Brendan Carr has been tapped by President-elect Trump to lead the Federal Communications Commission (FCC). Carr, a current FCC commissioner, has pledged to dismantle what he calls the "censorship cartel" and overhaul how broadcast and tech media are regulated. Carr also co-authored the FCC section of the right-wing "Project 2025," which aims to target big tech, cut diversity and equity efforts, and consider pulling TV licenses for content deemed not in the public interest. Critics warn that this agenda, coupled with Carr's ties to Elon Musk, could open doors to punishing media voices and stifling speech that challenges Trump's narrative. By scaling back diversity efforts and potentially revoking TV and radio licenses based on content, his policies could restrict platforms and even suppress Black voices or dissenting perspectives, also threatening hard-won progress in media representation and equitable access. On the bright side, Trump’s chief stooge on the coronavirus task force, Dr. Scott Atlas, has finally resigned. Meanwhile, a new report by NBC News shows that Uber’s predatory, gig-economy policies wreaked havoc on a generation of struggling working-class drivers in Kenya, using the same cut-throat tactics they perfected in the U.S. And lastly, new research shows that evictions massively exacerbated the pandemic, contributing to as many as 10,000 preventable deaths. THESE ARE THE STORIES YOU NEED TO KNOW: The holiday season is going to be a mess. After Thanksgiving, the nations doctors and disease experts are predicting a grim, overwhelming surge in coronavirus cases and hospitalizations, which might not let up until we finally have a vaccine. The numbers are staggering: we’re now at about a million new cases a week, and some epidemiologists think we could double the current 250,000 person death toll by March. Hospitals are overwhelmed: in California, Governor Newsom warned that the state’s ICU beds could be full by the middle of December, particularly in hard-hit areas like the central valley. In New York, meanwhile, Governor Andrew Cuomo fears a similar fate as New York City and other areas of the state weather yet another surge. Cuomo said as well that hospital space is the metric we should be paying attention to, even more so than the positive test rate in a given area. It’s an absolute travesty we even have to do this kind of math, but that’s where we’re at. The one good sign is that Scott Atlas, Trump’s go-to liar on the coronavirus task force, has formally resigned from his temporary post in the government. Atlas was the driving force behind the Trump administration’s downplaying of the virus and encouragement of misinformation. Also, there is a vaccine on the horizon. Moderna’s first shots could be given out as early as December 21, but that will only be to a small sliver of the population. Until everyone gets them, we’re in for a rough winter. Stay home if you can, and take care when you can’t. Uber Wreaks Havoc on Nigerian Drivers We’ve known that Uber was a soulless, predatory company for years now, since the drama back in 2017 with ex-CEO Travis Kalanick’s pursuit of market domination by any means, legal or illegal. But some of the tactics that Kalanick’s cutthroats perfected are now having ripple effects across the world. A new investigation by NBC news shows one of those case, in Nairobi, Kenya, where the company lured in massive influx of labor and then did everything they could to undercut their new drivers’ profits. In one case, NBC describes how Uber originally forced drivers to use larger, more expensive four-door cars. Then after many were locked into leases, they slashed the rates and started allowing smaller compacts to use the service, effectively undercutting everyone who was driving for the app before the change. This sent many drivers into a spiral of debt that their dwindling fares couldn’t keep up with, all because they were trying to play by the company’s rules. Uber employs over 12,000 drivers in Kenya, many of them in the capitol of Nairobi. NBC spoke to over 80 of them, and every one said they were struggling to make ends meet. This isn’t new: In 2017, Uber had to pay the U.S. Federal Trade Commission $20 million to resolve the fact that it exaggerated the amount drivers could earn and provided incorrect vehicle financing information to its workers. This is the exact same thing, just in a country with less regulatory protections and an even larger workforce of vulnerable people. There’s little to stop them taking this predatory capitalism show on the road all over the world. Study Shows Evictions Cost Lives We now have solid evidence that the government’s failure to ensure a nationwide eviction moratorium cost lives during the pandemic. A new study by Wake Forest University found that the premature expiration of state eviction bans led to more than 433,000 excess Covid-19 cases and 10,700 preventable deaths in the United States between March and September. The study specifically focused on the spread of the disease and its relationship to evictions in that period because it was before Trump’s loophole-filled CDC order barring evictions went into place. The CDC order provided some measure of relief, but if you remember a couple weeks back we discussed how some corporate landlords bypassed it by just not telling their tenants that they could stop their evictions by citing hardship from the pandemic. And before this system went into place, statewide eviction moratoriums often expired. After controlling for a bunch of other factors like mask mandates and other social restrictions, the researchers found that lifting eviction moratoriums were associated with significant increases in coronavirus infections and deaths. We’ll of course need further research on the matter, but what this says is that history will not look kindly on the people who failed to protect their constituents from this pandemic. AND NOW FOR SOME QUICKER QUICKIES: After pushing to go ahead with federal executions even through the lame-duck period, the Trump administration is now seeking for even more ways to kill people: this time entering a change in the federal record that would let executions be carried out by firing squad. It goes into effect on December 24, which means there’s a non-zero chance Trump could actually use one to execute someone before he leaves office. Ajit Pai, the former Verizon lawyer turned FCC Chair, will leave his seat on January 20, which should give the Biden administration a chance to undo some of the destruction he wrought in that seat. It won’t turn back the massive Sprint/TMobile monopoly, but it should give net neutrality advocates some light at the end of the tunnel. In oral arguments on Monday, the Supreme Court did not seem immediately disposed to let the Trump administration exclude undocumented immigrants from the numbers that allocate House seats, a move the GOP desperately wants as it would drastically shift the balance of power their way. Per the New York Times, various justices were skeptical and confused by the Trump administration’s legal argument. Arizona joined Wisconsin on Monday and finalized its vote count for the 2020 election, checking off basically the last box to make the election results earlier this month final. Still 50 days until Trump leaves office though, so we’ll see how it goes! Wheeler was the CEO of the wireless industry group CTIA from 1992 to 2004, and the CEO of the National Cable Television Association from 1979 to 1984. As the agency drafted its net neutrality rules, comedian John Oliver famously compared putting Wheeler in charge of the FCC to hiring a dingo to babysit your kids. But Wheeler wasn't a dingo.

Feds charge second Chinese Apple car worker with data theft The feds have charged a second Apple engineer with stealing company trade secrets with a plan to bring them back to China. Another Apple employee spotted Jizhong Chen taking snapshots of his workspace with a wide angle lens even though he was working under an NDA.  Apparently Chen had some 2,000 files on his hard drive, including manuals and schematics.  He says he was going to China to see family. But the feds allege he was actually planning to bring the files back to a Chinese car manufacturer he’d applied for a job with. It’s the second Apple employee charged with stealing trade secrets from the company’s self-driving car unit. Apple reports Group FaceTime bug Apple reported a bug with Group FaceTime that allowed callers to hear the people they were calling before they answered. The company took down Group Facetime when it learned of the bug, apologized, and announced that it would release a fix for the problem this week. Facebook hires three leading privacy critics from Access Now, EFF, and OTI The Information reports that Facebook has hired three leading privacy critics from Access Now, EFF, and OTI as the company tries to deal with the onslaught of backlash around its privacy woes. Robyn Greene, Nathan White, and Nate Cardozo have been critical of Facebook and all joined the company within the last month. Mignon Clyburn to advise TMobile/Sprint TMobile and Sprint have tapped former FCC Chair and Commissioner Mignon Clyburn to help advise them on their $26 billion merger. Clyburn said in a statement that she will be advising the two companies as a continuation of her work to ensure vulnerable populations have affordable access to 5G.

Early this week, the White House confirmed that President Trump picked FCC Commissioner Ajit Pai to chair the agency. This means that Republicans have a 2-1 majority until the vacancies can be filled by candidates confirmed by the Senate. While some of his more hysterical critics pull their hair out over the impending “death of the Open Internet,” others are looking forward to a new direction at the FCC. Hopefully this is characterized by a renewed spirit of bipartisanship on a wide range of telecom issues, including net neutrality and broadband deployment. Pai has proposed “Gigabit Opportunity Zones” to jumpstart broadband in both urban and rural low-income communities. What else can we expect from the new FCC? Evan and Berin discuss.

At Benton.org, Robbie McBeath discusses the totally changed political landscape in which Republicans will now control all three branches of government. South Dakota Senator John Thune is expected to continue to Chair the Senate Commerce Committee. Three Congressmen--Greg Walden, John Shimkus and Joe Barton are expected to pursue the House Energy and Commerce Chairmanship, with Walden being the favorite since House speaker Paul Ryan credits Walden, who served as Republican Congressional Committee Chair, with helping Republicans maintain control of Congress. Anticipated legislative initiatives include rewriting the Communications Act and an effort to override the FCC's net neutrality rules, as well as expanding mobile and internet access to rural areas and capping Lifeline expenditures to $1.5 billion. President-elect Trump will of course nominate a new FCC Chair to replace Tom Wheeler who is expected to leave before the inauguration on January 20th. Tech sector stocks declined following last week's election, as investors anticipated a new administration that would be less friendly to tech than Obama. The tech sector opposed Trump vigorously during the campaign, contributing barely anything to his campaign, outside of PayPal founder Peter Thiel who contributed $1.25 million late in the election season. Companies like Apple are concerned about what a new Trump administration will mean for encryption and the company's resistance to law enforcement requests for access to iPhone data during criminal investigations. Almost all of the Valley is concerned about what the new administration will mean not just for things like net neutrality and science-based policymaking, but also the sector's influence in Washington, which had grown exponentially during the Obama era. ---- Facebook announced that it will no longer allow advertisers to exclude audiences based on their race and ethnicity for ads related to housing, credit or employment. The company will also require advertisers to pledge not to place any discriminatory ads on Facebook. The company had come under fire from civil rights activists, the Congressional Black and Hispanic Caucuses, as well as several attorneys general after Pro Publica released a report showing how Facebook allowed advertisers selling real estate to exclude racial and ethnic groups. Two plaintiffs also sued Facebook under Title VII of the Civil Rights Act of 1964. ---- Following the 2016 presidential election, Facebook executives are now evaluating the role the platform plays in the dissemination of fake news, and the extent to which misinformation on the social network led to the election of Donald Trump. One piece of fake news shared over 1 million times falsely claimed that Pope Francis endorsed Donald Trump. Facebook has been under fire for bias in its newsfeed over the past year, and earlier this year was accused of suressing conservative news from its trending news results. Facebook CEO Mark Zuckerberg denies fake news on Facebook impacted the election in any way.  Mike Isaac has the story in the New York Times. ---- John Wagner reported in the Washington Post on Hillary Clinton's data driven campaign, one that was far more sophisticated than both Romney and Obama's, but which ultimate failed. It appears that both the Democratic establishment and the complex algorithm they used known as Ada, completely missed opportunities to campaign in Rust Belt states like Michigan and Minnesota, which Clinton lost. Campaign managers will look at this as a case study for many years to come into both how biases are reflected in algorithms and the extent to which campaigns should continue to rely on alogrithms to determine which states they should campaign in. --- A group of hackers known as Fancy Bear and Cozy Bear, widely believed to be affiliated with Russia, launched an attack on the servers of several NGOs, think tanks, universities, government agencies and other institutions on Wednesday, shortly after Trump claimed victory in Tuesday's election. The hackers sent phishing emails to the targets containing malicious links and zip files. Lorenzo Franceschi-Bicchierai at Motherboard has the story. ---- Finally, the US Court of Appeals for the DC Circuit blocked the FCC's prison phone rate cap last week, granting a petition for stay by a company called Securus technologies. The rate caps were set at 13 cents to 31 cents per minute. The Court stated that these caps were significantly below what prison phone providers need to fulfill their contractual obligations to prisons. John Brodkin has the story in Ars Technica.

Coming to you live deep in the Heart of America.Welcome back to The Live Show!First headline of the day: Investigator of the Secret Service prostitution scandal resigns.If you will remember back, there were a group of secret service agents who were on an advanced detail and they ended up going to Colombia. They were lady implicated in a prostitution scandal. And 8 of them were subsequently fired. For those of you who don’t understand how an advanced detail works, let me explain.When you’re doing close protection work, of which I have quite a bit of experience, you have on a large scale operation like you would have protecting a President or high ranking Senators or something like that, you typically have two teams. You have the actual close protection element that guards the person that you’re there to protect. And you have an advanced team that goes to the locations that the individual is going to be at prior to them arriving, does a bunch of coordination, and makes sure that things are secure.So you have a group of secret service agents who travel to Colombia as part of the advanced element. And while they were there, they got their advance work done, it was late in the night, they got an itch they got to scratch, it’s right there. It’s right in front of you, just go over there. So they ended up paying for sex and got kicked out of the Secret Service.Now, they had assigned an investigator, David Nieland, to try and figure out if a crime had been committed here. He was part of the Department of Homeland Security who was tasked with the internal review of the Secrete Service in the 2012 prostitution scandal. When you give people massive amounts of authority, if you needed any validation that corruption exists everywhere and that absolute power corrupts absolutely, you need to look no further than the single man who was in charge of monitoring and reviewing the Secret Service investigation. Here’s another one:Man beheads woman & jumps in front of trainhttp://nypost.com/2014/10/29/man-possibly-beheaded-woman-jumped-in-front-of-train-cops/A man beheaded a woman at her Long Island apartment Tuesday night and dragged her out into the street where he kicked her severed head about 20 feet before jumping in front of a train, cops and witnesses said.Some of the neighbors thought the headless body in the street was a Halloween prank, only to lift the lifeless body and discover it was real, witnesses said.The man was struck and killed by a LIRR train about 25 minutes later.It’s wild and crazy times in New York. Never a dull moment.You know, I laugh a little bit about it because, if you don’t, it’s just so sad. This is a bad situation. Bad things happen all the time. With 24 hour news cycles, you tend to see more of them than you saw years ago. But it was a rarity in this country when somebody got beheaded. Not so much anymore. We have a ton of stuff in the stack today.I got so much stuff today that I want to go over with you and so many different angles that I want to present to you.We have got some folks who are inside of the Obama Administration who are just saying some absolutely atrocious things about Prime Minister Benjamin Netanyahu.We’ve got the Michael Brown case and the anonymous leaking stuff so we’ll be talking about that.As I’ve mentioned on this show before, we’re starting to see the repercussions of what happens in an economy when you make things cheap. You get a lot of people who want it and a lot of people who were providing it who don’t want to provide it anymore. Now we’ve got a report here that some doctors are wary of taking insurance exchange patients.The FCC Chair is looking to spur the online video future. It looks as though the FCC is going to help facilitate a way for consumers to cut the cord from the cable companies.And, Google, I noticed this out of the BBC, they are developing a cancer and heart attack detector. In addition, Royals taking command in game 6. It’s like a totally different team. We get back in our own turf and now we’re in very good position because in the last 7 times there has been a game 7 in the World Series, the home advantage team has won. When you go to foreign countries, prostitution is legal, it’s open, they have entire houses with big signs that say ‘come here’ for your paid tail. But this guy in Florida, man, I don’t even know where would you go in Kansas City. I can only imagine but it would be the most unsafe place in town. Not all corporations fall under this new law. Right now the bar is set at 50 employees or more. So if you run a company with 50 or more employees or if you work for a company that has more than 50 employees, you’re going to be affected.Under the new mandate, if a company does not offer health insurance and has at least one employee receiving a subsidy from the government then that company must pay a $2,000 fine per employee.Even if the company does offer health insurance, if they have an employee who can get a better deal with a subsidized insurance program, that company will also be taxed at $2,000 per employee (exempting the first30 employees).”EXCERPT: “But it doesn’t stop there. Even if the employer does offer health insurance, if one person who works for them opts for an alternative, subsidized health insurance, that company is still liable to for the penalty because the company did not provide “adequate” coverage. So they’re damned if they do and damned if they don’t.Now step back for a moment and let’s contemplate what the cost of providing coverage might be to those employers. Remember, by the IRS’s own filings they expect the cheapest plan to run $20,000 year. This is several multiples higher than the current cost for health insurance. Companies that now offer insurance will now be faced with a choice. Pay double or triple what they now pay per employee or simply suck it up and pay the penalty. Which one do you think most large companies will choose?If you work for a small company (less than 50 employees) and you happen to have health insurance now, do you think they are likely to continue to provide it when premiums double or triple? The answer is no. What you will see over the next several years is companies dropping their health insurance coverage and pushing people onto the exchanges.” What it all means for you, your children, and your grandchildren?EXCERPT: “The new law will have a very damaging effect on entry­ level workers. When I turned 16, I walked across the street from my house and got a job washing dishes at a Pizza Hut for $5 an hour. Over the course of the next several years I moved from one company to the next. There was a high degree of mobility and I had the opportunity to advance at a young age. In the summer I switched from working 20 hours a week to 40 or 50, depending on who I was working for and how badly I needed money. There was a massive amount of opportunity for a kid who was willing to work hard.I also gained a great deal of work experience. I had the chance to work in a variety of industries and even tried my hand at entrepreneurship by cutting grass with a friend in the summer. Entry ­level jobs were easy to come by and a poor kid like me learned a lot about the value of hard work. Had I decided to stay at the Pizza Hut, I could have easily worked my way up to a manager and even purchased my own franchises down the line. There was upward mobility, a chance to start at the bottom and retire rich.I think that kind of opportunity is over. With the passage of ObamaCare, companies like Pizza Hut, McDonald’s, Home Depot, and a host of other companies that offer a low barrier for entry and a chance to advance, will have to drastically change the way the hire and advance employees.”As is typical with progressives, they have the best of intentions but they're never measured on the outcomes, only on the intentions. They had an intention of healthcare for all as though you could just mandate that everybody receives a certain amount of a commodity and not affect the supply and demand of that commodity at all.And this is what you get. Now people who have subsidized health programs, they don't have coverage. In fact, they can't even find a doctor. What will happen over time is fewer and fewer future students are going to get into the medical field to become doctors.It's coming, it's here now. And the longer it's here, the more it reaches it's tentacles into every part of our lives.Support the show.
