Send us a textOne of the two founders of the Foundation for Individual Rights in Education -- Harvey Silverglate -- figured the group might no last much past ten years beyond its 1999 founding. Instead, Silverglate, describes the group -- renamed Foundation for Individual Rights and Expression  -- as having filled the gap that was left when the ACLU became more of a progressive organization and less of a free expression protector. Fairfax criminal and DUI defense lawyer Jonathan Katz first met criminal defense and civil liberties lawyer Harvey Silverglate over twenty years ago through their mutual membership in the Naitonal Association of Criminal Defense Lawyers. He met First Amendment lawyer Robert Corn-Revere -- now FIRE's chief counsel -- through their mutual membership in the First Amendment Lawyers Association, of which Bob is a past president. Both Bob and Harvey are CATO Institute scholars. Jon Katz has advised a conservative student referred by FIRE, in his campus disciplinary proceeding when his private university trampled on his right to videotape a campus speaker and university-paid public figure when no advance warning had been made against such recording activity. Jon was also referred by FIRE to advise a state university professor whose First Amendment rights were violated by being suspended from his job due to an uproar by numerous alumni and members of the public after he appeared as an unwitting hotseat guest of the O'Reilly Factor (on which show Jon has twice appeared, and also has appeared twice on the Radio Factor.) Worse, the federal government zeroed in on this professor, and dragged him through a six month trial (which Jon did not handle) that resulted in acquittal on numerous counts and a hung jury (10-2) on some additional counts.What becomes readily apparent in this Beat the Prosecution episode is that staying true to our principles helps criminal defense and civil liberties lawyers win in court. Harvey tells of the jury nullification that delivered him acquittals of around 30 people prosecuted for trespassing in the carrying away from the office of a Harvard dean in his chair, in protest over the Vietnam war, with the prosecutor then declining to prosecute the approximately 70 additional defendants. Bob tells about winning in the Supreme Court against a prosecution under a statute criminalizing the filming of dogfighting and other animal cruelty ("crush films"). He worked at Youth Specialties for 34 years. Most of those years he spent leading the National Youth Workers Convention, which he loved and poured his heart and soul into.  Speaking of soul, Tic also had a killer soul patch. Yes!  You are in!  Thanks for making it in.  You ready for some reflection?  You called?  You sure?  This is Tom back at ya...aka...TommyP.  As you heard in the last episode, things went dry for me.  It happens.  It's part of the test.  There will be times when things go dry for you too.  What happened to the flow?  Pause, pray and reflect is what you need to know.  So I prayed, and then Casey stepped up.  And now Bob Shank comes at me and you get this nugget of wisdom, here you go...Are you called?  Are you sure?  Many of you don't know.  So thank you for tuning in.  For those not sure, you are here for a reason.  You're listening to this right now for a reason.  You have a purpose.  Don't let the enemy or others tell you different.  How do I know you have a purpose, check Jer 29:11.  Yet it is your job to ask.  To pray.  To tune in.  How often do you do that?  It should be daily.  Every day, you ask God.  Every day you check in.  Often are flawed human minds complicate things.  So we need teachers and mentors that can speak common sense into our lives.  The Bible is full of them.  There's a reason it's the top published book in the world.  Start in Proverbs.  Amazing wisdom in that book.  My favorite teacher is Jesus.  Simply to Matt, Mark, Luke and John.  Or if you are visual, I really like the Chosen series. Then you find mentors and teachers that are good with sharing above.  I like podcasts like Daily Hope, Unashamed, Dr. Bryan Lorrits, Southwest Church with Ricky Jenkins, Noe Garcia with NPHX, Tim Keller, Francis Chan the list goes on.What about my calling?  Oh yeah.  Here's another mentor of mine.  Bob Shank.  He founded something called The Master's Program.  I studied under him for 3 years.  Bob was mentored by Bob Buford the author of the best selling book Half Time.  Both Bob's were mentored by Peter Drucker, the leadership and business legend.  Who is quoted in just about every business school in the world.  Serious wisdom.  So here's a nugget for you shared by Bob...

After working together for 25 years, cinematographer Robert Yeoman, ASC and director Wes Anderson share a similar aesthetic and creative process. Bob finds he can anticipate what Anderson wants to see and exactly how he wants to shoot things. The trademark of a Wes Anderson movie is a sense of humor and whimsy, and each film has a distinct color palette that deliberately tells a story. Both Bob and Anderson love the symmetrical style of Kubrick movies, but the symmetry in the frame of Anderson's films draw on comic elements rather than those of horror. Anderson is involved in all the decisions on art direction, choices of textures, colors, costume, hair and makeup, testing many of his choices on film before making a decision. During their very long prep period, Anderson will make an animatic of the entire movie before the shoot, and try to match the reality to the animatic as much as possible. Bob finds this incredibly helpful, since Anderson's movies are very complex- many shots are oners and use complicated dolly movies. In the movie The French Dispatch, Bob and Anderson had planned on shooting at least one section in black and white. They fell in love with the black and white stock, so Bob ended up shooting a lot more than they had originally planned. Anderson also decided to mix three aspect ratios in the film to delineate different time periods and different stories, which Bob thought wouldn't work very well, but ended up liking the end result. On every movie he makes, Anderson has a library of DVDs, photo books and research books that are available for the cast and crew to borrow. Naturally, for The French Dispatch, French movies were often referenced. It made it easy for Bob to have a shorthand way to communicate with Anderson on which French film they were emulating for framing, lighting and aspect ratio. The 1989 film, Drugstore Cowboy, directed by Gus Van Sant, helped Bob make his name as a cinematographer. He used a much looser style, with the camera reacting to the actors rather than carefully planned out movements such as those favored by Wes Anderson. Bob found it a pleasure working with Van Sant, who is more of an experimental filmmaker, and from the moment he read the script for Drugstore Cowboy, he loved it. Bob's work on the comedies Bridesmaids, Ghostbusters (2016), and Get Him to the Greek also presented him with a different challenge- everything is cross shot with multiple cameras because so much of those movies are improvised. On both Bridesmaids and Ghostbusters, director Paul Feig's style is to allow the actors freedom to do what they like, and as the cinematographer, Bob let them have the space and simply moved with them, lighting in a more generalized way. The French Dispatch opens in theaters on October 22. Bob is a distinguished journalist and the author of many books, including The Moral Animal, Nonzero, and Why Buddhism is True. He also happens to be the co-founder of Bloggingheads, the platform on which The Glenn Show was born and has flourished. In our conversation, Bob walks us through the early days of Bloggingheads and the flash of inspiration that led him to create the site. We then move on to discuss Bob’s ideas about evolution and international relations, and how they’re influenced by game theory (something I know a bit about). Bob’s ideas about the nature of conflict and cooperation have a number of implications for combating the sort of nasty political tribalism that we see so much today, both domestically and internationally. Episode 11 was recorded just an hour and a half after Bob was discharged from the hospital because of COVID difficulties. This emotional and very transparent episode tells of Bob and Kelly's lessons during their ordeal with COVID. They share how they learned once again who they saw God through the fire as they experienced another "Even If Moment". Bob shares his thoughts from a sermon he listened to in the hospital, which was preached by their pastor, Scott Wakefield (First Christian Church). The text that was used in the sermon was Lamentations 3:16-24. Both Bob and Kelly also share songs that helped them through their COVID fire ("Praise You in the Storm, by Casting Crowns; "Bring the Rain" by Mercy Me). In particular, we discuss the journey of writing their well-known book Dynamic Physical Education for Elementary School Children (now in its 19th edition) and how they constantly strive to refine and improve each edition of the book. We also dive into a discussion about what quality physical education is and what it is not. Both Bob and Aaron remain highly committed to open dialogue about best practice and share not only what excites them about the profession in this episode but also what their biggest concerns are. We also share our thoughts about the role of social media in professional growth, but also how social media can stand in the way of getting better and constantly growing as educators. If I have one regret during my college education is that I never worked on a construction site. Once I graduated from college, I went straight to work in an architectural office, drawing up all sorts of stuff that I had literally never seen before in my life. I managed to get along but I was acutely aware of my lack of practical knowledge and I have been trying to make up for it over the last 20+ years. [Note: If you are reading this via email, click here to access the on-site audio player]  [hoops name="top1"] We'd like to thank today's guest, Nicholas Renard, the owner, architect and registered residential contractor of Dig-Architecture, an architect-led design-build firm in Jacksonville, Florida. We recorded today's episode live in Las Vegas from the Expo floor of the 2019 AIA Conference on Architecture as special guests of Huber Engineered Woods.  a small portion of Bob's tool collection My practical experience, and I suppose formal construction education, really didn't start until I bought my first house and didn't have the money to pay someone else to do the work. My wife had a job that required an extensive amount of traveling and since I am not a “go out to the bar” kind of dude (despite what others might think) I would stay home in the evenings and work on projects around the house. It was during this time that I started building up my tool collection. Did either of you work construction when you were in architecture school? [2:30 mark] Both Bob and Nick worked on projects with their father around the house and this gave them their initial exposure to the basics of the construction process. They spent time either watching or helping their fathers around the house as they took on projects of various scales. But of the three, Andrew is the only one who has ever actually worked in the construction industry during their architectural education.  Andrew worked in construction during the summers as a high school student. Then, while in grad school, he worked in a cabinetry shop construction custom cabinetry in a small shop in Oregon. Apparently, the common thread among the three of us is having built a deck in our backyards at some point in our lives. How do you think working in construction would benefit an architect? [10:17 mark] The translation from the drawing environment to the built environment typically takes time for a new professional in architecture. The knowledge of the process of construction, the tolerances involved, the order of operations and other physical activities all have an impact on the design and final product. So being able to understand all of these aspects of the downstream portions of your design is very beneficial and can impact your ability as a designer to impact the final result, the budget, and the overall process. Being able to understand and apply this to your projects is a valuable skill for any architect. Understanding the differences between the exactness of the drawing environment versus the built environment.  [14:30 mark] The system of education tends to push you as an architecture student to strive for perfection in your processes. This seems to translate over into your career and the way you design or draw digitally. The reality of the construction site is that there is not a possibility for perfection. Part of being on a construction site allows you to understand the tolerances of this process. Every part of the assemblies on a job site has built-in tolerances. And as they are assembled, those tolerances compound and create project dimensions that cannot be held to the digital perfection. Understanding this concept and how it affects your design is something that takes time as a young professional. One of the benefits of being on construction sites early in your education or career is that it reduces this time frame and allows you to grasp that concept quicker, move forward and apply it to your work. Both Bob and Ira have been smitten by bluegrass music most of their lives. Bob's band Big Hillbilly Bluegrass played a regular gig at Madam's Organ in DC for about 20 years, and through that made a connection that led to invites from State Department public affairs offices at various foreign missions. They eventually brought their bluegrass music to over 30 countries in Africa and Asia. Bob says, "You can make friends with music, that's the bottom line." They made deep emotional connections through music on every day of their tours. They played their music at numerous events in myriad venues and usually, local groups also played, and they often shared songs, finding common ground. The response to American Bluegrass music was uniformly positive. "There is almost a human genetic response to Foggy Mountain Breakdown," Bob says. Ira wasn't on all the tours but said he remembers playing with some amazing musicians in the Republic of Congo, and he also played for pygmies in the Central African Republic. Bob's favorite country was the Republic of Georgia, where he says the people "gather spontaneously and sing songs in hugely resonant voices that are one thousand years old." Bob also says, "We saw demonstrations of commonality almost incessantly" during the tour, and that "We were far more effective at creating good will among people than any platoon of military men."

That's what Brian Whitta, a realtor from the micropolitan city of Findlay, Ohio, experienced and he shares his story with us today. Time Stamped Show Notes:  00:33 – Today's episode isn't just crazy, but heart-breaking, too 00:44 – Leigh introduces Brian Whitta 01:00 – Brian is located in Findlay, Ohio 01:14 – He got his license in 2005, but has only been full-time for the past 3 years 01:37 – A micropolitan is an honor bestowed upon a city when they are not tied to a metropolitan area 01:54 – The criteria for receiving the honor includes having growth projects – Findlay is the world headquarters for Marathon Petroleum, Cooper Tire, with the largest dishwasher manufacturer plant, Whirlpool 03:04 – Brian's story starts with Bob, a family friend who asked him some real estate questions 03:11 – Brian went to Bob's house and the questions were about the sale of their home 03:24 – Bob had medical issues and they were considering moving to a condo unit 03:36 – Mary was adamant about their moving to the RIGHT condo 03:44 – Both Bob and Mary are nearly 80 years old 03:51 – The first day of their house being listed, they had 5 showings 03:57 – One agent quickly submitted an offer above the list price 04:04 – The appraisal was low and the couple decided to not go through with the sale 04:12 – The couple already had a condo in mind, but they couldn't make the sale go through 04:34 – Bob needed to sell the house for the sake of their health; so, the other agent and Brian negotiated a reduction in their commission to help with reducing the closing costs 04:48 – They made the sale go through 04:54 – The seller of the condo decided they wouldn't pay a realtor 05:04 – Brian and the other realtor needed the proceeds from the sale of the house to cover the costs for the purchase of the condo 05:14 – Bob and Mary decided they would pay Brian for the purchase of the condo 06:27 – At closing, the attorney mentioned about the option of wiring the proceeds to Bob 06:48 – Brian interrupted the attorney because they were supposed to get a cheque 07:23 – The attorney explained the benefits of the proceeds being wired as opposed to receiving a cheque and Bob and Mary agreed 07:56 – At 9am the following day, Bob called because the proceeds were still not in his account 08:20 – The title office assured them that the wire transfer would come that day 08:28 – At 11, Bob called Brian because the money wasn't there yet 08:42 – Bob didn't call at noon so Brian thought things were okay 08:50 – At 2pm (wire cut-off), he got a call that the money still hadn't arrived 09:02 – Brian called the title office 09:20 – The owner advised that the wire had already been made at the account number Bob provided 09:47 – The owner read the email to Brian and provided the account number, the address, the names of the parties involved, and the dollar amount 10:18 – Brian told the owner that this was not Bob's email address or his bank account numbers 10:25 – The owner said he'd call back and hung up 10:44 – Brian called his attorney and called Bob back regarding the wire fraud 11:39 – Brian informed them the title office is liable for the loss 11:48 – At 8pm, the office informed them the wire couldn't be stopped and that it went through 12:02 – They were on hold for the closing 12:22 – After 13 hours, Brian got a call that the money was rejected and had been returned 12:57 – The title office and bank fraud department coordinated with each other 13:12 – The owner of the title handed over the cheque and they were able to close the condo 13:21 – They later learned one of the emails of the transaction was hacked 15:30 – Processes and policies do not eliminate the risk for fraud 16:00 – Wire fraud is NOT only in big markets, it can happen anywhere 17:24 – It takes a different level of care to look after elderly clients 18:21 – Call Brian at 419-701-4040 18:31 – Connect with Brian on Selling Findlay 19:18 – Tweet Leigh Brown for your very own crazy story in real estate  3 Key Points There is a different level of care and concern needed to support your elderly clients. In 1981 takeaway pizza is a bit of a novelty! More messages from the the Curly Man's answering machine.  Dave Birdman plays a wide variety of stuff including "Sir Henry at Rawlinsons End" but he can't find "Poisoning Pigeons in the Park" as it's in the old studio.Both Bob and Dave plug the Thameside Radio mystery trip (to Brighton) leaving from Turnham Green next week.
