Intellectual property (IP) is a term you often hear in the world of creative businesses. I've observed that many business owners have a general understanding of IP but they don't necessarily comprehend how to protect it effectively. That's what I'm going to shed light on today so that you can understand what intellectual property means for your creative business and what you need to do to protect it.What is Intellectual Property?Simply put, intellectual property refers to your original creations—whether it's drawings, photographs, your name, or your tagline. For these to be considered your intellectual property, they need to be both original and created by you. Intellectual property fits into four primary categories: Trademarks, Copyright, Patents and Designs.TrademarksThe term "trademarks" is often misunderstood. Trademarking involves registering a trademark with IP Australia for exclusive use over a name or phrase crucial to your business but it can't be something you just fancy. It has to be capable of being trademarked. For example, if your business name, logo, or tagline is unique and vital to your branding, it might be worth considering trademarking it.Beyond trademark registration, there are other steps you can take to protect your IP:Register a Business Name: If a name or phrase is essential to your brand, register it as a business name to prevent others from legally using it.Register the URL: Secure the relevant domain names associated with your business to ensure no one else can use it.Document Usage Rights: If you allow third parties to use your intellectual property, make sure the terms in which they are entitled to use it are outlined in your service agreement. Crystal clear clarity is vital here so you can protect what's rightfully yours. CopyrightCopyright differs from trademarks because you don't need to apply to register it in Australia. The Copyright Act automatically protects your original works. Whether you create drawings, photos, logos, or designs, the copyright belongs to you as long as it's your original work.However, if you want to safeguard your creative work, you need to assert your ownership of your copyright. Client Agreements: Clearly state in your agreements that you retain copyright over your work and specify the usage rights granted to clients.Copyright Notices: Place copyright notices on your original works and client deliverables to indicate ownership.Cease and Desist: If someone infringes on your copyright, a cease and desist letter can be a powerful tool in protecting your rights.The Rise of AI and IP ProtectionMany creatives are curious about using AI in their work. While AI can streamline processes, using it to create work raises questions about originality. Remember, your copyright protects original work. If AI generates part of your creation, it may not be considered entirely original. Always consider this when integrating AI into your creative process as it could impact your legal standing.Protecting your intellectual property is vital for the growth and sustainability of your business. Not everyone has millions like you (she wrote) All you do is talk about money…what about all people who can't afford to pay you? Do you ever care about them?!! (this part she wrote was in ALL CAPS) When you continue to grow in your business, and your public presence has expanded to millions of people worldwide like my podcast and brand have, you are going to trigger people. It's impossible to help millions of people without upsetting 1-2% of them. If you haven't experienced that yet in your business or personal brand, you will, or you are playing it so safe to avoid this kind of judgment and nasty human behavior (which is also why your business isn't growing faster). My long-time Coordinator Nancy is in charge of my emails, 99% of the ones we get are beautiful, abundant, loving, and filled with heart-breaking incredible stories of survival. Than 1% of the emails and DM's are filled with people's self-hate, self-judgment, and anger about their own lives projected onto me and sometimes my team. I read them all with the same energy. Compassion. You will NEVER be able please everyone in business or in your personal life, if you keep trying to, you will lose yourself (I know this from experience). I know when I trigger someone it's actually a good thing, that means my message is getting to them. For every one person I may trigger, there are 99 who it woke up, who it empowered, who it validated, and who it changed. None of us no matter how experienced a coach, a counselor, a doctor, or a healer will be able to help someone who is DEAD SET on it not working. Some people will buy the business program, hire the nutritionist, sign up for an inner child healing retreat, wanting the desired outcome, but are in complete and total resistance to making it work. In fact, all they can focus on is how it isn't working fast enough, what they aren't receiving from you, and how they already “know all of these things” you're teaching them. These people are stuck in self-inflected purgatory (they have zero awareness of it). Their GIANT EGO is running the show, and they may have even signed up to work with you to further prove that “nothing works out for them,” to further prove that what you say isn't possible!!! This way, they don't have to make scary internal and external changes. Plus, what a great way to deflect from their own demons than to blame someone or something else. I help my clients establish business boundaries to protect and honor their energy, their intellectual property, and their money from the 1% of toxic people who would love to see them fail, so they can feel better about their own miserable lives. Do you know what I get on every week? And I record these and I just say the numbers. But 250 episodes. Wow. That is loads. That is so many, that is so much content. It's crazy. It blows me away how these numbers just creep up and if I was smart I would work out how many years that has been but I'm not sure I want to because that's a lot a lot a lot. Anyway This week I have an interview for you which is really really cool. So I have the lovely Nakia Gray on and we're talking all things legal. Now I know if you're anything like me that stuff scares me Like I'm not even kidding you. I do not find that stuff like enjoyable or easy or fun. The same with the finance stuff, these two areas for me are like oh I really have to focus and really have to remind myself to do these things. But The way she talks about it and some of the stuff she says is so so helpful. And it's really really important as small business owners that we have some kind of cover in some way or other. And one thing that was great to talk about is the fact of like the template thing. And I know you know I've heard people say you know you're not allowed to use or not allowed or you shouldn't use templates. You shouldn't just Google a privacy policy and use that. But you know what not everyone can afford to bring a lawyer in. So I talked to her about it and I said "You know, is that Okay? What do you think?" So yeah that's really helpful We talked around that. We talked about things around intellectual property. Also we talked about where you should never say you've got lifetime value of something which is really interesting cause that's definitely a mistake I've made in the past, years ago but I've definitely said you've got lifetime access to something and she talked about why you shouldn't say that. Um because basically it's not true is it because whose lifetime are you talking about yours or mine or what is a lifetime? Does that mean that I need you to still be serving me. I saw someone do lifetime access for a membership the other day which I think is fascinating because courses I can understand why people would say that like even ones. So I had a course of Jasmine Star, That was a really old course. And she actually said I'm checking this course down but you've got so long to download all the stuff. So technically yeah I have had access to that course for you know as long as I need it for a lifetime if you like. So courses I get but memberships I don't like what if that person decided

A dynamic, eye-opening conversation with Dr. Lydie. What may seem like boring law became fascinating!!!! Intellectual Property Law is deeply rooted in the history of our country. It dates back to the time the colonies secured independence from England, The founders wanted to ensure that their skill, innovation or creativity were free from English control. As a result, initially each colony, with the exception of Delaware, passed its own copyright law; each also had its own patent law. The discrepancies among the states rendered enforcement almost impossible. Therefore, the drafters of the Constitution wrote intellectual property into the document in order to have it fall under federal jurisdiction. It is so stated: To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries. - U.S. Const. Art. I, Sec. 8. What is the importance to Seniors, and especially to women? The reasons behind older adults starting their own businesses are many. Among them are: they've from their traditional job, are dissatisfied with the corporate world, they don't want to think of themselves as retiring, they lost their jobs due to society's misguided attitudes that older adults have outlived their usefulness in the youth driven workforce. it's worth noting that older entrepreneurs stay in business longer than younger ones. Within five years, 70 percent of businesses created by older entrepreneurs were still operating compared to 28 percent of their younger counterparts. This supports the fact that with age comes the experience, wisdom, personal and professional networks, and willingness to ask for help, all important factors in entrepreneurial success. Furthermore, as women we are prone to underestimating the value of our ideas and all too often, we share them or give them away without a thought. This has happened to me, has it happened to you? Intellectual property is the most valuable asset of a company that is why it should always be protected. Otherwise, employees come in and learn all your systems and processes, and then they leave. The next thing you realize, there’s a competitor down the road that is being run by that former employee. However, many companies don’t do a good job of securing their intellectual property because they don’t understand that. Art Nutter, the founder, chairman, and CEO of PatentBooks and a company called TAEUS, delves deep into the subject of intellectual property, bringing to light the significance of patents. He’s the Founder, Chairman and CEO of (https://taeus.com/) . People will go, “PatentBooks, I got. What is TAEUS?” People think it’s some Greek god of knowledge. I was going to invent that, but it’s an acronym for Take Apart Everything Under the Sun. That company was one that I started back in 1992 when the United States and big companies were thinking that foreign competition was copying their intellectual property. I approached AT&T one day and said, “You acquired NCR. Do you know what patents you acquired in that acquisition?” They said, “No.” I said, “I can tell you.” We proceeded to do that and turned to AT&T and then subsequently IBM into patent licensing powerhouses. IBM went from $100 million licensing income to $2 billion in licensing income over the space of ten years.” I think about that and say, “You started TAEUS.” Yes, I did. Out of the garage with frequent flyer miles, a laptop computer, a laser printer and that was it. Did you have experience in patent or anything or taking things apart? Yes, I’ve always taken things apart. We grew up on a farm. If something broke, we had to figure out how to fix it. I’ve had an inherent interest and curiosity in doing those things. However, the last job I had as an employee before I started TAEUS, I tended to get fired in most companies because I was usually the guy making too much money. That was my crime. I doubled the sales of this particular company in a space of nine months. This company was reverse engineering semiconductor memory chips. I discovered that there was a marketplace that was very interested in this reverse engineering data. That was this intellectual property marketplace because like I said in the late ‘80s, early ‘90s, US companies were thinking, “We’re getting killed by foreign competition. They must be copying our stuff, our ideas and our inventions.” In fact, they were and this was an easy way for them to document the other companies copying of their circuits. They literally would reverse engineer the circuits and then duplicate them exactly. It was government-funded in Japan and Korea and Taiwan and so forth. They wanted to establish semiconductor industries for themselves, which as from history, our semiconductor industry is pretty few and far between. You have the Intels, AMDs and in-house semiconductor capabilities but nowhere near likely the volume of semiconductor companies that did exist in here in the 1980s.
