Oral Arguments for the Court of Appeals for the Fourth Circuit
United States v. Marilyn Mosby
Why Nelly and Snoop went to inauguration. Abuse of presidential pardon power, J6ers v. Marilyn. This week hosts Tiffany Cross, Angela Rye, and Andrew Gillum react to Biden’s final days in office and Trump’s first. Former President Biden issued a flurry of last-minute pardons including preemptive pardons for his own family. So he knows how to look out for his own but not our own, got it. We’ll talk about who did NOT get a pardon (Marilyn Mosby)–meanwhile Trump jailbreaks the J6 insurrectionists. Rappers Nelly and Snoop Dogg performed at Trump’s inauguration despite past anti-Trump comments. “It’s not political,” Nelly said. “It’s out of respect for the office.” Is there any benefit for the Black community to engage with the Trump administration or are artists like Nelly and Snoop just being used? The hosts debate when the idea of “no permanent friends, no permanent enemies, only permanent interests” comes into play when dealing with Trump and his government. Historically Black community burns, DOJ on Tulsa massacre, and Trump cabinet picks. This week hosts Tiffany Cross, Angela Rye, and Andrew Gillum acknowledge our brothers and sisters still reeling from the wildfires in the LA area. We’ll pay special attention to a historic Black neighborhood in Altadena that was hit by the Eaton Fire. A shout out to Marilyn Mosby who’s running out of time to get a pardon from President Biden! Sign the petition @ justiceformarilynmosby.com It’s becoming increasingly common for members of Congress to challenge each other to fist fights. What’s behind this phenomenon and how likely is it that we’ll see our elected officials ACTUALLY come to blows? The DOJ has released a review of the Tulsa massacre. They found that the race riot was a “coordinated, military style attack” against the Black community but there’s no one left to prosecute. What’s next for the survivors? Trump’s cabinet is being confirmed by the Senate this week, including some of his more controversial picks like Christian Crusader Pete Hegseth. Marilyn Mosby, Baltimore's former top prosecutor, made headlines for her bold actions during her tenure. She fearlessly took on the Baltimore police, charging those involved in Freddie Gray's death, and advocated controversial positions, including refusing to prosecute low-level drug offenders. However, her own legal journey took an unexpected turn. Accused of federal fraud violations, she faced trial and ultimately received a non-custodial sentence. Was this an outlier? Did she receive special treatment? Join Doug Passon and Mark Allenbaugh as we delve into these questions and more on this week's episode of Set for Sentencing! IN THIS EPISODE: The backstory of the Marilyn Mosby Prosecution; Digging into the sentencing data and the facts to determine whether her non-custodial sentence was warranted; Critique of the sentencing memoranda (spoiler alert, the defense memo was F'ing fantastic); In praise of the Federal Public Defender; Gender disparity at sentencing; Walking the tightrope of using your kids as mitigation; Why lawyers should be less scared about going to trial; Remember that the guidelines actually suggest NON-CUSTODIAL sentences for ALL first time offenders!; Arguing collateral consequences at sentencing; Navigating the pitfalls of not accepting responsibility after trial. LINKS: "The 3Rs of Sentencing Narrative": In this I make a few references to something I call “relativity” and “redemption” stories, which are 2 of the “3Rs” of sentencing. If you'd like to dig into the full 3Rs, visit the shownotes on the website and you'll find a link to an article I wrote on the subject for the Champion. www.setforsentencing.com/mosby

Our prayers are with the families of those with loved ones in Rafah, but most importantly our calls to action are too. Where do we go from here, y'all? This week hosts Andrew Gillum, Angela Rye, and Tiffany Cross ask how many red lines have to be crossed before the Biden Administration takes meaningful action. Speaking of Biden, there's growing panic within the Democratic Party over increasing signs that the President is STRUGGLING to gain a lead in the 2024 election over white-supremacist and would-be-tyrant Donald Trump. The hosts look at the “signs” and debate the usefulness of election polling. And in this week's deep dive, the hosts respond to listener questions about folks in the community who question voting for Biden and who his base really is. We know y'all are struggling with this year's presidential election and the feeling that folks have to choose between “the lesser of two evils”. The hosts navigate this struggle for themselves—IN REAL TIME—and offer some tips on how to talk to friends and family about it. Gaza has been in the news a lot lately, including some truly horrific videos that have been coming from Rafah this last week. Benjamin Netanyahu has vowed to continue his assault on the city despite the civilian casualties and increasing condemnation from the international community. So, what are we going to do about it?? SOMETHING. The call to act is upon us. Sign the petition to support a presidential pardon for Marilyn Mosby at justiceformarilynmosby.com…yep, STILL. Take part in our NLP poll by clicking here. This week hosts Tiffany Cross, Angela Rye, and Andrew Gillum ask: when will we see a Black woman in the US Senate?? The United States has only ever had three Black women as senators. Currently there are none, but two candidates may change that come November… Speaking of elections, what's up with these Trump surrogates already denying the ‘24 election before it's even happened? And what will actually happen if Trump loses in November but his supporters don't accept the results? The hosts discuss this and the relevance (or not) of presidential debates. Then, our resident expert on all things FAMU, Andrew Gillum, covers the drama coming out of his alma mater. Then onto a special message from Bernie Sanders to young voters—will it matter? And speaking of political messaging, New York's Governor Hochul's cringe-worthy comments about “Black kids in the Bronx” this week. The hosts discuss the blindspots that sometimes exist with liberal white politicians. And Gov Hochul isn't the only politician garnering some controversy over racially-charged remarks. We got a reminder last week that some members of Congress are just straight up racist. And so we ask, are there white supremacists in Congress? Spoiler alert: yes, and the hosts will name a few. The White House refrained from expressing a stance on potential pardon requests, emphasizing a commitment to impartiality in matters of justice. When questioned about calls for President Joe Biden to pardon Marilyn Mosby, the former Baltimore City State's attorney, Press Secretary Karine Jean-Pierre adopted a noncommittal stance during Friday's White House press briefing. She explained that the pardon process for federal offenses falls under the jurisdiction of the U.S. Department of Justice. This week hosts Angela Rye, Andrew Gillum, and Tiffany Cross go to the circus: Trump's Trials. According to the trial testimony of David Pecker, Donald Trump participated in a “catch and kill” scheme with the National Enquirer. The paid scheme prevented them from publishing negative stories about him during the 2016 election. If only we were all so rich…we still wouldn't do it! And at the Supreme Court, oral arguments begin to determine whether former President Trump is immune from criminal prosecution for acts committed while in office. Protests against the war in Gaza have spread from Google to Morehouse, NYU, Columbia, Stanford, and Yale University (among others). What is up with framing the student-led, anti-war protests as antisemitic? We unpack it on the pod! In Politics Are Everywhere, American Airlines has made it more difficult to qualify for their frequent flier points, and Angela and Tiff are NOT happy. Andrew asks, is this first world problems y'all? And of course we'll hear from you, our #NLPFam listeners! We are 193 days away from Election Day. Welcome home y'all! Welcome home! This week, hosts Angela Rye, Andrew Gillum, and Tiffany Cross start the show with a look at Trump's recent “bloodbath” debacle. Trump's violent language on the campaign trail is nothing new, so how concerned should we be about political violence? What are the lasting effects of promoting violence as a political strategy? Is it “terrorism”?? Plus, you remember the First Step Act, that bipartisan criminal justice reform bill passed by the 115th Congress and signed into law by Donald Trump in 2018 that Republicans were patting themselves on the back for? You might have missed it in the mainstream news, but the ultra conservative Supreme Court just struck down a key part of the bill and the Justice who drafted the majority opinion MIGHT surprise you! The hosts dig into the SCOTUS ruling for this week's deep dive. Are you HIGH? Or feeling low because Mary Jane is still a Schedule I substance under the Controlled Substance ACT? Well, MVP Harris has some thoughts on it. If you're in Baltimore, support Marilyn Mosby by showing up to her rally. It's at noon this Saturday March 23rd at the Druid Hill YMCA and this is just... the first step. And since we know so many of you listen just for Tiffany's sports analysis, she'll be back to break down March Madness in this week's Politics Are Everywhere. You can fill out your NCAA Women's (and men's) March Madness Bracket on the NCAA website. —--------- We want to hear from you! Send us a video @nativelandpod and we may feature you on the podcast. Welcome home y'all! This week, hosts Angela Rye, Tiffany Cross and Andrew Gillum cover the TikTok ban, which overwhelmingly passed the House and awaits Senate action—why is it happening? The ACLU says the legislation violates the first amendment, Donald Trump is wavering, even though he was actually the first high ranking official to propose a ban on TikTok. Joe Biden said he'd sign the bill into law. The hosts offer their takes. In election politics, no surprises— Trump and Biden officially clinched the nomination. The hosts do a deep dive into what a Trump versus a Biden presidency would look like by examining each of their proposed budgets as President Biden just dropped his off to Congress on Tuesday! There's also an update on Trump's racketeering case in Georgia. That case could be affected by an impending Supreme Court Case that will decide if Trump enjoys broad “presidential” immunity for crimes committed while he was president. More on that in this and a later episode… Finally, the hosts will answer your questions, and give an update on the former State's Attorney, Marilyn Mosby. You can find her Go Fund Me page by clicking here, and we'll update this description with info on the March 23rd rally later this week. That's at the end of the episode, stick around. —------- We want to hear from you! Send us a video @nativelandpod and we may feature you on the podcast. Welcome home y'all! A spot for Nikki Haley voters with Biden? With Haley's drop out of the presidential race, we look ahead at what's to come for the two leading candidates following Super Tuesday. And, President Biden is set to deliver his State of the Union address. We'll analyze what key messages we hope to hear and how they might impact his presidential bid. In state politics, we spend a little time unpacking the rhetoric of North Carolina's republican gubernatorial candidate Mark Robinson and the hosts differing views on how or whether to keep Trump supporters in the fold. Plus, we'll delve deep into the controversy surrounding Marilyn Mosby, the Baltimore City State's Attorney who prosecuted officers in the Freddie Gray case and implemented a robust reform agenda that law enforcement is still mad about.. Facing sentencing on trumped up charges in May, we have to ask how someone so right is treated so wrong?! —------- We want to hear from you! The Context of White Supremacy hosts the weekly Compensatory Call-In 02/10/24. We encourage non-white listeners to dial in with their codified concepts, new terms, observations, research findings, workplace problems or triumphs, and/or suggestions on how best to Replace White #AntiBlackness It's Super Bowl eve in the US - and for many other parts of the world. While an audience of millions takes in the brain damage of Sunday's gridiron madness, Baltimore mourns the local Raven's missing out on the big game and former prosecuting attorney Marilyn Mosby being convicted for mortgage fraud. Following her perjury conviction earlier this year, Mosby could be sentenced to 30 years in federal prison. In Kansas City, Daysheion Renee Ponds, a 25-year-old black female, was brutalized by three White KCPD officers while viewing the Chiefs triumph over the Ravens during the NFL AFC Championship game just days ago. Ponds was viewing the football contest at a bar, and a dispute arose about the tab. In New York City, more details have been released about the beheading of Kawsheen Gelzer. The dismembered remains of the privileged black male were kept in a freezer and refrigerator for almost two years. Most media reports emphasize Gelzer's criminal past, narcotics peddling, and general black maleness to justify his barbaric end. #NoOneWhollBeMissed #TheCOWS15Years INVEST in The COWS – http://paypal.me/TheCOWS Cash App: https://cash.app/$TheCOWS CALL IN NUMBER: 605.313.5164 CODE: 564943#

Cori Bush is being investigated for misusing government funding to pay her husband for a private security job. -Former Baltimore DA was convicted of two counts or perjury for lying about hardships during Covid to withdrawal from Baltimore's Deferred Compensation Plan. She bought Florida real estate. -Biden finally decides to visit East Palestine, Ohio after the train derailment that sent toxic chemicals into the air and their water systems.
