her own produce from paddock to plate! Starting out in the early 80s in the kitchens of the famed Aussie restauranteur Stephanie Alexander, Annie has an amazing knowledge of French cooking, with its intricate techniques and traditional dishes. I love Annie's passion for working with the terroir when making up a menu. I also adored chatting with her about the history of food in France as well as nattering on with our observations of the evolution French life and how we connect with it here in Australia too. On this episode of the SeventySix Capital Sports Leadership Show, Wayne Kimmel interviewed 2X Stanley Cup Champion and author of Thundermouth: Memoirs of a Broad Street Bully and NHL Lifer, Joe Watson. Watson was one of the first hockey players drafted during the NHL expansion draft in 1967 for the newly created Philadelphia Flyers. Little did he know when he left the Boston Bruins that this unexpected career change would lead him to play on a two-time Stanley Cup champion team, eventually becoming known as the iconic Broad Street Bullies. Watson soon earned the nickname “Thundermouth” by Flyers teammate Ed Van Impe, for his strong voice that carried from one end of the ice to the other. Growing up in the remote town of Smithers, British Columbia, hockey was a way of life so Watson was lacing up skates as soon as he could walk, and never looked back. It was during these formative years that Watson, a left-handed defenseman, was inspired and encouraged by coaches to follow his dream of becoming a professional hockey player, and that's all he needed. His desire, discipline, and dedication paved the way from there. By age 16, Watson was on his way to Estevan, Saskatchewan where he was selected out of 104 players for the Junior A Estevan Bruins team. After three years with Estevan, Watson turned pro with the Minneapolis Bruins, a farm team for the Boston Bruins. From there, the franchise moved to Oklahoma City where Watson and his team won the championship and he was selected for the the All-Star team. The following year, he moved up to the Boston Bruins where he became good friends with his teammate Bobby Orr who, according to Watson, is one of the best hockey players of all time. In 1972, Watson welcomed his younger brother Jim to the Flyers team, and the Watson brothers captivated fans with their signature defense skills. They went on to play together in both the 1974 and 1975 Stanley Cup Championships, winning two Stanley Cups. At the time, Watson and Jim were only the fourth “brother” combination in the league to win, and the first from Smithers, British Columbia. PART TWO. In Canada, there is a stretch of highway between the cities of Prince Rupert and Prince George that covers 725 km (or 450 miles). For over 50 years, this dark, isolated road has swallowed up women and girls in the night from 1969 to present. Because of the despair that has happened along this corridor, it is now known as the Highway of Tears. In this three-part series, we will be exploring this area and the devastating stories found alongside it. In his book, Native Southerners: Indigenous History from Origins to Removal(University of Oklahoma Press, 2019), Dr. Gregory D. Smithers effectively articulates the complex history of Native Southerners. Smithers conveys the history of Native Southerners through numerous historical eras while properly reinterpreting popular misconceptions about the past in a way that is compelling and easy to understand. Smithers expresses the rich and complex history of Native Southerners as it was while exposing the reality of settler colonialism and U.S. removal policies. As shown throughout the book, Native Southerners were constantly adapting to a changing world. But ultimately Native Southerners flourished, leading Smither to state, “My, how the architects of removal and assimilation failed.” Gregory D. Smithers is an American historian with a particular interest in the rich history of the Cherokee people, Indigenous history in the Southeast, and environmental history. He received his Ph.D. in History from the University of California, Davis. He has taught in California, Hawaii, Scotland, and Ohio. He currently lives in Richmond, Virginia, where he is a professor of American history and Eminent Scholar in the College of Humanities and Sciences at Virginia Commonwealth University. Colin Mustful has an M.A. in history from Minnesota State University, Mankato, and is currently a candidate for an M.F.A. in Creative Writing from Augsburg University.
