How does the heart of a retired judge continue to impact the legal profession through alternative means? In this thought-provoking episode of The Heart of Law, join our perceptive host, Mirena Umizaj, as she welcomes the Honorable Judge Randa Trapp to explore her inspiring transition from the San Diego Superior Court to her new role as a neutral with Judicial Arbitration and Mediation Services (JAMS). Together, they discuss the importance of diversity in the legal sector and the transformative power of victim narratives in forging a more personalized path toward justice and healing. From the disciplined decks of the U.S. Navy to the esteemed bench of the San Diego County Superior Court, Judge Randa Trapp's career epitomizes a journey of resilience, dedication, and unparalleled service. As an alumna of San Jose State University and a respected veteran of the U.S. Navy, her formative experiences laid a robust foundation for her illustrious legal career. This relentless dedication propelled her into a prestigious role as an Adjunct Professor of Law at the University of San Diego School of Law, where she spent nearly two decades mentoring the future generation of legal professionals. Subsequently, her appointment to the San Diego County Superior Court by Governor Gray Davis in 2003 marked a significant milestone in her career, as she became the third-ever African American female judge to grace the bench of the third-largest court in the United States. Following her retirement in March 2021, Judge Randa Trapp continues to influence the legal landscape through her work with JAMS, the largest private provider of alternative dispute resolution (ADR) services worldwide. As the episode unfolds, Judge Randa Trapp takes a moment to reflect on her circuitous professional journey, emphasizing that her path to the legal sector was anything but linear. Starting her adult life in the tumultuous sixties without professional role models to guide her, she embarked on her undergraduate studies with aspirations of becoming a pharmacist. However, her career trajectory underwent a significant transformation when she paused her academic pursuits to serve in the Navy, an experience she acknowledges as pivotal in shaping her personal development and igniting her passion to effect positive change in the world. Motivated by this newfound purpose, she transitioned to studying political science and eventually made her way to Georgetown University Law Center. Embracing her journey's unique twists and turns, she often shares her story to inspire young individuals contemplating a future in law, emphasizing the importance of keeping an open mind because "the law is multifaceted." As the conversation deepens, Mirena probes into Judge Randa Trapp's tenure as a judge, leading her to reflect on this period as a defining highlight of her career. She fondly recalls the tradition of starting every jury trial with a flag ceremony to instill reverence and set the tone for the justice process that lay ahead. Shifting the discussion toward diversity within the legal sector, Mirena explores Judge Randa Trapp's commitment to promoting inclusivity within African American and broader minority communities. Judge Randa Trapp elaborates on her active engagement in these communities, emphasizing its significance in enabling young children of color to envision themselves in similar roles of influence, thereby nurturing their aspirations and dreams. Furthermore, she underscores the importance of establishing a judiciary diverse in gender, sexual orientation, and ethnicity to represent the community the court intends to serve authentically. As their conversation draws to a close, Mirena delves into Judge Randa Trapp's seamless transition to JAMS, where her unwavering commitment to justice takes on a new form in the complex field of mass torts. Through her role, she offers a unique platform for victims to share their stories, often for the first time, facilitating a healing process that transcends monetary compensation. Building on this foundation, Judge Randa Trapp further highlights the essential role of mass torts in securing justice for a multitude of aggrieved individuals. She emphasizes that it takes a "special kind of lawyer" to navigate this complex area, underscoring the importance of assembling the right team to ensure that each case receives the attention and advocacy it rightfully deserves. In this vein, Judge Randa Trapp's unwavering dedication to meaningful impact, underscores a deep commitment to justice and healing, cementing her as an indispensable figure in the legal community and the individuals she serves.

Once again, energy is at the forefront of a key election in California. As we've been reporting on KCBS, oil refineries in the state haven't seen profits this high in decades. Lately, Governor Gavin Newsom has been railing against these profits. He's now calling for a special session to debate a windfall tax against big oil to refund drivers for higher prices at the pump. It all comes amid challenges with the state's power grid, and just in time for a possible Public Safety Power Shutoff from PG&E this weekend in Northern California to prevent another devastating wildfire. For more, KCBS Radio news anchors Bret Burkhart and Patti Reising spoke to former California Governor Gray Davis, whose career was forever changed by energy issues in the state.

The Pandemic has either caused a crack-up in our politics or accelerated the crack-up that was well under way. And just when it looked like things were stabilizing, the politics of Covid have evolved along with the Delta variant. Ground zero for how this is playing out right now is California. California is home to approximately 40 million people and the 5th largest economy in the world. It's about to have an election on whether to re-call its incumbent governor, Gavin Newsom. How California voters have experienced government regulations — from lockdowns, mask mandates, school closings, and not to mention double-standards — shapes the political environment there. Is this a harbinger of what's to come to our national politics? To help us understand what's going on in California is the strategist who masterminded the last successful recall election. Mike Murphy was the chief strategist for Arnold Schwarzenegger's election in 2003, which was a re-call of then-Governor Gray Davis. Mike's campaign resumé goes well beyond California. His past clients include the successful gubernatorial campaigns of Mitt Romney in MA, Jeb Bush in FL, John Engler in Michigan and Tommy Thompson in Wisconsin. And that doesn't include all the Senate races he's worked on. Mike has also worked on campaigns in Europe and Canada. And he was the chief strategist on John McCain's maverick presidential primary campaign in 2000 and remained a close advisor to the late-Senator McCain for years. Today, you can catch Mike on the top-rated podcast, “Hacks on Tap” with David Axelrod and Robert Gibbs. He's a political analyst on MSNBC and NBC, and he co-authors a weekly newsletter with his latest political analysis: hacksontap.bulletin.com. At the University of Southern California, he is the Co-Director of the USC Center for the Political Future. This episode covers a lot of pandemic-related political trend analysis. But first, given the tragic news out of Afghanistan this past week, the episode begins with Mike's thoughts on President Biden and this crisis. Regardless of what one thinks of President Biden's policy in Afghanistan, a lot will depend on how our president performs in reassuring the American public and our allies abroad. This episode begins with a discussion on President Biden and Afghanistan and then the second half looks at political trends during the Delta phase of covid.

Twenty years ago, California went dark. Without enough electricity to power the state, rolling blackouts shut down businesses, PG&E filed for bankruptcy, the state's economy contracted and then-Governor Gray Davis' administration spiraled into crisis. Part of the blame rested with Enron Corporation, an energy company whose brokers created an artificial electricity shortage by taking power plants offline — thereby raising prices by 800% or more. Enron ultimately unravelled when whistleblowers revealed its books were cooked, but not before the company severely damaged energy markets. Two decades later, Forum asks what we've learned from that calamity— and whether our electricity supply is safe from market manipulation.

Democratic political strategist Garry South joins us to talk about the potential recall of Governor Gavin Newsom. South is uniquely positioned to weigh in on the subject: he headed Governor Gray Davis' 1998 and 2002 gubernatorial campaigns, and ran Gavin Newsom's first campaign for Governor back in 2009. South notes that the current recall effort will qualify for the ballot only because of the unique circumstances of 2020: the usual four-month signature-gathering period was extended - doubled, in fact - due to the pandemic, allowing organizers to meet the requisite 1,495,709 signatures. Also, since South correctly predicted that Alex Padilla would be Gov. Newsom's pick to replace Kamala Harris in the US Senate, we asked him who he thinks will be named Attorney General to replace Xavier Becerra. (Hint: it's not a certain big-city mayor.)

We cut to the chase with the question on everyone's mind: what happens to The Bash (AKA The Back to Session Bash) for 2021? The good news: it's on. The bad news: not til later. Quintana fills in all the details for this year's Bash, talks about the event's humble origins, and shares Lil John's drink of choice. We also discuss Quintana's new podcast, Politicalish, which mixes politics with his other interests, including true crime, MMA and Hip Hop. Quintana's passion for Hip Hop will come as no surprise to anyone who has attended The Bash, but we were surprised to hear that Assemblyman Kevin Mullin appeared on an episode of Politicalish specifically to discuss his Top 12 tracks. But, the podcast isn't all fun and games: the latest episode features reporter Jill Stewart discussing the 2003 Recall of Governor Gray Davis. Jill Stewart joins us as an expert in all twists, turns, and personalities she documented as a syndicated columnist. The overused phrase “perfect storm” here accurately describes the confluence of the late 90s dot com bubble burst, low voter turnout, an unpopular tax by an unpopular governor, and an energy crisis that led to only the 2nd recall of a governor in US history. And that’s where the real craziness began… with a field of 158 candidates including stand-ups, actors, porn stars, and personalities culminating in the election of bodybuilder, actor, and celebrity Arnold Schwarzenegger. Looking back Q and Jill have to decide: was it worth it?

More Key Moments in California School Funding History: A View From Inside the Capitol

Adventures in Ed Funding

How did California slide into such a deep school funding hole, and how can we climb our way back up? These are among the questions we take on in this latest adventure with special guest Gary Hart. As a former state legislator, longtime Senate Education Committee Chair, and Secretary of Education, Gary offers the critical perspective of someone who was “inside the Capitol building” during a truly pivotal time in the early life of Ed Funding. He began his career as a classroom teacher before serving two decades in the state legislature at a time (1974-1994) when so many key events in school funding unfolded. What led to the dramatic disinvestment in California’s schools, beginning in the 1970s? Rising real estate values, bad economic times and a major change in the state’s demographics all contributed, according to Gary. He also reflects on whether there’s anything he wishes he might’ve done differently while in office to help change the downward trajectory of per-student funding. And what about Proposition 98? Former Sen. Hart takes some exception to characterizations that legislators and governors “manipulated” the Prop. 98 constitutional guarantee for schools, causing it to become more of a “ceiling” than a “floor” for per-student funding. “Ballot box budgeting,” he says, “is not a good system.” We also explore the sometimes shifting borders between how prescriptive the state used to be in telling local school districts how to spend their funds, and the relatively recent move towards more local control. As our adventure continues, Gary takes on the mountain that California faces to increase school funding to the levels needed to support all students. A more stable state revenue system must be identified, he says, especially so the state is not so disproportionately reliant on income taxes. Finally, we consider whether, at the end of the day, increasing school funding comes down to whether or not those currently serving in Sacramento truly have the political will to take it on.More ResourcesFor a terrific history of California’s school funding slide, we recommend the 2004 documentary, “From First to Worst” a production of the Merrow Report by award-winning journalist John Merrow. In his role as chairman of the Senate Education Committee (1983 to 1994), he wrote important education legislation concerning school finance, class-size reduction, and charter schools. He also served as the Secretary of Education for Governor Gray Davis. In addition, he has served on the board of directors for the Public Policy Institute of California for more than ten years, including as chair. In 1995, he founded the California State University Institute for Education Reform, a policy center focusing on elementary and secondary school issues. Davis had been elected Governor the previous November, defeating Dan Lungren. His election ended a 16 year period during which Republicans controlled the Governor’s office. Davis was re-elected Governor in 2002, and nearly immediately, was targeted in a recall election that led to his removal from office. That October 2003 recall election installed Arnold Schwarzenegger as Governor. Among the issues discussed: the Bay Bridge retrofit. Ten years after the Loma Prieta earthquake, decisions still hadn’t been made about how to proceed. Davis also decried the ability of wealthy candidates to sidestep campaign-finance laws and self-fund their campaigns.

If we could get the first five years of life right, it would transform society: less crime, less violence, less poverty, more people having happy, productive lives. Lots of research backs that up. When young children suffer from poor health, neglect, missed learning opportunities, or trauma, they can pay for it for the rest of their lives. So do the rest of us. Many of our biggest social problems originate in troubled childhoods. So if the goal is to make the world better, improving life for the very young is one of the best things we can do. The people of California took a step in that direction in 1998 by passing Proposition 10. That created a state commission called First 5 and funded it with a tobacco tax. First 5 finds and supports effective early childhood programs. It also advocates on behalf of young children. The work gets done through 58 local First 5's, one in each California county. Spencer's guest is Gabriel Sanchez, the Director of Communications for the biggest one: First LA, covering Los Angeles County. Spencer first met Gabriel while both were doing communications work for the 2008 Obama for America campaign. As you’ll hear, Gabriel's experience includes politics, government, education, and now, trying to change the way we think about and invest in early childhood. Show Links First 5 LA First 5 California First 5 Parents' Site The Power of Moments, by Chip and Dan Heath (source of Gabriel's "trip over the truth" reference) "Myers study: Investing in children critical to nation’s economic, political future" "How to Say 'No' to a Toddler (Without Actually Saying No)" Gabriel Sanchez LinkedIn: www.linkedin.com/in/gabrielsanchez Southern California native Gabriel Sanchez is the Director of Communications at First 5 LA. As the principal communications and marketing strategist for the organization, Gabriel leads a department of 12 to spearhead communications, media, social marketing, public education, advertising, digital and social media, sponsorships and related activities for First 5 LA’s ongoing work to support young children and their parents across Los Angeles County. Gabriel came to First 5 LA from Green Dot Public Schools, where he was the communications director. Previously, he was a senior strategist with The Strategy Group in Pasadena and an independent communications consultant in Orange County, serving a range of corporate, labor and political clients. He also has served in top communications roles in the offices of then-Governor Gray Davis and then-Assembly Speaker Fabian Núñez. During the 2008 presidential campaign, he was the California Communications Director for Obama for America. Gabriel is a graduate of California State University Fullerton with a bachelor’s degree in political science and Chicano studies. He is in the process of completing a master’s degree in political science from Suffolk University in Boston, MA. He also is a graduate of the MALDEF Leadership Development Program, and Cal State Fullerton’s Leadership Institute. A Letter from Gabriel to His First 5 LA Communications Staff I was thinking deeply about the “why” of what we do. We point to facts and figures on brain development. We talk about outcome areas. Yes, it’s about kids. Yet I feel we aren’t connecting with audiences. Then I thought about how parents are the focus of our work. What do parents do when they become parents? They re-order and re-prioritize their lives. Parents sacrifice. Parents go without. No more going out to eat, weekend getaways or fancy sportcars (if you could afford that earlier). Sleep is a like a long-lost friend you hope to see again someday. Why? Why endure all of that? Because parents want that little human to be the best they can possibly be. We speak that truth in the tagline below our current logo, but I offer to you we haven’t embraced it fully. Aside from some tax credits, there isn’t any new revenue that comes in when you have a child. Your spending on baby furniture, food and clothing skyrocket. And your household income may dip if one parent chooses or has to stay home with baby. We offer tips, ideas and resources to parents to help with these priorities. We don’t ask parents to “make a greater investment in early childhood development.” Maybe we shouldn’t ask decision makers and lawmakers either. Rather, we should ask them to “think like a parent” and prioritize policies accordingly. We can bridge our parenting and community audiences with decision makers by messaging a “parenting approach to policies.” Parents – that, is constituents - sacrifice and re-prioritize to give their kids the best start. We should ask lawmakers to do the same, across all policies. We should be asking decision makers and lawmakers to re-order their priorities, not make new investments, as if they too were parents and had to sacrifice for their kids. The Mercury News last week and the NYT’s California Today newsletter capture examples of decision makers taking a parenting approach to law making. In this case, it’s because they became parents themselves and “tripped over the truth.” (h/t Dan and Chip Heath, the authors  “The Power of Moments,” who say, “the way to get an idea to stick is to have someone experience it.”) I can share my own example. I would have never lobbied my friend, then-Assembly Member Ricardo Lara, on diaper changing tables in mens’ restrooms unless I had experienced, first-hand, the frustration of needing to change my daughter’s diaper in stores that sold diapers and baby food. I’m not sure how this can fit into the message platform development, but I wanted to share the idea. Gabriel

On this episode of the Healthy Wealthy and Smart Podcast, I had the pleasure of welcoming Cynthia Toussaint onto the show to discuss her experiences as a patient managing Complex Regional Pain Syndrome. Cynthia Toussaint is the founder and spokesperson of For Grace, an organization that promotes better care and wellness for women in pain. Toussaint championed and gave key testimony at two California Senate hearings – one was dedicated to CRPS awareness, the second explored the chronic under-treatment of and gender bias toward women in pain. She will lead a 2017 conference that will convene healthcare and policy leaders to bring pain care into the 21st century. The solutions proposed at the event will mandate structural changes that respond to patient needs and gender inequalities in California. Toussaint is the author of Battle for Grace: A Memoir of Pain, Redemption and Impossible Love. In this episode, we discuss: -The story behind Cynthia’s long battle with Complex Regional Pain Syndrome -How Cynthia developed independent survival solutions when medical providers would no longer help -Why gratitude, acceptance and grieving are necessary components for the management of chronic pain -For Grace: better care and wellness for women in pain -And so much more!   Cynthia’s long history of battling unimaginable physical and psychological pain has taught her how to be resilient. She believes, “We don’t know what we can live with until we are there.”   Cynthia has used her past experiences as inspiration for her advocacy and has created meaningful change for CRPS patients. Based on her experience, she stresses, “Don’t ever let anybody say you can’t get something done.”   Cynthia has found that adversity can breed strength and that, “People who go through the impossible odds survive and they go on to make the world a better place.”   After exhausting her family support system and the recommendations of her medical providers were unable to help with her chronic pain, Cynthia found her greatest relief through her own strength and will. She states, “With high impact chronic pain, we have to refuse to be a victim. We have to be our own advocates. We have to be deeply involved with self management.”   For more information on Cynthia: Cynthia Toussaint serves as Spokesperson at For Grace and has had Complex Regional Pain Syndrome for 34 years. She later developed Fibromylagia and other over-lapping, auto-immune conditions. Cynthia founded For Grace in 2002 to raise awareness about CRPS and five years later expanded the organization’s mission to include all women in pain. Before becoming ill, she was an accomplished ballerina and worked professionally as a dancer, actor and singer.   Since 1997, she has been a leading advocate for women in pain, raising awareness through local, national and worldwide media as well as public speaking. Toussaint championed and gave key testimony at two California Senate informational hearings. The first, in May 2001, was dedicated to CRPS awareness. The second took place in February 2004 and explored the chronic under treatment of and gender bias toward women in pain. Both of these efforts were the first of their kind in the nation.   In 2006, Toussaint ran for the California State Assembly to bring attention to her CRPS Education Bill that Governor Schwarzenegger vetoed after she got it to his desk in its first year. Her next bill, a seven year effort, was signed into law by Governor Jerry Brown in 2015. This Step Therapy legislation reformed an unethical prescription practice used by the health insurance industry to save money in a way that increased the suffering of California pain patients.   Toussaint was the first CRPS sufferer to be featured in the New York Times, Los Angeles Times and on the Public Broadcasting System and National Public Radio. She is a consultant for The Discovery Channel, ABC News, FOX News, the National Pain Report and PainPathways, the official magazine of the World Institute of Pain. Also, she is a guide and guest contributor for Maria Shriver’s Architects of Change website.   Her many speaking engagements include the National Institutes of Health and Capitol Hill.   She is the author of Battle for Grace: A Memoir of Pain, Redemption and Impossible Love. Also, Toussaint is experiencing her first-ever partial CRPS remission largely due to the narrative therapy of writing this book.   Toussaint continues to be a leading advocate for health care reform in California. She was instrumental in changing public opinion which sparked sweeping HMO reform legislation that was signed by Governor Gray Davis in 1999. Her focus has now shifted to creating a single-payer, universal health care plan in California that would provide a model for the rest of the country.   Resources discussed on this show: Battle for Grace: A Memoir of Pain, Redemption and Impossible Love For Grace: Women in Pain Facebook Cynthia Toussaint Twitter For Grace Website   Thanks for listening and subscribing to the podcast!
