Is anybody really safe? You see the storyline in every form of entertainment, "Arrested for a crime they didn't commit", but what if it wasn't just a storyline? For Damien Echols, Jason Baldwin, and Jessie Misskelley it's the story of their lives. The West Memphis Three, as they have come to be known, were convicted of the murders of three 8-year-old boys who were killed on May 5th, 1993. Christopher Byers, Michael Moore, and Stevie Branch were found in a creek the next day, and one thing was on everyone's minds. Satanic Panic. Beliefs of the boys being sacrificed to Satan led investigators to accused Satanist, Damien Echols. The only problem was Damien wasn't a Satanist. That didn't stop the Arkansas justice system from sentencing him to death, Jason to Life imprisonment, and Jessie to Life+ for a crime they didn't commit. Slam the Gavel welcomes Gina Dobson to the podcast. Gina Dobson is an actor, a writer and a producer. It wasn't until her two children reached adulthood that she also revealed herself as a wrongly accused felon. In 1998, carrying only her one year-old son and a piggy bank of change, Gina fled to another state from years of life-threatening abuse. Two weeks later after her escape, Gina was arrested for murder. Her ex-boyfriend had filed a false report, claiming that the miscarriage Gina had FIVE YEARS EARLIER was actually murder. Gina spent months behind bars suffering HUMAN RIGHTS VIOLATIONS for the sake of protecting her child. This financially and emotionally drained her very supportive family members. In the end, Gina accepted a plea bargain for a lesser felony charge that would guarantee her freedom. After years of feeling broken by the abuse and the criminal record of "Concealment of Homicide without a Body," Gina now spreads the message of female empowerment and joyful healing through interviews and PSA's that increase awareness domestic violence and promote supportive resources for victims. We also discussed the "Alford Plea" (North Carolina v. Alford, 1970), also called a Kennedy plea. In the film industry, she seeks out unconventional female roles that go agains the patriarchal norm. Gina also co-founded "BAB on 3" which can be found on YouTube. It is a female-driven film production company that embraces authenticity, encourages under-represented people in filmmaking, and delivers the message that women need support from other women. To Reach Gina Dobson: https://ginadobson.com/******** Supportshow(https://www.buymeacoffee.com/maryannpetri)Maryann Petri: dismantlingfamilycourtcorruption.comhttps://www.tiktok.com/@maryannpetriFacebook: https://www.youtube.com/@slamthegavelpodcasthostmar5536Instagram: https://www.instagram.com/guitarpeace/Pinterest: Slam The Gavel Podcast/@guitarpeaceLinkedIn: https://www.linkedin.com/in/maryann-petri-62a46b1ab/ YouTube: https://www.youtube.com/@slamthegavelpodcasthostmar5536 Twitter https://x.com/PetriMaryann*DISCLAIMER* The use of this information is at the viewer/user's own risk. In 1995, a tragic fire in Pittsburgh set off a decades-long investigation that sent Greg Brown Jr. to prison. The Alford Plea lies somewhere between a criminal defendant claim of innocent and guilty. A strange area of our justice system that can leave those questioning the validity and need for such a plea. The case of Taylor Behl is one such case where the the defendant took an Alford Plea. In this case we have a missing 17 year old college freshman, surveillance cameras, the last person seeing her alive having a strange and violent background, and the question was justice truly served in this case? Today on Midday, we begin our series of Conversations with the Candidates. Over the next few months, we plan to speak with the major candidates in the Democratic primaries for Baltimore Mayor and City Council President, congressional candidates in the 3rd and 6th Districts, and candidates running for the U.S. Senate. Former Baltimore mayor Sheila Dixon joins us to discuss her campaign to return to city hall. She is a familiar political figure whose service in city government began nearly 40 years ago. A Democrat, she represented the 4th District on the City Council for 12 years beginning in 1987. She later served as the President of the City Council from 1999 until 2007, and then became Mayor in January of that year when Martin O'Malley was elected governor. After reelection to that position, her term was cut short when she resigned in early 2010 as part of an Alford Plea in a perjury case. Currently, she works with the MD Minority Contractor's Association.Email us at midday@wypr.org, tweet us: @MiddayWYPR, or call us at 410-662-8780.
This week's episode is eerily like last week's, and we didn't plan it at all. Today Zoey is going to hold your hand, whisper assuring words, and give you the treat of a bad joke every now and then as we navigate a complex legal decision together. Don't be afraid, Zoey's here to guide you. They won't let you get lost.Okay, maybe we're exaggerating. But the Alford Plea is a concept where a defendant pleads guilty to a lesser crime while maintaining their innocence in effort to get a lighter sentence. The Alford plea was born when Henry Alford, a Black man in North Carolina during the Civil Rights Era, was accused of killing a man. While there wasn't any physical evidence stacked against him, there were witnesses who were ready to testify that he argued with the other man, walked towards that man's house with a gun, and confessed to a friend he did it.Henry was convinced that he would be found guilty by the all white jury that would no doubtedly be placed before him, so his not-so-experienced Lawyer convinced him to plead guilty to avoid the death sentence. Henry agreed, but refused to admit guilt on the stand. He was sentenced to 30 years in prison, and used many in the appeal process to get the world to understand he wouldn't have plead guilty if he hadn't been afraid of the death sentence. Henry's case made it all the way to the Supreme Court, and now the concept of pleading guilty while maintaining your innocence is known as an Alford Plea. But first, Robin brings her Something Something and Zoey and Robin do a Buzzfeed Quiz to find out what horror movie genre they are.Sources: https://hauntedhospitality.wordpress.com/2023/09/12/ep-128-to-plea-or-not-to-plea-the-origin-and-history-of-the-alford-plea/Visit us on Social Media! Stephanie Spurgeon was a married mother of two who had been running a daycare facility from her home for 15 years. On August 21, 2008, Stephanie took care of 1 year old Maria Harris for the first time. Maria's grandmother picked her up that day, but soon noticed Maria was unresponsive. After 8 days in the hospital, Maria passed away. Because Stephanie was the last supervisor of the child, she was accused of murder and convicted of manslaughter based on the prosecution's argument of Abusive Head Trauma. After 9 years in the Florida prison system, numerous Innocence Projects helped Stephanie assert her innocence, and in 2021, she accepted an Alford Plea and was finally freed. In this updated episode, Jason Flom catches up with Stephanie to discuss the great advocacy work she is doing today to pay it forward to others who are wrongfully convicted. May 5th, 1993 was a tragic day for so many people in West Memphis Arkansas as three eight-year-old boys (Stevie Branch, Christopher Byers, and Michael Moore) went missing . By the next morning, instead of panic, the town felt palpable fear with the discover that the young second-graders had been brutally and senselessly murdered. By 1994, three local teens were in prison, convicted of the murders; but the story hasn't ended there. This is part 2 of our series in which we examine the trials and convictions as well as explore various theories concerning who might be the perpetrator(s). “Taking the Alford Plea hurt my soul more than being found guilty in 1994 did," shares Jason Baldwin, a man who is so much more than a member of the West Memphis 3. “When they forced me to take the Alford Plea something in me broke…” The presumption of innocence and guilt beyond a reasonable doubt is seemingly reserved for a select few. For many flowing through the US system of [in]justice particularly children like 16-year-old Jason Baldwin and 16-year-old Brendan Dassey, the presumption of innocence is nothing more than a fallacy, a notion of intent not delivered. Contending with forces that conspire to convict, targeted by unmerciful prosecutors and defended by bad state actors - the truth of their innocence becomes a casualty of chaos. Jason Baldwin joins me on the Sixth Hour to discuss his life pre and post-the-lived and survived experience of his wrongful conviction, Brendan Dassey, and his role as co-founder of innocence org Proclaim Justice. Music reproduced with permission. Song: Bad Man Artist: Sarah and the Underground Writer: Sarah Marie Dillard “One of the first songs written after 'Making a Murderer' was released, 'Bad Man' by Sarah & The Underground is an unofficial anthem of the fight to free Brendan Dassey." - Steven Drizin, Legal Defense for Brendan Dassey

This week, in Easton, Maryland, a prominent person is killed in their own kitchen, in a most brutal manner, leaving investigators scrambling, and the FBI preparing a profile of the killer(s). What follows can only be described as "insane". Suspects, coming & going, family members turning against each other, threats, and years of legal wrangling. An absolute mess, with an equally messy ending! Along the way, we find out that fowl calling is an international sport, that DNA should probably be introduced at trial, not after the trial, and that there just aren't answers to every question!! Katherine Mader spent two decades as a judge in Los Angeles Criminal Court, before retiring early in 2020. Before that she was the LAPD's first Inspector General, prosecuted two murder-for-hire trials and served as a defense attorney who convinced a jury to spare the life of the Hillside Strangler. In August of this year, Judge Mader published Inside the Robe: A Judge's Candid Tale of Criminal Justice in America, which best selling author Michael Connelly called: “a perfect book: engrossing and telling at the same time.” The Judge has granted Crime Story permission to excerpt the entirety of her book over the coming months. You can find previous installments of Inside the Robe here. This is Part 34.

This week, in Moses Lake, Washington, the dynamic in a group of young friends becomes very weird, when everyone decides to live in a one room apartment together. The problem is, some are runaways, one is pregnant, some are just plain dumb, and one claims to be a 19 year old Mafia hitman & high Satanic priest, named "Shadowlord". This all leads to a disturbingly brutal crime & even more inept cover up! Along the way, we find out that not all of Washington state is rainy, that teenagers can flip their whole image on a dime, and that you shouldn't have 10th graders help you cover up a murder!! Alex speaks to Jason Baldwin — one of the West Memphis Three — about the 18 years he spent in a maximum security prison, convicted for a murder he didn't commit. He was only released in 2011 when he and his co-defendants agreed to take an Alford Plea — a guilty plea in which they could proclaim their innocence, but admit the prosecution had enough evidence to prove their guilt. It was a decision that would profoundly impact what 'freedom' meant for Jason to this day. www.GoodMorningGwinnett.comSuwanee attorney Christa Kirk announced this past week that she will run for the Gwinnett Superior Court seat currently held by Judge Kathryn Schrader who is currently barred by a state committee from presiding over cases after she and three other people were indicted earlier this year on computer trespassing charges.Schrader’s seat is up for election next year and Kirk, who founded the Kirk Law Firm P.C. is the only person who has announced plans to run for it so far. Schrader has been under fire since it was revealed that she had hired private investigator T.J. Ward, who in turn brought in a man named Frank Karic and DragonCon founder Ed Kramer, because she believed Gwinnett District Attorney Danny Porter was hacking her computer. In October, the Georgia Judicial Qualifying Commission suspended Schrader in light of the indictment. The case has generated headline, not only because a judge has been indicted, but also because Kramer took an Alford Plea in 2013 on child molestation charges.SOURCE: www.gwinnettdailypost.com

S7E5: Damien Echols Survived Death Row and Now He Is Sharing the Spiritual Practices that Saved His Life with the World As a teenager, Damien Echols along with Jason Baldwin and Jessie Misskelley—known as the West Memphis Three—was convicted in 1994 of killing three 8-year-old boys in West Memphis, AK. There was no DNA linking the WM3 to the crime, and some of the DNA found at the crime scene even seemed to implicate the stepfather of one of the victims. The case gained national attention soon after the teenagers’ arrests when word was leaked that the murders were committed as part of a satanic ritual. A key prosecution witness in the second trial was a self-proclaimed cult expert who stated that the murders bore “trappings” of the occult. This testimony, combined with testimony about books Damien Echols read and some of his writings, plus evidence that he and Jason Baldwin liked heavy-metal music and several black t-shirts were found in Jason Baldwin’s closet, helped to convict the two teenagers. Damien Echols was sentenced to death; Jason Baldwin was sentenced to life without parole, and Misskelley was sentenced to 40 years. Following a 2010 decision by the Arkansas Supreme Court regarding newly produced DNA evidence and potential juror misconduct, the West Memphis Three negotiated a plea bargain with prosecutors. After serving more than 18 years in prison, all three of the WM3 took the Alford Plea, which meant that the state of Arkansas admitted no wrongdoing. While in prison, Damien was ordained into the Rinzai Zen Buddhist tradition. Today he teaches classes on Magick around the country and works as a visual artist. He and wife Lorri live in New York City with their three cats. He is the author of High Magick: A Guide to the Spiritual Practices That Saved My Life on Death Rowand the *New York Times *bestseller Life After Death and Yours For Eternity(with his wife Lorri Davis). S7E4: Noura Jackson: Wrongfully Convicted of Murdering Her Mother After Prosecutors Withheld Evidence of Her Innocence Noura Jackson was egregiously framed and wrongfully convicted of murdering her mother, Jennifer Jackson, in Memphis, TN in 2005. Amazingly, she spent over three years in jail awaiting trial before being sentenced to 20 years and nine months in prison. No physical evidence linked Noura to the murder, and DNA testing not only excluded her as a suspect, but it also suggested that two or three different people were present at the crime scene. The Supreme Court of Tennessee overturned her conviction unanimously in 2014, and in their 5-0 decision, they made strong statements about the misconduct that took place during her trial. The prosecutors threatened to retry Noura, and she was faced with little choice but to accept an Alford Plea in 2015. Noura Jackson was then sent back to prison for 15 months before she was finally released in 2016, after serving 11 years in prison. She is joined by one of her lawyers, Bryce Benjet, Senior Staff Attorney at the Innocence Project, in this episode. www.wrongfulconvictionpodcast.com Wrongful Conviction with Jason Flom is a production of Lava For Good™ Podcasts in association with Signal Co. In this week's episode of Watch.Read.Listen., we continue our discussion with Shoe on the effect of media on the criminal justice system. We compare The Jinx and Making a Murderer, how class affects justice, the effect of coercion on finding the truth, and the sad irony of pleading guilty but not guilty (i.e. the Alford Plea). In the end, we wrestle with the question "Does any of this matter, or is it just entertainment?" and maybe come up with an answer. In the This Week segment: Shoe: Unbreakable Kimmy Schmidt, The Lizzie Borden Chronicles, Better Call Saul, How to Get Away With Murder, Weezer, and My Chemical Romance. Duane: The Game of Owns Podcast, Radio Free Tatooine Podcast, Neil Gaiman's interview with Michael Chabon, and The Shaping of Middle-earth seminar from Mythgard Academy David: Better Call Saul, The Final Girls (movie), The Gift (movie), Southbound (anthology horror film), and the Orbit Magazine anthology by Rob St. Mary. Next month (March) will be Creator's Month, in which we explore the works of some of our favorite creators, starting with director, animator, and Python Terry Gilliam.
Anthony Murray was wrongfully convicted of first-degree murder in Illinois in 1998. In 2012, the Illinois Innocence Project presented new evidence that won him a third trial. In a surprise move, the county prosecutor approached Anthony with the “Alford Plea.” This shift presented Anthony with difficult choices. Join Anthony Murray and Larry Golden, Professor Emeritus of University of Illinois and founder and pro bono director of the Downstate Innocence Project to hear of Anthony's 16-year-journey.
Tina Resch achieved some fame during what the media called the Columbus Poltergeist case. In 1984 a series of unexplained events of alleged spontaneous telekinesis at her home were covered extensively by news media. The coverage included a series of color photographs that were taken by newspaper photojournalist Fred Shannon of The Columbus Dispatch of Columbus, Ohio, USA, which showed her sitting in an armchair with a telephone handset and flexible cable in flight in front of her from left to right. Now Christina Resch Boyer spends her days in the women's prison in Georgia. Accused of killing her 3 year old daughter and facing the death penalty, Tina took her lawyer's advice and entered an “Alford Plea”—meaning she accepted the sentence without admitting any guilt. Her court appointed lawyer never presented evidence that she wasn't even there when the child died. Researcher and friend of Christina's, Robin Bellamy, will discuss both the findings in the poltergeist case and ways to help Christina get help with her unjust imprisonment.
