Keir Starmer has performed a screeching about-turn on his flagship welfare reforms, all in the hope of quelling the rebellion from more than 120 MPs who have been promised ‘massive concessions' over concerns about disability benefits.These include moderating the bill to make it easier for people with multiple impairments to claim disability benefits, and offering to protect Personal Independence Payments (PIP) for all existing claimants for ever – to ensure there would be no detriment from the reforms for existing claimants, a key concern of the welfare rebels. But new claimants will be affected, as ministers desperately try to stop ever-spiralling disability and sickness welfare spending climbing to £100 billion by 2030. It means another big U-turn for Starmer – and another hole in the Treasury's finances. Early estimates suggest that the welfare bill climbdown could cost £2 billion: money which Rachel Reeves will now have to find elsewhere. Can Starmer recover? Host Tom Godar welcomes back to the show Husch Blackwell attorney Mary-Ann Czak for the second installment of a two-part discussion on a recently published memorandum from William Cowen, Acting General Counsel of the National Labor Relations Board (NLRB). The memo sets forth guidelines for NLRB regions to use in approaching settlement agreements that urge NLRB personnel to “focus on pursuing foreseeable harms that are clearly caused by the unfair labor practice.” In Part I of our show, Tom and Mary-Ann explore how the memo could lead to a reduction of the board's pursuit of expansive make-whole remedies that had created significant dissatisfaction among management-side counsel.In Part II, Tom and Mary-Ann discuss the possibility of seeing more non-admission clauses as part of settlement agreements under the current NLRB. The use of these clauses saw a sharp decline during the Biden administration as a matter of board policy; however, the Cowen memo seemingly rolls back this approach, providing the regions with ample latitude to incorporate non-admission clauses as they see fit.Tom and Mary-Ann then consider the issue of non-admission clauses from a more holistic standpoint vis-à-vis the Cowen memo. The memo sets forth guidelines for NLRB regions to use in approaching settlement agreements that urge NLRB personnel to “focus on pursuing foreseeable harms that are clearly caused by the unfair labor practice.” In Part I of our show, Tom and Mary-Ann explore how the memo could lead to a reduction of the board's pursuit of expansive make-whole remedies that had created significant dissatisfaction among management-side counsel. As Mary-Ann explains, the NLRB's aggressive posture on remedies was the product of a 2021 memorandum that directed board prosecutors to expanded remedies in settlement agreements, including consequential damages and employer letters of apology, among other items. In 2021, the board had a 100% settlement rate; by 2024, it had dropped to 96.3%. Some companies regarded the 2021 memorandum as punitive and have been willing to litigate rather than submit to what they regarded as an unfair settlement process that had created labor-management discord, extended the timeline for resolving cases, and driven up costs for both the government and litigants. After sustained speculation and a local elections drubbing, Keir Starmer announced today at PMQs that the government will be softening their policy on winter fuel. Whilst it won't come into effect for some time, they have agreed to ensure that ‘more pensioners are eligible for winter fuel payment.'  This comes hours after a memo was mysteriously leaked to the Telegraph. It contains an extensive list of recommendations from Deputy Prime Minister Angela Rayner to the Treasury, including a set of eight tax rises such as reinstating the pensions lifetime allowance and altering dividend taxes. This amounts to a direct challenge to Rachel Reeves's fiscal approach and preference for spending cuts. The bigger story, of course, is what this says about feelings within Labour – it's clearly not a happy family. Sources suggest that Angela Rayner is uneasy with the direction of travel in the Treasury and speaks for a silent majority in the Labour party who are fed up with defending controversial measures such as winter fuel. So who leaked this memo? Could Rayner be leading a mutiny? And will the U-turn on winter fuel placate the rebels?  Oscar Edmondson speaks to James Heale and Isabel Hardman.
