Adult film star Stormy Daniels returns to the New York courtroom today after graphically detailing her 2006 encounter with former President Donald Trump earlier this week. This trial is the first of four to take place this year, and Trump is charged with falsifying records in the repayments he made to his then-lawyer, Michael Cohen, who paid Daniels to keep her story quiet. On the Rundown, New York criminal defense attorney Jonna Spilbor shares why it's not illegal to defend your reputation and why Stormy Daniels' testimony is irrelevant to the case. The 2024 race is filled with more than just the presidential election. High-profile Senate and House seats are up for grabs this year, with the Maryland Senate race being one of the closely followed contests. Former Maryland Governor Larry Hogan and Republican candidate for Senate joins the podcast to discuss what he would like to accomplish as a U.S. Senator, how he feels about a lack of bipartisanship in Congress, and what he thinks about the rematch between President Biden and former President Trump. Plus, commentary by Jimmy Failla, host of “Fox Across America with Jimmy Failla.” Photo Credit: AP Learn more about your ad choices. Visit megaphone.fm/adchoices

Jennifer and James Crumbley were both sentenced to 10–15 years in prison on charges of involuntary manslaughter after the prosecution convinced the jury that the Crumbley's gross negligence enabled their son to commit a mass shooting at Oxford High School in 2021. Sentencing the parents of mass shooters is a relatively new concept for the courts. While the sentencing guidelines for this crime are typically seven years, the actual sentence Judge Cheryl Matthews handed down exceeded those guidelines, opting for a harsher-than-recommended punishment. Criminal defense attorney Jonna Spilbor joins the podcast to break down how this case marks a shift in standards for punishing guardians of mass shooters, why she feels that this case should not have been taken to criminal court, and shares her fears that this ruling will be a legal slippery slope. U.S. Secretary of Homeland Security Alejandro Mayorkas is set to become the first cabinet member facing impeachment in over 100 years. The move has been met with enthusiasm from Senate Republicans. Now, it faces an unlikely path forward, with Senate Majority Leader Schumer reportedly looking at multiple procedural options to avoid or table these articles of impeachment. House Speaker Johnson revealed on Tuesday that they would plan on delivering articles to the Senate next week, showing the GOP is not done fighting for this trial. Senator Roger Marshall (R-K.S.) says not allowing the trial would be “a nuclear option for the Democrats.” He joins the podcast to explain why our border crisis can be traced back to Secretary Mayorkas and why he believes impeachment is necessary. The Idaho Supreme Court has denied accused quadruple murderer Bryan Kohberger's request to consider dismissing the indictment charging him with the murders of four University of Idaho students. The denial is significant because it shows the court wouldn't even consider hearing Kohberger's argument as he tried to get the indictment dismissed. Kohberger's request remains sealed. Following the indictment of former President Trump last Thursday, many Republican lawmakers have voiced concerns about Manhattan District Attorney Alvin Bragg's decision to prioritize pursuing charges against the former President when they believe crime, particularly in big cities like New York City, remains a prevalent issue. Furthermore, the timing of this indictment, which is happening seven years after former President Trump made the alleged hush money payments during his 2016 presidential campaign that he is being indicted for, has many questioning if Bragg intends to "interfere" in the primary election cycle that is set to kick off in the coming months. Congresswoman Claudia Tenney, who has been a prominent voice in discussing these concerns, joins to discuss how she believes the indictment of the former President illustrates a case of "malicious prosecution" rooted in political bias, why allowing personal politics into the U.S. justice system is unacceptable, and how she believes this indictment could politically impact the 2024 election cycle. Last week, a Maryland appellate court reinstated the murder conviction of Adnan Syed, the subject of the famed true crime podcast "Serial." Last fall, Syed was freed from his life sentence in prison after a circuit court found the evidence in his criminal trial to be unreliable. Now, his conviction has been reversed because the court did not give the victim's family proper notice so they could attend the hearing. So what happens next in this case? Criminal defense attorney Jonna Spilbor joins the podcast to explain the legal precedent for reversing the circumstances of Sayed's conviction, the impact the true crime podcast had on Sayed's freedom, and the unanswered questions that remain in this case. Plus, commentary by former lieutenant governor of New York and New York Post columnist, Betsy McCaughey. Learn more about your ad choices. Visit megaphone.fm/adchoices
